This project is not pending an appeal of the environmentaldetermination. The environmental exemption determination for this project was made onSeptember 10,2010, and the opportunity to appeal that determination endedOctober 6, 2010 (Attachment 12).

Fiscal Impact Statement: None with this action. All costs associated with theprocessing of this project are paid from a deposit account maintained by the applicant.

Code Enforcement Impact: None with this action.

Housing Impact Statement: None with this action.

BACKGROUND

The project is located on the City of San Diego North City Water Reclamation Plant. Thereclamation plant consists of several water treatment buildings/tanks in addition to anadministrative building on the north westerly side ofthe property. All authorized vehicles andpersonnel must enter through a secure entrance on the Eastgate Mall access path. The property issurrounded by the 805 Freeway to the west, Miramar Road to the south, Eastgate Mall Drive tothe north, and industrial development to the east. Although the facility is located within the Part77 FAA notification area, the proposed design will not exceed the permitted height allowanceand will not require an FAA No Hazard to Air Navigation notice.

DISCUSSION

Project Description - AT&T Mobility submitted an application for a Neighborhood Use Permit(NUP) and a plarmed Development Permit (PDP) to install a Wireless Communication Facility(WCF) consisting of the installation of twelve antennas concealed behind Fiberglass ReinforcedPanels (FRPs). As illustrated in the zoning drawings and the photosimulation, the FRP panel hasbeen designed to replicate the current rooftop pyramid feature (Attachment 5). Due to this uniqueand creative design, AT&T Mobility will be able to fully conceal their proposed antennas fromany public perspectives. The associated ground mounted equipment is located behind a three­sided 8-foot high wall (approximately 371-sqaure feet) within an existing planter area on thewesterly side ofthe property. Due primarily to the existing topography, the westerly side of theproperty where the equipment is proposed is set back from the 805 Freeway and screened by theexisting raised grade reducing all visual impacts to the proposed equipment location (Attachment8).

Wireless Communication FacilityfWCFl Regulation - The project is located within the RS-l­14 zone and requires an NUP, per Municipal Code Section l41.0420(d)(2) which states that aNeighborhood Use Permit is required for all Wireless Communication Facilities in Residentialzone where the antennas associated with the WCF are located more than 100 feet from theproperty line of day care(s), elementary and middle school, and single or multi-unit residentialuses. The project also requires a PDP to exceed the 35-foot height limit established within theRS-I-14 zone and to exceed the 2S0-square foot equipment size limitation per Municipal CodeSection 141.0420(g)(3). These following deviations result in a consolidated NUP and PDP,Planning Commission decision with appeal rights to the City Council. After thoroughlyreviewing this project, statIhas determined that this WCF is appropriate and complies with Cityof San Diego Municipal Code section 141.0420.

Community Plan Analysis: The project location has been designated for industrial use in theUniversity Community Plan (Attachment 2). The University Community Plan does not containspecific policies on wireless communication facility development.

Council Policy 600-43 - The guidelines establish a hierarchy from the most preferred locations

(Preference 1) to the least preferred location (Preference 4) for WCFs. The project is proposedwithin a Preference 2 location according to Council Policy 600-43, which categorizes WCF'saccording to land use in which they are located. In this case, the project is located in a residentialzone containing a non-residential use and is considered to be a Preference 2 location. However,the proposed deviations required a PDP resulting in a Process 4 level decision. The applicant isrequired to submit a site justification letter explaining why a Preference 2 site was selected overPreference I level sites. AT&T Mobility's site justification letter pointed to a combination ofconcerns from the limited availability of preference I locations and the ability to design acompletely concealed facility. Also, due to the existing height of the water treatment building,the expected coverage to the surrounding area may be reduced if moved to another location.

General Plan - The General Plan, Section UD-A.15, states that WCFs should be concealed inexisting structures when possible, or otherwise use camouflage and screening techniques to hideor blend the facilities into the surrounding area. The design of the facility is to be aestheticallypleasing and respectful of the neighborhood context. The AT&T Mobility WCF design consistsof twelve antennas fully concealed inside a rooftop pyramid feature. As illustrated on thephotosimluation, the design of the faux pyramid is consistent with the other rooftop pyramid. Theassociated ground mounted equipment is behind a three-sided 8-foot high wall within an existingplanter area on the westerly side of the property. Due primarily to the existing topography, thewesterly side of the property where the equipment is proposed is set back from the 805 Freewayand screened by the existing raised grade reducing all visual impacts to the proposed equipmentlocation.

