    (5) In determiningwhat order to be made under subsection (3),theCourtForChildrenshalltreatthebestinterestsofachildasthe paramount consideration.

    (6) Notwithstanding paragraph (3)(a), the Board of Visitorsof the place of refuge in which a child is being detained mayreducetheperiodofdetentionof thechildbutnoreductionshallbe made whichwill have the effect of enabling the child to bereleasedfromtheplaceofrefugewithintwelvemonthsfromthedateofhisadmissionintotheplaceofrefugeasspecifiedinthatparagraph,exceptbytheauthorityoftheMinister.

    (7) TheCourtForChildrenshall,whenmakinganorderunder

    paragraph(3)(a) or (d),ordertheparentorguardianofachildto

    executeabondforthedurationoftheorderwithsuchconditionswhichmayinclude

    (a) inthecaseofparagraph(3)(a),regularvisitstotheplaceofrefugewherethechildisplaced;and

    (b) inthecaseofparagraph(3)(d),ensuringthatthechildremainsindoorswithinstipulatedtimes.

    (8) Any personwho

    (a) isorderedtoexecuteabondundersubsection(3)or(7),asthecasemaybe;and

    (b) fails to comply with any of the conditions of suchbond,

    commits an offence and shall on conviction be liable to a finenotexceeding ten thousand ringgit.

    (9) Any child sent to a place of refuge for detention underparagraph (3)(a) shall, on the expiration of the period of his

    detentionwhetherby

    (a) effluxionoftime;or

    (b) reason of any reduction made pursuant to subsection(6),

    be placed under the supervision of a SocialWelfare Officer orotherpersonappointedbytheProtectorforsuchpurpose.

    ( 10) The pe ri od of s uper vis ion for t he purpos e of

    subsection (9) shall be determined by the Board of Visitors ofthe placeof refuge on the recommendation of the Protector butshallnotinanycaseexceedoneyearfromthedateofexpirationoftheperiodofdetentionofthechild.

    (11) The Minister may on the application of the child orhis parent or guardian exempt the child from the applicationof subsection (9) if he is satisfied that the case warrants such

    exemption.

    (12) Withoutprejudiceto thepowersoftheBoardofVisitorspursuant to subsection (6) the Court For Children may, on theapplicationinwritingmadeby

    (a) a Protector;

    (b) the parent or guardian of the child to whom an ordermadeunderthissectionrelates;or

    (c) thechild,

    amend,varyorrevokeanyordermadeunderthissection

    (aa) iftheCourtForChildrenissatisfiedthatitisinthebestinterestsofthechildtodoso;and

    (bb) uponproofthatthecircumstancesunderwhichtheorderwasmadehavechangedafterthemakingoftheorder.

    (13) Anorderunder subsection (3)shallnotbemadewithout

    givingtheparentorguardianofthechildanopportunitytoattendandbeheard.

    (14 ) Notwi th standing subsect ion (13 ), an o rder undersubsection(3)maybemadeiftheCourtForChildrenissatisfiedoninformationgivenbyaProtectorthattheparentorguardianofthechild,havingbeenrequiredtoattend,hasfailedtodoso,orisnotavailableorcannotbefoundwithinareasonabletime.

    Children in urgent need of protection

    41. (1) Any childwho is in urgent need of protection may onhis own application in the prescribed form be received by theProtectorintoaplaceofrefugeiftheProtectorissatisfiedthatthechildisinurgentneedofprotection.

    (2) Achildisinurgentneedofprotectionifthereisreasonablecausetobelievethat

    (a) thechildisbeingthreatenedorintimidatedforpurposesofprostitutionorforpurposesofhavingsexualintercourse

    withanotheror for any immoral purpose;

    (b) the child is to be confined or detained by another in

    contraventionofthisPart;

    (c) an offence against this Part is being or likely to be

    committedinrespectofthechild;or

    (d) if the child is a female, that she is pregnant out ofwedlock.

    (3) Subject to subsections (4) and (5), and if circumstanceswarrant it, the person in charge of any place of refuge mayreceiveintotheplaceofrefugeanychildwho

    (a) isinurgentneedofprotection;and

    (b) makesanapplicationunderthissectiontothepersonincharge.

    (4) If the person in charge of a place of refuge receives anychild under subsection (3), that child shall be brought before aProtectorwithintwenty-fourhoursofhisadmissionintotheplaceofrefugewithafullreportofthecircumstances.

    (5) Achildadmittedunderthissectionispermittedtoresidein

    theplaceofrefugeonlysolongastheProtectorissatisfiedthatthechildisinurgentneedofprotectionunderthissection.

    (6) The Protector

    (a) whoreceivesachildundersubsection(1);or

    (b) beforewhom a child isbroughtunder subsection (4),

    shallimmediatelyinformtheCourtForChildrenofsuchadmission

    withafullreportofthecircumstancesandshallinthelikemannerinformtheCourtofhisdeparture.

    Inquiries and detention of a child who has been bought oracquired under false pretences, etc.

    42. (1) If the Protector has reasonable cause to believe that achild

    (a) hasbeenbroughtintooristobesentoutofMalaysiaand

    thecustodyofthechildhasbeenacquiredeither

    (i) after having been purchased; or

    (ii) by fraud, false representationor false pretence,

    whetherornot for thepurposeofprostitution;

    (b) hasbeenprocuredeitherwithinoroutsideMalaysiaforthe purposeofbeing used, trainedor disposed of as aprostitute;or

    (c) isbeingdetainedagainsthiswillforthepurposesof

    (i) prostitution or for immoral purposes; or

    (ii) being sent out of Malaysia for the purposes ofprostitution or for immoralpurposes,

    the Protector may order the child to be removed to a place ofrefugeandthechildshallbetemporarilydetainedinsuchplaceofrefuge.

    (2) Everychildwhois temporarilydetainedunder subsection(1)shallbebroughtbeforeaCourtForChildrenwithintwenty-fourhours exclusive ofthe timenecessary for the journey fromthe place where the child was so removed to the Court ForChildren.

    (3) If it is not possible to bring a child before a Court ForChildren within the time specified in subsection (1), the childshall be brought before a Magistrate who may direct that thechildbeplacedinaplaceofrefugeuntilsuchtimeasthechildcanbebroughtbeforeaCourtForChildren.

    (4) The Court For Children before whom a child is broughtshallorderthechildtobedetainedinaplaceofrefugeuntil

    (a) aninquiryintothecircumstancesofthechildscasehasbeen completed; and

    (b) areportoftheinquiryhasbeensubmittedtotheCourtForChildrenbytheProtectorundersubsection(6).

