A hearing of the House of the Representatives’ Committee on Homeland Securi ty chaired by Peter King (R-NY) titled “Radicalization in the US Muslim Community” took place on March 10, 2011, and was every bit as contentious as media coverage suggested it would be.

King, who infamously said the US has “too many mosques”, announced his plans to hold the hearing

several months ago, and since then Muslim and civil rights groups – chief among them the Council on American Islamic Relations

(CAIR) – went on a full court press to expose the hearing’s ill-founded premise.

Chandia Sentenced to 15 Years for Third Time, Will Appeal AgainBy Muslim Link Staff

After Judge Claude Hilton entered his court room, and after the spectators – including several dozen members of the Muslim community – arose and sat according to protocol, a curious thing happened.

Two freshman lawyers, recent law school graduates, were admitted to the bar. They read an oath in front of Judge Hilton, each swearing to “uphold the law and constitution of the United States, so help me God.”

For the supporters of Ali Asad Chandia who filled the room at the Alexandria Federal Court House for his second re-sentencing on March 11, 2011, the irony was literally in their faces.

Chandia, a Maryland area youth convicted in 2006 of providing “material support” to a group fighting the Indian occupation of Kashmir, says his 15-year sentence is not justified by law. His supporters agree, and so did the US Court of Appeals in both

2008 and 2010. The sentence was inflated by a federal sentencing tool known as a “terrorism enhancement” which allows crimes that can be classified as “terrorism” to receive far longer sentences than the same crimes that are not classified as “terrorism”.

In order to apply the “terrorism enhancement” to Chandia’s sentence,

trial judge Claude Hilton – who presided over the case and sentenced Chandia – is required to prove Chandia’s actions were “calculated to influence or affect the conduct of government by intimidation or coercion, or to retaliate against government conduct.” Judge Hilton provided no such proof of Chandia’s intentions on April 25, 2008, but instead read from a prepared document listing evidence and exhibits presented at trial, effectively ignoring the order from the Court of Appeals. He went through the same formality on March 11, 2011, stumbling through a prepared document as if he were reading it for the first time – mispronouncing words and names – as his “justification” that Chandia’s intentions were to “influence or affect” the actions of the Indian government.

After barely 15 minutes of reading, Judge Hilton asked Ali Asad Chandia if he had a statement to make before Judge Hilton imposed a sentence. Chandia surprised Judge Hilton and many in the courtroom by declining to make a statement. He then stumbled through imposing the same

15-year sentence on Chandia, adding time to one count on which Chandia was acquitted. Prosecutor John Gibbs hastily corrected Judge Hilton, and the Judge responded, “oh yeah”.

The entire re-sentencing hearing lasted about 15-minutes.

Led out of the courtroom by marshals, Chandia turned around and flashed a big smile to his supporters, who, like the new attorneys, invoked the help of Allah.

The Chandia defense intends to complain to the Court of Appeals for the third time, hoping the higher court will transfer the sentencing to a new judge. Chandia now returns to the special Communication Management Unit (CMU) in Indiana, one of two specially monitored federal prisons in the nation designed for Muslims convicted of crimes labeled “terrorism”.

George Mason Student Arrested Over Study CarrelBy Daniel de ViseWashington Post

Abdirashid Dahir, a George Mason University senior, says he was arrested by campus police on an abduction charge after a bizarre exchange with a fellow student over a study room at a campus library.

University officials said they are moving swiftly to investigate the incident.

It started last Tuesday, when Dahir settled on a study room at GMU’s Fenwick library after a long search; apparently such spaces are in high demand. Dahir realized he’d forgotten his laptop charger and went off to collect it. He returned seven minutes

later to find another student in his carrel.

Here is what happened next, according to an account assembled by Dahir and fellow s t u d e n t S a r a h Evans and posted to Facebook:

Dahir asked the female student why she’d taken his spot. She replied that she’d taken it because it was empty. He asked her to leave; she refused. When he, too, refused to leave, she called campus police.

While they awaited police, she told him of “her dislike of ‘foreigners,’ referring

to Abdi’s accent, saying how her father was a federal police officer, and that she intended on getting him in a lot of trouble,” according to the account.

Dahir propped open the door. The female student then called police again, falsely claiming he had locked her in the carrel. Apparently Dahir’s voice can be heard clearly on the dispatch recording of this call, repeatedly saying, “You’re lying.”

Officers arrived. The woman gave her account to them, out of Dahir’s earshot. Dahir then began to give his side of the story, whereupon the female student began to cry. At this, officers cut him off and resumed questioning the woman.

“You’ve got to be kidding me,” Dahir said. “I have a lot of work to do. I don’t understand why this has happened or why she’s crying.”

The officers moved him away from her. After a few minutes, the officers told Dahir to leave the library. He protested: Why was he, and not she, getting kicked out? Officers merely repeated, “You need to leave.”

Dahir went to the campus police station to file a complaint. He told his story to the chief of operations. The supervisor agreed he’d been treated wrongly and

On Sunday, March 13, 2011, area Muslim leaders gathered at Dar AlNoor Islamic Community Center in Woodbridge, Virginia for Counci l of Musl im Organizations of the Greater Washington D.C. area (CMO) General Assembly Meeting.

The CMO meeting featured presentations by the CMO Executive Council, along with brief updates from participating organizations on their projects and goals, along with a lunch provided by Dar AlNoor.

Nihad Awad, the Executive Director

of CAIR, addressed leaders on the recent King hearings. Awad briefed the community regarding the history behind the creation of the hearings and the role CAIR played in challenging the Islamophobic efforts of Congressman Peter King. Awad noted that due to the efforts of the Muslim community, several speakers known for hateful and divisive rhetoric were dropped from the witness list. Awad viewed the attacks on CAIR – more than 50 references were made to the civil rights and advocacy organization – as proof that King’s hearings had failed and that he had nothing left to do but to

to the Maryland State Department of Education. Four school systems will be selected to launch the program. The Maryland State Department of Education has an Arabic and Chinese education specialist to help in the program, such as in setting the curriculum. Arabic will also be introduced into the science curriculum such as the STEM program, or Science Technology Engineering and Mathematics. Units in science will be taught in Arabic or Chinese.

