The Mexican Law of Public Works and Related Services establishes the following:
“To perform any public work, it is required that the studies and designs, construction specifications, quality-related regulations, and the construction schedule be fully completed”.

However:
In reality, on many occassions public works bids are tendered without completed Construction Documents that can guarantee the correct execution of the project.

This situation causes a series of adverse results that affect the time and cost required to complete these projects. Among them:
● Authorization of additional resources to obtain the elements necessary for the completion of the project.
● Changes and modifications in the building process of the projects, with resulting imbalances in the contracts and cost increases.
● Differences and / or controversies bewteeen the parties , that may cause nonconformity and litigation.
● Release of funds falls behind regulatory allotment schedule.
● Start projects in the third quarter of the year.
● Cancellation of resources by the Secretariat of Public Finance and Credit.

Deficiency:
Currently no mechanism exists to assure that reserves for Construction Documents are set aside to guarantee the correct implementation of public projects.

Given the present situtation CMIC is promoting two proposals for the generation of reserves for Consruction Documents through:
● The 32 State governments (proposal 1)
● The Federal Government (proposal 2)
