Its ability to heal burns and cuts and Tooth Gel: Healing power of Aloe Vera proves beneficial for teeth and gums, too soothe pain has been documented as far back as the 10th century. Legend has it that Cleopatra used aloe vera to keep her skin soft. The modern use of aloe vera was first recognized the 1930s to heal radiation burns. Since then, it has been a common ingredient in ointments that heal sunburn, minor cuts, skin irritation, and many other ailments. Recently, aloe vera has gained some popularity as an active ingredient in tooth gel. Similar to its use on skin, the aloe vera in tooth gels is used to cleanse and soothe teeth and gums, and is as effective as toothpaste to fight cavities, according to the May/June 2009 issue of General Dentistry, the Academy of General Dentistry's (AGD) clinical, peer-reviewed journal. Maintain dams andreservoirs for regionaldevelopment

A ceremony to open Linpan Dam inKanbalu Township, Shwebo District, SagaingDivision was held at the pandal near the damon 26 July. The dam built on Linpan Creekhas a watershed area of 16 square miles. Withan annual rainfall of 41 inches, the averageannual water in-flow is 8,000 acre-ft.

The birth of Linpan Dam has broughtabout the emergence of the 11 miles longearth road linking Htankon Model Villageand Linpan Village in Kanbalu Township.With this, local people are now enjoying thefruits of better transport. Meanwhile,perennial crops such as mango, jackfruit andshade trees were grown for greening theenvirons of the dam and for the sake of localpeople.

In the past, local people in ShweboDistrict had to rely solely on rainwater foragriculture. At present, with the emergenceof Linpan Dam they can fully utilize irrigatedwater for the agriculture purpose makingbetter use of the facility, and it is estimatedthat the per care yield of paddy would increaseto over 100 baskets from 70 baskets.

Linpan Dam, 40 feet high and 9,800 feetwide, is of earthen type with 5.21 miles longmain canal and 9.92 miles long tributarycanals which can irrigate 2,000 acres offarmlands.

At a time when the government ismaking all-out efforts for the emergence of alarge number of roads and bridges as well asdams and reservoirs throughout the nationthe onus is on all the local people to maintainthose facilities for durability and regionaldevelopment.

LONDON, 28 July—More than halfof Britons think military operations inAfghanistan are futile and want troopsto be withdrawn immediately,according to an opinion poll publishedon Tuesday.

Fifty eight percent see the offensiveagainst Taleban extremists inAfghanistan as “unwinnable” and only31 percent disagree, according to thepoll conducted for the Independentnewspaper.

The poll showed 52 percent wanttroops out while 43 percent would likethem to stay.

Some 75 percent believe Britishtroops lack the equipment they need toperform their role in Afghanistan safely,compared to 16 percent who think they

have adequate resources, it said.However 60 percent of those polled

do not think more troops and resourcesshould be sent to the front line,according to the ConRes survey of1,008 Britons polled over the phoneearlier this month.

The poll comes as Britain onMonday announced the end of a majorbloody offensive against the Taleban inthe south of Afghanistan, while theMinistry of Defence said two moresoldiers had been killed there.

Two killed, 18 injured inattacks in Iraq

BAGHDAD, 28 July—Two people were killed and18 others injured in separate attacks in Iraqi cites onMonday, an Interior Ministry source said.

In Iraq’s northern city of Mosul, a bomb plantedin the car of Muhamed Fadhel al-Haiyali, a chieftainof a Sunni Arab tribe, detonated while the car travelledin Dawasa district of the central city, killing him andwounding his driver, the source told Xinhua oncondition of anonymity.

In a separate attack, a roadside bomb went offnear a joint patrol of Iraqi soldiers and policemen inthe Yarmouk district west of Mosul, wounding foursoldiers and three policemen, the source said.

Mosul, some 400 km north of Baghdad, is said tobe one of the last strongholds of al-Qaeda fighters inthe war-torn country. In Baghdad, a roadside bombstruck a police patrol in Palestine Street in easterncapital, killing a policeman and wounding four others,the source added. Six more Iraqi soldiers were woundedin a separate bomb explosion near their vehicle inwestern Baghdad, he said.

BEIJING, 28 July—The governmentshould raise both taxes and the retail priceof cigarettes as a tobacco control measure,experts said after a survey found 80.5percent of Chinese smokers supportraising tobacco taxes.

