Jammu and Kashmir Government––Notifications.

Whereas, the the Deputy Commissioner, Rajouri vide No. AC/LA/113-14 dated 10-05-2016 reported that the notification issued byCollector, Land Acquisition (ACR), Rajouri under section 4 (1) of theJ&K State Land Acquisition Act, was served upon the land owners/interested persons for filing objections, if any, to the proposed acquisitionbut no objection was received within the stipulated period as requiredunder sections 5&5-A of Land Acquisition Act ; and

Whereas, the report furnished by the Deputy Commissioner,Rajouri vide letter referred to above, has been examined and it hasbeen found that the land owners did not file objection within theprescribed period to the proposed acquisition ; and

Whereas, the Government is satisfied that the land particularswhereof are referred to above, is required purely for public purposeviz. construction of road from KM 19th of T01 to Muradpur underPMGSY.

Now, therefore, in pursuance of section 6 of the J&K State LandAcquisition Act, Samvat 1990, it is declared that the land measuring11 Kanals, 13 Marlas situated in Village Muradpur, Tehsil and DistrictRajouri, details whreeof are mentioned in Annexure “A” to thisnotification is required purely for public purposes viz. construction ofroad from KM 19th of T01 to Muradpur under PMGSY. Further, theCollector, Land Acquisition (ACR), Rajouri is directed under section7 of the said Act to take order for acquisition of the said land aftergiving prescribed notice to the interested person(s) as required underthe Land Acquisition Act/Rules.

However, the Collector concerned shall be personally responsiblefor identification and proper title verification of all types of land involvedin the case and apportionment of compensation amongst all the interestedpersons/rightful claimants in accordance with the relevant laws/rules inforce, while making the award.

Whereas, case was lodged by SHO, Doda through incharge Police

Post, Khellani vide his No. 74/5-A/PPK dated 27-06-2014, in which it wascomplained that incharge Police Post, Khellani has seized one vehicle

bearing registration No. 3033-JK21A and arrested 2 persons alongwith MFP Nagchatri (Trillium govanianum) equalling 125 Kg. being

transported illegally on 24-06-2014 ;

Whereas, after following all the codal formalities, the vehiclealong with illegal MFP stands confiscated vide No. 325-30/AO


dated 02-01-2015 read with Corrigendum Order No. 331-36/AO

dated 17-01-2015 ;

Whereas, prescribed time period of appeal before the Court of

Session under section 26-B is over and the confiscated vehicle isfree from all encumbrances wherein no application or appeal is

pending in any court.

It is, therefore, ordered that the vehicle bearing registrationNo. 3033/JK21A, is vested in favour of the Forest Department under

sub-section (1) of section 33 of the Jammu and Kashmir Forest Act,1987, with immediate effect.

Whereas, during the course of further investigation, on the basis ofstatement of witnesses, the seizure memo and other evidence, theInvestigating Officer has established a prima facie case against the accusedpersons under section 13 of the Unlawful Activities (Prevention) Act, 1967apart from other offence ; and

Whereas, the Authority appointed by the State Government undersub-section (2) of section 45 of the Unlawful Activities (Prevention)Act, 1967 has independently scrutinized the Case Diary file and all otherrelevant documents relating to the case and has come to a definite conclusionthat this is a fit case for accord of prosecution sanction against the accusedpersons ; and

Whereas, after perusing the Case Diary, the relevant documents andalso taking into consideration the observations/recommendations of theAuthority appointed under sub-section (2) of section 45 of the UnlawfulActivities (Prevention) Act, 1967, the State Government is of the view thatthere is sufficient material and evidence available against the accused personsfor their prosecution under the aforesaid provisions of law.

Now, therefore, in exercise of powers conferred by sub-section (1)of section 45 of the Unlawful Activities (Prevention) Act, 1967, the StateGovernment hereby accords sanction for launching prosecution against thebelow mentioned accused persons for the commission of offence punishable

SRO-288.––In exercise of the powers conferred by clause (b) ofsection 3 of the Jammu and Kashmir Grant of Permanent ResidentCertificate (Procedure) Act, 1963 (Act No. XIII of 1963), and insupersession of all previous notifications issued in this behalf, theGovernment hereby appoints Mr. Bashir Ahmad Indrabi, Sub-DivisionalMagistrate, Chadoora to be the competent authority for the purposes ofthe said Act within the territorial jurisdiction of Tehsil Chadoora,Chararisharief and Baghat-i-Kanipora of District Budgam.
