BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF MISSION HILLS, KANSAS:

SECTION 1. Existing Section 5-103.28 of the Code of Ordinances of the City of Mission Hills, Kansas, is hereby amended to read as follows:

5-103.28. RESOLUTION NO. 1838A RESOLUTION SETTING A PUBLIC HEARING TO DETERMINE WHETHER A STRUCTURE AT 5019 NIEMAN RD SHOULD BE DECLARED DANGEROUS OR UNSAFE AND ORDERED TO BE REPAIRED, RAZED, OR DEMOLISHED

NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF SHAWNEE, KANSAS, AS FOLLOWS:

PARAGRAPH 1. Tyler Wirth, Chief Building Official, for the City of Shawnee, Kansas filed a report with the Governing Body determining a private structure, with a commonly known address of 5019 Nieman Rd, and legally described as NIEMAN VALLEY LT 2 SHC 55 2 , is dangerous or unsafe.

ORDINANCE NO. 1494AN ORDINANCE ALLOWING CONSUMPTION OF ALCOHOL ON CERTAIN PUBLIC PROPERTY FOR A LIMITED TIME AND PURPOSE, PURSUANT TO K.S.A. 41-719(d).

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF MISSION HILLS, KANSAS:

Section 1. Purpose. The purpose of this ordinance is to allow for the sale and consumption of alcoholic liquor at the City of Mission Hills’ (“City”) Annual City Festival for Residents.

Section 2. Exemption of City Property. Pursuant to K.S.A. 41-719(d), the City hereby exempts for a limited time and purpose the following property (“Exempted Property”), title of which is vested in the City, from K.S.A. 41-719(c), which prohibits the drinking or consumption of alcoholic liquor by any person on public property:

Beginning at the intersection of Belinder Avenue and 67th Street and running north along Belinder Avenue to 66th Street, then westerly along 66th Street to Tomahawk Road, then northeasterly along Tomahawk Road to Verona Road, then north and east along Verona Road to its intersection with Overhill Road, then north easterly along Overhill Road to Ensley Lane, then south along Ensley Lane to its intersection with Tomahawk Road, then east along Tomahawk Road to Willow Lane, then south along Willow Lane to 67th Street, then west on 67th Street to the Point of Beginning.

The exemption of the Exempted Property from the provisions of K.S.A. 41-719(c) shall be limited to June 2 and 3, 2018, and thereafter, the exemption and all other sections of this ordinance shall be of no force or effect.

Section 3. Assembly on Public Property. Notwithstanding any provisions in the City Code of Ordinances to the contrary, the Exempted Property may be used for an assembly of the public on June 2 and 3, 2018, to celebrate the Annual City Festival for Residents, and the City Administrator or his or her designee is hereby authorized to allow picnicking, the erection of temporary structures, the sale of merchandise, the posting of signs and banners, and such other activities that are in keeping with an annual city festival. The City Administrator or his or her designee is further authorized to temporarily close such City streets as are necessary to facilitate the assembly of the public on the Exempted Property.

Section 4. Limited Suspension of Certain City Ordinances Pertaining to Alcoholic Liquor. Notwithstanding any provisions in the City Code of Ordinances to the contrary, including but not limited to the ordinance codified in Chapter IV, Article 1, Section 4-122, the City may allow the sale, possession, drinking and consumption of alco-holic liquor by persons twenty-one (21) years of age or older on June 2 and 3, 2018, on the Exempted Property in conjunction with the Annual City Festival for Residents; provided that the sale of such alcoholic liquor may only be made by a vendor approved by the City under such rules and regulations as determined by the City Administrator or his or her designee; and provided further that nothing contained in this ordinance shall constitute a suspension of any ordinances prohibiting drunkenness, disturbing the peace, or disorderly conduct on the Exempted Property.

Section 5. Limited Suspension of Certain City Ordinances Pertaining to Sale of Merchandise. Notwithstanding any provisions in the City Code of Ordinances to the contrary, the City may allow the sale by the City, or its designee, of merchandise related to the Annual City Festival for Residents on June 2 and 3, 2018, on the Exempted Property.

Section 6. Take Effect. This ordinance shall take effect and be enforced from and after its publication in the official City newspaper.

