  • Preamble:Recognizingtheinherentvalueandwisdomofelderlypeople,whichtheycontributetothecommunity,thislawaimstopromoterespectandappreciationfortheparticipationoftheelderlyinthecommunity.Thislawendeavorstoempower,include,andprotectthischerishedpopulationofeverycommunity.Furthermore,consideringtheoftenvulnerablestatusoftheelderly,thecommunityindividuallyandcollectivelyshalltakeactiontopromotetherightsandwellbeingoftheelderly.Thislawpurportsto(1)protecttherightsandinterestsoftheelderly,and(2)providetheelderlywiththesupportnecessarytosustainthequalityoflifeanddignityfittingtotheirrespectedstatusincommunity.Thecommunityshallprotectandpromotethehealthandmentalwellbeingoftheelderly,andshallhavethedutytorepresentandaugmentthelawfulrightsandinterestsoftheelderly.Chapter1.DefinitionsArticle1.TheElderlyForpurposesofthislaw,theelderlyshallconstitutethosepersonsofanageestablishedbydomesticlawthatproperlyindicatesthechallengesandneedsofthoseofanadvancedageandconditionandprovidestothemtherightsandprotectionscontainedinthislaw.Article2.ExploitationForpurposesofthislaw,exploitationshallmeantheunlawfulobtainingoffinancialorothermaterialbenefitfromtheelderlyforone'sownbenefit.Article3.AbuseForpurposesofthislaw,abuseshallmeanthephysical,mental,ormaterialmaltreatmentofanelderlyperson,includingbutnotlimitedtothedeprivationoffoodormedication,beatings,oralassaultsandisolation.Article4.NeglectForpurposesofthislaw,neglectshallmeantheomissionofproperattention,supervision,orprovisionofnecessitiestoanelderlyperson,tosuchanextentthatharmresultsorislikelytoresult.Article5.FamilyForpurposesofthislaw,familyshallmeanagroupofpersonsconnectedtotheelderlypersonbyblood,byaffinity,orbylaw,especiallywithintwoorthreegenerations.Article6.ThirdPartyCaretakers

  • Forpurposesofthislaw,ThirdPartyCaretakersshallmeaninstitutionsandindividualsthathavebeengivenauthoritytoprovidedirectsupportorservicestotheelderly,includingbutnotlimitedtoallpublicorprivateinstitutionsorindividualswithlegalauthoritytoexercisecontrolovertheelderlyperson.Chapter2.RightsArticle7.RighttoDignityTheelderlyhavetheinherentrighttolife,dignity,andtheintegrityoftheirpersons,whichshallbeprotectedbylaw.Article8.RighttoFreedomfromAbuse,Neglect,andExploitationTheelderlyhavetherighttobefreefromabuse,neglect,andexploitation.Article9.RighttoFreedomfromDiscriminationTheelderlyhavetherighttobefreefromdiscrimination.Theyshallbetreatedequallyfavorably,regardlessofhealthstatusordisability,asotheragegroups.Therightshallbeappliedtoallaspectsoflife,including,butnotlimitedto,employment,accesstoeducation,accommodations,andotherfacilities.Article10.RighttoAdequateHealthcareTheelderlyhavetherighttoastandardoflivingadequateforthehealthandwellbeingofthemselves,includingaccesstoaffordablehealthcare.Adequateandaffordablehealthcareincludesmedication,immunizationandmedicalcaresuchasphysicaltherapy,surgery,nursing,checkups,intheeventofsickness,disability,widowhood,oldageorotherlackoflivelihoodincircumstancesbeyondtheircontrol.Article11.RighttoMaintenance 11.1.Theelderlyhavetherighttoaccessbasicnecessities,includingbutnotlimitedto,adequatenutritionandpotablewaternecessaryfortheirhealthandwellbeing.11.2.Theelderlyhavetherighttoaccessbasicamenitiesoflife,includingbutnotlimitedto,appropriateshelter,clothing,andsanitationasperprevailingsocietalstandards.Article12.RighttoMaterialAssistanceTheelderlyhavetherighttoobtainmaterialassistancefromtheState.Materialassistanceshallbeprovidedintheformoftangiblesupportnecessaryforthemaintenanceoftheelderlyattimeswhenanelderlypersoncannotsupporthimselforherselforrelyonsupportfromtheir

