WCIN'S CLASSIC OLDIES TO FLY HIGH. . . John Thomas' J4 Broadcasting is offering up a unique format via satellite. It's syndicating WCIN, Cincinnati's urban oldies format. "The Classic Oldies Network" features top -10 R &B hits from the 50's through the 70's, flavored with jazz and blues from the same era. Thomas is

DOUG BANKS HITS THE BIG TIME. . . WGCI -FM, Chicago's afternoon driver Doug Banks will go national next January as ABC Radio Networks will syndicate his urban show that airs 3 pm to 7 pm ET. This is the first shot by any network at syndicating a standalone music -based show outside of morning drive. Banks has served as guest host for WGCI's Tom Joyner, whose morning show is also syndicated by ABC. WGCI's former music director, Vic Clemons, joins ABC to handle Network Operations for Joyner's show.

WASHINGTON THIS WEEK

The FCC's five commissioners have recommended to Congress a package of 37

deregulatory and streamlining proposals for consideration in the upcoming FCC reauthorization process. As they apply to radio, the proposals would eliminate the duplicative filings currently required for both a construction permit and an

operating license before a broadcast station can go on the air. It would also legalize the broadcast of lottery advertising, subject only to state - imposed restrictions. Finally, it would provide that a license authorization for a

station silent for une yee- automatically cancels.

Three broadcasters have joined the NAB Radio Board as new members. They are Sheridan Broadcasting Corp.'s Chairman Ronald Davenport, ABC Radio Networks Exec.

VP David Kantor, and Westwood One's President Jeff Lawenda. They will join the Board at its next meeting to be held in late June in Washington, DC.

ELSEWHERE

After extradition from the Dominican Republic, beleaguered talk show host Sonny Bloch was in Federal Court in Newark, NJ to face 35 counts of fraud. Bloch pleaded not guilty to all charges. Two of the four other men arrested in the case pleaded guilty to felony conspiracy charges. Philip Forma of Staten Island, NY

faces five years in prison and a $250,000 fine for one count of wire fraud while Alan Herr of Brooklyn, NY faces 15 years and $500,000 in fines for two counts of wire fraud. Both are cooperating with federal prosecutors.

Chicago talent agent Saul Foos, who was convicted of bilking clients out of

thousands of dollars, was sentenced to 5 1/2 years in prison, five years probation, 300 hours of community service, and $500,000 in restitution to his

victims. Inside Radio reports he'll start serving his sentence August 7 in a

Florida medium- security prison. Foos still faces action from the S.E.C. and he's been disbarred as an attorney.

According to the Hollywood Reporter, Doug Tracht, otherwise known as "The

Greaseman," may take to the television soon as he is reportedly in talks with Fox to join a show crafted similarly to NBC's Saturday Night Live. The Greaseman is

syndicated by Infinity Broadcasting.

The Winter 1995 book for Phoenix will be reissued as six diaries have been deleted from the sample after it was discovered that two diaries were filled out by people outside their intended household. Four other diaries had improper or excessive time edits. The diary problems were enough that Arbitron held up the release of

Phase 1 of the Spring Arbitrends.

Spokane gets a new duopoly as Elizabeth Burns' Queen B Radio, licensee of news - talk KXLY (AM) and adult contemporary KXLY -FM, will buy sports outlet KTRW and CHR KZZU for $1.75 million. The two stations have been under the care of Louis DeArias, the receiver for Highsmith Broadcasting, which is the old Olympia group. Queen B also owns Spokane Television, licensee of KXLY -TV, so a waiver will be required for this sale to be approved.

In El Paso, New Wave Broadcasting has purchased Pinnacle Broadcasting's classic rock KAMZ for $2 million. New Wave owns talk /sports KROD and album rock KLAQ. New Wave will also buy its AC simulcast partner WQNJ, Ocean Acres, which will combo with New Wave's WJLK, Asbury Park, to give them a duop in the Monmouth -Ocean market. Terms of the WQNJ deal weren't disclosed. No word yet on what is to

become of KAMZ's sister, Spanish KAMA, El Paso.

The Radio Advertising Bureau had more great news for April- -radio ad revenue was up 10 %, continuing its double -digit growth in 1995. National spot was up 14% in

April, while local was up 9 %. Year -to -date revenues through April are up 13% over the first four months of 1994. The Midwest enjoyed the biggest gains for local

revenue with an 11% jump, while the East topped the national revenue chart with a

20% gain.

Larry King returns to radio with a six -pack of 90 minute specials scheduled

through mid -1996. Syndicator Westwood One promises interviews with this

century's most stunning superstars and most reknown world leaders." The Larry

King Super Specials will be listener interactive via the Internet as well. For

SESAC has shuffled its senior management with a series of new appointments.