Susan Spinnato, the director of instructional programs for the Maryland State Department of Education, told the Muslim Link that the whole purpose of the program “is to move Maryland public schools, that are number one in the nation, to world class. You can’t be world class unless you’re globally

competent, and that means being able to speak another language and to have cross cultural knowledge.” She said that the pipelines program would have the effect of “placing Maryland on the cutting edge.”

The name “pipeline” is in reference to the program starting from the elementary school level. The future projection for the program is that the students will graduate from high school with proficiency in another language and that they will be able to pursue Arabic at the college level or as a career path.

Howard County, Maryland resident Anwer Hassan, who chairs the Governor’s Commission on Middle Eastern Affairs, told the Muslim Link that introducing Arabic language to public school students was one of the agenda items in meeting with the governor. Hassan also met with

the Maryland State Department of Education, and was the one to suggest that Arabic be introduced at the elementary school level rather than at a later stage, as children can grasp more at an early age.

“Years of effort has paid off. Im glad we have a governor in the state of Maryland who is really supportive of [this] initiative,” said Hassan. Arabic instruction is important for bridging the gap of understanding between the west and the Arab world, and for removing misconceptions about the Islamic faith, he added. National security and trade are also in need for more Arabic speakers, he said, adding that Maryland is a heavy exporter to the Middle East. Muslim children will also better understand their religion by knowing Arabic, said Hassan.

Same-Sex Marriage Bill Falls Short in MarylandBy SABRINA TAVERNISENew York Time, March 11, 2011

ANNAPOLIS, Md. — Lawmakers in Maryland on Friday failed to gather enough votes to pass a bill that would have allowed same-sex couples to marry, withdrawing it from consideration after hours of emotional debate and effectively killing the bill’s chances for passage this year.

The speaker of Maryland’s Democratic-controlled House of Delegates, Michael E. Busch, said that the bill, the Civil Marriage Protection Act, had fallen short of the 71 votes required for passage and that Democrats had decided to withdraw it instead of holding a vote that would fail.

“This is a distance run, not a sprint,” Mr. Busch said. “We’ll come back next year and take a strong look at it.”

The withdrawal capped a tumultuous few weeks, which began with the bill’s sponsors saying that its passage was all but assured and that Maryland would soon become the sixth state to legalize same-sex marriage.

But the closer the bill got to a final vote,

the bumpier its path became. One of its co-sponsors, Delegate Tiffany T. Alston, a freshman Democrat from Prince George’s County, had withdrawn her support, apparently bowing to pressure from her constituency, which contains a powerful religious community.

Two national groups that oppose same-sex marriage, the National Organization for Marriage and the Family Research Council, both highlighted African-American and religious opponents of the bill as central to its defeat.

“Particular thanks must go to the African-American pastors, church members and delegates who spoke out against the attempted hijacking of the concept of ‘civil rights,’ ” the Family Research Council said in a statement.

Democrats hold 98 of the House’s 141 seats, more than enough to overcome near-total Republican opposition, but ultimately about a third of all Democrats opposed it.

“Without the in te l l igence and cooperation of the Democrats who also wanted this bill to be defeated, today’s victory would have been much more difficult,” said Don H. Dwyer Jr.,

a Republican delegate.

The National Organization for Marriage said that it would spend part of the $1 million it had pledged to spend in Maryland to support Democrats who went against the bill, and to oppose the lone Republican who voted for it, Senator Allan Kittleman.

During the debate, Democrats gave some of the most impassioned opposition.

“I submit there is a cancer growing on the political process here,” said Emmett C. Burns, a delegate from Baltimore. Same-sex marriage violates natural law, he said, adding, “It does not create a family but a naturally sterile union.”

But the bill’s supporters — including six of the House’s seven openly gay delegates — offered deeply personal and sometimes tearful speeches that drew applause and standing ovations.

“I’ve heard that somehow, I am less than natural, I am less than human, I am less than,” said Luke H. Clippinger,

group’s killed several U.S. military personnel and civilians during the 1970s, had ties to Saddam Hussein’s regime in Iraq, and uses “propaganda and terrorism” to wage a worldwide campaign against the Iranian government, even while in exile. The group claims to have renounced terrorism in 2003.

MEK’s prominent U.S. supporters -- mostly Republicans, but some Democrats

too -- have attended pro-MEK events and personally voiced support for the removal of MEK from the U.S. terror list.

They include: former New Mexico governor Bill Richardson, former New York mayor Rudolph Guiliani, former homeland security secretary Tom Ridge, former White House Homeland Security advisor Frances Townsend, former attorney general Michael Mukasey, former CIA director Gen. Michael Hayden, former Colorado Congressman Tom Tancredo, former Indiana Congressman Lee Hamilton, and many others. They’ve made the enemy-of-my-enemy-is-my-

friend argument, noting that MEK is an organized resistance group opposing a terrorist state.

“The United States should not just be on your side,” Guiliani said at a pro-MEK event in December, the Washington Post reported. “It should be enthusiastically on your side. You want the same things we want.”

As Time magazine noted, however, the group isn’t popular back in Iran -- especially not with Iran’s pro-democracy movement, which challenged the regime following the country’s contested 2009

presidential election and whose members have also led some of the recent protests in Iran.

CMO Chairperson Asma Hanif and Imam Johari Abdul Malik briefed the leaders towards the end of the program on the current situation of Imam Mahdi Bray, a former CMO Chairperson, who had recently suffered a stroke and is at home recuperating. Sister Asma related that Imam Mahdi was in need of the support

of the community through their dua and visitation. During one visit to Imam Mahdi, Sister Asma related that Imam Mahdi had asked her very simply, “ where is everybody”? This served as a good reminder for all present to visit Imam Mahdi and appreciate all of the work he has done for so many organizations.

asked what he might do to make him “feel better.” Dahir said he wanted an apology from the officers.The two officers refused to apologize. Dahir asked how long before he could return to the library. He asked for it in writing, so he could take that document to a dean to continue his protest.