AN ORDINANCE ALLOWING THE CONSUMPTION OF ALCOHOL ON CERTAIN CITY-OWNED PROPERTY FOR LIMITED TIME AND PURPOSE, PURSUANT TO K.S.A. 2014 SUPP. 41-719(d).

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF MISSION HILLS, KANSAS:

Section 1. Purpose. The purpose of this ordinance is to allow for the consumption of alcoholic liquor at the Verona Columns for a private event.

Section 2. Exemption of City Property. Pursuant to K.S.A. 2014 Supp. 41-719(d), the City hereby exempts for a limited time and purpose the following property (“Exempted Property”), title of which is vested in the City, from K.S.A. 2014 Supp. 41-719(c), which prohibits the drinking or consumption of alcoholic liquor by any person on city-owned property:

Verona Columns Park

The exemption of the foregoing property from the provisions of K.S.A. 2014 Supp. 41-719(c) shall be limited to June 1, 2018, between the hours of 6:00 p.m. to 10:00 p.m. and thereafter the exemption and all other sections of this ordinance shall be of no force or effect.

Section 3. Assembly on Public Property. Pursuant to Chapter XI, Article 2, Section 11-202 of the City Code of Ordinances, the Exempted Property may be used for an private event on June 1, 2018, and the City Administrator is hereby authorized to allow picnicking, the erection of temporary structures (tables and chairs), the posting of signs and banners.

Section 4. Limited Suspension of Certain City Ordinances Pertaining to Alcoholic Liquor. Notwithstanding any provisions in the City Code of Ordinances to the contrary, including but not limited to the ordinances codified in Chapter IV, Article 4, Section 4-402 the City may allow the possession, drinking and consumption of alcoholic liquor by persons twenty-one (21) years of age or older on June 1, 2018, between the hours of 6:00 p.m. to 10:00 p.m., on the Exempted Property in conjunction with the private event and provided further that nothing contained in this ordinance shall constitute a suspension of any ordinances prohibiting drunkenness, disturbing the peace, or disorderly conduct on the Exempted Property.

Section 5. Take Effect. This ordinance shall take effect and be enforced from and after its publication.

A public hearing will be held on May 4, 2018, in the conference room of the Kansas Development Finance Authority, 534 South Kansas Avenue, Suite 800, in Topeka, Kansas at 9:00 a.m., or soon thereafter, regarding the issuance by the Health and Educational Facilities Authority of the State of Missouri of its revenue bonds in one or more series in an aggregate principal amount not to exceed $110,000,000 (the “Bonds”) for the purpose of making a loan to Saint Luke’s Health System, Inc., a Kansas not for profit corporation (the “Corporation”), to finance, refinance and reimburse the costs of certain health facilities owned and operated by the Corporation (and its affiliates), at the following locations: Saint Luke’s Hospital of Kansas City, 4401 Wornall Road, Kansas City, Missouri; Saint Luke’s North Hospital, 5830 N.E. Barry Road, Kansas City, Missouri; Saint Luke’s South Hospital, 12300 Metcalf Avenue, Overland Park, Kansas; and Saint Luke’s East Hospital, 100 N.E. Saint Luke’s Boulevard, Lee’s Summit, Missouri (including refinancing a portion of the Health and Educational Facilities Authority of the State of Missouri, Variable Rate Health Facilities Revenue Bonds (Saint Luke’s Health System, Inc.), Series 2012C). The hearing will be open to the public.

The Bonds, when issued, will be limited obligations of the Health and Educational Facilities Authority of the State of Missouri and will not constitute a general obligation or indebtedness of the State of Kansas or any political subdivision thereof, including the Kansas Development Finance Authority (the “KDFA”), nor will the Bonds constitute an indebtedness for which the faith and credit and taxing powers of the State of Kansas are pledged. The Bonds will be payable solely from amounts received from the Corporation, the obligation of which will be sufficient to pay the principal of, interest and redemption premium, if any, on the Bonds when they become due.