    (5) An inquiry referred to in paragraph (4)(a) shall bemadebya Protector.

    (6) The Protector shall complete the inquiry and submit the

    report of the inquiry to the Court For Children within a periodnotexceedingonemonthfromthedateoftheadmissionofthechildtotheplaceofrefuge.

    (7) If after considering the report submittedunder subsection(6)theCourtForChildrenissatisfiedthatachildbroughtbeforeitisinneedofprotectionandrehabilitation,theCourtmay

    (a) order the child to be detained in a place of refuge forsuchperiodnotexceedingthreeyearsfromthedateofthe order as theCourtmay in the best interests of thechilddeemfit;or

    (b) make anorder placing the child under the supervisionofaSocialWelfareOfficerappointedbytheCourtforsuchperiodnotexceedingthreeyearsfromthedateoftheorderastheCourtmayintheinterestofsuchchild

    deemfit.

    (8) Theordermade under subsection (7)mayhave theeffectof extending the period ofsuchdetentionorsupervision, as thecasemaybe,beyondthedateonwhichthechildattainstheageofeighteenyears.

    (9) Subsections 40(12) to (14) shall apply in respect of anyordermadeundersubsection(7)astheyapplytoanordermadeunder section40.

    (10) If the Court For Children is not satisfied that the childbroughtbeforeitisinneedofprotectionandrehabilitation,theCourt For Children shall order the child to be returned to thecareandcustodyofhisparentorguardian.

    Chapter2

    OFFENCES

    Offences

    43. (1) Anypersonwho

    (a) sells,letsforhireorotherwisedisposesof,orbuysorhires or otherwise obtains possession of, a child withintent that the child is to be employed or used for thepurposeofprostitution,eitherwithinoroutsideMalaysia,

    or knowing or having reason to believe that the childwillbesoemployedorused;

    (b) procuresa child for purposes of prostitutionor for thepurposes of having sexual intercourse with any otherperson,eitherwithin oroutsideMalaysia;

    (c) byorunderanyfalsepretence,falserepresentation,orfraudulentordeceitfulmeansmadeorused,eitherwithinoroutsideMalaysia, brings or assists inbringing into,ortakesoutoforassistsintakingoutof,Malaysia,achild with intent that the child is to be employed orusedforpurposesofprostitution,eitherwithinoroutsideMalaysia, orknowing or having reason tobelieve thatthechildwillbesoemployedorused;

    (d) bringsintoMalaysia,receivesorharboursachildknowing

    or having reason to believe that the child has beenprocuredforpurposesofprostitutionorforthepurposesofhavingsexualintercoursewithanyotherperson,eitherwithinoroutsideMalaysia,andwithintenttoaidsuchpurpose;

    (e) knowing or having reason to believe that a child hasbeenbroughtintoMalaysiainthecircumstancesassetout in paragraph (c) or has been sold, let for hire, orhired or purchased in the circumstances as set out in

    paragraph (a), or incontraventionofany otherwrittenlaw receives or harbours the child with intent that heis tobeemployedorused for purposes ofprostitutioneitherwithin oroutsideMalaysia;

    (f) detainsachildinabrothelagainstthechildswill;

    (g) detainsachildinanyplaceagainstthechildswillwithintent that the child is to be employed or used forpurposesofprostitutionorforanyunlawfulorimmoral

    purpose;

    (h) bymeansofanyadvertisementorothernoticepublishedinanymannerordisplayedinanyplaceoffersachildfor purposes of prostitution or seeks information forthat purpose or accepts such advertisement or noticeforpublicationordisplay;

    (i) actsasanintermediaryonbehalfofachildorexercisescontrol or influence over the movements of a child in

    such amanner as to show that the person is aiding orabettingorcontrollingtheprostitutionofthatchild;

    (j) engagesorhires,foranyvaluableconsideration,achildtoprovideservices for that persons sexual gratification;

    (k) attemptstodoanyactincontraventionofthissection,

    commitsanoffenceandshallonconviction

    (aa) in the case of offences under paragraphs (a) to (h) orparagraph (k), be liable to a fine not exceeding fiftythousand ringgit or to imprisonment for a term notexceedingfifteenyearsortoboth;and

    (bb) in the caseofanoffenceunderparagraph (i) or (j),beliable to a fine not exceeding fifty thousand ringgit

    and to imprisonment for a term of not less than threeyearsbutnotmorethanfifteenyearsandshallalsobepunishedwithwhipping ofnotmore thansix strokes.

    (2) Any person who is convicted of a second or subsequentoffence

    (a) underparagraphs(1)(a) to(g) orparagraph(1)(k),shallbeliabletowhippingofnotmorethantenstrokes;and

    (b) under paragraphs (1)(i) or (j), shall be punished withwhippingofnotlessthansixstrokesbutnotmorethantenstrokes,

    in addition to any term of imprisonment imposed in relation tosuchoffence.

    (3) Sections 173a and 294 of the Criminal Procedure Codeshall not apply in respect of offences under paragraphs (1)(i)and (j).

    Presumptions relating to section 43

    44. For the purposes of section 43, it shall be presumed untilthecontraryisprovedthataperson

    (a) who takes or causes to be taken into a brothel a childhas disposed ofthechildwiththe intentorknowledgementioned in paragraph43(1)(a);

    (b) whoreceivesachildintoabrothelorharboursachildinabrothelhasobtainedpossessionofthechildwiththeintent orknowledgementioned inparagraph 43(1)(a);

    (c) hasdetainedachildinanybrothelorinanyplaceagainst

    thechildswillif,withintenttocompelorinducehim

    toremaininthebrothelortheplace,thatperson

    (i) withholds from the child anywearing apparel or

    anyotherpropertybelongingtothechildorany

    wearing apparel commonly or last used by the

    child;

    (ii) threatens the childwith legal proceedings if the

    child takes away any wearing apparel or any

    otherproperty which has been lent orhiredout

    orsuppliedtothechild;

    (iii) threatens thechildwithlegalproceedings forthe

    recoveryofanydebtorallegeddebtorusesany

    otherthreat;or

    (iv) without any lawful authority detains the childs

    identity card issued under the law relating to

    national registrationor thechilds passport.