  • family,includingfundstosupportthemaintenanceandanelderlyperson,nutritionalfood,clothing,shelter,andmedicine.Article13.RighttoPropertyTheelderlyhavetherighttomaintaincontrolover,tocontinuemakingdecisionsabout,anddisposeofproperty,financialaffairs,andpersonaleffectsinaccordancetolaw.Article14.RighttoParticipationinSociety14.1.Theelderlyhavetherighttoparticipateineducationandtrainingprogramsaswellassocial,economic,cultural,andpoliticallife.14.2.Theelderlyhavetherighttopreferentialaccesstocareinhealthandtransportation.Article15.RighttoWork15.1.Theelderlyhavetherighttoworkbasedontheirabilities.15.2.Theelderlyhavetherighttojustcompensationandemploymentconditionssuitabletotheirneeds.Chapter3.DutiesArticle16.DutyofThirdPartyCaretakersThirdPartyCaretakersshallhavethedutytosupportanelderlypersonwhenauthorizedbythefamily,theStateorotherresponsiblepartiestosupporttheelderlyperson.Theauthorizedindividualsorserviceorganizationsshallfulfilltheircommitmentstotheirpatientsandtofulfillalldutiesinthislawandunderdomesticlawandkeeptheinterestsandwellbeingoftheelderlyinmindatalltimes.Article17.DutyoftheFamily17.1.Thefamilyofanelderlypersonshallhavethedutytocareforthehealthandmentalwellbeingoftheelderlyand,ingeneral,toprovidethenecessarysupporttomeettheirbasicneeds.17.2.Thefamilyshallhavethedutytofulfilltheresponsibilitiesprovidedin17.1,unlessthefamilylackssufficientmeanstodoso.Article18.DutyoftheState18.1.TheStateshallhavethedutytoprotectthehealthandmentalwellbeingoftheelderlywhenthefamilylackssufficientmeanstodoso.

  • 18.2.TheStateshallhavethedutytorepresentandprotectthelawfulrightsandinterestsoftheelderly.18.3.TheStateshallhavethedutytotakemeasurestocarryoutcultural,sportsandrecreationalactivitiesofapublicnaturethataresuitedtotheelderlyinordertoenrichtheirculturallife.18.4.TheStateshallhavethedutytopunishinaccordancewithlawthosewhoabuse,neglect,exploitordiscriminateagainsttheelderly.ThesedutiesmaybecarriedoutbytheDepartmentofJusticeortheagencysetoutinSection18.10.Thisdutyshallinclude,butnotbelimitedto:

    18.4.1.Enactingofcriminallawsprohibitingtheabuse,neglect,exploitationanddiscriminationoftheelderly,18.4.2.Designingandmanagingofaprogramofresponseandservicesfortheelderlywhohavebeen,orareallegedtobe,victimsofabuse,neglect,exploitation,ordiscrimination,18.4.3.Establishingafundtoaidlocalgovernmentagencies,provideragencies,orboth,tocarryoutthesefunctions,and,contingentonadequatefunding,tofundattorneysorlegalservicesprovideragenciesfortheprovisionoflegalassistancetotheelderly.