Conclusion - The project has been determined by staff to be consistent with the purpose andintent of the applicable development regulations of the San Diego Municipal Code, whichincludes the development regulations from the RS-1-14 zone and the Wireless CommunicationFacilities Regulations Section 141.0420 except for the requested deviations. The project asproposed is requesting a height deviation to exceed the 35-foot height limit and to exceed the250-square feet equipment limitation. These deviations can be supported by staff as a result ofthe creative design employed by the applicant. With the fully stealth design, neither the antennas,nor the equipment will be visible. Therefore, staff supports the University Planning Group'srecommendation to support the proposed AT&T Mobility project. In conclusions, Staffrecommends that the Planning Commission approve Planned Development Permit No. 798878and Neighborhood Use Permit No. 798879.

ALTERNATIVES

1. APPROVE Planned Development Permit No. 798878 and Neighborhood Use Pennit No.798879, with modifications.

2. DENY Planned Development Permit No. 798878 and Neighborhood Use Permit No.798879, if the findings required to approve the project cannot be affirmed.

WHEREAS, CITY OF SAN DIEGO., Owner, and AT&T MOBILITY, Permittee, filed an applicationwith the City of San Diego tor a permit to install a Wireless Communication Facility (WCF) consistingof twelve (12) panel antennas concealed behind Fiberglass Reinforced Panels (FRP) inside a fauxpyramid structure to match others. The 371- square feet equipment enclosure is located within an existingplanter area on the westerly side of the property behind an eight foot high CMU wall as described in andby reference to the approved Exhibits "A" and corresponding conditions of approval for the associatedPlanned Development Permit No. 798878 and Neighborhood Use Permit No. 798879;

WHEREAS, the project site is located at 4949 Eastgate Mall Drive, San Diego, CA 92121, in the RS-l­14 zone of the University Community Plan;

WHEREAS, the project site is legally described as that portion of pueblo Lot 1306, of the Pueblo Landsof San Diego, in the City of San Diego, County of San Diego, State of California, according to amp madeby James Pascoe in 1870, a copy of which was filed in the Office ofthe County Recorder of San DiegoCounty, November 14,1921 and known as miscellaneous map no. 36, lying easterly of the easterly lineof state highway Il-SD-805 as described in deed to State of California recorded January 8, 1971 asfile/page no. 3902 of official records and lying northerly of the northerly line of Miramar Road asdescribed in parcell of document recorded August 27, 1973 as file/page no. 73-214715 of officialrecords;

WHEREAS, on December 9, 2010, the Planning Commission ofthe City of San Diego consideredPlanned Development Permit No. 798878 and Neighborhood Use Permit No. 798879 pursuant to theLand Development Code of the City of San Diego; NOW, THEREFORE,

WHEREAS, on September 10, 2010, the City of San Diego, as Lead Agency, through the DevelopmentServices Department, made and issued an Environmental Determination that the project is exempt fromthe California Environmental Quality Act (CEQA) (Public Resources Code section 21000 et. seq.) underCEQA Guideline Section 15301 [New Construction] and there was no appeal of theEnvironmental Determination filed within the time period provided by San Diego Municipal CodeSection 112.0520;

BE IT RESOLVED by the Planning Commission of the City of San Diego as follows:

That the Planning Commission adopts the following written Findings; dated December 9, 2010.

FINDINGS:

Findings for all Planned Development Permits

1. The proposed development will not adversely affect the applicable land use plan; Neither the

City of San Diego General Plan nor the University Community Plan addresses wirelesscommunication facilities as a specific land use. Pursuant to the San Diego Land DevelopmentCode, wireless communication facilities are permitted in all zones citywide with the appropriatepermit process. Wireless communication facilities are separately regulated uses, which havelimitations or require compliance with conditions in order to minimize potential impacts. The intentofthe regulations is to camouflage facilities from public view. The site is currently designated foran industrial use in the University Community Plan. The WCF as designed is located on the roof ofthe existing water treatment building, completely concealed behind Fiberglass Reinforced Panels(FRP) within a pyramid structure designed to match the existing ones OIl site. The equipmentassociated with this project is located within an existing planter area, behind an 8-foot hight CMUwall will not be visible to the public. The General Plan, Section UD-A.15, states that WCFs shouldbe concealed in existing structures when possible, or otherwise use camouflage and screeningtechniques to hide or blend the facilities into the surrounding area. The design of facilities is to beaesthetically pleasing and respectful of the neighborhood contact. The AT&T design is consistentwith the General Plan's requirement since the WCF is completely concealed behind a rooftopfeature minimizing any visual impacts to and from the site. Therefore, the AT&T Mobility WCF4949 Eastgate Mall Drive does comply with the City of San Diego General Plan will not adverselyaffect the applicable land use plan.

