Paragraph 3 of the second schedule thereof states that “ for the purposes of paragraph 1(a) of this schedule, the term "unprocessed” includes low value added activity such as sorting, drying, salting, filleting, deboning, freezing, chilling, or bulk packaging, where, except in the case of packaging, the value added does not exceed 5% of the total value of the supply.

The purpose of this practice note is therefore to inform the general public and officers of Uganda Revenue Authority that ALL imported rice is considered to be unprocessed agricultural produce for purposes of the Value Added Tax Act and therefore falls under the provisions of the second schedule which provides for exempt goods.

The Commissioner General of Uganda Revenue Authority hereby issues these practice notes under section 79 of the Value Added Tax Act, Cap 349 for the guidance of the taxpayers and the officers of Uganda Revenue Authority.

GUIDANCE ON THE TREATMENT OF VALUE ADDED TAX ON IMPORTED RICE

Paragraph 1(a) of the second schedule of the Value Added Tax Act. Cap 349 provides that, "the supply of unprocessed agricultural products and livestock is an exempt supply".

The Electricity (Application For Permit, Licence And TariffReview) Regulations, 2007.

(Under section 32, 75 and 119(2)(e) of the Electricity Act, 1999, Cap145).

IN EXERCISE of the powers conferred upon the Authority by section119(2)(e) of the Electricity Act 1999, Cap, 145 these Regulations aremade this 18th day of December, 2007.

PART I—PRELIMINARY

1. Title.These Regulations may be cited as the Electricity (Application forPermit, Licence and Tariff Review) Regulations, 2007.

2. Interpretation.In these Regulations, unless the context otherwise requires—

“Act” means the Electricity Act, 1999, Cap 145;

“applicant” means a person who has submitted an application for apermit, licence or tariff review;

“Authority” means the Electricity Regulatory Authority establishedby section 4 of the Act;

“formal presentation” means a written presentation by an interestedparty who has registered for a public hearing;

“Government agency” means any Government ministry,department, corporate body or individual authorised to act onbehalf of that body or institution;

“informal presentation” means an oral presentation by an interestedparty who has registered for a public hearing;

“interested party” means a person with an interest in or who isaffected by the subject matter of a public hearing;

“licence” means a licence issued under the Act;

“local language” means any indigenous language of Uganda or a dialectof an indigenous language;

“permit” means a permit issued under section 31 of the Act;

“tariff” means the approved electricity rates of charges payable byconsumers.

PART II—LICENSING PROCEDURE.

3. Notice of intended application.(1) A person who intends to establish a project for which a licence

is required under the Act shall submit to the Authority a notice ofintended application in Form A set out in the Schedule.

(2) The notice of intended application shall contain—

(a) information on the financial and legal status; and the technicaland industrial competence and experience of the intendedapplicant;

(b) a description of the project and the time plan for the executionof the project;

(c) a review of the use of land for the project and the relation ofthe project to local authorities;

(d) a review of public and private measures necessary to carry outthe project;

(e) information relating to permissions required from publicauthorities;

(f) a description of the impact of the project on electricity supply,socioeconomics, cultural heritage, the environment, naturalresources and wildlife; and

(g) any other relevant information required by the Authority.

(3) A notice of intended application shall be deemed to beincomplete where the information and requirements under subregulation (2)have not been submitted by the applicant.

(4) Where a notice of intended application is incomplete in terms ofsubregulation (3), the Authority shall inform the applicant in writingwithin thirty days after the date of submission of the notice.

(5) The Authority may, within thirty days after the date ofsubmission of the notice, request for additional information from theapplicant as the Authority may deem necessary.

4. Publication of notice of intended application.(1) The Authority shall, within thirty days after receipt of a

complete notice of intended application, cause the notice to be publishedin the Gazette and in at least one national newspaper of wide circulationin Uganda.

(2) The notice published under subregulation (1) shall—

(a) contain a summary of the notice of intended application; and

(b) inform members of the public that the notice may beinspected—

(i) at the offices of the Authority;

(ii) at a public office within the jurisdiction of the localgovernments affected by the project; or

(iii) at any other appropriate place as the Authority maydetermine.

(3) The Authority shall invite directly affected parties and affectedpublic agencies to make comments on the notice within a fixed period ofnot less than thirty days after the date of publication of the notice.

(4) The affected parties and affected public agencies shall submitcomments in writing and shall deliver them by person, post, fax or e-mail.

(5) The Authority shall confirm in writing, receipt of the commentsreceived under subregulation (4).

(6) The Authority shall forward to the intended applicant, thecomments from the affected parties and affected public agencies.

(7) The applicant shall respond to the comments of the affectedparties and public affected agencies within fifteen days after receipt ofthe comments.

5. Grant of permit(1) The Authority may, within thirty days after the expiration of the

notice, issue a permit to the intended applicant, taking into account theresponses and comments made by the applicant under regulation 4(7).

