Four years of ISPA

Only a few months ahead of accession, the role of ISPA in preparing the new Member states for the

Community cohesion policy appears even more important, in particular because ISPA was to assist

the acceding countries in the smooth transition to the Cohesion Fund and to familiarise

administrations and beneficiaries with the Commission procedures and requirements for EU

structural measures.

In providing financial assistance to environmental projects that require large infrastructure

investments, essentially for water supply, wastewater treatment and waste management, ISPA has

helped candidate countries to strengthen their understanding and their administrative capacity to

implement key environmental legislation.

In the transport sector, ISPA contributed to the development of the future trans-European transport

network by supporting the interconnection and interoperability within the candidate countries’

national networks as well as between these networks and the Union’s network.

ISPA also provided technical assistance to enhance notably the capacity of national bodies with

respect to environmental policy implementation and public procurement, as candidate countries

experienced difficulties to implement the required standards.

Finally, it promoted decentralised management of procurement by the beneficiary countries (EDIS)

and undertook several systems audits to assess the management and control systems in the

candidate countries.

As a result, since 2000, the Commission approved 324 projects, representing a total ISPA

contribution of more than € 7 billion, of which over € 4.3 billion has been committed and more than

€ 1.0 billion paid out.

ISPA The Instrument for Structural Policies for Pre-accession (ISPA) has been set up as part of Agenda 2000 and was confirmed by the Luxembourg European Council of December 1997 which provided for an enhanced pre-accession strategy. The strategy encompassed three different pre-accession instruments (PHARE, ISPA, SAPARD) which were to assist the candidate countries in preparing for accession during the next seven years (2000-2006). According to the “Ispa Regulation” (Council Regulation (EC) N° 1267/1999 of 21 June 1999) “Ispa shall provide assistance to contribute to the preparation for accession to the European Union of the following applicant countries: Bulgaria, Czech Republic, Estonia, Hungary, Latvia, Lithuania, Poland, Romania, Slovakia, and Slovenia, in the area of economic and social cohesion, concerning environment and transport policies […]”.

Budget

The yearly ISPA budget amounts to more than € 1 billion, distributed over the beneficiary countries according to their population, surface and GDP per capita. Whereas for practical reasons a margin of flexibility was created, the Commission has endeavoured each year to establish the actual beneficiaries’ allocations near to the midpoint of their range. Also, the Commission has aimed to distribute the funds equally between the environment and transport sectors.

Project approval procedure

Project proposals submitted by the beneficiary country; Project appraisal by DG Regio.F, inter-service consultation of other Commission

services and, where appropriate, co-ordination with IFIs (International financial institutions);

Opinion by Management Committee (representatives of the Member States); Decision of the Commission; Signature of the Financing Memorandum by the Commission and the beneficiary

country.

Projects have to be in line with ISPA national sector strategies elaborated by the beneficiary country and endorsed by the Commission, which formulate mid term investment priorities for the two sectors as well as project selection criteria. Technical assistance projects cover project-related assistance as well as assistance to put decentralised implementation procedures (EDIS) in place. By implementing EDIS, candidate countries will gradually shift from a system of ex-ante control by the Commission of tendering and contracting towards a regime of ex-post control which prevails for Member States.

Implementation The beneficiary countries are responsible for the implementation. However, as long as EDIS is not in place, the Commission exercises close control over all stages of project implementation. After the signature of a project, the beneficiary country receives a first advance payment. A second advance is paid out after the signature of a significant works contract. These advances provide the candidate countries with the necessary cash flow to pre-finance contract payments. Effective disbursements are then reimbursed up to 80% of the ISPA grant. The remainder is paid out after acceptance of the final report once the project has been completed.

Changes for new Member states

As of January 2004, no new ISPA projects will be accepted for the 8 countries that will join the EU in May 2004. Existing ISPA projects will be transformed into Cohesion Fund projects. Amounts committed before January 2004 will be paid out from the ISPA payment budget covering the period 2000-3. Bulgaria and Romania remain eligible to ISPA and will benefit from gradually increasing allocations.

