PART I—B

Jammu and Kashmir Government—Notifications.

J&K) was constituted by the Government vide Notification SRO-146 of 1999 dated 26-04-1999 read with Notification SRO-340 of 1999dated 13-08-1999 with the following terms of reference :––

(i) to inquire whether non-permanent residents have obtainedPermanent Resident Certificate in contravention of Jammuand Kashmir Grant of PRC Act, 1963 (Act No. XIII of1963) and other laws pertaining to the subject and thecircumstances thereof ;

(ii) if so, to identify the officers/officials who haveissued such certificates in violation of the law on the subject; and

(iii) consequently to suggest measures for providing an effectivecheck to prevent such violation of the provisions of theJ&K Grant of Permanent Resident Certificates ProcedureAct, 1963.

Whereas, the said Commission of Inquiry regarding State SubjectPermanent Resident Certificates, J&K, has in all submitted five reportswith the latest report submitted vide letter No. COI SSC/99/658-62dated 01-03-2013 to the Revenue Department. In these reports 136persons have been found to be non-permanent residents of the Stateagainst which permanent resident certificates of 6 persons have alreadybeen cancelled by the Government. These 136 persons include 67persons who even after due service did not choose to cause theirappearance before the Commission and therefore, the Commissiondeclared them as non-permanent residents of the State andrecommended that their Permanent Resident Certificates becancelled ;

Whereas, the Commission regarding Permanent Resident Certifcates,J&K also identified 230 persons against whom complaints were filedbefore the Commission for having fake Permanent Resident Certificatesbut due to incomplete address details, the Commission could not finaliseits recommendations. The complainants were also not traceable to obtainfurther details from them for updating the addresses of thesepersons ;


Whereas, the lists furnished by the Commission for cancellationof the PRCs have been categorised as under :–––

I Annexure A List of the persons/beneficiaries who havebeen declared as Non-State Subjects bythe Commission.

II Annexure B List of persons who choose notto causetheir appearance despite service of noticesbefore the Commission and thus declaredas Non-State Subjects.

III Annexure C List of persons/beneficiaries in whosefavour the PRCs were issued by theincompetent authorities and thus declaredas Non-State Subjects by the Commission.

Whereas, section 6 of the Jammu and Kashmir Grant ofPermanent Resident Certificate (Procedure) Act, 1963 provides asunder :––

(1) The Government may, at any time, either on its own motionor on an application made to it in this behalf, call for therecord of any case pending before or disposed by acompetent authority and may uphold or reverse the ordersof the competent authority or may pass any other ordersor give any directions as it may deem fit :

Provided that no orders prejudicial to an interested personshall be passed without giving such a person a reasonableopportunity to be heard.

(2) If it appears to a competent authority that a substantialquestion of law or public interest is involved in anyproceedings under this Act, it may report it to theGovernment and the Government may pass any orders orissue any directions, it may deem fit.

Whereas, the report of the Commission regarding State Subject/Permanent Resident Certificates reveals that adequate opportunityof being heard has been given by the Commission to the personswhose Permanent Resident Certificates have been recommended forcancellation ; and

Whereas, the Government, after having duly considered the reportsof the Commission submitted on 28-02-2011, 08-03-2012 and 01-03-2013has accepted the findings of the Commission along with therecommendations and has decided as under :––

1. the Permanent Resident Certificates of the persons figuringin Annexures A & B, who have been declared as non-permanent residents by the Commission, shall be cancelledbesides initiating consequential action in terms of Rule 8 ofthe J&K Grant of Permanent Resident Certificate (Procedure)Rules, 1968 ;

2. the Permanent Resident Certificates of persons figuringin Annexure C in whose favour the PermanentResident Certificates have been issued by authorities notcompetent/authorised to issue such certificates shall also becancelled ;

3. the competent authorities shall be directed to verify theentitlement of persons figuring in Annexure C for grant offresh Permanent Resident Certificates ;

4. such persons figuring in Annexure C who after properverification by the competent authorities, are found non-permanent residents, follow up action as provided under Rule8 of the said rules shall be taken by the concerned DeputyCommissioners and Tehsildars ; and

5. a notice shall be issued in leading newspapers to the personsagainst whom the complaints could not be disposed off dueto incomplete addresses. They shall be asked to submit theirobjections/documents in support of their claim to bepermanent residents of the State within a period of fifteendays from the date of issuance of the notice failing whichfurther action as warranted under rules shall be taken.

Now, therefore, it is hereby ordered that–––

a. the Permanent Resident Certificates of persons figuringin Annexures A, B & C are hereby cancelled and declaredas nonest ab-initio ;


b. the persons figuring in Annexures A & B are herebydeclared as non-permanent residents of the State ofJammu and Kashmir ;

c. the concerned Deputy Commissioners and Tehsildars shallproceed forthwith against the persons figuring in AnnexureA & B in terms of Rule 8 of the J&K Grant of PermanentResident Certificate (Procedure) Rules, 1968 forconsequential action ;

d. the authorities competent to issue Permanent ResidentCertificates in respective districts shall verify entitlementof the persons figuring in Annexure-C for grant of freshPermanent Resident Certificates under rules within aperiod of two months and those not found entitled to suchcertificates shall also be proceeded against in terms ofRule 8 ; and

e. the State Crime Branch shall register cases against thepersons detailed in Annexures A, B & C and investigateas to how and under what circumstances they haveobtained the PRCs despite being non-permanent residentsof the State of Jammu and Kashmir and also against theauthorities who have issued Permanent ResidentCertificates without competence/authorisation besidesthose in whose favour such certificates were issued.