    Detention pending proceedings

    45. (1) AnyCourtinquiringintoor tryinganyoffencespecified

    in the Second Schedule (in this Act referred to as scheduled

    offence)mayorderachild

    (a) withrespecttowhomascheduledoffenceisallegedto

    havebeencommitted;and

    (b) whomtheCourtconsiderstobeinneedofprotection,

    tobedetainedtemporarilyinaplaceofsafetyuntilthedetermination

    of the proceedingsagainst the person chargedbut the detention

    shall not extend beyond the date on which the child attains the

    ageofeighteenyears.

    (2) Notwithstanding thedeterminationof theproceedings, the

    Court may, on an applicationmade by the Protector and if the

    Court issatisfied thata childis inneedof protection,order the

    detention of the child in a place of safety in accordance withparagraph30(1)(d).

    BEYONDCONTROL

    Children beyond control

    46. (1) If the parent or guardian of a child requests the CourtForChildreninwritingtodetainachildinanapprovedschool,placeofrefuge,probationhostelorcentreonthegroundthattheparent orguardian isunable toexerciseproper control over thechild,theCourtForChildren

    (a) shallimmediatelyinquireintothecircumstancesofthechildscase;

    (b) shalldirecttheprobationofficertosubmitaprobationreporttotheCourtForChildrenfortheCourttodeterminewhetheranorderundersubsection(2)maybemadeinrespectofthechild;and

    (c) may order the child to be temporarily detained in anapproved school, place of refuge, probation hostel orcentreifitdeemsitnecessarytodoso.

    (2) If after considering the report referred to in paragraph(1)(b) theCourtForChildrenissatisfiedthat

    (a) itisexpedientsotodealwiththechild;and

    (b) theparentorguardianunderstandstheresultswhichwillfollowfromandconsentstothemakingoftheorder,

    the Court For Children may, on the recommendation of theprobation officer, order that thechild

    (aa) besenttoanapprovedschool,placeofrefuge,probationhostelorcentre,asmaybeappropriate;or

    (bb) beplacedforsuchperiodnotexceedingthreeyearsunderthesupervisionof

    (i) a probation officer; or

    (ii) some other person appointed for the purpose bytheCourt,

    andanysuchordermay require thechild to reside fora period not exceeding twelve months in a probationhostel.

    Supervision by probation officer

    47. (1) IfaCourtForChildrenmakesanorderunderparagraph

    46(2)(bb) placing a child under the supervision of a probationofficerorofsomeotherperson,thatofficerorotherperson

    (a) shall,whiletheorderremainsinforce,visit,adviseandbefriendthechild;and

    (b) may,ifitappearsnecessarytodoso,atanytimewhilethe order remains in force, bring the child before theSupervisingCourt.

    (2) The Supervising Court before whom a child is broughtunder paragraph (1)(b) may, if it deems it expedient to do so,amendtheordermadeundersection46and

    (a) sendthechild,subjecttotheconsentofthechildsparentor guardian, to anapproved school,placeof refuge orcentre,whichever is appropriate;or

    (b) place the child in the care of a fit and proper person,whether a relative or not,who iswilling to undertakethe care of the child, for the unexpired period of theorder.

    partVIII

    TRAFFICKING INANDABDUCTIONOFCHILDREN

    Unlawful transfer of possession, custody or control of child

    48. (1) Anypersonwho takes part inanytransaction theobjector one of the objects of which is to transfer or confer, whollyor partly, temporarily or permanently, the possession, custodyorcontrol ofa childfor any valuableconsiderationcommits anoffenceandshallonconvictionbeliabletoafinenotexceedingtenthousandringgitortoimprisonmentforatermnotexceedingfiveyearsortoboth.

    (2) Anypersonwhowithoutlawfulauthorityorexcuseharbours

    orhasinhispossession,custodyorcontrolachildwithrespecttowhomthetemporaryorpermanentpossession,custodyorcontrolhas been transferred or conferred for valuable consideration by

    anyotherpersonwithinoroutsideMalaysiacommitsanoffenceand shall on conviction be liable to a fine not exceeding tenthousand ringgit or to imprisonment for a term not exceeding

    fiveyearsortoboth.

    (3) Forthepurposesofsubsection (2),ifanypersonharboursorhasinhispossession,custodyorcontrolachildwithoutlawfulauthorityorexcuse,thechildshall,untilthecontraryisproved,bepresumed tobea childwith respect towhom the temporaryorpermanentpossession,custodyorcontrolhasbeentransferredor conferred forvaluable consideration.

    (4) It shallbeadefence inanyprosecutionunderthissection

    toprovethat

    (a) thetransfertookplaceincontemplationoforpursuanttoabona fide marriageor adoption; and

    (b) at least one of the natural parents of the child or theguardian of the child was a consenting party to themarriageor to the adoptionby the adopting party,

    and had expressly consented to the particular marriage oradoption.

    Importation of child by false pretences

    49. Any personwho

    (a) byorunderanyfalsepretenceorrepresentationmade;or

    (b) byfraudulentordeceitfulmeansused,

    eitherwithinoroutsideMalaysia,bringsorassistsinbringingachildintoMalaysiacommitsanoffenceandshallonconvictionbe liable to a fine not exceeding ten thousand ringgit or toimprisonmentforatermnotexceedingfiveyearsortoboth.

    Examination of child and person in charge

    50. AProtectororanypersonauthorizedinwritingbyaProtectormayrequire

    (a) achildwhohasenteredorbeenbroughtintoMalaysia;and

    (b) anypersonwhomayappeartohavethecustodyorcontrolofsuchchild,

    toappearbeforehim,atanyreasonabletimeandatanyconvenientplace, tobe examinedpursuant tosection113.

    Protector may require security

    51. If a Protector has reasonable cause to bel ieve that achild

    (a) hasbeenbroughtintoMalaysiaeither

    (i) a fter having been transferred for valuableconsideration; or

    (ii) by fraud, misrepresentation or any falsepretence;

    (b) has been transferred to the custody or control of anypersonforvaluableconsiderationeitherwithinoroutsideMalaysia;or

    (c) isbeingdetainedagainsthiswillbysomepersonotherthanhisparentorguardian,

    theProtectormay

    (aa) require any person in whose custody or under whosecontrolthechildappearstobe

    (i) tofurnishhimwithcopiesofthechildsandthatpersons own photographs; and

    (ii) tofurnishsecuritytothesatisfactionoftheProtectorthatthechild

    (A) will not leave the area or the State in whichhe then iswithout the priorwritten consentoftheProtector;

    (B) willnotbe transferred to thecareorcustodyofanyotherpersonwithoutthepriorwrittenconsentoftheProtector;and

    (C) willbeproducedbeforetheProtectorwhenevertheProtector requires; or

    (bb) inthefirstinstance,orifdefaultbemadeincomplyingwith any order made under paragraph (aa), make anorderthat

    (i) thechildbetakenoutofthecustodyofthepersoninwhosecare,custodyorcontrolthechildisandplacedthechildinaplaceofsafety;or

    (ii) on such security and on such conditions as theProtector may require, the child be placed inthecustodyofarelativeorotherfitandproperperson,

    until the child attains the age of eighteen years or foranyshorterperiod.