At the hearing, all individuals who appear will be given an opportunity to express their views for or against the proposal to issue the Bonds to finance and refinance the project, and all written comments previously filed with the KDFA at its offices at 534 South Kansas Avenue, Suite 800, Topeka, Kansas 66603 will be considered. AN ORDINANCE AUTHORIZING A THIRD AMENDMENT OF BASE LEASE AGREEMENT AND LEASE AGREEMENT AND THIRD SUPPLEMENTAL BOND TRUST INDENTURE IN CONNECTION WITH THE CITY OF WESTWOOD, KANSAS OF NOT TO EXCEED $9,000,000 AGGREGATE PRINCIPAL AMOUNT OF TAXABLE INDUSTRIAL REVENUE BONDS (WOODSIDE VILLAGE NORTH PROJECT), SERIES 2014.

WHEREAS, the City of Westwood, Kansas (the “Issuer”) is a municipal corporation and political subdivision duly organized and validly as a city of the third class; and WHEREAS, the Issuer is authorized by K.S.A. 12-1740 to 12-1749d, inclusive, as amended (collectively, the “Act”), to issue revenue bonds, the proceeds of which shall be used for the purpose of paying all or part of the cost of purchasing, acquiring, constructing, reconstructing, improving, equipping, furnishing, repairing, enlarging or remodeling facilities for agricultural, commercial, hospital, industrial, natural resources, recreational development and manufacturing purposes; and WHEREAS, pursuant to the Act, the Issuer issued its Taxable Industrial Revenue Bonds (Woodside Village North Project), Series 2014 (the “Bonds”), in an aggregate principal amount not to exceed $9,000,000, for the purpose of (a) constructing, renovating, furnishing and equipping a commercial facility project for Woodside Redevelopment, LLC and Woodside Village North, LLC, each a Kansas limited liability company (the “Company”), and (b) paying certain costs of issuance, all as further described in the hereinafter referred to Bond Indenture and Lease Agreement; and WHEREAS, the Bonds were issued under a Bond Trust Indenture dated as of the date set forth therein, as amended (collectively, the “Bond Indenture”), by and between the Issuer and UMB Bank, N.A., as Bond Trustee (the “Bond Trustee”); and WHEREAS, the Company leased the Project to the Issuer pursuant to the Base Lease Agreement of even date with the Bond Indenture, as amended (collectively, the “Base Lease”) between the Company and the Issuer; and WHEREAS, simultaneously with the execution and delivery of the Bond Indenture, the Issuer entered into a Lease Agreement dated as of the date set forth therein, as amended (collectively, the “Lease Agreement”); and WHEREAS, the Issuer further finds and determines that it is necessary and desirable in connection with the issuance of the Bonds that the Issuer execute and deliver certain documents and that the Issuer take certain other actions as herein provided; WHEREAS, the Company, the City, the Bond Trustee and the Bondowner desire to extend the maturity of the Bonds to February 1, 2019 and extend the term of the Base Lease and the Lease Agreement to February 1, 2019. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF WESTWOOD, KANSAS, AS FOLLOWS:

Section 1. Authorization of the Third Amendment. The Third Amendment of Base Lease Agreement and Lease Agreement and Third Supplemental Bond Trust Indenture among the Company, the Issuer, the Bond Trustee and the sole Bondowner is hereby approved in substantially the form presented to and reviewed by the Issuer and the Issuer is hereby authorized to execute and deliver each of such documents (the “Issuer Documents”) with such changes therein (including the dated date thereof) as shall be approved by the officials of the Issuer executing such document, such officials’ signatures thereon being conclusive evidence of their approval and the Issuer’s approval thereof: Section 2. Further Authority. The Issuer shall, and the officials, agents and employees of the Issuer are hereby authorized and directed to, take such further action, and execute such other documents, certificates and instruments as may be necessary or desirable to carry out and comply with the intent of this Ordinance, and to carry out, comply with and perform the duties of the Issuer with respect to the Bonds and the Issuer Documents. Section 3. Effective Date. Non-resident corporations that are not already registered with the Kansas Secretary of State and all non-resident individuals and partnerships are required by law to register with the Director of Revenue, State Office Building, Topeka, Kansas, and to pay a fee of Ten Dollars ($10.00) for each and every contract as a precedent to commencing work on the contract. For contracts in excess of Ten Thousand Dollars ($10,000), the foreign contractor shall file with the Director of Revenue an acceptable bond for ten percent (10%) of the contract.
