Chairman and Members The Personnel Board for Mobile County, Alabama Dear Members,

Activities within the Department reflect a significant increase in the number of requests

from the jurisdictions we serve. The data reveals significant increases in promotional

examinations (53%); number of test given (56%), number of successful applicants (64%),

number of certifications made (71%) and number of appoints (65%). This has truly been a busy

year.

Of equal note is our effort to implement our on-line applications system. This process

began in July and continued through the end of the year and beyond. This is significant

technology advancement as we continue to improve our service offerings. We are increasingly

looking at ways to utilize technology to address our response times and add value to all our

customers. We welcome your suggestions.

Again, I thank the Board Members for their continued support. The employees in the

Department work hard and diligently to provide the service required of all our customers. Our

goal is to continue to foster an environment of collaboration (public officials, support of

community groups, interested individuals, merit system employees) in order to deliver the

services expected of us by the citizenry.

I now invite you to read further for a recap of this past year’s activities.

PERSONNEL BOARD

At the annual meeting of the Supervisory Committee held June 15, 2011, the Committee

elected Mr. Sydney G. Raine as Board Member Number Three to represent Personnel Board

District Three as a successor to William M. Bridges whose term expired September 15, 2011.

At a special meeting of the Supervisory Committee held August 24, 2011, the Committee

elected Frank C. Sullivan, Jr. as Board Member#1 to represent Personnel Board District One to

fill the unexpired term of Sydney Raine until September 15, 2012.

Mr. Sydney Raine currently serves as Chairman and Mr. Earl Broadus serves as Vice-

Chairman of the Personnel Board.

The Board held 12 regular meetings and 12 special meetings during 2011, including 17

meetings at which public hearings were held, for a total of 24 meetings. The Board also held 31

public hearings on disciplinary matters.

HEARINGS ON APPEALS

During the year 2011 the Board held twelve hearings on appeals from dismissal. The

Appointing Authority was upheld completely in six cases. Three hearings convened and

settlement agreements were read into the record. At one hearing the employee did not appear

so the appeal was dismissed for want of prosecution. In two cases the dismissal was altered to

a suspension and the employees were reinstated. After two hearings convened, the employees

withdrew their appeals. One decision was appealed to Circuit Court by the Appointing Authority

but was later withdrawn.

There were fourteen suspension hearings held by the Board. The Appointing Authority

was upheld completely in three cases and three appeals were settled during the hearings. The

suspension was completed set aside in one case, the length of the suspension was altered in

three cases, the suspension was altered to a reprimand in one case, and the suspension was

modified to a dismissal in one case. One appeal was withdrawn after the hearing convened. At

one hearing the employee did not appear so the appeal was dismissed for want of prosecution.

Two hearings held by the Board were for appeals from demotion. In one case the

Appointing Authority was upheld and in one case the demotion was modified to a suspension

and the employee was reinstated.

The Board convened one hearing that involved both an appeal from suspension and an

appeal from dismissal filed by one employee. The suspension was upheld and the dismissal

was modified to a suspension and the employee was reinstated.

The Board held two hearings that were appeals to step three of the grievance procedure.

The Appointing Authority was upheld in both cases.

GRIEVANCES

During the year 2011, there were twenty-seven grievances filed. A total of fifteen were

settled at the first step hearing, two were withdrawn, and one was denied. Of the nine

grievances that were taken to the second step hearing, two were won by the grievant, two were

upheld in favor of the department, two were withdrawn, and two were denied. Of these

grievances, four were processed to the third step before the Personnel Board at which time one

was withdrawn, two were denied, and one is pending.

LEGAL Listed below is a summary of all court cases filed or continuing in 2011. The Attorney and

Assistant Attorney for the Board also rendered legal opinions on the application of laws, rules

and regulations, and conducted hearings on appeals from dismissal, demotion, suspension, and

grievances.