William Velez has been named Managing Director /COO. Velez takes over for Vincent

Candilora, who has been upped to Vice Chairman /director. Pat Collins moves into

the Sr. VP /Licensing slot. Charlotte Scott steps in as Sr. VP /Operations. All

four will be based in Nashville.

NBA Radio is handling the coverage of all games of the 1995 NBA finals, as well as

The ABC Radio Networks will be syndicating an hour -long Fourth of July special

produced by Paul Harvey, Jr., Incident at Lexington Green, an original historical

drama that commemorates the American Revolution. The show celebrates the events

surrounding the "shot heard round the world" with interesting facts and that

CBS Radio President Nancy Widmann has been selected to receive the NAB National

Radio Award. The award, which will be presented at the luncheon on Friday, Sept.

8 at the NAB Radio Show in New Orleans, will be given to Widmann "because of her

outstanding record of industry leadership."

Arbitron has appointed Thomas C.N. Evans to the post of VP /Research Communications

and Market Development. Evans will serve as Arbitron's primary liaison to the New

York -based research community. Evans had been Westwood One's VP /Research.

NAB is making an effort to include small market broadcasters at this year's Radio

Show in New Orleans. Specific sessions at this year's show include promotions, new sources of revenue, cost savings, station financing, license renewals, and

SW Networks and a company called Thinking Pictures are teaming up to enable SW

listeners who have access to the Internet to interact with rock and roll venues

around the world accessing real time audio and video. Access will be through a

new World Wide Web sit called ROCK.COM. The site will be linked to SW's Internet

HOW MUCH IS ENOUGH. Not everyone is looking for unlimited ownership out of

the new telecom bill. Greater Media, Beasley, Jersey Shore Broadcasting, Entercom, Empire Broadcasting, Precision Media, Amcom General, Bengal Communications, and Press Broadcasting have teamed up to voice their collective concerns over total deregulation of the broadcast industry. Benchmark Communications' Bruce Spector has fired off a letter to NAB President Eddie Fritts voicing similar concerns. The companies represent the radio portion in the "Coalition for Broadcast Diversity," a lobbying group attempting to persuade Congress that elimination of ownership caps is dangerous because smaller owners won't be able to compete with larger group owners that own the majority of

stations in a market. However, the group stresses it's not against "reasonable increases" in the ownership limits.

$1,666.66 PER SECOND. . . New York -based Cliff Freeman & Partners took home $100,000 for the best radio spot in the Radio Advertising Bureau's Mercury Awards. The Commission has ruled that Tsunami Communications, which intends to buy KTCL and KIIX, Denver, can do so, even over the objections of Noble Broadcasting. Noble objected to the purchase after discovering that Tsunami's owner, Tony Galluzzo, is Chief Operating Officer of Critical Mass Media, which is 95% owned by Jacor's Randy Michaels. Galluzzo is also a former Jacor employee. Noble was also concerned that the transaction is being financed by a Jacor subsidiary and Jacor would also have a joint sales agreement on 30% of the combo's ad time. All told,

Noble claims Jacor would have de facto control over the combo, and therefore wanted it to be attributable to Jacor -- pushing them over the maximum number of

stations one can own in a market. In denying Noble's objections, the Commission acknowledged that Jacor is voluntarily limiting itself to 30% of ad sales. It

also stated that "former employment and joint sales agreements do not amount to a

finding of de facto control under existing precedent." Further, "it is not

necessary to decide the attribution question" because Jacor and Tsunami agree to

be bound by future policy decisions.




WASHINGTON THIS WEEK (cont'd)

According to NAB's Radioweek, the Commission has finally approved a retailer promotion that has historically pushed the limits of the FCC's lottery advertising rules. The promotion usually involves a retailer which will refund all or part of a purchase if a specific event happens within a certain time frame. (i.e. a

certain amount of rain or snowfall on a specific day.) The Chief of the

Complaints and Investigations Branch rules the promotion as a "premium" because if

the event occurs, everyone wins or loses, whereas in a lottery, some people win while others lose. Therefore the element of chance is not a factor in selecting the winner or determining the amount of the prize. However, the NAB warns broadcasters to check with the state's lottery laws to avoid problems with local statutes.

In the wake of the Supreme Court's decision that dealt a blow to EEO programs, the FCC is looking at its EEO policies. According to Inside Radio, the Commission has put its filing deadlines on hold for wireless auctions so it has time to analyze the impact of the ruling.

As this issue goes to press, the telecom reform bill passed the Senate with the removal of a ceiling on the number of stations a company can own. The bill was been batted back and forth all week. Majority Leader Bob Dole's ownership deregulation eliminates the ownership caps to a point - -the Commission would have the right to review concentration issues on a case -by -case basis. Still to come: a visit to the House, and if passed there, then on to the White House.