At that, an officer told him, “Now I’ll make sure you’re given one year away from the library.”

“That’s fine, as long as it’s in writing,” Dahir said.

He was handed a citation — two weeks, the maximum penalty, as it turned out — and left. He scheduled a meeting with a university administrator who oversees the police, then returned to his dorm.

A couple hours later, one of the officers located Dahir in a study room on his

residence hall, where he’d finally set up for the delayed appointment with his studies.

“Now I’m here to arrest you,” the officer said.

“For what?”

“Abduction.”

“Who did I abduct?”

The officer did not respond.

Dahir was handcuffed and searched, and taken to a magistrate. He says he still doesn’t know the rationale behind the felony abduction charge: On the charging document, the arresting officer merely wrote the definition of the code, he told me in a telephone interview.

In front of the magistrate, Dahir told the arresting officer, “When I become a lawyer I will make sure officers like you are taken off the force.”

The officer replied, “Oh, yeah? We’ll see about that.”

After 17 hours in jail, Dahir was released on $2,500 bond. A preliminary hearing is scheduled for April 6. Since the incident, Dahir has been barred from his hall, leaving him “homeless and at the mercy of off-campus friends with open couches,” the account states. He’s unable to fulfill his duties as a resident assistant at the dorm.

“I am charged with felony abduction,” he told me.

The university released this statement on the affair:

“The allegations are currently under review by both the university police and the university’s Judicial Affairs office. Mason police officials are continuing to look at all details of the incident. If any new information is uncovered it will be conveyed to the appropriate authorities in Fairfax County and to the university.

“The university’s Judicial Affairs office has also begun its process to look into the allegations. Both law enforcement officials and the Judicial Affairs office recognize the urgency of the situation and are moving as quickly as possible. The narrator then ominously warns that Jasser’s push for the “separation of mosque and state” has been “attacked in the American Muslim community.” So while speakers in the film (including Gaffney, who has been shunned by some prominent conservatives because he is a “crazy bigot [4]”) issue the disclaimer that they’re not talking about American Muslims writ large, the vaguely defined “American Muslim community” is accused of “attacking” the rare good Muslim.

Jasser is not only presented as the

good Muslim, but the good American and, critically, the good conservative. Jasser—who has contributed to the campaigns of Arizona Republicans—reveals his true objection: “I raise my kids to be conservative, family-value Muslims,” he says in a film produced by the twice-divorced Gingrich and his third wife, Callista. “These ideas don’t matter to them [the Islamists].... [for them], its about a political collectivism.” In his loaded use of the term “political collectivism,” Jasser is not alone: other anti-Islam conservatives maintain that the Muslim Brotherhood’s aim is not just a caliphate but a socialist caliphate. The Brotherhood’s “common mission,” says Jasser, is to “advance Sharia, to advance political Islam and the collectivism of a Muslim political movement in America that’s different from our Constitution and our Bill of Rights.”

Just last weekend, President Obama’s Deputy National Security Advisor Denis McDonough spoke at an event hosted by the All Dulles Area Muslim Society,

a Washington, DC–area mosque whose executive director, Iman Mohamed Magid, is also president of the Islamic Society of North America (ISNA). ISNA is a mainstream Muslim group that has worked with and been praised by the Union for Reform Judaism, the Interfaith Alliance and others. During the anti-Park51 hysteria, ISNA convened [5] an interfaith summit to combat Islamophobia and was joined in its efforts by numerous Christian and Jewish denominational leaders.

But Jasser refuses to believe that ISNA is anything but part of an insidious Muslim Brotherhood plot. In Gingrich’s film, he targets the Obama administration because White House adviser Valerie Jarrett was the keynote speaker at ISNA’s 2009 annual conference, but conveniently omits that megachurch superstar Rick Warren also spoke there [6] (on the Fourth of July, no less). Jasser complains that Obama administration officials “pander to groups that are clearly Islamist.”

This attack on the Obama administration may well point not only to the possible testimony at King’s hearings but to the right’s political rhetoric heading into the 2012 presidential campaign: vague, unsupported insinuation about the connectedness of Obama, radical Islam and “collectivism.” By speaking to “these groups,” Jasser charged, administration officials “put our country in peril, because they are advocating and promoting and basically apologizing for groups that have ideas that are a slippery slope toward that jihadism.”

U.S. Attorney Karen Loeffler said Lonnie Vernon, 55, was arrested for threatening to kill a federal judge. She said more information about federal charges would be released today Fairbanks Police Chief Loren Zager said the operation involved multiple police actions related to Fairbanks-area members of the “sovereign citizen” movement.

The operation was complete by evening, according to the U.S. Attorney’s Office in Anchorage.

Alaska State Troopers had earlier shut down a road near Cox’s home, according to the Fairbanks Daily News-Miner. The 26-year-old militia leader is a self-described “sovereign.”

An arrest warrant for Cox was issued last month when he failed to show up for a court appearance on a weapons charge.

Cox, a vocal proponent of Americans’ right to bear arms, had earlier vowed to defy what he described as an illegitimate and overbearing government.

The News-Miner reported a state trooper carrying a rifle blocked off an intersection near Cox’s listed address Thursday afternoon. A neighbor who lives on the same road said it was not blocked as of 5 p.m.

Along with troopers and Fairbanks police, the FBI and U.S. Marshals Service carried out the arrests, according to troopers.

An update posted on Cox’s Facebook page at about 7:30 p.m. said: “Schaeffer has been taken into custody by the FBI. Please pray for his safety and the safety of his family.”

The sovereign citizen movement is characterized by a rejection of U.S. laws and taxes. In general, participants believe that federal, state and local

statutes and laws do not apply to them.