(2) A permit issued under subregulation (1) shall—

(a) be for a specific period and is subject to review at intervalsspecified in the permit;

(b) allow the intended applicant to carry out studies and any otheractivities that may be necessary to enable the intendedapplicant to prepare an application for a licence.

6. Renewal of permit(1) The Authority may renew a permit on such terms and conditions

as it may determine.

(2) A permit holder may, within ninety days before the expiry of thepermit, apply to the Authority, giving a statement of reasons for therenewal of the permit.

(3) The Authority may, on receipt of an application undersubregulation (2), renew the permit on such terms and conditions as theAuthority may determine.

7. Form of application for licence.(1) An application for a licence under the Act shall be submitted to

the Authority and shall contain—

(a) the legal and financial status of the applicant;

(b) a technical and economic description of the project;

(c) a description of how the project fits in with the existing andplanned power supply system;

(d) the planned time of commencement and completion of theconstruction of the project;

(e) a view of the project’s adaption to the landscape; includingnecessary maps and drawings;

(f) the impact of the project on public interests and possiblemitigation;

(g) the results of assessments, including environmental impactassessments and studies carried out and reports of thoseassessments and studies;

(h) impacts of the project on private interests, including theinterests of affected landowners and holders of other rights;and

(i) consents and permits required under any other law.

(2) An application for a licence under the Act shall be in Form Bset out in the Schedule.

(3) The application shall be accompanied by an evaluation by theapplicant of all the comments from affected parties and affected publicagencies received under regulation 4(6).

(4) The Authority shall not process an application unless all therequirements and information in the application form have been submitted.

(5) The Applicant shall, where the requirements and information inthe application are incomplete, inform the applicant within thirty days afterthe date of submission of the application, that the application is incomplete.

(6) The Authority may, within thirty days after receipt of theapplication, request for additional information from the applicant as theAuthority may deem necessary.

(7) The Authority shall, within thirty days after receipt of acomplete application, confirm in writing to the applicant, that theapplication is complete.

(8) The Authority—

(a) may require an applicant to make arrangements as may besatisfactory to the Authority for the execution of a bond orother form of security for the performance and observance ofthe conditions to which the licence may be subject; and

(b) shall require the applicant to take out the necessary insurancepolicies to protect against liabilities that may arise as a resultof activities done under the licence.

8. Publication of application for licence.(1) The Authority shall, within forty days after receipt of a

complete application for a licence, cause a notice of the application to bepublished in the Gazette and in at least one national newspaper of widecirculation in Uganda.

(2) The notice published under subregulation (1) shall—

(a) indicate receipt of the application for the licence;

(b) contain a description of the nature and location of theproposed undertaking;

(c) inform members of the public that the application may beinspected at the offices of the Authority or at any other placethat the Authority may determine;

(d) invite directly affected parties and public agencies in the areaaffected by the project to submit in writing, any objection andcomments on the project within thirty days after publication ofthe notice.

9. Licences through competitive process.(1) Where the Government or a government agency initiates a

project under the Act which is likely to benefit from public finances, theAuthority shall, through a fair, open and competitive process, inviteapplications for licences in accordance with the Public Procurement andDisposal of Public Assets Act, 2003.

(2) Where the Authority, in the public interest, identifies a need fora project under the Act, the Authority may invite applications and awardlicences through a fair, open and competitive process.

(3) Where a privately initiated project under section 29 of the Actis converted into a public-private partnership, the Authority may awarda licence through a fair, open and competitive process.

(4) Where two or more investors or developers have interest in the samesite or project to generate, sale or distribute electricity to the same communityor to the national grid and the required capacity or energy can be suppliedconveniently by only one investor or developer, the Authority may award apermit or licence through a fair, open and competitive process.

(5) A competitive process of issuing a licence shall not apply wherea private entity has, at its expense, carried out a feasibility study, unlessthe Authority determines that it is in the public interest to do so.

(6) Where a private entity has carried out a feasibility study, theAuthority shall refund the costs of the feasibility study and otherexpenses incurred by the private entity.

(7) Where the Authority uses the competitive process, Parts IV and Vof the Public Procurement and Disposal of Public Assets Act, 2003 or theprocurement rules of the funding agency involved in the project, shall apply.

10. Grant of licence.The Authority shall, in granting a licence, take into consideration thepolicies of the Government, matters provided for under the Act and anyother relevant law, the report of the public hearing and any other matterthat the Authority may consider to have a bearing on the operations ofthe applicant.

11. Refusal to grant licence.(1) The Authority shall, where it refuses to grant a licence, give the

applicant a statement of its reasons in writing for the refusal within thirtydays after the refusal.

(2) A person aggrieved by the refusal of the Authority to grant alicence may appeal to the Electricity Disputes Tribunal.

12. Transfer and assignment of licence.(1) A licensee who intends to transfer or assign a licence shall

submit an application in Form C set out in the Schedule.

