Stress comes in 3 main forms physical/mechanical, chemical/toxicity and psychological/emotional. DD Palmer suggested that, “Life is the expression of tone. Tone is the normal degree of nerve tension.” This is the fundamental principle of chiropractic. Even the World Health Organization says that health is a states of physical, mental and social well-being and not merely the absence of disease or infirmity. I’m sure that if you were to ask your patients what it is exactly you do? Few would give you an answer based on reducing stress on the body. Most would say to alleviate pain. But are we telling them the whole story? Wednesday, 07 March 2012 The following are twoof the most common questions that the FCAInsurance Liaison Office receives, regarding MedicalRecords.

Q: How long must I maintain patient records in myoffice?

A: You would think this would be a simple answer,but as you will see below, it really isn’t just oneanswer.

• Chapter 460 of the Florida Statutes requires thatchiropractic physicians retain patient records for 4years after the patient was last seen.

• HIPAA (which is Federal) requires that patientrecords be kept for 6 years, regardless of whenpatient was last seen. Download HIPAA Manual.

• Medicare requires you to keep patient records for7 years, regardless of when patient was last seen.

• When dealing with records of minors, retention

times begin when they reach the age of 18.

• MA PFFS (Medicare Advantage Private Fee forService Plans) – Some of these plans require thatpatient records be kept for up to 10 years.

• IRS requires that financial records be kept for 7years. Go to the http://www.irs.gov/ for moreinformation.

Remember that x-rays are medical records and,therefore, you would follow the same guidelines asabove. It is also a good idea to check with yourliability/malpractice carrier as they may havedifferent standards.

Q: What happens to the patient records if the doc-tor closes his practice, moves to another location ordies? Do these same rules apply?

A: Following is Rule 64B2-17.006 from the FloridaAdministrative Code, regarding notification to thepatients as well as record disposition in thesesituations.

64B2-17.006 Retention of Chiropractic Records;

Time Limitations.

(1) The chiropractor who terminates his practice, orthe executor, administrator, personal representative,survivor or succeeding practitioner of a deceasedchiropractor licensed pursuant to Chapter 460,Florida Statutes, shall retain the chiropractic recordsof any “patient of record” in existence upon date oftermination of practice, or upon the death of thechiropractor for at least two (2) years from the dateof the termination of practice, or death of thechiropractor. “Patient of record” for the purpose ofthis rule is a patient who has received treatmentwithin the last two (2) years.

(2) Within one (1) month from the date of termina-tion of practice, or the chiropractor’s death, thechiropractor who has terminated his practice, or theexecutor, administrator, personal representative,survivor or succeeding practitioner of the deceasedchiropractor shall notify the Board Office who thenew records owner is and where the medicalrecords can be found, and shall cause to bepublished in the newspaper of general circulation inthe county where the chiropractor resided or prac-ticed, on two separate occasions, one week apart, anotice indicating to the patients of the chiropractorwho has terminated his practice, or of the deceasedchiropractor that the patient’s chiropractic recordsare available to that patient or their duly constitutedrepresentative from a specific person at a certainlocation.

(3) At the conclusion of a twenty-two month periodof time from the date of termination of practice orthe chiropractor’s death, the chiropractor who hasterminated his practice or, the executor,administrator, personal representative, survivor orsucceeding practitioner shall cause to be publishedonce during each week for four (4) consecutiveweeks, in the newspaper of general circulation inthe county where the chiropractor resided orpracticed, a notice indicating to the patients of thechiropractor who has terminated his practice, or ofthe deceased chiropractor that their chiropracticrecords may be disposed of or destroyed one (1)

month or later from the last day of the fourth weekof publication of notice. Records shall be disposedof or destroyed in such a manner as to preserve theconfidentiality of the information contained therein.

(4) A chiropractor shall retain chiropractic

records for at least four (4) years from the date

of the patient’s last appointment with the

chiropractor. (5) A chiropractor who relocates his orher practice and will no longer be available to his orher former patients shall follow the procedures listedin paragraphs (1), (2), and (3) above. A chiropractorwho relocates to a practice site no more than 20miles away from the previous practice site shalleither provide written notice of such relocation to allpatients by U.S. Mail, or shall follow the procedureslisted in paragraph (2). In situations involving medical examinations, tests,procedures, or treatments requested by anemployer, an insurance company, or another thirdparty, appropriate medical records shall bemaintained by the physician and shall be subject toSection 456.057, Florida Statutes. However, whensuch examinations, tests, procedures, or treatmentsare pursuant to a court order or rule or areconducted as part of an independent medicalexamination pursuant to Section 440.13 or627.736(7), Florida Statutes, the recordmaintenance requirements of Section 456.057,Florida Statutes, and this rule do not apply. Nothingherein shall be interpreted to permit the destructionof medical records that have been made pursuantto any examination, test, procedure, or treatmentexcept as permitted by law or rule.