Broadcast station employment continued its downward trend in 1994 according to the just -released Broadcast and Cable Employment Report. Employment for broadcast stations having five or more full -time employees was up slightly over 1993. Of

all full -time broadcast employees, female representation increased from 39.6% to 39.9% and minority representation was up .2% to 18.4 %.

In proceedings before the Commission, it took the following actions:

- -Denied Richard L. Plessinger's petition for reconsideration of the denial of his request to substitute non -adjacent channel 293 Cl (106.5 MHz) for channel 265 A (100.9 MHz) for WOYS, Apalachicola, FL. Plessinger has an app. for a C3 on 100.5 MHz, as well.

- -Dismissed as moot Value Radio Corporation's petition for reconsideration of an R &O which substituted 106.3 C2 for 102.3 A at Stephenson, MI. The channel in

question is for Pacer Radio's construction permit for WFON.

- -Dismissed Patricia Mason's petition for reconsideration of an R &O which substituted 106.1 A from 107.3 A for WHST, Tawas City, MI.

- -Denied the petition for reconsideration filed by the Center for Study and Application of Black Economic Development concerning the renewal of license for KUCB -FM, Des Moines, IA.

- -Denied Grapevine Radio, Inc.'s application for review of a December, 1992 Mass Media Bureau decision granting the assignment of KGEO and KGFM -FM, Bakersfield to Lagniappe Broadcasting, Inc. and dismissing Grapevine's petition to deny.

In a curious stance by the Commission, it seems that the terms for certain types of radio LMA's may not be legal for television stations under the same circumstances. The Mass Media Bureau's new policy bars time brokerage LMA's where the LMA'ing company holds an option to purchase the station during the LMA and will also finance the acquisition itself. The policy will remain in effect until the Commission finishes its review of ownership attribution policies. In the case of these television LMA's, the Commission is concerned that "otherwise permissible cooperative arrangements . . . are being used in combination by those broadcasters to obtain, indirectly, controlling interests in multiple stations that they would be prohibited from holding directly under the multiple ownership rules." Yet, the MMB has turned the other cheek on similar radio LMA's. The MMB will require full

documentation and all related agreements involving an LMA -to- purchase for all television transactions.





The NAB and the RTNDA have told the Ninth Circuit Court of Appeals that it should reject attempts by a public interest group to relitigate fairness doctrine issues that the NAB claims have been fully considered by the FCC and the courts. In a

case involving the FCC's inaction on a petition asking that the fairness doctrine be reinstated in connection with a 1994 California ballot initiative, NAB and RTNDA urged the court to reject the Coalition for a Healthy California's claims that the fairness doctrine is required by statute. The NAB and RTNDA noted that the petitioners' complaint is moot because the election is over and that no complaints against any California stations have been lodged.

The FCC's address list for radio stations and translators in Florida, Puerto Rico, and the Virgin Islands, and translator licensees in Oregon is out. The Commission will be mailing renewal packets in mid -July. If your station's address is

different from the one listed in Public Notice 54203 dated June 5, 1995, send FCC Form 5072 "Change in Official Mailing Address for Broadcast Station" to the FCC,

Washington, DC 20554, Attention Janice Smith - Room 302. Corrections should be submitted no later than July 5.

The NAB's legal department has produced a booklet entitled "Checklist for On -Air Radio Personnel" which outlines specific FCC rules and policies and other laws that affect radio broadcasting. The checklist is designed to help stations avoid FCC fines and other legal jeopardy. For more info, call (202) 429 -5300.

New York -based Cliff Freeman & Partners took home $100,000 for the best radio spot in the Radio Advertising Bureau's Mercury Awards. The "Teacher" spot for Staples beat out hundreds of entries for the top prize. $20,000 was awarded in each of four categories: Tops in the humor division went to Paul & Walt Worldwide for

"The Simpsons- Robert Goulet." Best narrative spot was Houston Effler Herstek Favat for the "Truth -Sackman," produced for the Massachusetts Dept. of Public Health. Winner for Music /Sound Design was Pomposello for Nickolodeon's "Back to the Roots." The best station -produced spot was done by Barnstable Broadcasting's WGKX, Memphis for "Galaxy Muffler." A $5,000 second prize went to Infinity's WBCN, Boston for Nantucket Nectar's "Juice Guys." Over $200,000 was awarded during the black tie dinner hosted by Dick Clark at the Waldorf- Astoria in New York City.