    Offence of taking or sending out a child without appropriate

    consent of person having lawful custody

    52. (1) Anyparent or guardianwho

    (a) doesnothavethelawfulcustodyofachild;and

    (b) takes or sends out a child, whether within or outsideMalaysia,

    withouttheconsentofthepersonwhohasthelawfulcustodyofthe child commits an offence and shall on conviction be liabletoafinenotexceedingtenthousandringgitortoimprisonmentforatermnotexceedingfiveyearsortoboth.

    (2) Apersonhaslawfulcustodyofachildunderthissectionif

    hehasbeenconferredcustodyofthechildbyvirtueofanywrittenlaworbyanorderofaCourt,includingaSyariahCourt.

    (3) It shall be a defence under this section if a parent orguardiantakesorsendsachildawaywithouttheconsentofthepersonhavinglawfulcustodyofthechildif

    (a) theparentorguardian

    (i) doesitinthebeliefthattheotherpersonconsented,

    orwouldhaveconsented,ifhewasawareofallthe relevantcircumstances;or

    (ii) has taken all reasonable steps to communicatewith the other person but has been unable tocommunicatewithhim;

    (b) theparentorguardianhasreasonablegroundstobelievethatthechildisbeingabused,neglected,abandonedorexposedinamannerlikelytocausethechildphysicaloremotionalinjury;or

    (c) theotherpersonhasunreasonablyrefusedtoconsentalthoughhewasawareofalltherelevantcircumstances.

    Recovery order

    53. (1) Ifit appears totheCourt that thereis reason tobelievethata child hadbeen takenor sent awaywithouttheconsentofthe person who has lawful custody of the child as described insection52,theCourtmaymakearecoveryorder.

    (2) ArecoveryordermaybemadebytheCourtonapplicationbeingmade by or on behalf of any person who has the lawfulcustodyofthechild.

    (3) For the purposes of this section, a recovery ordermay

    (a) directanypersonwhoisinapositiontodosotoproducethe childon request toany authorized person;

    (b) authorize the removal of the child by any authorizedperson;

    (c) requireanypersonwhohasinformationastothechilds

    whereaboutstodisclosethatinformationtotheauthorizedperson;

    (d) authorize any police officer toenter into any premisesspecified in the order and search for the child, usingreasonable force if necessary.

    (4) Any person who intentionally obstructs an authorizedpersonfromexercisingthepowersundersubsection(3)commitsanoffenceandshallonconvictionbeliabletoimprisonmentfor

    atermnotexceedingthreeyearsandtowhippingnotexceedingsixstrokes.

    INSTITUTIONS

    orappointanyplace,institutionorcentretobeaplaceofrefuge

    for the care and rehabilitation ofchildren.

    (2) The Minister may at any time direct the closing of any

    placeofrefugeestablishedorappointedundersubsection(1).

    Child who escapes or is removed from place of safety or place

    of refuge

    56. Anychildwhoescapesoris removedfromaplaceofsafety

    orplaceofrefugewithoutlawfulauthority

    (a) maybearrestedwithoutawarrantbyanyProtectoror

    policeofficerandshallbebroughtbacktotheplaceof

    safetyorplaceofrefuge;and

    (b) shall bedetained

    (i) in the case of a place of safety, for such period

    which is equal to the unexpired residue of his

    stayundertheorderoriginallymadebytheCourtFor Children; and

    which is equal to the period during which he

    was unlawfully at large and for the unexpired

    Offence of removing or helping a child to escape from place

    of safety or place of refuge

    57. Any personwho

    (a) removesachildfromaplaceofsafetyorplaceofrefuge

    without lawful authority;

    (b) knowinglyassistsorinduces,directlyorindirectly,achild

    to escape from a place of safety or a place of refuge;

    or

    (c) knowingly harbours or conceals a child who has so

    escaped, or prevents him from returning to the place

    ofsafetyorplaceofrefuge,

    commits an offence and shall on conviction be liable to a fine

    notexceedingtenthousandringgitortoimprisonmentforaterm

    notexceedingfiveyearsortoboth.

    Chapter2

    PLACESOFDETENTION

    Places of detention

    58. (1) TheMinistermay,bynotificationintheGazette,establish

    or appoint such places of detention as may be required for the

    purposesofthisAct.

    (2) Achildshallordinarilyberemanded incustody inaplace

    ofdetentionestablishedorappointedunderthisActandsituated

    inthesameStateinwhichissituatedtheCourtForChildrenbywhichthechildisremanded.

    (3) The order or judgment in pursuance of which a child iscommittedtocustodyinaplaceofdetentionshallbe

    (a) deliveredwiththechildtothepersoninchargeofthe

    placeofdetention;and

    (b) anauthorityforhisdetentionintheplaceofdetentioninaccordancewiththetermsoftheorderorjudgment.

    (4) Achildwhilebeingdetainedandwhilebeingconveyedtoandfromtheplaceofdetention shallbedeemed tobe in lawfulcustody.

    (5) TheMinister

    (a) shallcauseplacesofdetentiontobeinspected;and

    (b) maymake regulations

    (i) astotheclassification,treatment,employmentandcontrol of children detained in such places ofdetention; and

    (ii) to provide for the appointment of fit and properpersons to visit periodically children detained in

    suchplacesofdetention.

    Child who escapes or is removed from place of detention

    59. Anychildwhoescapesorisremovedfromaplaceofdetentionwithout lawful authority

    (a) may be arrested without a warrant by any Protectoror police officer and be brought back to the place of

    detention; and(b) shallbedetainedintheplaceofdetentionfortheunexpiredresidueofhistermofdetentionundertheorderoriginallyissuedbytheCourtForChildren.

    Offence of removing or helping a child to escape from placeof detention

    60. Any personwho

    (a) removesachildfromaplaceofdetentionwithoutlawful authority;

    Chapter 3

    PROBATIONHOSTELS

    Probation hostels

    61. (1) TheMinistermay,bynotificationintheGazette,establishor appoint such probation hostels as may be required for thepurposesofthisAct.

