WHEREAS, by Deed of Trust dated July 26, 2013, and recorded on July 27, 2013, appearing of record in Record Book 978, page 1528 the Register’s Office of Gibson County, Tennessee, Jeffrey C. Scott and Jodie E. Scott conveyed to Investors Title Company, TRUSTEE, certain real estate therein described, to secure the payment of a certain indebtedness therein set forth to FirstBank; and

WHEREAS, default was made in the payment of the indebtedness secured by the Trust Deed, and FirstBank the lawful holder of the note evidencing the indebtedness declared the entire balance due and payable; and

WHEREAS, in proceedings in the United States Bankruptcy Court for the Western District of Tennessee, Western Division, in the case styled Jeffery Caldwell Scott and Jodie Elizabeth Scott, Bankruptcy No. 14-13346, Chapter 7, the Honorable Jimmy L. Croom, Bankruptcy Judge, has entered an order, by consent, abandoning property and modifying the automatic stay as to 2036 Chris Circle, Milan, TN 38358, entered on February 25, 2015, which permits the Successor Trustee to sell at foreclosure the property described in the Trust Deed.

WHEREAS, Charles C. Exum was appointed Successor Trustee by instrument appearing of record in Record Book 995, page 427 in the Register’s Office of Gibson County, Tennessee.

NOW, THEREFORE, notice is hereby given that on June 3, 2015, at 1 o’clock p.m., at the front door of the Court House in Trenton, Tennessee, I will sell to the last, highest and best bidder for cash or for credit bid against the secured debt, and convey absolute title free from right, title interest of Grantor, and in addition, equitable and statutory rights of redemption by Grantor after foreclosure sale are expressly waived to the extent not prohibited all of which is set forth in the deed of trust, the following real estate lying and being in the 13th Civil District of Gibson County, Tennessee, and more particularly described as follows: Being Lot No. 4 of the Crestview Subdivision of the City of Milan, Tennessee, a plat of which subdivision is recorded in Plat Book 1, page 144, in the Register’s Office of Gibson County, Tennessee, and better described as follows: Beginning at a point in the north margin of Chris Circle, said point located in the southeast corner of this lot and the southwest corner of Lot No. 3; runs thence with the west boundary of Lot No. 3, North 6 degrees 30 minutes West 120.5 feet to a stake; runs thence South 83 degrees 30 minutes West 194.5 feet to a stake in the east boundary of Lot No. 5; runs thence with the east boundary of Lot No. 5, South 51 degrees 45 minutes East 183.5 feet to a stake in the north margin of Chris Circle; runs thence with the margin of said Chris Circle 64.3 feet to the point of beginning.

Being the same property conveyed to Jeffery C. Scott and wife, Jodie E. Scott by Warranty Deed from Maurine H. Shoaf, dated July 26, 2013, recorded in Record Book 978, page 1525, in the Register’s Office of Gibson County, Tennessee.

The street address of the property is 2036 Chris Circle, Milan, TN 38358.

Said property will be sold by me as Successor Trustee only and subject to any unpaid taxes and assessments and all valid restrictions, covenants or easements, if any, of record on said property, and subject to any and all other liens having priority over the Trust Deed. The Successor Trustee reserves the right to make oral announcements at the time of the public sale which shall apply to the terms of the sale. The Successor Trustee may postpone any sale hereunder to another time or place by so announcing to all present at the time and place of the sale scheduled herein, without the necessity of any further notice whatsoever.