The Branson Country Music Network is back to basics -- feeding country music to

20+ affiliates. Its somewhat short -lived syndicated classic hits format, "American Hit Radio," is being phased out. Despite the effort, it frankly never caught on, and the handful of affils are virtually all airing the country format now. The country network serves primarily the Ozarks and the Southeast, but it's also heard in Pennsylvania, the Mountain West, and in the Lone Star State.

The Texas Supreme Court has ruled that an accident involving two police officers and a drunken driver is not the fault of a Beaumont radio station. KZZB -FM, Beaumont, (now under new ownership as KYKR) was sued along with a local nightclub after sponsoring a ladies night promotion. Two police officers directing traffic around an accident involving a driver who was drinking at the club were struck by another driver who was also at the club. The officers sued the station, saying it

contributed to the accident. The court struck down a lower court ruling which found the station liable. The Supreme Court said the radio station was not liable because the promotions weren't done with the intent of causing unlawful behavior.

Sensitive to the Oklahoma City bombing, Arbitron has assured its subscribers that the Oklahoma City Spring 1995 Arbitron Radio Market Report was "clearly up to

standard" with respect to overall diary return, intab diary distribution, and station crediting. The firm reported good distribution across the four weeks of

the survey. The bombing occurred on the last day of Week 3, so Arbitron manually reviewed the diaries of the last two weeks and found little evidence of listener confusion. Slightly fewer diaries were returned after the blast but were considered well within the range of normal variation. The Premiere Radio Networks have signed a representation agreement with Sports Byline, USA, the largest sports talk web in the country, which reaches 317 US affils plus additional Armed Forces Radio Network outlets. The pact will provide immediate access to more than 3,000 affiliates nationwide. SBL was founded in

In a follow up to last week's story, rumors have been flying recently that Doug Tracht (aka The Greaseman) was in talks with the Fox Television Necwork about a

new show similar to Saturday Night Live. According to Variety, Fox Entertainment President John Matolan bluntly denied the rumors stating, "I have never spoken to Tracht and, until this moment, I had never heard of him."

In Tampa, Jacor picks up a duopoly by purchasing Sunshine State Broadcasting's easy listening station WDUV, Bradenton and talker WBRD, Palmetto for an undisclosed amount. WDUV has an app to upgrade to a full C and move to 103.5 MHz, which will better their coverage in Tampa. Jacor owns news -talker WFLA and CHR WFLZ there.

New Wave Broadcasting will have a new FM in El Paso by picking up Pinnacle's classic rocker KAMZ (a Stern affiliate) for $2 million. New Wave owns talk and sports KROD (an Imus affiliate), and album rocker KLAQ. Tichenor Media is buying KAMZ's sister station regional Mexican KAMA for $490,000. The sale will give Tichenor a new duopoly with its Spanish hits KBNA -AM & FM.

Arthur Liu's Multi Cultural Broadcasting is doubling up in L.A. with the purchase of contemporary Christian KYMS, Santa Ana for $9.1 million. In line with other Multi Cultural stations, KYMS switched to foreign language brokered programming (Asian) last week. Liu owns Spanish KALI, San Gabriel in the L.A. market, as well.

Criterion Media Group is doubling up in the Santa Barbara market with the purchase of adult contemporary KSBL, Carpinteria from Great Electric Communications for an undisclosed amount. Criterion owns talker KQSB and album rock KTYD.

The Interep Radio Store has released what it considers "...one of the most comprehensive studies on qualitative audience characteristics for radio's major formats..." The "1995 Study of Radio Formats" focuses on the lifestyle composition of 19 different format categories. Breakouts include age, education, occupation, household income, and home ownership. National and regional rankings are included.

Among the highlights: country cumes highest - at 15.9 - among all formats in the U.S., followed by news /talk (9.6) and AC (9.3) Leading formats targeting young adult demos (18 -54) are AOR, CHR, classic rock, new age, Spanish, and urban contemp. In the 25 to 54 demo, the leading music formats are golden oldies, black /rhythm & blues, AC, jazz, soft AC (tied), and country. The same demographic group's non -musical preferences were religious programming, followed by all -news and news -talk, which tied. New York -based SW Networks announced it will syndicate a weekly two hour show featuring famed attorney Alan Dershowitz. The show is slated to air Sunday evenings from 7 tc 9 pm ET beginning Sunday, June 25. SW claims 20 affiliates for its inaugural broadcast, including WABC, New York. As previously announced, SW's syndication effort for former New York governor Mario Cuomo will kick off Saturday, June 24. The show will air Saturdays from 9 am to noon ET. However, there seems to be some confusion over whether or not Cuomo will be on WABC, too. An article in New York Newday reports that WABC is still considering whether or not to air the show, even though GM Don Bouloukos has said in press releases that the station will be Cuomo's "New York home."