2. The proposed development will not be detrimental to the pUblic health, safety, and welfare;The Telecommunication Act of 1996 preempts local governments trom regulating the "placement,construction and modification of wireless communication facilities on the basis of theenvironmental effects of Radio Frequency (RF) emissions to the extent that such facilities complywith the Federal Communication Commission's (FCC) standards for such emissions." A conditionhas been included with the project to required AT&T Mobility to submit an RF report to the City ofSan Diego demonstrating compliance with the FCC standards for wireless facilities. Therefore,based on the above, the project would not result in any significant health or safety risks to thesurrounding area.

3. The proposed development will comply with the regulations of the Land Development Code;The AT&T Mobility WCF complies with Municipal Code Section 141.0420 which requires WCFsto use all reasonable means to conceal or minimize the visual impacts of the wirelesscommunication facilities through integration. Integration with the existing structures or amongother existing uses shall be accomplished through the use of architecture, landscape and sitingsolutions. The project is completely concealed on the rooftop of an existing water treatmentbuilding within the North City Water Reclamation Plant. The associated ground mountedequipment is located behind a three-sided 8-foot high wall (approximately 371-sqaure feet) withinan existing planter area on the westerly side of the property. Due primarily to the existingtopography, the westerly side of the property where the equipment is proposed is set back from the805 Freeway screened by the existing raised grade reducing any visual impacts to the proposedequiprnentlocation

However, the project is located within the RS-I-14 zone which has a 35-foot height limitation. Theproposed WCF is located on highest point of the building consistent with the other pyramid design,and requires a Plarmed Development Permit for tlle height deviation. Although the project exceedsthe height requirement, the WCF is concealed behind the faux pyramid structure and is consistentwith the existing rooftop elements. Therefore, the height deviation can be supported by staff.

The project is also proposing to exceed the 250-square feet equipment limitation per MunicipalCode Section 141.0420(g)(3). The 371 square feet equipmentenciosure is located within an exitingplanter area. The equipment is effectively screened behind a new 8-foot high CMU wall with theequipment abutting the existing water treatment building. The associated cable tray will also beplaced on the corner of the water treatment building, and will be painted and textured to match.More importantly, due to the existing topography, the westerly side of the property where theequipment is proposed is adequately set back from the 805 Freeway and screened by the existingraised grade reducing any visual impacts to the proposed equipment location. Therefore, theequipment limitation deviation to exceed the 250 square feet can be supported by staff.

4. The proposed development, when eonsidered as a whole, will be beneficial to the community;The proposed wireless communication facility is fully concealed reducing any significant visualimpact to the neighboring residents and surrounding community. As part of this application, AT&TMobility will increase cellular data and voice coverage to and around the surrounding community.More importantly, with the requested deviations, both the antennas and equipment will not bevisible to the general public and when considered as a whole, will be beneficial to the community.

5. Any proposed deviations pursuant to Section 126.0602(b)(I) are appropriate for this locationand will result in a more desirable project than would be achieved if designed in strictconformance witb the development regulations of the applicable zone. The proposed rooftoppyramid with FRP panels conceals all twelve panel antennas minimizing all visual impacts to andfrom the facility. This unique and creative concealment design, allows AT&T Mobility to furtherimprove their voice and data coverage to the surrounding area. To comply with the heightrequirement for the RS-I-14 zone, potential designs may include ta.,ade mounted antennas andother more obtrusive structures at or below 35 feet. This proposed rooftop WCF concealed inside afaux pyramid feature is a more desirable design as opposed to fa.,ade mounted antennas or a 35-foothigh stand alone structure. Such installations are discouraged when a design such as the AT&TMobility's can be accomplished to fully conceal the antennas without adding any visual impacts tothe site. Therefore, the deviations to exceed the maximum allowable height of 35 feet and to exceedthe equipment size limitation of 250-square feet would result in a completely concealed project, anda more desirable project than would be achieved if designed in strict conformance with thedevelopment regulations ofthe RS-I-14 zone and Municipal Code Section 141.0420.