CITY OF MOBILE POLICE DEPARTMENT v. MOBILE COUNTY PERSONNEL BOARD & CASSANDRA MATTHEWS (Case No. CV-11-484)

The Public Safety Dispatcher II with the City of Mobile Police Department was

suspended from her employment for a period of 24 working hours without pay effective

February 21, 2011 for insubordination. On February 15, 2011 the employee appealed the

suspension to the Board. Subsequently, the employee was then terminated from her

employment effective May 2, 2011 for conduct unbecoming an employee in the public service,

incompetency, and violation of any lawful or reasonable regulations or order made and given by

a superior officer. On May 13, 2011 the employee appealed this termination to the Board, and

the matter was heard on July 12, 2011. The Board entered an Order dated July 26, 2011, which

modified the termination to a suspension and reinstated her employment effective July 30, 2011.

On July 28, 2011, the City of Mobile Police Department appealed the Board's Order of

July 26, 2011, which amended and modified the termination of Cassandra Matthews. The

certified transcript of the proceedings before the Board was filed in the Circuit Court on

September 8, 2011. The matter is pending before the Honorable James C. Wood for legal

argument.

MOBILE COUNTY PERSONNEL BOARD v. WATER WORKS & SEWER BOARD OF THE CITY OF PRICHARD (Case No. CV-09-902154) This is a complaint for Declaratory and Injunctive Relief brought by the Mobile County

Personnel Board seeking a declaration that The Water Works and Sewer Board of the City of

Prichard cannot terminate or otherwise impair the civil service status of its employees by

transferring the operation and management of the utility to a private company.

The hearing on the Motion for Preliminary Injunction was heard and denied by the Hon.

John Lockett on November 25, 2009. While the matter was pending a hearing date on the

merits, Mr. Paul David, former Superintendent for the Sewer Board, filed a motion to intervene

which was granted by the Court. The Court heard additional oral argument, and denied David's

Motion for Preliminary Injunction as well. The Court heard the Motion for Partial Summary

Judgment on August 4, 2011. On February 22, 2012 the Court ruled on the central issue as to

whether the Water Works and Sewer Board of the City of Prichard remained under the

jurisdiction of the Mobile County Personnel Board. The Court concluded that it did, subject to its

Rules and Regulations regarding the layoff of its employees within the classified service. The

matter is currently scheduled for April 16, 2012 for the Court to determine damages.

MITCHELL A. BRYARS, JR. v. MOBILE COUNTY PERSONNEL BOARD & THE MOBILE COUNTY SHERIFF’S OFFICE (Case No. CV-10-1670)

The former Deputy Sheriff with the Mobile County Sheriff’s Office was terminated from

his employment on September 15, 2010 for physical incapacity to perform essential job

functions. The termination was appealed to the Board and heard on October 19, 2010. On

November 2, 2010, the Board entered an Order affirming the termination and instructed the

Personnel Director to place Mr. Bryars’ name on the layoff re-employment list for a period of two

(2) years.

On November 3, 2010, Mr. Bryars appealed the Board’s decision to the Circuit Court,

and after several continuances, the matter was set for oral argument before Honorable James

C. Wood on February 24, 2012. On the said hearing date, the employee’s attorney filed a

Motion to Withdraw the Appeal of the Board’s Order which was granted by the Court.

RODRICK SHOOTS v. MOBILE COUNTY PERSONNEL BOARD (Case No. CV-2011-000499) On March 30, 2011 Roderick Shoots appealed the decision of the Mobile County

Personnel Board affirming his demotion from the position of Fire Service Inspector to the

position of Firefighter in the Mobile Fire and Rescue Department. The matter was briefed and

argued to the Mobile County Circuit Court. On October 4, 2011 Circuit Court Judge Robert H.

Smith denied Shoots’ appeal, thereby affirming the board’s order upholding the demotion.