    (2) The Minister may make regulations for the regulation,management and inspectionof probationhostels.

    Child under ten years of age not to be sent to probationhostel

    62. ACourtForChildrenshallnotmakeanorderrequiringachildundertheageoftenyearstobesenttoaprobationhostel.

    Child who escapes or is removed from probation hostel

    63. Anychildwhoescapesorisremovedfromaprobationhostelwithout lawful authority

    (a) maybearrestedwithoutawarrantbyanyprobationofficerorpoliceofficer;and

    (b) bebroughtbacktothathostelorbeforetheSupervisingCourt,

    andtheSupervisingCourtmaydealwithhimfortheoffencefor

    whichhewassenttotheprobationhostelinthesamemannerinwhich the SupervisingCourt could deal with him if it had justfoundhimguiltyofthatoffence.

    Offence of removing or helping a child to escape from probationhostel

    64. Any personwho(a) removesachildfromaprobationhostelwithoutlawfulauthority;

    (b) knowingly assists or induces, directly or indirectly, achildtoescapefromaprobationhostel;or

    (c) knowingly harbours or conceals a child who has soescaped,orpreventshimfromreturningtotheprobationhostel,

    commits an offence and shall on conviction be liable to a finenotexceedingtenthousandringgitortoimprisonmentforatermnotexceedingfiveyearsortoboth.

    Chapter 4

    APPROVEDSCHOOLS

    Approved schools

    65. (1) TheMinistermay,bynotificationintheGazette,establishor appoint such approved schools as may be required for theeducation, training and detentionofchildren tobesent there inpursuance of thisAct.

    (2) TheMinistermayclassify such approved schools

    (a) accordingtotheagesofthepersonsforwhomtheyareintended;and

    (b) insuchotherwaysashemaythinkfitsoastoensurethat a child sent to an approved school is sent to aschoolappropriatetohiscase.

    Child under ten years of age not to be sent to approvedschool

    66. ACourtForChildrenshallnotmakeanorderrequiringachildundertheageoftenyearstobesenttoanapprovedschool.

    When a child can be sent to approved school

    67. (1) If

    (a) achildisfoundguiltyofanyoffence;

    (b) theprobationreportsubmittedtotheCourtForChildren

    showsthat

    (i) theparentsorguardianofthechildcannolonger

    exerciseorisincapableofexercisinganyproper,

    controloverhim;and

    (ii) thechildisinneedofinstitutionalrehabilitation;

    and

    (c) it appears to the Court For Children that although the

    offence committed is not serious in nature but it is

    expedientthatthechildbesubjecttodetentionforsuchtermandundersuchinstructionanddisciplineasappears

    mostconducivetohisreformation,

    the Court For Children shall, on the recommendation of the

    probationofficer,sendthechildtoanapprovedschool.

    (2) If a Court For Children orders a child to be sent to an

    approvedschool,theordershallbeanauthorityforhisdetention

    inthatapprovedschoolforaperiodofthreeyearsfromthedate

    oftheorder.

    (3) Notwithstanding subsection (2) the Board of Visitors

    of the approved school to which a child is sent may, in their

    discretion

    (a) shortentheperiodofdetentionforreasonswhichappear

    tothemtobesufficient;or

    (b) permitanysuchchildtobereleasedforsuchperiodand

    uponsuchconditionsastheymaydeemfittoimpose.

    (4) A child shall not be permitted to be released from an

    approved school under paragraph (3)(b) during the first twelve

    monthsoftheperiodofdetentionwithouttheconsentinwritingoftheMinister.

    Approved school order to be delivered to the authority, etc.,who conveys child to the school

    68. (1) TheCourtForChildrenwhichmakesanapprovedschoolorder shall cause it to be delivered to the authority or personresponsibleforconveyingthechildtotheschool,andtheauthorityor personwho conveys the child to the school shalldeliver theapprovedschoolordertothepersonforthetimebeinginchargeoftheschool.

    (2) TheCourtForChildrenwhichmakesan approved schoolorder shall cause all such information in the possession of theCourt with respect to a child as is in the opinion of the Court

    shouldbeknownbythepersonforthetimebeinginchargeofthe school,to betransmitted to the person for the timebeing inchargeoftheschool.

    (3) If a child has been ordered to be sent to an approvedschool, any person who knowingly harbours or conceals himafterthetimehascomeforhimtogototheschoolcommitsanoffenceandshallonconvictionbeliabletoafinenotexceedingtenthousandringgitortoimprisonmentforatermnotexceedingfiveyearsortoboth.

    (4) Ifapersonauthorizedtotakeachildtoanapprovedschoolis,whenthetimehascomeforhimtogototheschool,unableto

    (a) findthechild;or

    (b) obtainpossessionofthechild,

    the Court ForChildrenmay, if satisfied by information on oath

    oraffirmationthatthereisreasonablegroundforbelievingthatsome person named in the information can produce the child,issue a summons requiring the person so named to attend attheCourtonsuchdayasmaybespecifiedinthesummonsandproduce thechild.

    (5) If theperson referred to in subsection (4) fails to complywith the requisition under that subsection without reasonableexcuse he shall, in addition to any other liability to which hemay be subject to under thisAct, on conviction be liable to afine notexceeding ten thousand ringgit.

    Further detention in approved school beyond period oforder

    69. If the person for the time being in charge of an approvedschoolissatisfiedthatachild

    (a) whoseperiodofdetentionintheapprovedschoolisabouttoexpireneedsfurthercareortraining;and

    (b) cannot be placed in suitable employmentwithout suchfurthercareortraining,

    hemay,iftheBoardofVisitorsoftheapprovedschoolconsent,detainhimfora furtherperiodnotexceedingsixmonthsbutany

    suchperiodshallnotextendbeyondthedatethechildattainstheageofeighteenyears.

    Aftercare of child released from approved school

    70. If a child is sent to an approved school, the Court ForChildrenmakingtheordershall,atthesametime,makeanorderthat after the expiration of the period of his detention he shall,foraperiodofoneyear,beunderthesupervisionof

    (a) aprobationofficer;or

    (b) suchotherpersonas theChildWelfareCommitteemayappoint.

    Escape from approved school, etc., or failure to return toapproved school after expiry of leave, etc.