Neighborhood Use Permit - Section 126.0205

1. This Planned Development Pennit No. 798878 and Neighborhood Use pennit No. 798879 isgranted by the Planning Commission of the City of San Diego to CITY OF SAN DIEGO,Owner, and AT&T MOBILITY, Pennittee, pursuant to San Diego Municipal Code [SDMC]section Chapter 12, Article 6, Division 6 and Chapter 12, Article 4, Division and LDC 141.0420of the Wireless Communication Facilities regulations. The site is located at 4949 Eastgate Mallin the RS-l-14 zone of the University Community Plan. The project site is legally described asthat portion ofpueblo Lot 1306, of the Pueblo Lands of San Diego, in the City of San Diego,County of San Diego, State of California, according to amp made by James Pascoe in 1870, acopy ofwmch was filed in the Office of the County Recorder of San Diego County, November14, 1921 and known as miscellaneous map no. 36, lying easterly of the easterly line of statehighway II-SD-805 as described in deed to State of California recorded January 8, 1971 astile/page no. 3902 of official records and lying northerly of the northerly line of Miramar Roadas described in parcel 1 of document recorded August 27, 1973 as file/page no. 73-214715 ofofficial records.

Subject to the tenns and conditions set forth in this Permit, pennission is granted toOwner and Pennittee for a Wireless Communication Facility (WCF), described and identified bysize, dimension, quantity, type, and location on the approved exhibits [Exhibit "A"] datedDecember 9, 20I0, on tile in the Development Services Department.

The project shall include:

a. Wireless Communication Facility (WCF) consisting of twelve (12) panel antennasconcealed behind Fiberglass Reinforced Panels (FRP) inside a faux pyramid structure

to match others. The 371- square feet equipment enclosure is located within an existingplanter area on the westerly side of the property behind an eight foot high CMU walland;

b. Public and private accessory improvements determined by the Development ServicesDepartment to be consistent with the land use and development standards for this site inaccordance with the adopted community plan, the California Environmental QualityAct [CEQA] and the CEQA Guidelines, the City Engineer's requirements, zoningregulations, conditions of this Permit, and any other applicable regulations of theSDMC.

STANDARD REQUIREMENTS:

1. This pennit must be utilized within thirty-six (36) months after the date on which all rightsof appeal have expired. If this permit is not utilized in accordance with Chapter 12, Article 6,Division 1 of the SDMC within the 36 month period, this permit shall be void unless anExtension of Tirne has been granted. Any such Extension of Time must meet all SDMCrequirements and applicable guidelines in effect at the time the extension is considered by theappropriate decision maker.

2. The project complies with the Telecommunication Facility Guidelines as a CompleteConcealment Facility and as a result, the permit will not contain an expiration date. It is theresponsibility of the wireless carrier and owner(s) to maintain the appearance of the approvedfacility to condition set forth in this permit unless the site is removed and restored to its originalcondition. Code compliance shall be notified if the appearance or the scope of the project haschanged without the approval of the City Manager.

3. No pennit for the construction, occupancy, or operation of any facility or improvementdescribed herein shall be granted, nor shall any activity authorized by this Pennit be conductedon the premises until:

a. The Owner/Pennittee signs and returns the Pennit to the Development ServicesDepartment; and

b. The Pennit is recorded in the Office of the San Diego County Recorder.

4. While this Pelmit is in effect, the subject property shall be used only for the purposes andunder the tenns and conditions set forth in this Permit unless otherwise authorized by theappropriate City decision maker.

5. This Pennit is a covenant running with the subject property and all of the requirements andconditions of this Permit and related documents shall be binding upon the Permittee and anysuccessor(s) in interest.

6. The continued use of this Permit shall be subject to the regulations of this and any otherapplicable governmental agency.

7. Issuance of this Permit by the City of San Diego does not authorize the Permittee for thisPermit to violate any Federal, State or City laws, ordinances, regulations or policies including,but not limited to, the Endangered Species Act of 1973 [ESA1and any amendments thereto (16U.S.C. § 1531 et seq.).