JACQULYN IVORY v. MOBILE COUNTY PERSONNEL BOARD (Case No. CV-11-515) On February 28, 2011 Jacqulyn Ivory, a Youth Detention Officer I employed by the

Mobile County Juvenile Court, received a five day suspension from her employment. The

Appointing Authority had imposed a five day suspension, but after hearing the evidence the

Personnel Board concluded that additional discipline was appropriate and increased the length

of the suspension to 10 days. This matter was briefed and argued in the Mobile County Circuit

Court. By order of October 4, 2011 Circuit Court Judge Robert H. Smith affirmed the action of

the Personnel Board both denying the appeal and affirming the increased penalty.

CITY COUNCIL OF THE CITY OF MOBILE v. PERSONNEL BOARD (Case No. CV-08-901870) The issue in this litigation was whether the City Council City of Mobile, the Appointing

Authority for the position of City Clerk, could determine the City Clerk’s salary. The issue turned

on construction of Personnel Board Rule 5.2(b) which provides that a promoted employee shall

receive not less than two steps, or a 10% pay increase, up to the maximum established for the

class, at the discretion of the Appointing Authority. The matter was settled between the parties

and the case was dismissed without judicial resolution.

CITY OF MOBILE UNITED PUBLIC SERVICE WORKERS, INC., (Case No. CV-2011-000484) This litigation concerns the position of Public Service Supervisor I in the dredge division

of the Public Works Department. The matter has been briefed and is awaiting decision. The

plaintiff, an association of public service workers, complained that the promotional examination

used to fill the position of Public Service Supervisor I was a ‘ruse’ designed to fill the position

with an individual currently serving in the position in an acting capacity. The Personnel Board

denied the allegation and hearing was held before the Circuit Court. Board also moved to

dismiss the complaint because the plaintiff association lacks standing to pursue the action. On

February 27, 2012 the Circuit Court entered an order dismissing the complaint without

prejudice.

AMENDMENTS TO THE RULES A Public hearing was held on August 2, 2011, to consider a proposed amendment to

Personnel Board Rule 3.7, Military Leave. The proposed amendment was approved on that

date by adding the underlined portion so Rule 3.7, Military Leave, now reads as follows:

MILITARY LEAVE. 3.7 An employee who is an active member of the Alabama National Guard, naval militia, the Alabama state guard organized in lieu of the national guard, the National Disaster Medical System or any reserve component of the armed forces of the United States, shall be granted leave of absence with pay, as determined by the Appointing Authority and approved by the Personnel Board, for not more than 168 hours for those employees employed on a forty (40) hour work week, and 235 hours for those employees who work the fifty-six (56) hour work week during any calendar year for the purpose of engaging in field or coast defense, other training, or service ordered under the provisions of the National Defense Act, or of the federal laws governing the United States reserves. In addition thereto, such persons shall be entitled to be paid for no more than 168 hours for forty (40) hour per week employees or 235 hours for fifty-six (56) hour per week employees at any one time while called by the Governor to duty in the active service of the State. Any employee retained for a longer period of time in the active military service of the State of Alabama or in the armed forces of the United States referred to in the immediately preceding paragraph, shall be granted leave of absence without pay for a period not to exceed ninety (90) days beyond the date of his discharge from duty or from hospitalization continuing after such discharge for a period of not more than one (1) year. Nothing in this rule shall serve to deprive any employee returning from Military Leave of his right to resume his position or a position of like seniority, status and pay, upon presentation of proper proof of his entitlement thereto, and upon making written application with the Board within ninety (90) days from the date of his release from active duty, or from hospitalization continuing after such discharge for a period of not more than one (1) year, unless the employer’s circumstances have so changed as to make it impossible or unreasonable to do so. Upon resuming his position, his service in the Classified Service will be deemed continuous.

PROMOTIONS

There were 318 promotional appointments resulting from 146 promotional examinations

processed in 2011.

CLASSIFICATION AND PAY

The Personnel Board adopted specifications and salary grades for eight new classes in

2011. In addition, the Board approved amendments to the pay plan for already existing classes,

revisions to seven existing specifications, and abolished 139 specifications that were not being

used any longer. The City of Saraland granted a 2.5% cost of living increase of effective

February 12, 2011. The Mobile County Racing Commission granted a 5% cost of living

increase effective February 5, 2011. The Mobile Area Water and Sewer System granted their

employees a 5% cost of living increase effective October 8, 2011.