    71. (1) Anychildwho

    (a) escapesfromtheapprovedschoolinwhichheisdetained,or from any hospital, home or place in which he isreceivingmedical attention;

    (b) being absent from the approved school on temporaryleaveofabsenceorwith permission

    (i) runsawayfromthepersoninwhosechargeheis;or

    (ii) fails to return to the approved school upon theexpiration of his leave, or upon the revocationofsuchpermission;or

    (c) beingabsentfromtheapprovedschoolundersupervision,fails to return to the approved school upon beingrecalled,

    may be arrested without a warrant and be brought before theCourt For Children where the child is found or the approvedschoolissituated.

    (2) If a child brought before a Court For Children undersubsection(1)isundertheageoffourteenyears,theCourtForChildrenshallorderthechildtobebroughtbacktotheapprovedschoolortobesenttoanotherapprovedschoolfor

    (a) a periodwhich is equal to the period duringwhich he

    wasunlawfullyatlarge;

    (b) theremainderofhisperiodofdetention;and

    (c) suchperiodnotexceedingsixmonthsastheCourtmaydirect,inadditiontotheperiodsmentionedinparagraphs(a) and (b).

    (3) If a child brought before the Court For Children undersubsection (1) has attained the age of fourteenyears, the CourtForChildrenmayorderthechild

    (a) tobebroughtbacktotheapprovedschoolortobesenttoanotherapprovedschoolfor

    (i) aperiodequaltotheperiodduringwhichhewasunlawfullyatlarge;

    (ii) the remainder of his period of detention; and

    (iii) such further periodnot exceeding sixmonths astheCourtmaydirect;or

    (b) ifcircumstanceswarrantitandontherecommendationoftheprobationofficertheCourtthinksitnecessarytodo so, to be sent to a Henry Gurney School for suchperiodastheCourtmaydirect.

    Offence of removing or helping a child to escape from approvedschool

    72. Any personwho(a) removesachildfromanapprovedschoolwithoutlawfulauthority;

    (b) knowingly assists or induces, directly or indirectly, achildtoescapefromanapprovedschool;or

    (c) knowingly harbours or conceals a child who has so

    escaped,orpreventshimfromreturningtotheapprovedschool,

    commits an offence and shall on conviction be liable to a finenotexceedingtenthousandringgitortoimprisonmentforatermnotexceedingfiveyearsortoboth.

    Chapter 5

    HENRYGURNEYSCHOOLS

    Henry Gurney Schools

    73. TheMinistermay, by notification in theGazette, establishor appoint such Henry Gurney Schools as may be required forthepurposesofthisAct.

    Child under fourteen years of age not to be sent to HenryGurney School

    74. A Court For Children shall not make an order requiringa child under the age of fourteen years to be sent to a HenryGurneySchool.

    When a child can be sent to Henry Gurney School

    75. (1) If

    (a) a child is found guilty of any offencepunishablewithimprisonment;

    (b) theprobationreportsubmittedtotheCourtForChildrenshowsthat

    (i) theparentsorguardianofthechildcannolongerexerciseoris incapableofexercisinganypropercontroloverhim;

    (ii) the child ishabitually in thecompanyofpersonsofbadcharacter;and

    (iii) the child isnot suitable tobe rehabilitated in anapproved school; and

    (c) itappearstotheCourtForChildren (i) that the offence committed is serious in nature;

    and

    (ii) by reason of the nature of the childs criminalhabitsandtendenciesitisexpedientthatthechildbesubjecttodetentionforsuchtermandundersuch instruction and discipline as appears mostconducivetohisreformationandtherepressionof crime,

    the Court For Children shall, on the recommendation of theprobation officer, send the child toaHenryGurneySchool.

    (2) IfaCourtForChildrenordersachildagedfourteenyearsorabovetobesenttoaHenryGurneySchool

    (a) theordershallbe

    (i) anauthorityforhisdetentionforaperiodofthreeyearsfromthedateoftheorder;and

    (ii) valid for his detentionup to but not after he hasattainedtheageoftwenty-oneyears;and

    (b) sections 68 to 72 shall apply with the fol lowingmodifications:

    (i) forthewordsapprovedschoolwhereverappearingthereshallbesubstitutedthewordsHenryGurneySchool; and

    (ii) insection69,forthewordstheBoardofVisitorsof the approved school consent there shall besubstituted the words the Director General ofPrisons in the case of a Henry Gurney Schoolconsentsandtheagereferredtointhatsectionshallbeincreasedbythreeyears.

    (3) Notwithstanding subsection (2), the Director General ofPrisonsmay, inhisdiscretion

    (a) shorten the period of detention of a child in a HenryGurney School for reasonswhich appear to him to besufficient; or

    (b) releaseanysuchchildwithpermissionforsuchperiodanduponsuchconditionsashemaydeemfittoimpose.

    Chapter 6

    SPECIALPROVISIONS INRELATIONTOPLACESOFSAFETY,

    PLACESOFREFUGE,APPROVEDSCHOOLS

    ANDHENRYGURNEYSCHOOLS

    Power in respect of persons of eighteen years but undertwenty-one years of age

    76. Notwithstanding anything in this Act, the High Court, aSessions Court and a Magistrates Court shall have the powertoorder thedetention, inaHenryGurneySchool,up tobutnotafterhe has attainedtheageoftwenty-oneyears, of any personwhohas attained the age of eighteen yearsbut has not attainedtheageoftwenty-oneyearsatthedateofmakingsuchorder.

    Power of Minister to remove person undergoing imprisonmentto Henry Gurney School

    77. (1) TheMinistermay,bywarrantunderhishand,directanypersonwho

    (a) hasattainedtheageofeighteenyearsbuthasnotattainedtheageoftwenty-oneyears;and

    (b) is inprison under a sentenceof imprisonment,

    toberemovedtoaHenryGurneySchool.

    (2) If awarrantismadeunder subsection (1)(a) the unexpired residue of that persons prison sentenceshallbedeemedtobecancelled;and

    (b) suchwarrantshallbeanauthorityforthedetentionofthatpersonintheHenryGurneySchoolunderthisActuntil the date when his sentence, less any remissionfor good conduct earned while serving his sentence inprison,would,butforthissection,haveexpired.

    (3) A warrant under subsection (1) shall not be made unlesstheageofthepersonandtheunexpiredresidueofhissentence

    ofimprisonmentpermithimtobedetainedintheHenryGurneySchoolfornotlessthantwoyears.

