Dated 28–10–2015.

Whereas, vide SRO-305 dated 08-09-2015, the Government calledupon Ladakh Autonomous Hill Development Council Constituencies of LehDistrict to elect the members for constituting the 5th Ladakh AutonomousHill Development Council (LAHDC), Leh ;

Whereas, in terms of section 14 of the LAHDC Act, 1997, the termsof members, both elected and nomimated, commences from the date offirst meeting of the Council after general election ;

Whereas, the five years term of the existing 4th Ladakh AutonomousHill Development Council, Leh is coming to an end on 28-10-2015 ;

Whereas, due to the circumstances beyond its control, it has notbeen possible for the newly constituted 5th LAHDC, Leh to hold its firstmeeting in terms of rule 93 of LAHDC (Election) Rules, 1995 and elect itsChairman before 28th October, 2015 ;

Whereas, the cessation of the existence of the present Council andthe likely delay in taking over the function and responsibilities of the LadakhAutonomous Hill Development Council, Leh by the newly constituted 5thCouncil is likely to create a vaccum, which cannot be allowed to come intoexistence and as such needs to be addressed.


Now, therefore, the Government in excercise of the executive powersconferred upon it by section 5 of the State Constitution and all other enablingprovisions in this regard, authorizes Deputy Commissioner, Leh (ChiefExecutive Officer, Ladakh Autonomous Hill Development Council, Leh)to perform the functions and responsibilities of the Ladakh AutonomousHill Development Council, Leh till the newly constituted Council formallytakes over its function and responsibilities.

(ii) Two similar completed works costing not less than theamount equal to 50% of the estimated cost.

(iii) One similar completed works costing not less than theamount equal to 80% of the estimated cost.

2. e-Bid may be submitted by––

A single firm that meets all qualification requirements setforthin paras 1(a) and 1(b) above.

(a) A joint venture of firms having not more than two partnerswho shall meet all qualification requirements collectivelysetforth in 1(a) and 1(b) above. Either of the partner can bedesignated as lead partner on whose name tender shall bepurchased.

(b) All the e-Bids must be accompanied by the scanned copy ofEMD in the form of Bank Guarantee pledged to the Executive

SRO-382.––Whereas, on 02-02-2013, Police Station, Kupwarareceived a reliable information to the effect that some unknown miscreantshave pasted posters on the walls of local Jamia Masjid, Tikker, therebythreatening the Panch and Sarpanches to resign from their positions ; and

Whereas, in this connection, Case FIR No. 26/2013 under section 13of the Unlawful Activities (Prevention) Act, 1967 and 506, RPC was

registered in Police Station, Kupwara and investigation initiated ; and

Whereas, during the course of investigation, handwriting of the

suspected person, Gh. Nabi Malik S/o Haji Gh. Ahmad Malik R/o Tikker

Kupwara was sent to FSL and as per report of FSL, handwriting of said

person matched with that of threatening poster ; and

Whereas, during the course of further investigation, on the basis of

statement of witnesses, the seizure memo and other evidence, the accused

was arrested and the Investigating Officer established a prima facie case

against the accused person under section 13 of the Unlawful Activities

(Prevention) Act, 1967 ; and

Whereas, the Authority appointed by the State Government under

sub-section (2) of section 45 of the Unlawful Activities (Prevention)

Act, 1967 has independently scrutinized the case diary file and all other

relevant documents relating to the case and has come to a definite conclusion

that this is a fit case for accord of prosecution sanction against the accused

person ; and

Whereas, after perusing the case diary, the relevant documents and

also taking into consideration the observations/views of the Authority

appointed under sub-section (2) of section 45 of the Unlawful Activities

(Prevention) Act, 1967, the State Government is of the view that there is

sufficient material and evidence available against the accused person for

his prosecution under the aforesaid provisions of law.

Now, therefore, in exercise of powers conferred by sub-section (1)

of section 45 of the Unlawful Activities (Prevention) Act, 1967, the State

Government hereby accords sanction for launching prosecution against

the accused person namely Gh. Nabi Malik S/o Haji Gh. Ahmad Malik

S/o Mohammad Yousuf Malik R/o Arwani, Bijbehara while coming fromPadshahibagh towards Arwani crossing ; and

Whereas, during the course of investigation, the subject disclosedthat in April, 1995 he went to Pakistan for weapon training and returned

illegally via Nepal Border carrying a fake Passport as a member of banned

Hizbul Mujahidin outfit whose main aim was to threaten the integrity, security

and sovereignty of India ; and

Whereas, in this connection, Case FIR No. 114/2012 under

section 13(2) of the Unlawful Activities (Prevention) Act, 1967, was

registered in Police Station, Bijbehara and investigation initiated ; and

Whereas, during the course of investigation, on the basis of statements

of witnesses, the seizure memos and other evidence, the Investigating

Officer has established a prima facie case against the accused person

under section 13 (2) of the Unlawful Activities (Prevention) Act, 1967 ; and

Halqa Panchayat Meeting/Resolution

Today on 4th of July, 2015, a meetig of Halqa Panchayat, Pangiariwas held under the Chairmanship of Sh. Sian Dass, Sarpanch of HalqaPanchayat at Panchayat Ghar, Pangiari. All the members of the HalqaPanchayat were present in the meeting.