VETERANS

A total of 560 employees received paid leave to participate in military training during

2011. At the beginning of the calendar year 2011, twenty of our Merit System employees were

still on military leave and thirty-seven additional employees were granted leave during the year.

Thirty-seven employees safely returned to their job during the year, and eighteen employees

were still out as of December 31, 2011.

Also, extra points were awarded to 332 veterans who applied for open competitive

examinations during 2011.

INFORMATION SYSTEMS The Information Systems division has once again had a busy year in 2011. We continue

to maintain and improve our services to the department, to the agencies we serve, and to the

public. To that end, we have evaluated processes and revamped programs for improved

operations; implemented new software to increase productivity; replaced and installed new

hardware and equipment to provide new and better services.

Payroll processes are improving, jurisdiction errors are dropping, and payroll registers

are clearing more quickly due to the replacement of manual verification procedures by computer

programs, which do the job with increased speed and accuracy. We continue to add agencies

to our electronic payroll processing, which now includes: Mobile County, City of Mobile, City of

Prichard, City of Chickasaw, City of Saraland, City of Satsuma, Mobile Water, Mobile County

Health Department, Prichard Water and Sewer, Mobile Public Library, Mobile County Racing

Commission, and Mobile County Personnel Department. Other areas assisted by our

programming staff included efficiency rating process, accounts payable, unskilled laborer

process, and job analysis project.

The latter half of 2011 was spent in assisting in the implementation of our new on-line

application system. The Information Systems division was responsible for the transfer of a little

over 2 years’ worth of data for conversion into the new system. 5,102 applications, 645

employment registers and all supporting data was compiled and delivered for inclusion in the

new system. Final conversion and implementation will take place in early 2012, and we are

looking forward to working in the new system.

Our equipment upgrade program consists of replacing hardware on a 2/3 rotation. In

keeping with this plan, we are in the process of upgrading PCs and printers in all areas of the

department. We also installed a new audio/visual system in our Board Meeting room, consisting

of dual projectors and screens, to improve the presentation of information and to provide a wider

variety of locations for merit system employee training. Internally, we installed a SmartBoard

system in our Project Meeting room to enhance creative solutions to the challenges we meet.

As part of the on-line application system, we began installation of four kiosks in our lobby to

provide internet access for applicants who may otherwise be restricted from our online system.

A refresh of our website was overdue, and a tie-in with our online application system

gave us the perfect opportunity to move ahead on this project. A new layout and color scheme

gave us a fresh new look and easier access to the information we provide. The completion of a

major portion of the website changes will coincide with the implementation of the new on-line

application system in early 2012.

We look forward to 2012 as we prepare to meet the challenges presented by the many

projects begun in 2011.

TRAINING & RECRUITMENT

The Training and Recruitment area continues to strive to meet the challenges and needs

of the System’s workforce and remains focused on its primary goal. The goal is simply to

provide a platform for learning and development so employees may improve and advance in

their careers. To achieve this goal, it is important to offer employees opportunities to develop

new skills; to expand their working knowledge; and to broaden their abilities. In 2011, many of

the challenges of the past several years remain but efforts to deliver needed training continue.

While the primary purpose of this area is to provide training programs, department work

encompasses other areas, such as recruitment, typing test uploads and review of employee

development pay incentive packets. Summary information of these activities is also shared

below.

Training Activities In 2011, it was ever more important to center our efforts on the training needs of

employees and their jurisdictions. In doing so, training in the following areas was provided:

computer skills; employee development; safety training; skill programs; supervisory skills and

merit system orientation. Delivery formats encompassed scheduled training (instructor-led),

online (multiple and mini sessions); on-site training (instructor-led) and the introduction of a

group meeting format via the internet.

Other Activities The impact of a downturned economy affected other areas of the work. Recruitment

activities remain minimal due to fewer job openings throughout the system. The number of
