On March 17, 2020, the Court entered an order, Dkt. 464, granting Defendants’ Consent

Motion for Clarification or Reconsideration of the Court’s March 4, 2020 Order, Dkt. 463.

Defendants’ motion was prompted by the Court’s prior order to produce documents from families

of responsive documents that the Government previously withheld as non-responsive. While

preparing those documents for production, Defendants discovered that a small subset of the

documents were subject to privileges, which generally were not previously claimed because the

documents were marked non-responsive. Dkt. 463 at 1. In granting the motion, the Court ordered

Defendants to “produce privilege logs to Plaintiffs and the Court specific to the privileged

documents discovered while preparing the family of documents for production.” Dkt. 464 at 2.

That privilege log is attached hereto.

Defendants note that in preparing the attached log this week, they determined that five

documents (out of more than three hundred withheld for privilege) should instead have been

produced. The documents were removed from the log and Defendants will produce these five

documents expeditiously, pursuant to the Court’s prior order.