The Agenda of the meeting is to publish Budget rates approved bythe Gram Sabha, which was proposed by the Halqa Panchayat, in theRanbir Government Press, Jammu for Government Gazette.

After discussion the Panchayat passed resolution for submission ofForm No. 14 (Rate list of taxes) to the Manager of Ranbir Govt. Press,Jammu to publish in the Government Gazette.

Halqua Panchayat Meeting

Today on 15th of July, 2015 a meeting of Halqa Panchayat, Pangiariheld at Panchayat Ghar, Pangiari under the Chairmanship of Sh. Sian DassSharma, Sarpanch of Halqa Panchayat. All the Panches of Halqa Panchayatwere persent in the meeting.

The Agenda of the meeting is to prpare the Budget estimate ofincome and expenditure for the year 2015-16 in respect of Halqa Panchayat,Pangiari as per Panchayati Raj Act, 1989, section 21, sub-section 4 ofPanchayati Raj Rule of 1996.

The Sarpanch of the Halqa Panchayat discussed about the preparationof Budget estimate. He discussed with the Panchayat Members about theassessment list and rate of taxes and fees.

Sh. Prabh Dayail, Panch opposed any tax or fees on earning personof Halqa Panchayat as the Sarpanch has proposed the same. After discussionthe Panchayat Members unanimously decided not to impose the fees onearning persons.

Sh. Subash Chander, Panch of Halqa Panchayat suggested for toincrease the tax/fees on the material loaded by the Tractor/Tipper from theNalla side in the Halqa Panchayat.

The Sarpanch told the Member that the fees/tax on the Tractor/Tipperwill be discussed, proposed in the list and will be discussed with concerned.

After long discussion, the Halqa Panchayat proposed the followingTaxes/Fees :—

Gram Sabha

A Gram Sabha of Halqa Panchayat, Pangiari held at PanchayatGhar, Pangiari under the Chairmanship of Sian Dass, Sarpanch of the HalqaPanchayat. The voters of the Halqa Panchayat and members were presentin the meeting.

The Agenda of the Gram Sabha was to discuss the Budget Estimateof income and expenditure for the year 2015-16, which was prepared bythe members of Halqa Panchayat, Pangiari as per Panchayati RajAct, 1989, section 21 of sub-section (4) of Panchayati Raj Rule, 1996 oftheir approval by the Gram Sabha.

The Gram Sabha held long to discuss the Budget Estimate which wasprepared by the Panchayat and presented before the Gram Sabha. TheGram Sabha felt satisfied with the decision taken by the Panchayat to perparethe Budget as per Panchayati Raj Act, 1989 for the welfare of villagers.

At the starting of Gram Sabha some of participants were not agreed,having misunderstanding about the fees and taxes.

After long discussion, the Sarpanch satisfied all about the Budget.

Shri Rashpal Dass appreciated the Halqa Panchayat/Gram Sabhathat it is for the first time to discuss this type of Budget.

Shri Nandi Ram suggested to auction the fish in the Gopala Pond toraise the income of Halqa Panchayat. Sarpanch assured to take up thematter with concerned Block Development Officer, Akhnoor.

HALQA PANCHAYAT MEETING

Today on 11th of July, 2015, a meeting of Halqa Panchayat KainkJagir held at Panchayat Ghar Kaink Jagir under the Chairmanship ofShri Niranjan Singh, Sarpanch of the Halqa Panchayat. All the Panchesof Halqa Panchayat were present in the meeting.

The agenda of the meeting is to prepare the Budget estimate ofincome and expenditure for the year 2015-16 in respect of Halqa PanchayatKaink Jagir as per Panchayati Raj Act, 1989, Section 21 Sub-Section 4of Panchayati Raj Rules of 1996.


The Sarpanch of the Halqa Panchayat discussed about the preparationof Budget estimate. He discussed with the Panchayat members about theassessment list and rate of taxes and fees.

Shri Rakesh Kumar, Panch opposed any tax or fees on earningperson of Halqa Panchayat as the Sarpanch has proposed the same.After discussion the Panchayat members unanimously decided not toimpose the fees on earning persons.

Shri Pawan Kumar, Panch of Halqa Panchayat suggested for toincrease the tax/fees on Mobile towers which is 20,000/- per tower as perthe rate proposed by the Panchayat.

