    Whereas, on the basis of indent placed by ChiefEngineer, Irrigation and Flood Control Department, Jammu videNo. IFCJ/W/14274-77 dated 28-10-2017, a notification undersection 4(1) was issued by Collector, Land Acquisition (ACR), Rajourivide No. AC/LA/1021-23 dated 18-12-2017 for land measuring12 Marlas situated in Village Thanamang, Tehsil Darhal, DistrictRajouri ;

    Whereas, the District Collector, Land Acquisition (DC),Rajouri vide letter No. AC/LA/1389/90 dated 02-04-2018 hasreported that the notification issued under section 4(1) of the J&KState Land Acquisition Act by Collector, Land Acquisition (ACR),Rajouri was served upon the interested persons for filing objections,if any, to the proposed acquisition, but no objection was received fromthe land owners/interested persons in the prescribed period asrequired under sections 5&5-A of the Land Acquisition Act ;

    Whereas, the report furnished by District Collector, LandAcquisition (DC), Rajouri vide above referred letter has been examinedand it has been found that the land owners did not file any objectionto the proposed acquisition ;

    Whereas, the Government is satisfied that the land particularswhereof are given above is required for public purpose viz. forconstruction of Khul by Irrigation Department situated at VillageThanamang, Tehsil Darhal, District Rajouri.

    Now, therefore, in pursuance of Section 6 of the J&K StateLand Acquisition Act, Samvat 1990, it is declared that the landmeasuring 12 Marlas situated in Village Thanamang, Tehsil Darhal,District Rajouri, particulars whereof are given above is required forpublic purposes viz. for construction Khul by Irrigation Departmentsituated at Village Thanamang, Tehsil Darhal, District Rajouri. Further,the Collector, Land Acquisition (DC), Rajouri is directed under section7 of the said Act to take orders for acquisition of the said land aftergiving prescribed notice to the interested person(s) as required underthe Land Acquisition Act/rules.

    Attention is invited to Circular No. 03-01-2018-IGST dated25-05-2018 issued by GST Policy Wing Central Board of IndirectTaxes and Customs whereby applicability of integrated tax on goods

In the saidcircular, it was enunciated that from 1 st of April, 2018, the supplyof warehoused goods before their clearance from the warehousewould not be subject to the levy of integrated tax.

    2. It has been brought to notice of the undersigned that duringthe period from 1st of July, 2017 to 31st of March, 2018(hereinafter referred to as the “said period”), the commonportal did not have the facility to enable the taxpayer toreport payment of integrated tax, in the details required tobe submitted in FORM GSTR-1, for such supplies especiallywhere the supplier and the recipient were located in thesame State or Union Territory. Hence taxpayers makingsuch supplies were required to report such supplies as intra-State supplies and discharged central tax and state taxinstead of integrated tax accordingly. Now, representationshave been received from trade to clarify the same.

    3. In order to ensure uniformity in the implementation of theprovisions of law across the field formations, I, Commissioner,State Taxes, Jammu and Kashmir in exercise of its powersconferred by section 168 (1) of the Jammu and KashmirGoods and Services Tax Act, 2017, hereby issue thefollowing instructions.

    4. Supply of warehoused goods while deposited in custombonded warehouses had the character of inter-State supplyas per the provisions of Integrated Goods and Services TaxAct, 2017. But, due to non-availability of the facility on thecommon portal, suppliers have reported such supplies asintra-State supplies and discharged central tax and state taxon such supplies instead of integrated tax. In view ofrevenue neutral position of such tax payment and thatfacility to correctly report the nature of transaction in

    FORM GSTR-1 furnished on the common portal was notavailable during the period July, 2017 to March, 2018.It has been decided that as a one-time exception, supplierswho have paid central tax and state tax on such suppliesduring the said period would be deemed to have compliedwith the provisions of law as far as payment of tax onsuch supplies is concerned as long as the amount of taxpaid as central tax and state tax is equal to the due amountof integrated tax on such supplies.

    5. Difficulty, if any, in the implementation of this Circular maybe brought to the notice of the undersigned.

    Circular

    A registered person supplying taxable goods or services or bothis required to issue a tax invoice as per the provisions contained insection 31 of the Jammu and Kashmir Goods and Services Tax Act,2017 (JKGST Act for short), rule 46 of the Jammu and KashmirGoods and Services Tax Rules, 2017 (JKGST Rules for short),specifies the particulars which are required to be mentioned in a taxinvoice.

    2. It has been brought to the notice of the undersigned thata number of registered persons (especially in the banking, insuranceand telecom sectors, etc.) are not mentioning the place of supply alongwith the name of the State in case of a supply made in the courseof inter-State trade or commerce in contravention of rule 46(n) ofthe JKGST Rules which mandates that the said details must bementioned in a tax invoice. In order to ensure uniformity in theimplementation of the provisions of law across the field formations,I, Commissioner, State Taxes, Jammu and Kashmir, in exercise ofits powers conferred by section 168 (1) of the Jammu and KashmirGoods and Services Tax Act, 2017, hereby issue the followinginstructions.

    3. After introduction of GST which is a destination-basedconsumption tax, it is essential to ensure that the tax paid by aregistered person accrues to the State in which the consumption of

It is therefore, instructed that all registered personsmaking supply of goods or services or both in the course of inter-State trade or commerce shall specify the place of supply along withthe name of the State in the tax invoice. The provisions of sections10 and 12 of the Integrated Goods and Services Tax Act, 2017 maybe referred to in order to determine the place of supply in case ofsupply of goods and services respectively. Contravention of any ofthe provisions of the Act or the rules made thereunder attracts penalaction under the provisions of sections 122 or 125 of the JKGSTAct.