This week ACLU Immigrants’ Rights Project Deputy Director Lee Gelernt argued in the Supreme Court what some are calling “the most important case of the term.” In Ashcroft v. al-Kidd, we seek to hold former Attorney General John Ashcroft responsible for the detention of Abdullah al-Kidd, an innocent American citizen who was wrongfully imprisoned under the material witness statute. The material witness statute is meant only to allow the government to briefly detain a witness to make sure he or she testifies in court. But in the wake of 9/11, Ashcroft enacted a widespread policy of abusing this limited power in order to arrest, jail, and interrogate citizens and non-citizens the government deemed suspicious, but against whom they had no evidence of wrongdoing. Al-Kidd is a victim of Ashcroft’s unlawful policy.

Arrested in Dulles International Airport in 2003 and detained for more than two weeks in harsh conditions, al-Kidd was never asked to testify in the case for which his testimony was supposedly needed. Instead, he was kept under restrictive conditions for months that forced him to abandon an educational scholarship and led to the breakdown of his marriage and career. The 9th Circuit Court of Appeals found the Justice Department’s position in this case to be “repugnant to the Constitution” and a “painful reminder of some of the most ignominious chapters of our national history.” The Supreme Court,

however, offered Ashcroft one more shot when it announced it would hear his appeal, and thus the ACLU appeared before the court on Wednesday.

Although the case before the Supreme Court does not specifically involve al-Kidd’s conditions of confinement, they are relevant to whether al-Kidd was genuinely viewed as a witness. Justice Ginsburg reminded the court on Wednesday that al-Kidd was kept under extremely harsh conditions during his 16-day detention. He was kept awake for hours on end, with a bright light shining in his cell 24/7. Whenever he was let out of his cell – usually only for one hour a day – he was shackled at the wrists, ankles, and waist. At one point, he was left naked for hours in plain view of other clothed prisoners and guards. According to al-Kidd, he was detained with convicts and federal inmates– who were still treated better than he was. Turning to Neal Katyal, the government attorney defending Ashcroft, Justice Ruth Bader Ginsburg said: “Now that doesn’t sound like the way one would treat someone whose testimony you want.” We don’t think so either.

While the facts of the case make obvious that al-Kidd deserves justice for the undue hardship he suffered at the hands of Ashcroft’s directive, the Supreme Court yesterday was considering the government’s argument that Ashcroft, a former attorney general, cannot even be sued. Ashcroft argues that no matter what happened, he cannot legally be held liable

and he deserves full immunity from this lawsuit.

According to Ashcroft’s attorney, it apparently does not matter if our client was arrested as a witness and detained solely for the purpose of being investigated as a suspect. Nor does it matter that the government had no probable cause to believe al-Kidd was guilty of a crime. Katyal argued that the motives behind the arrest and detention of al-Kidd are irrelevant, and the courts have no business looking into an official’s intentions. “Allowing such suits to proceed would result in burdensome litigation and interfere with the ability of prosecutors to do their jobs,” Katyal said at Wednesday’s argument.

But should we let fear of “burdensome litigation” stand in the way of justice for an American citizen? Don’t we want the courts to “interfere” with government officials when they are violating the Constitution? In the case of al-Kidd, the facts make clear that an innocent citizen faced extreme hardship under an illegal government policy. But the government doesn’t have to worry about any of those facts if the court awards immunity and such atrocious treatment of a man like al-Kidd becomes justified, because the attorney general was “just doing his job.”

Immunity from being sued is an extraordinary protection; it stops a case before it even begins, before a person even has a chance to prove the allegations.

If Ashcroft receives immunity for his actions against al-Kidd, officials in the future will feel free to distort the law to serve unconstitutional purposes, safe in the knowledge that there will be no consequences for doing so. To allow such an egregious misuse of the material witness statute will only reinforce the atmosphere of impunity that exists whenever a government official invokes “national security” as a justification for his or her actions.

Lee summed it up best in his argument:

The [Fourth Amendment] is fundamental to our traditions, is widely viewed as a defining feature of our country, and has been steadfastly protected by this court for more than two centuries in both good and bad times. The material witness statute represents a dramatic departure to the rule, allowing the arrest of uncharged, innocent, even cooperative people. […] What we’re talking about here is a statute that has enormous consequences […] and to say that there is going to be absolute immunity is very dangerous.

Hopefully, the court will agree.

(March 16, 2011) WASHINGTON: CIA contractor Raymond Davis was flown out of Pakistan on Wednesday after being acquitted of two murder charges and released by a Pakistani court, a US official said.

“Davis was released from Pakistani custody and is out of the country. There was no quid pro quo,” the official said, speaking on condition of anonymity.

US Ambassador Cameron Munter on the release of Davis said: “I wish to express my respect for Pakistan and its people, and my thanks for their commitment to building our relationship.”

A court freed Davis after blood money was paid in accordance with sharia law, the Punjab Law Minister Rana Sanaullah said.

“The family members of the slain

m e n a p p e a r e d in the court and i n d e p e n d e n t l y verified they had p a r d o n e d h i m (Davis),” Sanaullah t o l d a p r i v a t e television.

“ H e h a s b e e n released from jail. Now it is up to him. He can go wherever he wants,” he added.

Raja Irshad, a lawyer for the families of the two dead men, said a total of 200 million Pakistani rupees (2.35 million dollars) was paid as compensation. That was confirmed by public prosecutor Abdul Samad.

“The family members told the judge that there was no pressure on them to accept the compensation and they had signed the pardon documents

voluntarily, independently and with due consideration,” Irshad said.

Police investigator Muneer Ahmed told AFP the deal had been done by “mutual agreement” and the court had received signed family statements before ordering Davis’ release.

PML-N spokesman Pervez Rasheed said the Punjab government was not involved in the release of Davis, DawnNews reported.

Moreover, Ayesha, the sister of Shumaila Kanwal, the wife of victim Faheem Ahmed, said “we are not aware of any such settlement and we did not opt for any…we want justice.”

“They confined us in the jail for four hours and did not allow us to take part in the court proceedings. We were not allowed to leave the prison,” one of the lawyers,

Asad Manzoor Butt, told AFP.

Butt said the families of the men had agreed with authorities to accept blood money over the deaths the previous night.