    Power of Minister to remove child undergoing imprisonmentto approved school or Henry Gurney School

    78. (1) TheMinister may, by warrant under his hand, direct achild who is in prison under an order of imprisonment to beremoved toanapprovedschool oraHenryGurneySchool.

    (2) If awarrantismade under subsection (1)

    (a) theunexpiredresidueofthatchildsprisonordershallbedeemedtobecancelled;and

    (b) suchwarrantshallbeanauthorityforthedetentionofthatchild in the approved schoolor theHenryGurneySchool, as the case may be, under this Act until thedatewhenhisprisonorder,lessanyremissionforgoodconductearnedwhileservinghistermofimprisonment,would, but for this section, have expired.

    (3) TheMinister may, at any time for reasons which appeartohimtobesufficient,byorderinwritingdirecttheremovalofanychildfrom

    (a) anapprovedschooltoanyotherapprovedschoolortoaHenryGurneySchool;or

    (b) aHenryGurneySchooltoanyotherHenryGurneySchoolortoanapprovedschool,

    asmaybespecifiedintheorder.

    Power to subst i tute term of detent ion to term of imprisonment

    79. IfitismadetoappeartoanyCourtForChildrenupontheapplication of the person in charge of any approved school orHenry Gurney School that any child detained in the approvedschoolorHenryGurneySchoolunderthisAct

    (a) hasbeenguiltyofaseriousandwilfulbreachoftherulesof the approved school orHenryGurneySchool;

    (b) hasbeenguiltyofincitingotherinmatesoftheapprovedschoolorHenryGurneySchooltosuchabreach;or

    (c) is incorrigible or exercising a bad influence on the

    otherinmatesoftheapprovedschoolorHenryGurneySchool,

    theCourtForChildrenmaysubstitutefortheunexpiredresidueofthetermofdetentionofthatchildsuchtermofimprisonmentnotexceedingtheunexpiredresidueastheCourtmaydetermine.

    Transfer of child from one place of safety or place of refuge

    to another place of safety or place of refuge

    80. Withoutprejudicetoanywrittenlawrelatingtoimmigration,wheneveranorderhasbeenmadeunderthisActforthedetentionofachildinaplaceofsafetyorplaceofrefugeanditappearsto theDirector General that in the best interests of the child itis expedient that he be transferred from that place of safety orplace of refuge to another place of safety or place of refugewithin Malaysia, it shall be lawful for the Director General toissueanorderthatthechildshallbesotransferred.

    Chapter 7

    MISCELLANEOUS

    Child or person detained to be subject to regulations

    81. Everychilddetainedinanyplaceofsafetyorplaceofrefuge,

    place of detention, probation hostel, approved school orHenryGurneySchool,oreverypersondetainedinaHenryGurneySchoolunder thisAct shallduring the periodof the childs or personsdetention, besubject tosuch regulations asmay beprescribed.

    Board of Visitors

    82. TheMinistermayappointforeachplaceofsafety,placeof

    refugeandapprovedschoolaBoardofVisitorstoperformsuchduties and functions as theMinistermay prescribe.

    CRIMINALPROCEDUREINCOURTFORCHILDREN

    Chapter 1

    CHARGE,BAIL,ETC.

    Trials of children to be in conformity with this Act

    83. (1) Notwithstanding anything contained in any written lawrelating to the arrest, detention and trial of persons committingany offencebut subject to subsections (3) and (4), a child whois alleged to have committed an offence shall not be arrested,detained or triedexcept inaccordancewith thisAct.

    (2) WhenachildischargedwithanoffencebeforeaCourtForChildrenandduringthependencyofthecaseheattainstheageof eighteenyears theCourt ForChildren shall, notwithstandingany provisions of thisAct, continue to hear the charge againstthechildandmay

    (a) exercisethepowerundersection76;(b) exercisethepowerunderparagraph91(1)(a),(b),(c),(d)or (g);or

    (c) iftheoffenceispunishablewithimprisonment,imposeany termof imprisonmentwhich couldbeawardedbya SessionsCourt.

    (3) When an offence is committed by a child but a charge

    inrespectofthatoffenceismadeagainstthechildafterhehasattainedtheageofeighteenyears,thechargeshallbeheardbyaCourtotherthanaCourtForChildrenandthatotherCourtmayexercisethepowermentionedinparagraph(2) (a), (b) or (c).

    (4) A charge made jointly against a child and a person whohas attainedtheageof eighteenyearsshall be heardbyaCourtotherthanaCourtForChildrenandthatotherCourtshall

    (a) exerciseinrespectofthechildallthepowerswhichmay

    be exercised under this Act by a Court For Children;and

    (b) beforeexercisingthepowersreferredtoinparagraph(a),consider theprobation report.

    Bail

    84. (1) Ifachildisarrestedwithorwithoutawarrant,thechildshallbebroughtbeforeaCourtForChildrenwithintwenty-fourhours exclusive of the time necessary for the journey from theplaceofarresttotheCourtForChildren.

    (2) If it is not possible to bring a child before a Court ForChildren within the time specified in subsection (1), the childshall be brought before a Magistrate who may direct that thechildberemandedinaplaceofdetentionuntilsuchtimeasthechild can bebroughtbefore theCourt ForChildren.

    (3) The Court For Children before whom a child is broughtshallinquireintothecaseandunless

    (a) thechargeisoneofmurderorothergravecrime;

    (b) itisnecessaryinthebestinterestsofthechildarrestedto remove him from association with any undesirable

    person;or

    (c) the Court For Children has reason to believe that thereleaseofthechildwoulddefeattheendsofjustice,

    theCourtForChildrenshallreleasethechildonabond,withorwithout sureties, for such amount aswill, in the opinion of theCourtForChildren,securetheattendanceofthatchilduponthehearingof the charge, being executedby his parent or guardianorother responsibleperson.

    (4) Nothing in this section shall be deemed to affect thepowers of a police officer to release the child arrested on bailinaccordancewiththeCriminalProcedureCode.

    Separation of child from adult in police stations or Courts

    85. Appropriatearrangements shall bemade

    (a) topreventachildwhile (i) being detained in a police station;

    (ii) being conveyed to or from anyCourt; or

    (iii) waitingbefore or after attendance in anyCourt,

    fromassociatingwithanadultwho ischargedwithanoffence;

    (b) toensurethatachild,ifagirl,whilebeingsodetainedorconveyed,orwaiting,isunderthecareofawoman;and

    (c) topreventthepictureofachildwhile

    (i) being detained in a police station;

    (ii) being conveyed to or from anyCourt; or

    (iii) waitingbefore or after attendance in anyCourt,

    frombeing recorded in anymanner on tapeor f ilmorbyanyelectronicmedium.

