SUIT TO QUIET TITLE AFTER TAX SALE
The Plaintiff above-named,through his undersigned attorney,comes to Complain about the De-fendants above-named and wouldrespectfully show to this HonorableCourt:This case is brought pursuant to§15-53-10 et seq. of the Code ofLaws of South Carolina, 1976, asamended, for the purpose of ob-taining a declaration of rights, sta-tus, and other legal relationships ofthe parties hereto with regards tothe subject property, and to deter-mine any and all adverse rightsand claims to the subject property.Plaintiff is a South Carolina Lim-
ited Liability Company who pur-chased the property that is thesubject of this matter at a tax saleconducted by the CharlestonCounty Delinquent Tax Collector. Upon information and belief, De-
fendant Turner, “Turner” is a resi-dent of Charleston County, SouthCarolina. Defendant was the for-mer owner of the subject propertyprior to losing it for failure to paythe annual ad valorem taxes forCharleston County. Upon information and belief, de-fendant CFNA Receivables, Inc.“CFNA” changed its name fromCitifinancial, Inc. Upon informationand belief, CFNA is the same en-tity, a South Carolina corporation ingood standing, that was Citifinan-cial, Inc. , previously located at921-B Houston Northcutt Blvd., Mt.Pleasant, SC 29464. CFNA isnamed as a Defendant in this caseto adjudicate its rights in the sub-ject property, if any based on amortgage signed to Citifiancial,Inc. by previous owners of theproperty, Frank Turner and Celes-tine W. Turner on February 6, 2003that was recorded in theCharleston County RMC Office inBook E436, Page 460 on February7, 2003. Jurisdiction and venue is proper asthe property that is the subject of
this matter is in Charleston County,South Carolina. Plaintiff is the owner of this prop-erty by virtue of a “tax” deed fromDaniel M. Gregory, Delinquent TaxCollector Charleston County,dated February 4, 2014, recordedFebruary 14, 2014, RMC Office,Charleston County, Book 388,Page 582. Upon information and belief, De-fendant Turner, was the soleowner of this property for the entiretime of this action that is relevantfrom on or near 2002 until Febru-ary 14, 2014, the date of therecording of the “tax” deed men-tioned in No. 6 above. That Defendants, nor any of itssuccessors, or agents failed to paythe real property taxed levied andassessed against the subject prop-erty for the tax year 2011 by theduly authorized political subdivi-sions of the State of South Car-olina, including, but not limited to,County of Charleston, for taxes tobe collected by the County ofCharleston.That on or near May 21, 2012,Charleston County Delinquent TaxOffice, issued its tax execution forthe tax year 2011 on the subjectproperty against Defendant Turnerafter Defendants continued to failto pay the taxes. A Copy of thisExecution is attached with theComplaint as Exhibit A. That said execution strictlycharged and commanded theDelinquent Tax Collector and/orCharleston County Treasurer tolevy by distress and sell so muchof the property the subject of thisaction as necessary to satisfy thedelinquent taxes, assessments,penalties and costs then due as re-quired by SC Code of Laws §12-51-40a. The taxes, assessments, penaltiesand costs were still not paid by onor near June 15, 2015. Thereforeand thereafter, the CharlestonCounty Delinquent Tax Collector,successfully took exclusive pos-session of the subject property bymailing the Official Notice of Levyto the Defendant “Certified Mail-Return Receipt Requested- Re-stricted Delivery” to Defendant atthe address he gave to CharlestonCounty for notices, which was2145 Josephine Drive, Mt. Pleas-ant, SC 29466. This notice was re-turned by the Post Office signed byDefendant Turner on June 20,2012. A copy of the Notice andthe “Green Card” that Ms. Turnersigned is included with this Com-plaint as Exhibit B. At that time,the Delinquent Tax Office took ex-clusive physical possession of thesubject property. That on or near November 5,2012, the Office of the CharlestonCounty Delinquent Tax Office soldthe subject property for the contin-ued failure to pay the ad valoremtaxes of 2011. The Delinquent TaxOffice sold the property during thenormal hours of sale and after dueadvertisement of same in the Postand Courier. The winning bidderwas Plaintiff for the sum of FIVETHOUSAND DOLLARS($5,000.00). Plaintiff or his agentpaid this sum to the CharlestonCounty Delinquent Tax Collectoron the same date as the sale. Acopy of the advertisements in thePost and Courier advertising theproperty for sale on October 15,22, and 29, 2012 are attached asExhibit C of this Complaint. Notice of the sale and redemptionamount was mailed to DefendantTurner on or just after December4, 2012. A copy of this Notice is in-cluded with this Complaint as Ex-hibit D. That on or near October 11, 2013,between 20 and 45 days beforethe expiration of the one year re-demption time period, the Office ofthe Delinquent Tax Office forCharleston County sent the “FinalNotice- Ending of the RedemptionPeriod” that is required by §12-51-120, SC Code of Laws. This No-tice was sent “Certified Mail-Return Receipt Requested, Re-stricted Delivery”. The Notice to
Defendant Turner was returned“Unclaimed- Unable to Forward” .A copy of this letter and the at-tempted delivery is attached as Ex-hibit E. Further, notice was sent to Citifi-nancial, Inc, at the last known ad-dress for it, the address (921-BHouston Northcutt Blvd., Mt.Pleasant, SC 29466) listed for it onthe Mortgage on the property thatis the subject of this matter thatwas signed to them. This noticewas returned “Undeliverable asAddressed- Unable to Forward”.Exhibit F is the letter to Citifinan-cial and the Green Card thatshows the Delinquent Tax Officeused to attempt delivery on Citifi-nancial. That no one, no Defendant, noranyone on their behalf, redeemedthe subject property during the oneyear redemption period.That Plaintiff is now the owner ofthe subject property in fee simpleabsolute. That, upon review of the records ofthe Charleston County DelinquentTax Office and the Treasurer ofCharleston County, all relevantfacets of Charleston County gov-ernment followed all requirementsunder statutory and common law inall material respects with regardsto this tax sale.That the duly assessed real prop-erty taxes, together with all assess-ments, penalties and costs,constituted a first lien on the prop-erty and was senior to all otherliens against the said property. That, by virtue of the failure of De-fendants to pay the taxes on thesubject property for the year 2011,by virtue of Plaintiff!s successfulbid at the delinquent tax sale on ornear November 5, 2012 by virtueof Defendants! failure to redeemthe subject property, and by virtueof the conveyance of the subjectproperty to Plaintiff mentioned pre-viously in this Complaint, any andall interests of Defendants in theproperty have been extinguished. Plaintiff is unaware of any otherparty that may have a valid claimon the subject property other thanthe Defendants, their heirs and as-signs.That, upon information and belief,Plaintiff is entitled to judgment de-claring himself the sole owner ofthe subject property in fee simpleand the interests of Defendantsshould be barred forever.