SRO-202.––In exercise of the powers conferred by the proviso tosection 124 of the Constitution of Jammu and Kashmir, the Governor herebymakes the following rules, namely :––

1. Short title and commencement.––(1) These rules may be calledthe Jammu and Kashmir Special Recruitment Rules, 2015.

(2) They shall come into force at once.

Laws, Regulations and Rules passed thereunder.

2. Definitions.––In these rules unless the context otherwiserequires,––

(a) ‘appointee’ means a person who has been appointed underthese rules ;

(b) ‘Service Selection Board’ means the Service Selection Boardconstituted under the Jammu and Kashmir Decentralizationand Recruitment Act, 2010 and the rules framed thereunder ;

(c) ‘Government’ means the Jammu and Kashmir Government ;

(d) ‘post’ means a post borne on the establishment of anydepartment of the Government ;

(e) ‘selection agency’ means the Public Service Commission orService Selection Board, as the case may be ;

(f) ‘Selection Committee’ means Selection Committee orCommittees constituted under rule 5 of these rules ; and

(g) Words and expressions used in these rules but not definedshall have the same meaning as assigned to them in the Jammuand Kashmir Civil Services (Classification, Control and Appeal)Rules, 1956.

3. Application of the rules.––These rules shall apply to allnon-gazetted posts borne on the establishment of any department or serviceof the Government and such gazetted post, as may be notified by theGovernment from time to time.

4. Reference of vacancies.––All the departments shall refer theexisting vacancies and also the vacancies that would accrue during theyear to the concerned selection agencies within a period of one month fromthe date of issuance of these rules indicating therein the district-wise breakupof available vacancies in each cadre viz. State, Divisional and District cadre.

5. Appointment under these rules.––(1) Notwithstanding anythingto the contrary contained in any rule or order for the time being in force

relating to the method of recruitment and conditions of service forrecruitment in any service, or to any post, under the Government––

(i) the appointments to all non-gazetted posts borne on theestablishment of any Department or Service of the Governmentshall be made by the Government on temporary basis on thebasis of the selection made by the Selection Committee,consisting of––

(a) Chairman or a member of the Services Selection Boardto benominated by the Chairman.............Convenor ;

(b) District Head of the indenting office/Department........... Member ;

(c) One officer of, or above, the rank of Deputy Secretaryto the Government from the concerned Department................. Member ; and

(ii) the appointments to the gazetted posts, notified under rule 3 ofthese rules shall be made by the Committee, consisting of––

(a) a member of the Public Selection Commission to benominated by the Chairman..............Convenor ;

(b) subject matter experts to be co-opted by the ChairmanPublic Service Commission..............Member :

Provided that nothing hereinabove shall apply to the postswhich have been referred to the Public ServiceCommission or the Services Selection Board on the dateof issuance of these rules.

(2) The Selection Committees referred to in sub-rule (1) shall makethe selections as per the provisions of the Jammu and Kashmir ReservationAct, 2004 and rules framed thereunder.

6. Eligibility .––Eligibility for appointment shall be the same asprescribed under the rules of recruitment applicable to the relevant post orservice.

7. Mode of selection.––(1) The selection agency shall inviteapplications for recruitment under these rules in respect of district, divisionor State cadre posts. After assessing the merit of the candidates in a fairand transparent manner, the selection agency shall prepare a select listwhich shall not exceed the number of vacancies so advertised and furnishthe same to the appointing authority within a period of three months fromthe date of reference of the vacancies.

(2) The selection agency shall also prepare a waiting list up to 20%of the total number of selected candidates and forward the same to theconcerned appointing authority.

(3) The appointing authority shall issue appointment orders strictly inaccordance with the select list furnished by the selection agency within aperiod of 15 days positively.

8. Nature of Appointment.––(1) A person appointed under theserules shall be initially on probation for a period of five years and aftercompletion of five years his service shall be declared as permanent subjectto passing of such tests, or successfully undergoing such training, as providedunder the Jammu and Kashmir Civil Services (Classification, Control andAppeal) Rules, 1956 or as prescribed under the relevant recruitment rulesgoverning the post/service to which he has been appointed.

(2) The appointee shall have to necessarily work for a period of fiveyears on the post against which he has been appointed and such appointeeshall not be eligible for transfer for whatsoever reason during the temporaryservice of five years :

Provided that any person appointed against any available vacancy onthe basis of being a resident of backward area or an area adjoining Line ofActual Control shall serve in such areas for a period of not less than sevenyears.

9. Fixation of pay.––(1) During the period of first five years, theappointee shall be entitled to the minimum of scale of pay along with thegrade pay applicable to the post against which he is appointed.

(2) Every appointee shall after completion of five years period onprobation be entitled to fixation of pay in the time scale of pay applicable tothe post against which he is appointed.

10. Increments, dearness allowance and other allowances.––(1) The persons appointed under these rules shall be entitled to annualincrements, Dearness Allowance, House Rent Allowance and CityCompensatory Allowance after successful completion of their five years’service on consolidated salary.

(2) These appointees shall be entitled to the benefits under the MedicalAttendance Rules and Leave Rules from the date of their appointmentitself.

11. Seniority.––(1) The seniority of persons appointed under theserules shall reckon from the date of their appointment.

(2) The period spent on probation/consolidated salary shall also reckonfor purposes of calculating the qualifying service of these appointees forpensionery and other benefits provided under rules.

12. Other conditions of service.––In the matter of other conditionsof service like age, qualification, discipline, conduct and other allied matters,a person appointed under these rules shall be governed by the recruitmentrules of the service to which the post occupied by him belongs, besidesother rules, regulations and orders in vogue in the State Civil Services ingeneral.