8. The Permittee shall secure all necessary building permits. The Permittee is informed thatto secure these permits, substantial building modifications and site improvements may berequired to comply with applicable building, fire, mechanical, and plumbing codes, and State andFederal disability access laws.

9. Construction plans shall be in substantial conformity to Exhibit"A." Changes,modifications, or alterations to the construction plans are prohibited unless appropriateapplication(s) or amendment(s) to this Permit have been granted.

10. All ofthe conditions contained in this Permit have been considered and were determined­necessary to make the findings required for approval of this Permit. The Permit holder isrequired to comply with each and every condition in order to maintain the entitlements that aregranted by this Permit.

If any condition of this Permit, on a legal challenge by the OwnerlPermittee of this Permit, isfouod or held by a court of competent jurisdiction to be invalid, unenforceable, or unreasonable,this Permit shall be void. However, in such an event, the OwnerlPermittee shall have the right,by paying applicable processing fees, to bring a request for a new permit without the "invalid"conditions(s) back to the discretionary body which approved the Permit for a detennination bythat body as to whether all of the findings necessary for the issuance of the proposed pennit canstill be made in the absence of the "invalid" condition(s). Such hearing shall be a hearing denovo, and the discretionary body shall have the absolute right to approve, disapprove, or modifythe proposed pennit and the condition(s) contained therein.

11. The OwnerlPennittee shall defend, indemnify, and hold harmless the City, its agents,officers, and employees from any and all claims, actions, proceedings, damages, judgments, orcosts, including attorney's fees, against the City or its agents, officers, or employees, relating tothe issuance of this permit including, but not limited to, any action to attack, set aside, void,challenge, or annul this development approval and any environmental document or decision.The City will promptly notify OwnerlPennittee of any claim, action, or proceeding and, if theCity should fail to cooperate fully in the defense, the OwnerlPermittee shall not thereafter beresponsible to defend, indemnifY, and hold harmless the City or its agents, officers, andemployees. The City may elect to conduct its own defense, participate in its own defense, orobtain independent legal couosel in defense of any claim related to this indemnification. In theevent of such election, OwnerlPennittee shall pay all of the costs related thereto, includingwithout limitation reasonable attorney's fees and costs. In the event of a disagreement betweenthe City and Owner/Permittee regarding litigation issues, the City shall have the authority tocontrol the litigation and make litigation related decisions, including, but not limited to,settlement or other disposition of the matter. However, the OwnerlPennittee shall not be requiredto payor perform any settlement uoless such settlement is approved by OwnerlPennittee.

ENGINEERING REQUIREMENTS:

12. The project proposes to export no material from the project site. Any excavated materialthat is exported, shall be exported to a legal disposal site in accordance with the StandardSpecifications for Public Works Construction (the "Green Book"), 2003 edition and RegionalSupplement Amendments adopted by Regional Standards Committee.

13. The drainage system proposed for this development, as shown on the site plan, is privateand subject to approval by the City Engineer.

14. Prior to the issuance of any construction permit, the Permittee shall enter into aMaintenance Agreement for the ongoing permanent BMP maintenance, satisfactory to the CityEngineer.

15. Prior to the issuance of any construction permit, the Permittee shall incorporate anyconstruction Best Management Practices necessary to comply with Chapter 14, Article 2,Division 1 (Grading Regulations) of the San Diego Municipal Code, into the construction plansor specifications.

16. Prior to the issuance of any construction permit the Permittee shall submit a WaterPollution Control Plan (WPCP). The WPCP shall be prepared in accordance with the guidelinesin Appendix E of the City's Storm Water Standards.

17, Any party on whom fees, dedications, reservations, or other exactions have been imposedas conditions of approval of this development permit, may protest the imposition within 90 daysof the approval of this development permit by filing a written protest with the City Clerkpursuant to California Government Code 66020.

PLANNING/DESIGN REQUIREMENTS:

18. A topographical survey conforming to the provisions of the SDMC may be required ifit isdetermined, during construction, that there may be a conflict between the building(s) underconstruction and a condition of this Permit or a regulation ofthe underlying zone. The cost ofany such survey shall be borne by the Permittee.