The Sarpanch told the members that the fees of Mobile Tower wasapproved by the Government and for increase in tax he will discuss withthe Block Development Officer, Akhnoor.

GRAM SABHA

A Gram Sabha of Halqa Panchayat Kaink Jagir held at Panchayat

Ghar Kaink Jagir under the Chairmanship of Shri Niranjan Singh, Sarpanchof the Halqa Panchayat. The voters of Halqa Panchayat and members

of Halqa Panchayat were present in the Gram Sabha.

The agenda of the Gram Sabha was to discuss the Budget estimateof income and expenditure for the year 2015-16, which was prepared by

the members of Halqa Panchayat Kaink Jagir as per Panchayati Raj Act,1989, Section 21, Sub-Section 4 of Panchayati Raj Rules 1996 and their

approval by the Gram Sabha.

The Gram Sabha held a long discussion regarding the Budget which

was prepared by the Panchayat and presented before the Gram Sabha.The Gram Sabha felt satisfied with the decision taken by the Panchayat

to prepare the budget as per Panchayati Raj Act, 1989 for the welfareof villagers.

Shri Kishori Lal prominent person said that it is for the first time that

Gram Sabha got to discuss this type of budget. Many villagers wereinquistive about the budget being discussed.


Some of the villagers had questions and querries about the budget

which was resolved by the Sarpanch by explaining and answering them.

Shri Gurdeep Singh suggested that the fees of tower should beincreased from 20,000/- to 30,000/- per annum. The Sarpanch of HalqaPanchayat explained briefly that this fees of tower has been fixed by theGovernment yet he assured that he will take up the matter with BlockDevelopment Officer, Akhnoor.

Some of the villagers had questions and quarries about the Budget,which was resolved by the Sarpanch by explaining and answering them.

Sh. Pritam Lal suggested that the fees of towers should be increasedfrom 20,000 to 30,000 per annum. The Sarpanch of Halqa Panchayatexplained briefly that the fees of towers has been fined by the Governemntyet he assured that he will take up the matter with Block DevelopmentOfficer, Akhnoor.

GRAM SABHA

A Gram Sabha of Halqa Panchayat, Rajachak was held at PanchayatGhar, Rajachak under the Chairmanship of Sh. Sat Paul Sharma, Sarpanchof the Halqa Panchayat. The voters of Halqa Panchayat and members ofHalqa Panchayat were present in the Gram Sabha.

The agenda of the Gram Sabha was to discuss the Budget Estimatesof income and expenditure for the year 2015-16, which was prepared bythe member of Halqa Panchayat, Rajachak as per Panchayati Raj Act,1989, section 21, sub-section (4) of Panchayati Raj Rule, 1996 and theirapproval by the Gram Sabha.

The Gram Sabha held a long discussion regarding the Budget,which was prepared by the Panchayat and presented before the GramSabha. The Gram Sabha felt satisfied with the decision taken by thePanchayat to prepare the Budget as per Panchyati Raj Act, 1989 forthe welfare of villagers.



Today on 12-07-2015, a meeting of Halqa Panchayat, Rajachak washeld at Panchayat Ghar, Rajachak under the Chairmanship of Sh. Sat PaulSharma, Sarpanch of the Halqa Panchayat. All the Panches of HalqaPanchayat were present in the meeting.

The agenda of the meeting is to prepare the Budget Estimate incomeand expenditure for the year 2015-16 in respect of Halqa Panchayat,Rajachak as per the Panchyati Raj Act, 1989, section 21, sub section (4) ofPanchayati Raj Rule of 1996.

Smt. Neelam Devi, Panch of Halqa Panchayat Suggested for toincrease the tax fees on Mobile Towers, which is 20,000/- per tower as perrate proposed by the Panchayat.

The Sarpanch told members that the fees of Mobile Tower wasapproved by the Government for increase in tax. He will discuss with theBlock Development Officer, Akhnoor.

After long discussion, the Halqa Panchayat proposed the followingtaxes and fees as :––

Halqa Panchayat Meeting

Today on 8th of August, 2015, a meeting of Halqa Panchayat,Gandharwan was held at Panchayat Ghar, Gandharwan under theChairmanship of Shri Devinder Singh, Sarpanch of the Halqa Panchayat.All the members of Halqa Panchayat were present in the meeting.

The agenda of the meeting is to publish the rate list approved by theGram Sabha in the Ranbir Government Press, Jammu for GovernmentGazette.

After a brief discussion, the Panchayat passed a resolution forsubmission of Form No. 14 (Rate list of taxes) to the Manager of RanbirGovernment Press, Jammu to publish the same in the Government Gazette.


It was also decided in the meeting that the copies of PanchayatResolution and Gram Sabha Resolution will be submitted to Director,Rural Development, Jammu, District Panchayat Officer, Jammu and BlockDevelopment Officer, Akhnoor for information please.