    Custody of child not discharged on bail after arrest

    86. (1) Ifa childhaving been arrestedandwhile awaiting trial

    beforeaCourtForChildrenisnotreleasedundersection84,theCourtForChildrenbeforewhomthechildisbroughtshallcausehim to be detained in a place of detention provided under thisActuntilhecanbebroughtbeforetheCourthavingjurisdictionunlesstheCourtForChildrencertifiesthat

    (a) itisimpracticabletodoso;

    (b) heisofsounrulyordepravedacharacterthathecannotbesafelysodetained;or

    (c) byreasonofhisstateofhealthorofhismentalorbodilyconditionitisinadvisablesotodetainhim.

    (2) Under the circumstances referred to in paragraph (1)(a),(b) or (c), theCourtForChildren shallhavethepower toorderthechildtobedetained

    (a) inapolicestation,policecellorpolicelock-up,separateorapartfromadultoffenders;or

    (b) inamentalhospital,

    asthecasemayrequire.

    (3) Ifanorderfordetentioninamentalhospitalismadeundersubsection(2),ChapterXXXIIIoftheCriminalProcedureCodeshallapplywithsuchmodificationsasmaybenecessary.

    Submission of information by police officer after arrest

    87. Afterthearrestofachild,thepoliceofficerorotherpersonmakingthearrestshall

    (a) immediately inform a probation officer and thechildsparentorguardianofthearrest;and

    (b) if the child is charged with any offence, cause to be

    transmittedtotheprobationofficeracopyofthechargeandotherinformationnecessarytoenabletheprobationofficertotakesuchactionasmaybenecessarytoprepareorobtain,asthecasemaybe,aprobationreport.

    Chapter 2

    TRIALS

    Parent or guardian required to attend

    88. (1) If a child is charged with any offence, the Court ForChildren shall require the childs parents or guardian to attendat the Court For Children before which the case is heard ordetermined during all the stages of the proceedings, unless theCourt ForChildren is satisfied that itwould be unreasonable torequire the attendanceof the parentsor guardian.

    (2) Anyparentor guardianofa childwhofails to attend theCourtForChildrenwhenrequiredtodosoundersubsection(1)commits an offence and shall on conviction be liable to a finenotexceedingfivethousandringgitortoimprisonmentforatermnotexceedingtwoyearsortoboth.

    Parents or guardian may be required to withdraw

    89. IfinanycasetheCourtForChildrenconsidersitnecessaryinthebestinterestsofthechild,theCourtmayrequirehisparentsorguardian,asthecasemaybe,towithdrawfromtheCourt.

    Procedure in Court For Children

    90. (1) IfachildisbroughtbeforeaCourtForChildrenforany

    offence, it shall be the duty of the Court to explain to him insimple language suitable tohisage,maturity andunderstandingthesubstanceoftheallegedoffence.

    (2) Thedutyreferredtoin subsection (1)maybeundertaken,underthesupervisionoftheCourtby

    (a) thedefencecounselactingforthechild;or

    (b) any other responsible person as determined by theCourt.

    (3) Afterthesubstanceoftheallegedoffencehasbeenexplainedtothechild,theCourtshallaskthechildwhetherheadmitsthefactsconstitutingtheoffence.

    (4) If the child admits the facts constituting the offence, theCourt shall

    (a) ascertain that the child understands the nature andconsequences ofhis admission; and

    (b) recordafindingofguilt.

    (5) Ifthechilddoesnotadmitthefactsconstitutingtheoffence,theCourtshallthenheartheevidenceofthewitnessesinsupportthereof.

    (6) At thecloseof theevidence in chiefof eachwitness, thewitnessmaybecross-examinedbyoronbehalfofthechild.

    (7) TheCourtForChildrenshall,exceptifthechildislegallyrepresented,allowthechildsparentsorguardianoranyrelativeor other responsible person to assist him in conducting hisdefence.

    (8) If in any case where the child is not legally representedorassisted inhis defence asprovided for in subsection (7), thechild, insteadof asking questions bywayof cross-examination,makes assertions, theCourtForChildren

    (a) mayputtothechildsuchquestionsasmaybenecessaryinordertobringout,orexplainanythingin,theassertionsofthechild;and

    (b) shallthenputtothewitnesssuchquestionsastheCourtthinksnecessaryonbehalfofthechild.

    (9) If it appears to theCourtthat aprima facie caseismadeout

    (a) theCourtshallexplainto thechildthesubstanceof theevidence against him and, in particular, any points intheevidencewhichspeciallytellagainsthimor requirehis explanation;

    (b) thechildshallbeallowedto

    (i) give evidence upon oath or affirmation; or

    (ii) make any statement if he so desires; and

    (c) the evidence of any witness for the defence shall beheard.

    (10) If the Court For Children finds the child is not guilty,theCourtshallrecordanorderofacquittal.

    (11) If

    (a) afindingofguilthasbeenrecorded;or

    (b) theCourtissatisfiedthattheoffenceisproved,

    thechildandthechildsparentorguardianorotherresponsibleperson,ifpresent,shallthenbeaskediftheydesiretosayanythinginextenuationormitigationofthepenaltyorotherwise.

    (12) TheCourtForChildrenshall,beforedecidinghowtodeal

    withthechild,considertheprobationreport.

    (13) Aprobation report referredtoinsubsection (12)shallbeprepared by a probation officer and the report

    (a) shallcontainsuchinformationastothechildsgeneralconduct,homesurroundings,schoolrecordandmedicalhistory as may enable the Court For Children to dealwiththecaseinthebestinterestsofthechild;andmayput to him any question arising out of the probation

    report;and(b) mayincludeanywrittenreportofaSocialWelfareOfficer,

    a registered medical practitioner or any other personwhom the Court For Children thinks fit to provide areportonthechild.

    (14) Forthepurposeofobtainingaprobationreport,theCourtForChildrenmay fromtime totimereleasethechildonbailorremandhiminaplaceofdetention.

    (15) If the Court For Children has considered the probationreport,theCourtshallexplainto

    (a) thechildthesubstanceofanypartofthereportbearingonhischaracterorconductwhichtheCourtconsidersto

    bematerialtothemannerinwhichheshouldbedealtwith;and

    (b) theparentorguardian,ifpresent,thesubstanceofanypartof the repor