19. All private outdoor lighting shall be shaded and adjusted to fall on the same premiseswhere such lights are located and in accordance with the applicable regulations in the SDMC.

20. Once the Permittee deems the construction pursuant to this Permit complete, Permitteeshall send a letter (Subject: Planning Inspection Project Number 212265) to the City of SanDiego, Development Services Department requesting a planning inspection. The site is officiallydeemed complete once the City Manager signs the letter. The Permittee shall be provided with acopy of the signed letter for record purposes.

21. All facilities and related equipment shall be: maintained in good working order; free fromtrash, debris, graffiti; and designed to discourage vandalism. Any damaged equipment shall berepaired or replaced within thirty (30) calendar days.

22. The Permittee shall notify the City prior to the sale or transfer of this site to any otherprovider or if the site is no longer operational requiring the removal and the restoration of thissite to its original condition.

23. The photosimulation(s) for the proposed project shall be printed (not stapled) on thebuilding plans. This is to ensure the construction team building the project is in compliance withapproved the 'Exhibit A.'

24. No overhead cabling is allowed for this project.

25. The Permittee shall not cause or allow the antennas located on the building to be differentsizes (length, width, or height) than as shown on the stamped approved plans.

26. The proposed cable tray shall be painted and textured (design to include the horizontallines) to match the existing water treatment building to the satisfaction of the DevelopmentServices Department.

27. The fmal product shall conform to the stamp approved plans and approvedphotosimulations prior to final inspection approval.

28. Please note that an Administrative Planuing Hold will be placed on the project prior toFinal Clearance from the City's Building Inspector to ensure compliance with the approved plansand associated conditions. Prior to calling for your Final Inspection from your buildinginspection official, please contact the Project Manager listed below at 619-687-5984 to schedulean inspection ofthe completed facility. Please schedule this administrative inspection at leastfive working days ahead of the requested Final.

29. Prior to the issuance of a construction permit, the telecommunication provider shall providea certified cumulative radio frequency model study demonstrating compliance with the FederalCommunications Commission's Radio Frequency Guidelines. All significant contributors to theambient RF environment should be considered in the radio frequency model study.

30. All equipment, including transformers, emergency generators and air conditionersbelonging to AT&T Mobility shall be designed and operated consistent with the City noiseordinance. Ventilation openings shall be baffled and directed away from residential areas.Vibration resonance of operating equipment in the equipment enclosures shall be eliminated.

31. All facilities and related equipment shall be maintained in good working order and freefrom trash, debris, graffiti and designed to discourage vandalism. Any damaged equipment shallbe repaired or replaced within thirty (30) calendar days

32. The Pennittee shall place appropriate signage on the WCF as required by CAL-OSHA tothe satisfaction of the Development Services Department.

33. Use of or replacement ofany building fa"ade or mechanical screen with FRP material forpurposes of concealing antennas shall not result in any noticeable lines or edges in the transitionto the faux pyramid. All FRP shall be painted and textured to match the existing pyramid featureto the satisfaction of the Development Services Department.

INFORMATION ONLY:

• The issuance of this discretionary use pennit alone does not allow the immediatecommencement or continued operation of the proposed use on site. The operation allowedby this discretionary use permit may only begin or recommence after all conditions listedon this permit are fully completed and all required ministerial pennits have been issued andreceived final inspection.

• Any party on whom fees, dedications, reservations, or other exactions have been imposedas conditions of approval of this Pennit, may protest the imposition within ninety days ofthe approval of this development pennit by filing a written protest with the City Clerkpursuant to California Government Code-section 66020.

• This development may be subject to impact fees at the time of construction permitIssuance.

As a property owner, tenant or person who has requested notice, you should know that the PlanningCommission will hold a public hearing to approve, conditionally approve, or deny an application for aWireless Communication Facility (WCF) located at 4949 Eastgate Mall in the RS-1-14 zone within theUniversity community plan. The proposed antennas are concealed inside a rooftop pyramid featuredesigned to match existing. The equipment associated with the project shall be placed on the groundlevel, behind a fenced enclosure.

TIle decision of the Planning Commission is final unless the project is appealed to the City Council. Inorder to appeal the decision of the Planning Commission you must be present at the public hearing andfile a speaker slip concerning the application or have expressed interest by writing to the PlanningCommission before the close of the public hearing. The appeal must be made within 10 working days of the PlanningCommission decision.