Greenwood Performance Systems Executive Vice President of Broadcasting Stan Forrer

passed away this week. A native of Kansas, Stan helped develop and implement a

variety of sales training programs in the broadcast industry. He was 42 years

old.

National Public Radio's "Performance Today" has launched a "Young Artists in

Residence" series, showcasing the talents of young classical music artists on

nationwide radio. During students' residencies, each will be heard with host

Martin Goldsmith for commentary, conversation, and live performances. For more

Throughout July, NPR reporters will explore the spirit and practice of U.S.

Democracy in a special series, "Democracy in America." The reports will air

during Morning Edition, All Things Considered, and Weekend Edition beginning

Greater Media's Operations Manager Julian Breen at WPEN and WMGK, Philadelphia is

ending his 20 year stint with the company to start his own consulting firm. His

new firm will focus on audience analysis and research.

Former Fairmont Broadcasting President Mark Hubbard is launching Flagship

Broadcasting, which has $250 million from ABRY Partners, to purchase radio

stations. Inside Radio reports the new venture is concentrating on markets 20 -100

and will be based in Cincinnati.

ACT OF GOD? Another new station has hit the airwaves, but it may requires some heavenly intervention to remain there. Essentially carrying the "Love Radio" Christian format from WWNH in Madbury, NH, WRUT(FM) in West Rutland, VT has a checkered history. The CP for 107.5 expired in 1989, and the station has been in

a regulatory morass ever since. Operator WRUT, Inc. has filed a petition for reconsideration for license application. The FCC's position is that the petition is still pending and that there is no explicit authorization to operate. The company has a similar situation at WTIJ in the Brattleboro /Keene market, but that station is not yet on the air. To make the situation even more confusing, WZRT in

Rutland, at 97.1, was itself once known as WRUT, and they've begun to receive mail intended for the newest incarnation.

RAGAN HENRY HITS THREE FM'S IN ATLANTIC CITY. In the Atlantic City market, Ragan Henry is doubling up by purchasing hot AC WAYV, Atlantic City from Atlantic City Broadcasting for $2.7 million. Henry already owns adult standards WCMC and rocker WZXL, Wildwood, NJ. Since Henry is in an LMA with AC WFNN, Villas, NJ, there's no word on whether he'll convert that arrangement to a sales agreement or end the relationship.

Now that the Senate has passed the telecom bill, which virtually eliminates limits on radio ownership, the Coalition for Broadcast Diversity, which is steadily picking up support, will focus its efforts on the House version of the bill. The CBD, which has grown to a representation of 18 different media companies, agrees that raising limits is a good thing, but eliminating the ceiling could be disastrous for everyone but radio's largest group owners. In a press release, the CBD proposes:

- -setting national radio ownership limits to 50 AM's and 50 FM's.

- -retaining the current limitations on local ownership.

- -FCC to examine "the effects of local ownership restrictions...to ensure that the radio industry is not...hampered in its ability to compete with emerging technologies, while at the same time safeguarding a robust level of programming competition in local markets."

The CBD also points out, "It is ironic that this has become a political issue when members of both parties acknowledge the importance of a diverse and responsible media every time they address media issues."

The bill also allows for a ten year license renewal period. NAB President Eddie Fritts applauded the vote stating, "We are delighted that radio ownership deregulation was included in the bill. This provision will be instrumental in helping the radio industry remain an important and competitive player in tomorrow's communications marketplace." The House is expected to begin debate in July on its version.

The Commission released a fairly thick Notice of Proposed Rulemaking on Satellite DAB this week, asking for public comment on everything from how providers should be compensated to the impact the service will have on land -based broadcasters. Comments are due September 15. Replies are due October 13.

Just when you thought your budget was set for FY '95, think again. The Commission has adopted a new fee schedule after Congress told the agency to find another $116,400,000 to cover costs --93% more than it was asked to cover in FY '94. So, beginning September 18, the FCC will take about 25% more for fees than it had planned from each of your radio stations.





The Commission is taking steps to eliminate the existing backlog of assignment and transfer (A &T) applications and reduce the amount of time it takes to act on any A &T applications. The effort targets the disposal by the end of this week of all

"non- routine" A &T applications (those that are contested or require a waiver) that have been pending for over 180 days, except for cases that are blocked because of

circumstances beyond the Bureau's control. By the end of July, it wants to get rid of all petitions for reconsideration of staff actions regarding sales applications pending for over 180 days.

In order to eliminate a backlog in the future, the Commission has resolved to act

on all non -routine applications or petitions for reconsideration in no more than 120 days and resolve them within 180 days. "Frivolous" petitions to deny will be

acted on within 30 days of the close of the pleading cycle, while frivolous informal objections will be acted on within 30 days of the close of the period established by the public notice announcing acceptance of the application.