Another laywer for the families, Nauman Atiq, confirmed that the lawyers had been held at the court and told not to speak to media.

Blood money, or “diyya” is a provision under Islamic sharia law in which compensation can be paid to relatives of those killed to secure a pardon, and is commonly used to resolve such cases in Pakistan.

Israel to expand settlements after family killing

Israel is to build hundreds of homes in West Bank settlements in response to the murder of five members of a Jewish settler family, including two children and a baby, believed to be the work of Palestinian militants. The events of the weekend are likely to further push back the prospects of renewed peace talks between Israel and the Palestinians.

The decision to approve 500 housing units was taken on Saturday night, less than 24 hours after the Fogel family were attacked with knives as they slept in their home in the isolated settlement of Itamar, deep in the West Bank. All five had their throats slit.

Thousands of people attended their funeral in Jerusalem on Sunday. Three children in the family survived.

The homes are to be built in the large settlement blocks which Israel expects to keep under any peace agreement with the Palestinians. It is the biggest tranche of construction announced since the end of the settlement freeze almost six months ago. Some members of the Israeli cabinet pushed for a more radical response to the family’s murder. Interior minister Eli Yishai, of the pro-settlement, rightwing Shas party, said Israel should build “at least a thousand new homes for each person murdered”.

Housing minister Ariel Atias, also of Shas, said: “We must strengthen the settlement, and the time is now.”

The move signals a stiffening of the Israeli government’s stance in the face of international pressure for a gesture to encourage peace talks to resume. The prime minister, Binyamin Netanyahu, had been expected to propose an interim Palestinian state on temporary borders, but analysts suggested that may now be shelved.

The Palestinian Authority said the construction announcement was aimed at addressing Netanyahu’s domestic political problems within his fragile coalition. It would not “cause the Palestinians to forego their right to independence and freedom,” said a spokesman, Ahmad Assaf.

Further details of Friday night’s attack emerged amid criticism that security procedures at the settlement had not been

properly observed.

The attacker or attackers scaled Itamar’s perimeter fence, triggering an alarm. Settlement security investigated but failed to notify the Israeli military. The intruders waited inside the settlement for some time after identifying their target, then entered the Fogels’ house through a window. Two children were killed first, then the father, who was asleep with his baby daughter, and then the mother, who, it was reported, attempted to shoot the attackers with the family’s gun. The attackers then escaped over the perimeter fence, triggering a second alarm.

repeatedly insisted Davis was an embassy employee and enjoyed diplomatic immunity, particularly after it emerged he was working for the CIA.

The Davis case had sparked protests in Pakistan, with religious groups angrily denouncing the American who claimed he

acted in self-defence to fend off an armed robbery when he shot dead the two men.

US authorities insisted Davis was protected by full diplomatic immunity, but the Pakistan government refused to back that claim and a decision on his status was on Monday deferred by the Lahore high court for criminal judges to decide.

Revelations that Davis was a CIA contractor heaped pressure on Pakistan’s

embattled government and further ramped up burning public mistrust of Washington, damaging fragile relations between the two wary allies.

1- Six Ettiquettes of Learning

Ibn al-Qayyim[1] - rahimahullaah- said: “There are six stages to knowledge: Firstly: Asking questions in a good manner. Secondly: Remaining quiet and listening attentively. Thirdly: Understanding well. Fourthly: Memorising. Fifthly: Teaching. Sixthly- and it is its fruit: Acting upon the knowledge and keeping to its limits.”

2- Fruits of Humility

Ibn al-Qayyim - rahimahullaah - said: One of the Salaf (Pious Predecessors) said: “Indeed a servant commits a sin by which he enters Paradise; and another does a good deed by which he enters the Fire.” It was asked: How is that? So he replied: “The one who committed the sin, constantly thinks about it; which causes him to fear it, regret it, weep over it and feel ashamed in front of his Lord - the Most High - due to it. He stands before Allaah, broken-hearted and with his head lowered in humility. So this sin is more beneficial to him than doing many acts of obedience, since it caused him to have humility and humbleness - which leads to the servant’s happiness and success - to the extent that this sin becomes the cause for him entering Paradise. As for the doer of good, then he does not consider this good a favour from his Lord Upon him. Rather, he becomes arrogant and amazed with himself, saying: I have achieved such and such, and such and such . So this further increases him in self adulation, pride and arrogance - such that this becomes the cause for his destruction.”

3- Purifying the Heart

Ibn al-Qayyim - rahimahullaah- said: “There is no doubt that the heart becomes covered with rust, just as metal dishes - silver, and their like - become rusty. So the rust of the heart is polished with dhikr (remembrance of Allaah), for dhikr

polishes the heart until it becomes like a shiny mirror. However, when dhikr is abandoned, the rust returns; and when it commences then the heart again begins to be cleansed. Thus the heart becoming rusty is due to two matters: sins and ahafah ( neglecting remembrance of Allaah ). Likewise, it is cleansed and polished by two things : istighfaar (seeking Allaah’s forgiveness) and dhikr.”

4- Jihaad Against the Self

Jihaad (striving) against the soul has four stages: Firstly: To strive in learning guidance and the religion of truth, without which there will be no success. Indeed, there can be no true happiness, nor any delight in this world and in the Hereafter, except through it. Secondly: Striving to act upon what has been learnt, since knowledge without action will not benefit, rather it will cause harm. Thirdly: Striving to invite others towards it and to teach those who do not know, otherwise he may be considered from those who hide what Allaah has revealed of guidance and clear explanation. Such knowledge will neither benefit, nor save a person from the punishment of Allaah. Fourthly: Striving to be patient and persevering against those who oppose this da’wah (call) to Allaah and those who seek to cause harm - patiently bearing all these hardships for the sake of Allaah.