The survey, conducted by TsinghuaUniversity, Harvard University and theresearch institute for fiscal science underthe Ministry of Finance, polled 3,000families in 18 cities about their opinionson cigarettes taxes. About 85 percent ofrespondents supported the government

increasing tobacco taxes, and 80.5 percentof smokers were also in favor.

The survey was conducted in Aprilahead of the 1 May increase in productionand consumption taxes on cigarettes.

Under the hike, a five percentconsumption tax was imposed oncigarette wholesalers. It meant taxes oncartons of cigarettes costing 70 yuan($10) or more increased from 45 percentto 56 percent. Taxes on cartons costingless than 70 yuan increased from 30percent to 36 percent.—Internet

rent account deficit of 7.07 billion US dollars in thefirst half of 2009, down 58 percent year-on-year, thecountry’s Central Bank said on Monday.

Brazil’s current account deficit in the first half of2008 was 16.8 billion dollars.

The country’s current account deficit stood at 535million dollars in June, down from 2.78 billion dol-lars in the same month last year.

The sharp decrease was largely due to a fall in theprofit and dividend remittances and the fact that thecountry’s imports fell more than exports.

HOHHOT, 28 July— Water pollution had caused231 people to suffer from diarrhea in Chifeng City,north China’s Inner Mongolia Autonomous Region,local authorities said on Monday.

The first diarrhea case was reported on lateSaturday. As of 5:30. am Sunday, 231 cases have beenreported. All the cases were suspected to be caused bywater pollution, said an official with Chifeng municipalhealth bureau.

All the patients received free medical treatment,said the official.The pollution was caused by theheavy rainfall in 23 July, which raised the city’s waterlevel and made water from a nearby lake flow into thewater-supply well, the official said.

WELLINGTON, 28 July — New Zealand PrimeMinister JohnKey said on Tuesday that thegovernment is likely to set a target of a 15 percentreduction in greenhouse gas emissions by 2020.

A round of public consultation on what thetarget should be hasjust been completed, withenvironmental groups pushing for a 40 percentreduction.

The target will be tabled at the next round ofinternational climate change negotiations inGermany in August. YANGON, 28 July—Criminal Cases Nos 47/2009, 48/2009, 49/2009 against US citizen Mr John WilliamYettaw, Daw Aung San Suu Kyi, Daw Khin Khin Win and Ma Win Ma Ma were heard at Yangon North DistrictCourt at 10 am today.

The court heard the arguments of the lawyers defending Daw Aung San Suu Kyi, Daw Khin Khin Winand Ma Win Ma Ma and Mr John William Yettaw in Criminal Case No 47/2009.

It pronounced an order rejecting the lawyers’ application for submission of the Ministry of ForeignAffairs’ response to the queries raised by the Working Group on Arbitrary Detention in the United Nations andfor questioning the presenter as a court witness under Article (540) of Penal Code of Criminal Procedure.

The order says that Daw Aung San Suu Kyi is put on trial under Article (22) of the Law to Safeguardthe State Against the Dangers of Those Desiring to Cause Subversive Acts; that Article (22) is that any personplaced under restriction will face a legal punishment if he opposes, breaches or fails to obey the restriction orderor prohibition order; that nothing is arguable regarding the restriction order, prohibition order and extendedprohibition order put on Daw Aung San Suu Kyi; that the plaintiffs submit restriction order as evidence (b),prohibition order, as evidence (b-1) and extended prohibition order, as evidence (b-2); and that Daw Aung SanSuu Kyi’s Advocate U Kyi Win submitted an appeal against the said restriction order, prohibition order andextended prohibition order to the Government Office of the Union of Myanmar, however the appeal wasrejected because of lack of sound evidences.

It says that the Government Office sent a forwarding letter on rejection of the appeal dated 30 April 2009;that Daw Aung San Suu Kyi knows that restriction order, prohibition order and extended prohibition order havebeen issued and they are still in force; and that in the case, plaintiffs and their witnesses and the accused andtheir witnesses have been questioned.

It is found that the statements and arguments and the evidences provided by both sides do not supportor reflect the reasons enumerated in the application; that the context of the case is to find out whether the accusedopposes, breaches or fails to obey the restriction order or prohibition order; and that so an order is pronouncedto reject Daw Aung San Suu Kyi’s lawers’ application for submission in the court under Article 540 (Part II)of Penal Code of Criminal Procedure, deducing that there is no reason to take the application into consideration.

Final arguments of Lawyer U Khin Maung Oo defending Mr John William Yettaw and final statementsof the deputy district law officer for the plaintiffs in Criminal Cases Nos 48/2009 and 49/2009 were heard.