The Commission has reassigned several attorneys from its Audio Services Division in order to accomplish its goals. It also plans to more carefully screen all

incoming pleadings to make sure they comply with procedural rules and to assess the seriousness of the allegations. Petitions to deny, petitions for

reconsideration, and applications for review that fail to comply with procedural requirements will be summarily dismissed.

The Commission has denied the application of Spitzer Communications Co. for review of an earlier order which affirmed the Mass Media Bureau's downgrade of KIQK's frequency of 104.3 C to 104.1 Cl at Rapid City, SD, and modification of the construction permit of Tom -Tom Communications to specify operation on 104.1 MHz.

In other actions, the Commission:

- -denied ECI License Company, L.P.'s petition for reconsideration of a Report & Order which substituted 103.5 C for 103.3 Cl at Bradenton, FL, and modified the

license of WDUV.

- -granted Key Chain's petition for reconsideration and denied the petition for

reconsideration filed by Jupiter Broadcasting (Joint Petitioners) in the matter of amending the FM table by reshuffling three Florida Keys stations.

- -denied C.R. Crisler's petition for reconsideration of a decision to permit the upgrade of KRRQ, Lafayette, LA, by substituting 95.5 C2 for 95.5 A.

Bible Broadcasting Network's license for WHPE -FM, High Point, NC in the

Greensboro -Winston /Salem market has been redesignated to non -commercial. The

station is on 95.5 MHz.

The FCC is closing its Baltimore field office in order to cut costs. The office's work load will be absorbed by the Laurel, MD office.

Julius Genachowski has been named Counsel to FCC Chairman Reed Hundt effective June 26. Genachowski will focus on Mass Media and International issues and will also advise the Chairman on constitutional law and other legal matters. Genachowski has been working at the FCC since 1994 as Special Counsel to the

General Counsel.

House and Senate versions of a new performance rights bills are making their way through subcommittees this week. The bills require digital subscription audio services, such as those offered on cable or satellite, to pay performers and writers for the music played on these services. The House Judiciary Committee Courts and Intellectual Property Subcommittee's version of the bill exempts broadcasters from the new fee. NAB President Eddie Fritz applauded the move and,

at the same time, dismissed claims that American broadcast performance rights are

needed so that record companies can collect performance rights in other countries. A Senate vote on its version will happen soon.




ELSEWHERE

There's a new radio group based in Coral Springs, FL, former home of Birch Ratings. Southeastern Broadcasting is a joint venture of Birch founder Tom Birch, his partner Ray Quinn, and the LBJ Holding Company, whose principal shareholder is

Luci Baines Johnson, the daughter of the late President Lyndon Johnson. The new group's first acquisition results in a duopoly in the Savannah market by buying black gospel WSOK and hot AC WAEV from Birch and Quinn's Opus Media Group for

$2.35 million and buying urban AC LMA partner WLVH, Hardeeville (Savannah) for $2

million from Savannah Radio Partners. Savannah Radio Partners is partially owned by Birch and Quinn. In the Jackson, MS market, Opus Media Group also owns urban oldies WKXI, black gospel WOAD, urban WJMI, and urban AC WKXI -FM, Magee, MS. Opus also owns country KMYY, Monroe, LA. Birch and Quinn also have an interest in

Emerald Coast Broadcasting, the licensee of adult contemporary WWAV, Santa Rosa Beach, FL (Ft. Walton Beach).

Novelist Stephen King's Zone Broadcasting is doubling up in Bangor by purchasing news -talk WNSW and album rocker WKIT -FM, Brewer, ME, from H & L Communications for

an undisclosed sum. King also owns sports -outlet WZON, Bangor, which he sold in

1990, but got back after a bankruptcy proceeding in 1993.

Crawford Broadcasting is adding to its collection by picking up John Kelley's 50,000 watt WPTR, Albany, NY. Terms weren't disclosed. Crawford will probably flip the mostly -satellite talker to religion.

The emerging LifeTalk Radio Network has begun satellite feeds of "upbeat" gospel music and interactive telephone talk from flagship station KSOH in Yakima, WA.

While music currently comprises the majority of the programming, the web is

progressing toward 60% talk. LifeTalk certainly has a religious orientation, but

its telephone talk programs will target a broader family audience. The network itself is non -commercial - it's funded by listener support - but it permits commercially -licensed affils to sell time in the conventional manner. One of the early affiliates is KSVA, which is a brand new signal in the Albuquerque area.