When these four stages are completed then such a person is considered to be amongst the Rabbaaniyyoon. The Salaf were agreed that a Scholar does not deserve the title of Rabbaanee until he recognises and knows the truth, acts upon it, and teaches it to others. So whosoever has knowledge, acts upon it, and teaches this knowledge to others, is considered from the Rabbaaniyyoon.”[6]

5- Trials of the Heart

Ibn al-Qayyim said, whilst commenting upon the following hadeeth: “Trials and

tribulations will be presented to hearts, as a reed mat is interwoven stick by stick. Any heart which absorbs these trials will have a black mark put in it. However, any heart that rejects them will have a white mark put in it. The result is that hearts will be of two kinds: one white like a white stone, which will not be harmed by trials as long as the heavens and earth endure; and the other dark and rusty, like an over-turned vessel; not able to recognise the good, nor reject evil, but rather being absorbed with its desires.”

“The fitan (trials) which are presented to the hearts - and which are the cause of its weakness - are: [i] the trials relating to shahwah (false desire) and (ii) the trials relating to shubhah (doubt)... so the first causes intentions and desires to be corrupted, whilst the second causes knowledge and beliefs to be corrupted”. Speaking about such trials, he - rahimahullaah - said: “Hearts - when exposed to such fitan (trials) - are of two types: [The first type]: a heart, which, when exposed to such trials, absorbs it like a sponge that soaks-up water, leaving in it a black stain. Such a heart continues to soak-up the various trials that are presented to it, until it becomes dark and corrupted - which is what is meant by “an over-turned vessel. “So when this occurs, two dangerous and deadly diseases take hold of it and plunge it into destruction:

Firstly: confusing good with evil, so it neither recognises the good, nor rejects the evil. This disease may take hold of it to such an extent that it believes good to be evil; and evil to be good, Sunnah to be bid’ah (innovation); and innovations to be the Sunnah. and the truth to be falsehood: and falsehood the truth.

Secondly: judging by its whims and desires, over and against what Allaah’s Messenger sallallaahu ‘alayhi wa sallam came with being enslaved by its whims and desires and being led by them also.[The second type]: a white heart in which

the light of eemaan is bright and its radiance is illuminating. So when trials are presented to such a heart, it rejects and turns away from them. This further increases its light and illumination and its strength.”

6- Four Principles of Worship

“(TheAayah): “You alone do we worship.” [Soorah al faatihah 1:5] is built upon four principles:-

Ascertaining what Allaah and His Messenger love and are pleased with, from (i) the sayings of the heart and [ii] of the tongue; and (iii) the actions of the heart and [iv] of the limbs. So al-’uboodiyyah (servitude and slavery to Allaah) is a comprehensive term for all these four Stages.

The one who actualises them has indeed actualised: “You alone do we worship.”

The saying of the heart: It is i’tiqaad (belief) in what Allaah - the Most Perfect - informed about His Self; concerning His Names, His Attributes, His Actions, His Angels, and all that He sent upon the tongue of His Messenger sallallaahu ‘alayhi wa sallam.The saying of the tongue: It is to inform and convey (what Allaah has revealed), to call to it, defend it, to explain the false innovations which oppose it, to establish its remembrance and to convey what it orders.

The action of the heart: Such as love for Him, reliance upon Him, repenting to Him, having fear and hope in Him, making the Deen purely and sincerely for Him, having patience in what He orders and prohibits, having patience with what He decrees and being pleased with it, having allegiance and enmity for His sake, humbling oneself in front

on The Daily Show, and today he’s in the New York Times for his longtime support of the Irish Republican Army -- which killed hundreds of civilians in attacks against the British. While acknowledging that “terrorism is terrorism,” the New York politician made no apologies for his support of the IRA, telling the Times that “the I.R.A. never attacked the United States. And my loyalty is to the United States.”

King’s not the only American politician to have publicly supported a terrorist group. An Iranian militant group known as the Mujahadin-e Khalq, or MEK, has also enjoyed the support of several prominent U.S. political fi gures despite the group’s designation as a terrorist organization. Five people in the Fairbanks area were arrested Thursday by state and federal law enforcement on charges connected with an alleged plot to kidnap or kill state troopers and a Fairbanks judge, according to the Alaska State Troopers.

Francis “Schaeffer” Cox, Lonnie Vernon, Karen Vernon, Coleman Barney and Michael Anderson are accused of conspiring to commit murder, kidnapping, and arson, as well as weapons misconduct, hindering prosecution and tampering with evidence, according to trooper spokeswoman Megan Peters in a written statement late Thursday.

An investigation “revealed extensive plans to kidnap or kill Alaska state troopers and a Fairbanks judge,” the statement said. The plans included “extensive

surveillance” on the homes of two Fairbanks troopers, the statement said.

“Investigation also revealed that extensive surveillance on troopers in the Fairbanks area had occurred, specifically on the locations of the homes for two Alaska state troopers,” the statement said. “Furthermore, Cox et. al. had acquired a large cache of weapons in order to carry out attacks against their targeted victims. House Homeland Secur i ty Committee Chairman Peter King’s (R-NY) hearing on American-Muslim radicalization Thursday was destined to have its fair share of dumb statements, especially since a majority of conservatives believe Muslims are more prone to violence than adherents of other religions.

Here’s a roundup of some of the strangest comments made at the hearing.

1) Neo-Nazis don’t commit terrorist acts

“There is no equivalency of threat between al Qaeda and Neo-Nazis, environmental extremists, and other isolated madmen,” Peter King said. “Indeed, by the Justice Department’s own record, not

one terror-related case in the last two years involved neo-Nazis, environmental extremists, or anti-war groups.”

According to FBI data compiled in a January 2011 report, there have been 14 attempts at domestic terrorism by individuals or groups identifi ed as “Neo-Nazi.” High-profi le examples since 2009 include Holocaust Museum shooter James Von Brunn and Justin Viera.

2) Probing U.S. Muslims is just like probing Nazi war criminals, KKK

Rep. Dan Lungren (R-CA) implied that investigating American Muslims is not so different from probing Nazi war criminals.

“I would say to those who criticize us for a singular focus here that I have been on panels that have investigated the continuing

presence of Nazi war criminals in the United States,” Lungren said, adding, “I’ve been there where we’ve examined the Ku Klux Klan...and skinhead groups and militias.”