If the law is breached …U Myo Myint (Law)

Every independent country has their sovereignty.They can freely exercise legislative power, executivepower and judicial power for their interest.

Myanmar is an independent, sovereign countrywith the rights to formulate and prescribe appropriatelaws, and to form a government with suitable admin-istrative machinery. It also has its own judicial sys-tem and judicial organs.

About 200 world countries have different geo-graphical features, climates, races, traditions, cul-tures, languages, literatures, religious faiths, cos-tumes and historical backgrounds. However, theyshare same goals in writing and enacting necessarylaws for restoration of State stability and communitypeace, public security and development; forminggovernments capable of leading the countries con-cerned, and operating courts to enforce the laws.

All the countries such as the United States ofAmerica, United Kingdom, France, China, the Rus-sian Federation, India, Korea, Australia, Germany,Saudi Arabia and Kuwait, etc. have their govern-ments, but each government has different formationfrom that of others. They practise their laws as neces-sary. They have courts to hear cases in accordancewith the laws concerned. Criminals and offenders arenot privileged. Such people are arrested by the police,charged, and put on trial. So, all countries acceptsayings such as “No man is above the law”, and“Ignorance of law is no excuse”.

In hearing a case in United Kingdom, five or sixordinary people without much knowledge of the laware invited to form a jury such as shopkeeper, barber,shoemaker and housewife. And they are requested tolisten to the details of the statements and argumentswith a sense of social etiquette. The real judge sitsamong them, but does not get involved in hearing thecase. He explains the nature and development of thecase and facts about the law to them. He does notmake a verdict, either. The jury members have to castvotes to decide if the accused is guilty or not. Thejudge reads out the verdict based on their decision incourt.

The US’s jury system is based on British judicialsystem. Throughout the colonial period, British colo-nies including Myanmar used juries to hear cases inline with the British judicial system. After they re-gained independence, they laid down and practiseown judicial systems, in place of the jury system.World countries have different laws, governmentsand judicial systems on the grounds of differentpeoples, cultures and religious faiths.

In Myanmar, according to the Myanmar cus-tomary law, the people have the vested right, underwhich a citizen can be vested with the possessions ifother spouse dies, and the children are vested withthe belongings if their parents die. That is in con-formity with the Myanmar lifestyle, the nature andreligious faith of the people. In Christianity, headsof families, fathers and husbands make wills toleave their money and property to be given as theywish. Their wives and children are not vested theirmoney and property automatically. In some wills,certain amount of money and property is given todrivers, housemaids and nurses who they think to beloyal to them, and the remaining money and prop-erty are to be donated to a particular organization,instead of giving parts of their money and propertyto their wives and children.

In some Myanmar movies and novels, Buddhistfathers make wills under which certain amounts ofmoney and property are given to their wives and

children. However, wills are not legal in Buddhism.After the rule of the British colonialists, Myanmar

made amendments to the laws, judicial systems andbureaucracy administrative machinery patterns pre-scribed by the British colonialists. In the colonial days,even Myanmar elders at the age of over 70 had to kow-tow and answer ‘Phayar’ (respectful form of addresstowards monks and loyalty) to British judges who wereat the age of around 30 while the cases were in progress.In the Myanmar judicial system, the accused have therights to defend themselves from the lawsuits, givearguments and appeal. Except some cases to be heardin closed rooms in special tribunals, all cases are heardin public. Unusual punishments designed to tarnish thedignity of the accused (such as a thief with a signboardsaying ‘Thief’ hung on his neck has to shout “I’m athief” every time he is struck with a rod) are not handeddown. Any of the law shall not be applied with retro-spective effect to make a verdict. The case is to beheard in accordance with the law that exists when theaccused commit crimes.

In many western countries including the US, alarge number of cases are heard secretly behind closeddoors. In Myanmar, some cases were heard by specialtribunals (the people were not allowed to listen to thejudicial proceedings) in the times of the Britishcolonialists, the AFPFL government, and the revolu-tionary government. For instance, murder case inHsinswe Village by Thakin Soe and the treason breachedby Ohn Kyaw Myint and party were heard under theguard of heavy security force at the hall (training hall)of Insein Jail.

Both in other countries and in Myanmar, importantcases are heard in specific halls because unscrupulouspersons in disguise of ordinary people listening to thelegal proceedings can disrupt the hearing of the case,try to grab or kill the accused to prevent from providingevidences.