The company that handles marketing for one of the newest NFL franchises, the

Carolina Panthers, is suing Pacific Broadcasting's rocker WXRC, Newton, NC

(Charlotte) for the use of the name. The station is using the "Panther" name as

its slogan, but Jefferson -Pilot's WBT, Charlotte, has the rights to the games, and according to the suit, the right to promote the affiliation. In a story in the Charlotte Observer, Richardson Sports L.P. and National Football League Properties, Inc. are suing the station to destroy its promotional materials and stop using the name. The station airs disclaimers twice an hour that the two

entities are not related.

According to Inside Radio, SFX Broadcasting's WYHY, Lebanon, TN (Nashville), got

hit with a page 5B note, a cover note, and a tape flag for running a promotion April 5th that mentioned its "'ratings- challenged' poster boys," but didn't mention Arbitron. IR reports WYHY GM John King called the flag "outrageous" and "petty."

Time, Inc.'s Entertainment Weekly magazine will provide entertainment news coverage for the ABC Radio Networks. The publication will also provide commentary and special reports on breaking entertainment- oriented news. In addition, much of the joint coverage will be provided on America Online as well as video segments for ABC NewsOne, ABC's television affiliate news service.

ABC Radio Networks was honored with five awards at the New York Festival's 1995

International Radio Awards. ABC's one hour news magazine, Perspective, won the

Gold World Medal in the "Best Radio News Magazine" category. Perspective was also

a finalist in "Best Sound" category. ABC's ESPN Radio Network won three awards for "Best Sports Coverage," "Best Radio Personality: Syndicated," and "Best Sports Commentary /Analysis." CBS News Radio picked up a Gold World Medal for its Haiti coverage in the "Best Ongoing News Story" category. The winners were selected from a field of over 1,200 radio entries from 33 countries.

CBS Radio Representatives' Director of Research Terry Drucker has sent a message

to agencies stressing that Cost Per Point (CPP) should not be the only criterion

used to buy radio. She's published a brochure entitled "Cost Per Point: Not the

Only Tool" which points out that CPP was developed for television buying, and that

because radio is format -driven and not homogeneous (as television is), buying in a

market based strictly on CPP may prevent the message from getting to the target

region's affiliate sales. Allen had been at Standard News most recently, as well

as Unistar and Drake- Chenault.

Bill Rose is the new Marketing Manager /Radio Station Sales at Arbitron. He was

promoted from Sr. AE /Radio Station Services. He'll be responsible for working on

improving computer services for radio stations and coordinating the redesign of

Arbitron's printed reports.

The Associated Press has promoted Carol Robinson to western division radio sales

manager. She will oversee sales and marketing in the Western half of the U.S.

She had been a regional radio executive handling the Mid -Atlantic states.

THIS BUD'S FOR WHO? THANKS TO ARBITRON, WE'LL KNOW. As a result of Arbitron's marketing partnership with Scarborough Research, 58 Arbitron Spring '95 market reports will include a qualitative section featuring listenership in specific socioeconomic and consumer profile categories. Arbitron Freident Pierre Bouvard said the move answers a call to help the industry get past cost per point. Details of the new section is on page 8.

WITH THE SOUND OF A TOILET FLUSHING. Sonny Bloch's Clearwater, FL -based Independent Broadcasters Network fell silent at 5:00 pm June 25. After Bloch's arrest on fraud charges, the Securities and Exchange Commission froze all of his assets, causing IBN's inability to pay for its satellite time. The network has consistently denied Bloch had any involvement with the web. The majority of IBN's affiliates were only using one or two shows per week and were easily able to fill with other networks or other programming. During the life of the Sonny Bloch show, M Street was never able to verify more than 20 to 25 affiliates for his investment program. Bloch's owned stations have remained on the air with the use of other networks.

All fees must be paid by Sept. 30, but procedures for paying the revised', fees have

not yet been released. Congress ordered the Commission to come up with another $116.4 million to cover FCC operating costs. The average fee was raised approx. 25 %. However, fees on receive -only satellite dishes have been eliminated. Small

market broadcasters have criticized the fees because they must pay the same rates

as stations in New York or L.A. The Commission said fee assessments based on

Arbitron market size aren't adequate, and went back to the class -based schedule it

used last year.

KRGN, Amarillo, TX, owned by Maranatha Radio, Inc., has changed its license status to non -commercial.

The NAB has new board chairmen as Philip A. Jones, president of Des Moines -based Meredith Broadcasting was elected chairman of the Joint Board. NewCity Communications' President /CEO Dick Ferguson will chair the Radio Board. Howard B.

Anderson, president and owner of KHWY, Inc., Los Angeles, has been elected vice chair for radio.

In a move to help the radio industry move beyond "cost per point," Arbitron announced it will add limited Scarborough qualitative information as a section of

the Spring '95 books for the 58 markets where Scarborough measures consumer,

retail, and media behavior. The "no- charge" addition of the information is the

most visible result of a joint marketing deal between the two companies. Because the new sections provide information on listener buying habits by station, it

should help agencies to understand that "body counts" don't necessarily dictate efficient buys.