“We were not criticized -- or if we were, I didn’t think it was reasonable criticism to say we didn’t look at other gangs at that time.”

3) ‘We’ve surrendered the constitution to the jihadists’

Zuhdi Jasser, founder and president of American Islamic Forum for Democracy, lamented, “We’ve surrendered the constitution to the jihadists.”

an overfl ow room was set-up. A few protesters made it inside the hearing room wearing shirts that said “No Bigotry”, but they were warned that any outbursts would

get them removed.

The House Homeland Securi ty Committee has about 30 members including both Republican and Democrat congressional representatives.

Soon after he started the hearing by hitting the gavel, King began addressing the controversy in the run-up to the hearing, saying the media and some organizations – he specifi cally mentioned CAIR – tried to mis-characterize and sensationalize the hearing.

“To back down would be a craven surrender to political correctness and an abdication of what I believe to be the main responsibility of this committee -- to protect America from a terrorist attack,” said King, who also directed attention to an exhibit showing a map of “terror plots” across the nation.

King’s reference to CAIR were repeated in pointed attacks on the group – the largest and most prominent among Muslim advocacy organizations – throughout the hearing. “In the lead-up to this hearing I found it shocking and sad that the mainstream media accepted CAIR’s accusations as if it were a legitimate organization,” said King as part of his opening remarks. Other republican committee members also

attacked CAIR, one member calling it a “terrorist organization”.

Democratic committee members were very vocal about their opposition to the hearing right from the start.

Bennie Thompson (D-MS) questioned why the committee wasn’t holding hearings on the “white supremacist threat”.

The first witness to speak was congressman John Dingell (D-MI) whose constituents include many of Michigan’s Arabs and Muslims. He urged the committee to not “blot the good name of Arabs or Muslim Americans en mass”. Muslim congressman Keith Ellison (D-MN) also testifi ed, taking

strong exception to the using “Muslim community” in the title of the hearing. Speaking about a Muslim American fi rst responder who died on 9/11 trying to “save the lives of other Americans”, Ellison broke down and cried.

Virginia congressman Frank Wolf, a republican whose district includes areas like Fairfax which have large and active Muslim populations, also took direct aim at CAIR, saying the group is “stifl ing debate” and has “disturbing origins and connections to terrorist financing.” Wolf also listed several cases linked to his district, including the case of Ahmed Abu Ali from Falls Church. He said “radical wahabism” is the major ideology of the terrorists.

The testimony of the three congressmen was followed by the main witnesses for the day – four in total – and subsequent questioning by committee members.

The fi rst and most controversial witness was Arizona Muslim doctor Zudhi Jasser. His testimony focused on the fact that “radicalization” is a “continuum” and “enablers” like Imams, speakers, and others set an ideological foundation in the minds of Muslims who later become radicals. Combating all the phases of the ideology are “what we need your help in solving”, Jasser told the committee.

Although Representative Peter King (R-NY) hasn’t officially announced the witness list for Thursday’s hearing on “The Extent of Radicalization in the American Muslim Community and that Community’s Response,” a leaked list [1] confi rms that his star witness will be Dr. Zuhdi Jasser. An Arizona physician and founder of the nonprofi t American Islamic Forum for Democracy, Jasser is a favorite in the cottage industry created to hype the threat of “creeping Sharia law.” He’s frequently presented as a representative of—and advocate for—“true” moderate Islam.

Unlike more wild-eyed anti-Muslim agitators like Frank Gaffney (with whom Jasser has collaborated) and Pamela Geller, Jasser comes across as calm, sober and professional. He gained notoriety in 2008, with the release of the Clarion Fund [2] fi lm The Third Jihad, which claimed that a fi fth column of Muslim extremists have infi ltrated America with the intent of establishing a theocratic state. The star of the fi lm, Jasser helped promote the claim [3] that

has ricocheted all over the right—that a single document written by a lone Muslim Brotherhood member in the early 1990s proves that American Muslim charities and advocacy groups are part of a plot to subvert the Constitution and America and install an Islamic theocracy.

More recently, Jasser made an appearance in Newt Gingrich’s 2010 documentary, America At Risk: The War With No Name, produced by Citizens United, the conservative group whose efforts to air its anti–Hillary Clinton documentary led to the Supreme Court decision allowing unlimited corporate money in campaigns. The release of the film roughly coincided with the Geller-created

hysteria over Park51, as well as with Gingrich’s own calls to ban Sharia, warning of “a comprehensive political, economic and religious movement that seeks to impose sharia—Islamic law—upon all aspects of global society.” The fi lm is notably anti-Obama. (Just last week, Gingrich launched a presidential campaign exploratory committee.)

Jasser is undoubtedly part of a strategy to deflect widespread criticism that King’s hearings are an attempt smear all Muslims with a broad brush. That’s an accusation that Jasser and others in the anti-Muslim agitprop stable are accustomed to averting. And they do so with a sleight of hand: that it’s not individual American Muslims who are radical, it’s their leaders—Muslim charities and civil rights groups, imams and a religious leadership that is dominated by radicals, who in turn dupe the gullible masses.

Why do so many see extremist acts by non-Muslims as mere isolated incidents, yet see extremist acts by Muslims as a systemic problem worthy of military invasions?

The least intriguing aspect of Republican Rep. Peter King’s congressional hearing this week on terrorism and the “radicalization in the American Muslim community” is the spectacle’s obvious hypocrisy. King was himself a cheerleader of a terrorist group (the Irish Republican Army), and his hearings ignore new government statistics showing that since 9/11, right-wing and white supremacist terrorist plots have outnumbered those of Muslims. Indeed, as the law enforcement data prove, if “radicalization” is a concern, it is at least as much of a problem in the ultraconservative community as it is in the American Muslim community.