The core of the Myanmar judicial system is the lawand whether the accused is found guilty or not, withoutdiscrimination on the grounds of colour, race or status.In many cases in the US, prison term is sentenced to theBlacks (Negroes) not to the Whites although they arethe same, offenders; woman culprits are asked to walkwith bare foots and with iron fetters in public. In AbuGhraib Prison in Iraq and Guantanamo Prison of theUS Navy in Cuba Island, and CIA’s secret prisons inEurope, prisoners are interrogated inhumanly.Myanmar does not practise such inhuman methods.

Certain radio stations in the West and other mediawhere expatriates are given places are constantly criti-cizing Myanmar’s judicial system and law with biastowards the accused.

It is the case that US citizen Mr John WilliamYettaw secretly entered the compound of Daw AungSan Suu Kyi’s house through the door on the side ofInya Lake on the night of 3 May 2009, and left thehouse on 5 May night, swimming across the lake.Then, he was arrested by security members in the lake.

In the arrest, responsible persons inspected hisbelongings. He also entered the house of Daw Suu Kyiin November 2008. In fact, Daw Suu Kyi was alreadyrestricted under Article (7) of the Law to Safeguard the

State Against the Dangers of Those Desiring to CauseSubversive Acts. Then, Detention Order was issuedunder Article 10 (A), Restriction Order under Article10 (B) / 11, and Continued Restriction Order underArticle 13 / 14 of the Law, and she was kept to stayinside the house. She was allowed to do the cooking,and to receive medical treatment.

Yettaw entered Daw Suu Kyi’s house through theback door of the fence by swimming across the InyaLake in the dark. If the motive of leaving two chadorsand some stuff by Yettaw was to be exposed, it wouldbecome an exciting Hollywood movie. We would belikely to see a thriller in which the actress escapes indisguise.

His first intrusion can even be said to violatethe law. He intruded the second time. Daw Suu Kyireceived the intruder for two nights and providedhim with meals, a room and longyis. He was evennursed as he got cramp in his legs. She received theintruder although she could shout to securityguards for help. Although the house and com-pound are regarded as restricted areas by law, oneintruded and the other accepted. Doesn’t it violatethe law? It can be questionable whether these aredemocratization activities.

Fearing that the public would be realizing the truesituation, internal and external anti-government groupsshouted that Yettaw’s being able to enter the com-pound was due to poor security and that they wereworried about her security. They shouted almost everyday. They hid what they wanted to conceal from thepublic on security grounds. On the night of 3 MayYettaw swam with the help of drinking water plasticcontainers through the culvert box near the KoreanEmbassy not far from Daw Suu Kyi’s house. The routewas not far. But he got cramp in his legs and Daw SuuKyi had to nurse him for two days. It was strange thathe did not get any cramp in his legs on his way backeven though he had to swim diagonally across the InyaLake to nearly reach IBC and the residence of the USdiplomat. Anyhow, if there is a criminal case, just facecharges in accord with the law.

Now, the NLD inside the country started tomake political profit taking advantage of the case.Again, there have been external interferences.Every country prescribes the Act of Contempt ofCourt. The aim is to protect the courts in orderthat they can address legal issues in a fair and justway. There is contempt of court act in Myanmar.

There are three types of contempt of court.(a) Inclusive are defamation of the court, criti-

cism of the court to harm its dignity, present-ing wrong facts about the trial in progressbefore the judge, satirical writings about thejudge and accusations against the court that itwill not be able to pass sound judgment.

(b) Inclusive are disturbing of the court activity,taking photos of the trial in progress withoutany permission of the court and presenting thephoto of the defendant before the court in thecase in which there is a problem of whetherthe face of the defendant is recognized or not.

Threatening and unnecessarily attempting to influ-ence the trial should be avoided. Anyone should not beinvolved in such acts as favouring the defendant, favour-ing the plaintiff and using influence.

At the time when the trial against Daw SuuKyi, Yettaw, Daw Khin Khin Win and Ma Win MaMa is taking place in accord with the law, anyoneshould not say unnecessarily that Daw Suu Kyi isguilty. Anyone should not say that all political

prisoners including Daw Suu Kyi are to be released.Please read the above three points on contempt ofcourt carefully. There should be no prediction thatwho is guilty or who is not guilty until the courtpasses the judgment. It is not possible to say thatone is not to be arrested or convicted as he is froma political party or a politician regardless of thecrime he has committed. No man is above the law.Crime does not pay. Everyone who breaches thelaw shall face a lawsuit and obey the court decision.Only then, will there be the rule of law andcommunity peace and tranquility. If politiciansand a certain party members who are in prison fortheir offences are to be released as political prisoners,criminals who are in prison for their offences suchas theft, robbery and murder will apply for partymembership, wear party brooches and demandtheir release.