Overview of Ispa projects decided between 2000 and 2003

General In terms of commitments, the Commission achieved to allocate the ISPA funds at the mid-point of the candidate countries’ budget range for the period 2000-2003, as well as to distribute them almost equally between the environment and transport sectors (except for Bulgaria and Romania). The average rate of co-financing for the 324 projects that were approved amounted to 65%, the remainder being financed from the beneficiary countries’ own resources, either with the assistance of loan-financing from IFIs or not. The 324 projects represent a total cost of € 11,6 billion of which € 10,8 billion was considered eligible, whereas the corresponding total ISPA contribution amounted to € 7,0 billion, of which € 4,3 billion or 61,7% has been committed.

Per sector In terms of commitments, an equal distribution between the environment and transport sectors was achieved. Including project-related technical assistance, the number of transport projects amounted to 102, whereas environment projects totalled 211.

Technical assistance to prepare for decentralisation (EDIS) represented 10 projects (one in each country), whereas the project to relieve the consequences of the 2002 flood in the Czech republic is divided evenly over the two sectors.

In the environment sector, 81 projects related to sewerage and treatment, 61 to combined drinking water-sewerage measures and 45 to solid waste management. In 2003, the first air quality project was adopted. In the transport sector, an almost equal number of projects for rail (46) and for road (48) were approved, albeit with a larger share for rail (€ 1,070 billion) than for road (€ 1,002 billion) in terms of commitments.

Technical assistance

In addition to the 10 project EDIS projects, 62 technical assistance projects were decided, either to prepare or to assess project proposals, or to improve administrative capacity. The total amount decided on TA projects (including EDIS) exceeds € 167 million. Regarding EDIS, four acceding countries have applied for the waiving of the ex-ante control, confirming that the minimum criteria and conditions stipulated for granting EDIS had been met. Even if EDIS will not have been accredited for all countries before accession, the EDIS process will remain a core element of the Commission's initiative to strengthen the administrative capacity for project management and contracting in the new Member states. Finally, the Commission has launched several technical assistance measures at its own initiative such as seminars and training in the beneficiary countries on issues like the Water framework directive, Public-private partnerships, tendering and contracting, etc.

Progress in implementation

The payment rate on decided ISPA projects gradually increased over the years. Initially, delays in tendering and contracting often delayed progress on the ground and, consequently, the payment of second advances and request for reimbursement. However, by the end of 2003, more than € 1 billion has been paid out, representing almost 25% of the total of ISPA grants committed.

From ISPA to the Cohesion Fund

Following the completion of the accession negotiations at the Copenhagen European Council in December 2002, the new Member states will benefit from an allocation of € 21.7 billion for structural measures for the period 2004-06, i.e. average per capita aid in 2006 of € 117. One third is allocated to the Cohesion Fund, with the provision for Structural Funds being targeted mainly at Objective 1 level. Community Initiatives will be restricted to Interreg and Equal. As the set-up of ISPA has been closely based on the Cohesion Fund, these instruments share a large number of common features such as a project-based approach, high rates of assistance, a focus on transport and environment, the whole territory of a Member state, indicative allocations per country, and similar project applications, appraisal and monitoring procedures. Therefore, it is expected that, from a procedural point of view, transition from one instrument to the other should be relatively straightforward. For the acceding ISPA beneficiary countries, ISPA has ceased end 2003 and it is the Cohesion Fund that now applies, implying that ongoing ISPA projects will be completed under Cohesion Fund rules and be considered as Cohesion Fund projects. As a result, ISPA commitments distributed over the period 2004-2006 for projects decided before 2004 will become Cohesion Fund commitments. However, under the Cohesion Fund, the yearly allocations1 for the 8 acceding countries will rise to € 2.8 billion per year for the period 2004-2006 compared to € 0.75 billion under ISPA so far. Whilst it is true that a substantial part of the increased budget can be accounted for by commitments to known projects –i.e. decided ISPA projects and projects to be approved under ISPA in 2003-, additional efforts are required from the acceding ISPA beneficiary countries to identify and prepare new investments in order to create a project pipeline which enables the effective absorption of the Cohesion Fund budget. Similar efforts are needed by Bulgaria and Romania which, although not acceding in 2004, will also benefit from additional ISPA allocations following the Copenhagen European Council.