King has defended his hearing’s narrow focus by saying that “there are a small percentage (of Muslims) who have allied themselves with al-Qaida” and that “the leaders of that community do not face up to that reality (and are) not willing to speak out and condemn this type of radicalization.” In the wake of Joseph Stack’s kamikaze attack on the IRS, Scott Roeder’s killing of abortion provider George Tiller, and Byron Williams’ Glenn-Beck-inspired terrorist plot (among

other atrocities), King should be saying exactly the same thing about his fellow conservatives — but he’s not.

As I said, this hypocrisy isn’t interesting because it’s so utterly undeniable. However, what is interesting — and profoundly telling — is King’s explanation for his behavior. He says simply that “It makes no sense to talk about other (read: non-Muslim) types of extremism.”

The remark, of course, typifies a broader sentiment in America and raises the most important “why” question: Why do so many like King see extremist acts by non-Muslims as mere isolated incidents that “make no sense to talk about,” yet see extremist acts by Muslims as a systemic problem worthy of military invasions and now congressional witch hunts?

The short answer is 9/11—but that’s oversimplified. Anti-Muslim sentiment was embedded in American society well before that horrific attack stoked a bigoted backlash. The real answer is connected to overwrought Reagan/Bush-era pop culture that first equated “terrorist” with “Muslim.”

As film scholar Jack Shaheen discovered in his book “Reel Bad Arabs,” roughly a third of the most blatantly anti-Muslim films of the last century were made in the 1980s alone. These movies used sporadic atrocities committed by individual Islamic extremists (the Lebanon bombing, the Berlin bombing, etc.) to demonize all Muslims. Consequently, Hollywood’s go-to villain in the 1980s became the Muslim terrorist—whether it was “Iron Eagle’s” unnamed Middle Eastern country or “Back to the Future’s” bazooka-wielding Libyans.

Notice that those two movies were aimed at ’80s kids who have now grown up. That was the norm with Islamophobic pop culture in the Reagan/Bush period — and not just in film. Early ’80s editions of the G.I. Joe comic book, for example, had the heroes alternately fighting Iranians and “infiltrating a Persian Gulf nation.” Likewise, in the lead-up to the first Gulf War, there were Muslim-demonizing board games for kids like “The Butcher of Baghdad” and “Arabian Nightmare.” And, of course, there was the World

Wrestling Federation, whose preeminent Bad Guy was the keffiyeh-clad Iron Sheik — described by one wrestling publication at the time as an “evil hitman (who) shows no mercy in terrorist attacks on the USA’s best.”

And so what started as a cheap pop culture trope in the 1980s has now become the unquestioned assumption — the assumption that King’s hearings clearly appeal to. His inquisition and the sentiment it represents asks us to continue indulging the stereotypes we were sold as kids, and to ignore what should be the most frightening fact of all: the fact that no matter what stories we were told in the ’80s, “radicalization” is a systemic problem, and not limited to any one religious minority.

Jasser put forward many other claims during the questioning session, putting repeated emphasis on the problem of “separatism” rooted in the idea of Islam as a “theo-political global movement” that seeks to reestablish the khilafah, or Islamic state. He claimed that most major Islamic organizations in the US like CAIR, ISNA, and the Association of Muslim Jurists in America (AMJA) are connected to the Muslim Brotherhood and are examples of “political Islam”.

The second witness was the father of an African-American convert to Islam who was convicted of shooting US soldiers in Little Rock, Arkansas. Melvin Bledsoe said his son was “brainwashed” by Muslim radicals a little bit at a time. He said his son took pictures off his bedroom walls and did not want to touch dogs, signs, he said, that his son was becoming a radical.

The third witness was the uncle of Somali youth from Minnesota who reportedly joined the civil war in Somalia after being radicalized. Abdirizak Bihi said the Muslim community and groups like CAIR tried to prevent him for cooperating with the FBI, adding that he was told the community would be “destroyed” and that he was a “tool of the infidels”.

The star witness for the democrats and for those who opposed the hearing was Los Angeles’ Sheriff Lee Baca. The long time law enforcement professional who presides over one of the most ethnically diverse regions in the nation maintained

that he has received nothing but cooperation from the Muslim community in his policing. He emphasized needing to establish a “trust” relationship with the community, and said much of policing gang activity can be applied to tackling threats from violent radicals.

The entire hearing last around four hours and is available for viewing in the video library section of C-SPAN.

Critics maintain the hearings were more political theater than substantive.

The Muslim Link asked Professor Robert Pape for his take on the hearings. Pape, a professor of political science at the University of Chicago who wrote “Cutting the Fuse: The Explosion of Global Suicide Terrorism and How to Stop It” which correlates terrorism with foreign occupation, said the hearings missed the mark.

“The King hearings [missed] a major opportunity to explain the degree and reason for radicalism leading to

homegrown terrorism. This is a rare black swan problem due to excessive anger over US military policies, not a white swan problem caused by religious extremism. Hopefully the scope of the hearings will expand to give a more factual presentation of what we face,” said Pape, reached over email.

At a press conference after the hearing, King said the US should support efforts like that of “moderate” Muslims like Dr. Zudi Jasser. CAIR called King “unfit” to lead the Homeland Security Committee.

5) America couldn’t possibly ally with Muslim countries

Zuhdi Jasser glossed over quite a bit of U.S. foreign policy when saying this: “To ever be an ally with a Muslim country based on Sharia would be impossible.”

As it turns out, the United States is -- or has been -- allied with numerous Muslim nations that practice Sharia law, including Saudi Arabia, Afghanistan and Egypt.

6) Obama isn’t ‘singling out’ Muslims enough

While warning of “the threat of Sharia law to the U.S. constitution,” Rep. Jeff Duncan (R-SC) emphatically declared that he was “astonished” and “outraged” at the Obama administration’s “continued failure to single out who our enemy is.” But Duncan also insisted that nobody on his “side of the aisle” was intent on attacking Islam in general.

Every Muslim has read that the Prophet Sallallahu ‘alyhi wa sallam told his ummah about the wonderful nature of honey. In the Qur’an in Surah An-Nahl, Allah described honey as a “drink of varying color wherein is healing for men”.