The new section will allow subscribers to look at the socioeconomic profiles of

their listeners as well as retail and consumer profiles. The new section will be

at the back of each book in two sections. The first, called the "Consumer Profiles Report," will show profiles for Adults 18+ in these categories:

- -Soft drink consumption (drank any past. week) - -Fast food restaurants (3+ visits per month) - -Auto purchase (last new vehicle over $20K) - -Air travel (3 or more domestic trips past year) - -Furniture purchase (spent $250 or more past year)

Each of these categories' listenership will be broken down by age, gender, marital status, occupation, household size, presence of children, employment status, home

ownership, and household income. A separate table shows listening for the

categories by selected media use: radio listening, cable telvision service, and

newspaper readership.

The second section, called the "Radio Report" page, will show Adult 18+ total week cume persons, percent coverage, percent composition, and index for each station in

the report by these categories:

- -Household income - -Occupation -- Presence of children - -Regular soft drink consumption by brand -- Frequency of fast food restaurant visits in past month - -Auto ownership by type -- Frequency of domestic air travel -- Amount spent on furniture in past year

Future reports may include different retail, product, and service categories. Arbitron continues to have internal discussions regarding the redesign of other sections of the market report.

Apollo Partners takes a giant leap by selling its stations in Salt Lake City,

Charleston, SC, and Kansas City to Regent Communications for $50 million. Apollo President Bill Stakelin will join Regent as Exec. VP /COO. The stations involved in the sale are:

--talk KALL and oldies KODJ, both Salt Lake City; and country KKAT, Ogden. - -CHR KMXV, Kansas City, MO and gold -based AC KUDL, Kansas City, KS.

- -country WEZL, Charleston, SC and oldies WXLY, North Charleston, SC.

The sale puts Regent in Kansas City, Salt Lake City, Dayton, Louisville, Las

Vegas, and Charleston, SC, and puts the company among the top 35 radio groups ranked by revenue.

The Park Lane Group is doubling up in Flagstaff as it's agreed to purchase talker KVNA (AM) and alternative KVNA -FM from TVNA, L.P. The terms weren't disclosed. Park Lane already owns rocker KZGL, Cottonwood in the market. There was no

mention in the press release of TVNA's silent KCLS - -a 10 kw days /500 watt nights AM on 690 KHz. Park Lane plans to double up in other markets it's in soon, like

Redding, Lake Tahoe, and Lancaster -Palmdale, CA.

In the Louisville market, Excelsior Communcations is doubling up by purchasing WAJE, New Albany, IN, from New Albany Communications for an undisclosed sum. WAJE is a brand new station that will put a good signal into Louisville. Excelsior owns oldies WRKA, St. Matthews, KY in that market. The sale is expected to close this fall.

The battle for presence in radio news rooms heats up this week as ABC Radio and

Reuters have announced a five year joint venture to expand ABC's NewsWire service. According to a press release, ABC is looking to improve the "depth and quality" of

its wire service and it will target several thousand stations in need of a wire service. The deal will combine Reuters' state and regional coverage through its

States News Service, Reuters' local business and financial news, and ABC's national and international coverage into a complete, satellite -delivered service that allows stations to customize their feeds. Stations will now be provided with crisis coverage, bulletins and breaking news, hourly news summaries, sports summaries and running scores, business news reports, stock market updates, entertainment reports, morning show prep material, and local weather reports and

instant warnings.

Osborn Communications Corp. is refinancing to the tune of a $56 million revolving credit facility. The credit line, secured from Society National Bank, will allow the company to repay an outstanding loan and leave $10 million for acquisitions. The company anticipates the refinancing will save $1.5 million per year in

interest.

Oldies delivers Baby- Boomers better than any other radio format, according to

research at the Interep Radio Store, which has caused the company to launch yet another format network, "BOOM!" The BOOM! network targets Baby- Boomers, which are now squarely part of the lucrative 25 -54 year -old demo, and the oldies format has the highest concentration of these listeners in radio.

The Interep Radio Store says the gay consumer marketplace is one of the most "upscale, receptive, and untapped consumer groups in America -- and radio can

deliver them." According to a just -released report from the Interep research division, radio is a key vehicle to reach these estimated 12.5 million consumers because radio is the medium of choice to those households categorized as "DINK"

Todd Sloan will handle the VP /Finance -Controller spot. Sloan was Senior Manager at Ernst & Young. Anita Wallgren is now VP/Legal and Business Affairs. Wallgren was VP /Associate General Counsel of Citicasters.