The AFPFL government held a trial against anAmerican spy, Gordon Seagraves who was serving as

a doctor at Namkham Hospital and doing missionaryworks, for his persuasion of Kachin army officer NawSai to go underground. At that time, the Time magazinecriticized the Myanmar judiciary system sayingwhether the judges of the Supreme Court understoodthe law. Now there are also criticisms. Seagraves gotonly a light sentence and in prison for six months. Hewas ordered not to go back to Namkham.

If right judiciary system is desired, don’tcommit contempt of court. Follow the courtdecision as a member of the civilized society.Threatening and unnecessarily attempting toinfluence the trial should be avoided. Anyoneshould not be involved in such acts as favouringthe defendant, favouring the plaintiff and usinginfluence. We have already taken lessons from thefour 8’s unrest with anarchy reigning such aslootings, beheadings and lawlessness. Respect thelaw and feel safe.

BERLIN, 28 July—Shocked police arrested a 12-year-old boy for pushing heroin, and described him asthe youngest drug dealer in Berlin.

The child was caught in the Kreuzberg area of theGerman capital selling the deadly drug heroin onMonday evening. He was spotted in a park diggingaround in a sand pit.

nursing advises those coaching young athletes that “nopain, no gain” is a myth.

Mary Kamienski of the University of Medicineand Dentistry of New Jersey says sports should not bepainful.

Australian researcherssay moderate amounts oftransfused blood did notincrease death rates.

The study, publishedin Anesthesiology, finds80 percent of 1,841 pa-tients undergoing low-risk cardiac surgery re-quiring blood-producttransfusion in about halfof the cases were alivemore than 10 years aftersurgery.

The researchers saythe study did find certainpre-existing patient condi-tions — such as beinganemic before surgery orhaving cardiovascular orkidney disease — reducedlong-term survival aftersurgery.

“We were also hop-ing to establish if havinga blood transfusion waslikely to promote cancerin the recipient of theblood transfusion as some

Lung cancer significantlyprolongs survival withoutprogression of the cancer,but does not dramaticallyimprove overall survival,US researchers found.

Lead author Dr KathyAlbain of LoyolaUniversity HealthSystem’s CardinalBernardin Cancer Centerand colleagues said thepatients who did appearto have a major benefitfrom surgery were those

in whom a section of thelung was removed, ratherthan the entire lung.

The study, to bepresented on Tuesday atthe annual meeting of theUS Society for the Studyof Ingestive Behavior(SSIB), finds that after asix-month behavioralweight loss programme,depressed patients not onlylost 8 percent of their initialweight but also reportedsignificant improvementsin their symptoms ofdepression, as well asreductions in triglycerides,which are a risk factor forheart disease and stroke.

Fifty-one depressed andnon-depressed subjectswere recruited into thestudy to follow a supervisedweight loss programmethat included lifestyle

modification and mealreplacements. Bothdepressed and non-depressed subjects lostsignificant amounts ofweight, with depressedindividuals losing 8 percentof their initial body weight,compared with 11 percentloss by non-depressedindividuals.

NAY PYI TAW, 28 July—The Township Health Department transferred a 23-year-old woman who had returned from the Republic of India to Yangon EastDistrict People's Hospital yesterday as she had a fever. The National HealthLaboratory gave her a medical check-up and she was found infected with the NewInfluenza A(H1N1) virus. The patient had arrived Myanmar by flight No TG-303via Thailand on 20 July.

Five family members together with the patient are kept in home quarantine.The authorities concerned are keeping a close watch on 128 passengers who werewith the patient on the same flight at places where they are living.

Similarly, a 33-year-old man who had returned from Malaysia was foundhaving a fever and thus he was sent to Waibargi Specialist Hospital yesterdayunder the arrangement of Airport Health Department and North OkkalapaTownship Health Department. The National Health Laboratory gave him a check-up and he was found infected with the New Influenza A(H1N1) virus. The patienthad returned to Myanmar by flight No BM-502 from Malaysia on 27 July.

Two family members of the patient are kept in home quarantine. Theauthorities concerned are keeping a close watch on 94 passengers who were withthe patient on the same flight at places where they are living.

Up to now, the number of patients infected with the virus has reached nineand four out of them have been discharged from the hospital as they have fullyrecovered. The specialists are taking intensive care to the remaining five patients.