    18.5.TheStateshallhavethedutytotakenecessarymeasurestoprotectthehealthandwellbeingoftheelderly,providingadequateandaffordablehealthcare.18.6.TheStateshallhavethedutytotakemeasurestoensuretheelderlybasicnecessitiesoflifesuchasadequatenutritionandpotablewaternecessaryfortheirhealthandwellbeing.Thestateshallalsoberesponsibletotakemeasurestocreateconditionsconducivefortheelderlytohaveaccesstobasicamenitiesoflifeincludingbutnotlimitedtoappropriateshelter,clothing,andsanitationasperprevailingsocietalstandards.TheStateshallstrivetocreatesuchconditionsthroughcommittingstateresourcestowarddevelopingnecessaryinfrastructure,andprovisionofapteconomicassistancetotheelderly.18.7.TheStateshallhavethedutytoestablishnecessaryprogramsandregulationsthatprovidematerialassistancetotheelderlyandthosewhosupporttheelderly.Materialassistanceshallbeprovidedintheformoftangiblesupportnecessaryforthemaintenanceoftheelderlyattimeswhenanelderlypersoncannotsupporthimselforherselforrelyonsupportfromtheirfamily,includingbasicnecessitiesandamenitiesasprovidedby11.1and11.2.18.8.TheStateshallhavethedutytoprotecttherightoftheelderlytoworkbasedontheirabilitiesandtakenecessarymeasurestoensureadequateconditionsandjustcompensation.ThisdutymaybecarriedoutbytheDepartmentofLaborortheagencysetoutinSection18.10.Thisdutyshallinclude,butnotbelimitedto:

  • 18.8.1.Implementingapolicytoencourageemployersandthepublic,ingeneral,tounderstandtheimportanceofemployingtheelderly,tostabilizeemployment,andtofindwaysofmeetingproblemsarisingfromtheimpactofageonemployment,18.8.2.Promotingthedevelopmentandimprovementofoccupationalabilityoftheelderly,18.8.3.Regulatingandmonitoringthestateofworkingfacilitiesandotherconditionsinwhichtheelderlyareemployed,and 18.8.4.Promotingprojectsthatadministrativelyand/orfinanciallyassistemployersinmanagingelderlyemployees,suchas:counselingandadvising,vocationaltrainingandmaintainingfacilitiesnecessarytopromoteactiveinvolvementoftheelderlyintheworkforce.

    18.9.TheStateshallsupportandmonitorthirdpartycaretakers.ThisdutymaybecarriedoutbytheDepartmentofLaborortheagencysetoutinSection18.10.Thisdutyshallinclude,butnotbelimitedto:

    18.9.1.Requiringthirdpartycaretakerstoestablishcodesofconductandadequatelytrainandlicenseallcaretakers,18.9.2.Mandatingfrequentandcontinuingtrainingforallcaretakingprofessionalstokeeptheseimportantprofessionalsuptodateonthebestpracticestoensurethatthehealthandwellbeingoftheelderlyareprotected,18.9.3.Providingappropriatelegalstructuresandremediesinthecaseofthirdpartycaretakerabuseornegligence,18.9.4.Educatingthirdpartycaretakersandtheelderlyontheirrights,responsibilities,protectionsguaranteedunderthislawanddomesticlaw,and18.9.5.Continuouslysupervisingauthorizedorganizationsandprofessionalstoensurethattheelderlyareservedinaccordancewiththeirlegalrightsandprotectionsandappropriatelysanctionthosecaretakingprofessionalswhodonotadheretothisandallapplicablelawconcerningtheirpatientsorclients.

    18.10.TheStateshallestablishagovernmentbodyfortheprotectionoftheelderly.Thedepartmentshallhavetheresponsibilityto:

    (iii) establishing Federal guidelines and disseminating best practices for uniform datacollectionandreportingbyStates;(iv) working with States, the Department of Justice, and other Federal entities toannually collect,maintain,anddisseminatedata relating toelderabuse,neglect,andexploitation,totheextentpracticable;(v) establishing an information clearinghouse to collect, maintain, and disseminateinformationconcerningbestpracticesand resources for training, technicalassistance,and other activities to assist States and communities to carry out evidencebasedprogramstopreventandaddresselderabuse,neglect,andexploitation;(vi)conductingresearchrelatedtoelderabuse,neglect,andexploitation;(vii)providing technicalassistance toStatesandothereligibleentities thatprovideorfundtheprovisionoftheservices;(viii)carryingoutastudy todetermine thenational incidenceandprevalenceofelderabuse,neglect,andexploitationinallsettings;and(ix) promoting collaborative efforts and diminishing duplicative efforts in thedevelopmentandcarryingoutofelder justiceprogramsattheFederal,Stateand locallevels;