(2) The Authority shall, before approving a transfer or assignmentof a licence, be satisfied that—

(a) the transferee or assignee has fulfilled the requirements forlicensing under the Act;

(b) the transferee or assignee has accepted and is willing toundertake the obligations under the licence; and

(c) the transferee or assignee has paid the transfer fee.

(3) The Authority shall, within thirty days after receipt of anapplication to transfer or assign a licence—

(a) publish the application in the Gazette or in at least onenewspaper of wide circulation in Uganda; and

(b) communicate its decision to the applicant.

PART III—COMPUTATION OF TARIFFS

13. Computation of tariffs.(1) The computation of tariffs in respect of a licence, shall be in

accordance with the tariff methodology, procedures of tariff calculationand terms of supply approved by the Authority in respect of the licenceapplied for and shall also be in accordance with the Electricity (TariffCode) Regulations, 2003.

(2) The tariff computation methodology shall form part of theconditions attached to the licence.

14. Tariff review.(1) A licensee may, if permitted in the licence to do so, apply for a

tariff review where any of the costs prescribed in subregulation (2) havesubstantively changed since the issuance of the licence or approval of theexisting tariffs.

(2) The costs referred to in subregulation (1) are—(a) power acquisition related costs;(b) operation and maintenance costs;(c) investment related costs;(d) returns on investment;(e) adjustment factors for system losses, inflation or foreign

exchange rates;

(f) tariff methodologies; and

(g) other costs approved by the Authority.

(3) There shall be two categories of tariff review namely—

(a) quarterly automatic tariff adjustments, covering fluctuation andforeign exchange fluctuations based on the agreed tariffmethodology rates incorporated in the licence; and

(b) other tariff adjustments resulting from the factors provided forin subregulation (2) or other justified cause.

15. Quarterly automatic tariff adjustments.(1) The Authority, upon receipt of an application for an automatic

tariff adjustment, scrutinise the application and verify the adjustmentswith the rates incorporated in the licence within fifteen days after receiptof the application.

(2) The Authority shall notify the applicant in writing where thereis a disagreement or need to clarify on the proposed adjustments and theapplicant shall respond in writing to clarify on the issues raised by theapplicant within two weeks after receipt of the notification.

(3) The Authority shall approve or reject the tariff adjustmentswithin thirty days after receipt of the application or the last clarificationor required information, and shall notify the applicant in writing.

16. Other tariff adjustments.(1) The Authority shall, upon receipt of an application for other tariff

adjustments resulting from changes in other factors or for other justifiedcause, scrutinise the application and shall, within thirty days after receipt ofthe application, acknowledge in writing receipt of the application.

(2) The Authority shall, where there is need to clarify or providemore information in the application, notify the applicant in writing, andthe applicant shall make the clarification or provide the requiredinformation within a period specified by the Authority.

(3) The Authority shall, within fifteen days after receipt of acomplete application, cause a notice of the application to be published inthe Gazette and in at least one newspaper of wide circulation in Uganda.

(4) The notice published under subregulation (3) shall include—

(a) a summary of the proposed tariffs;

(b) reasons for the changes;

(c) an invitation for stakeholders and the public to inspect theapplication within fifteen days after publication of the notice;and

(d) submit comments or objections to the application.

(5) The inspection by the public under subregulation (4) (d) of theapplication shall be subject to restrictions on access to confidentialinformation of the applicant.

(6) The Authority may approve, reject or modify the required tariffstaking into account—

(a) reasons and information submitted to justify changes in thetariffs;

(b) factors within the control of the applicant; and

(c) comments from stakeholders and the public.

PART IV—PUBLIC HEARINGS ON APPLICATIONS

17. Public hearing.(1) The Authority may conduct a public hearing in respect of any

application made under these Regulations.

(2) A public hearing shall promote transparency and goodgovernance in the decision making processes of the Authority andshall—

(a) provide an opportunity for stakeholders and the public toparticipate in the socio-economic, political and environmentalimpact assessment of the permit, licence or tariff reviewapplication;

(b) provide comments, questions and answers in respect ofapplications before the Authority; and

(c) provide information which may assist the Authority to arriveat a fair and just decision in respect of an application before it.

18. Notice of public hearing.(1) The Authority shall give notice of a public hearing—

(a) in at least one newspaper of wide circulation in Uganda;

(b) in a newspaper having general circulation in the area wherethe proposed subject of the application is to be located; or

(c) through any other form of mass media or communication.

(2) The notice of a public hearing shall be in Form D set out in theSchedule.

(3) The notice of a public hearing shall be published at least sevendays before the hearing.

(4) The Authority shall post the notice of public hearing at thedistrict or subcounty headquarters in which the subject or project of theapplication is to be located.

(5) The Authority may serve a notice of public hearing in Form Eset out in the Schedule, upon any person, body, institution ororganisation by ordinary mail, inviting any person, body, institution ororganisation to make a presentation at the hearing.

19. Procedure at public hearing.(1) A public hearing shall be held in public, in any place in Uganda.

(2) A public hearing shall be conducted in English and shall bepresided over by the Chairperson of the Authority or any other personappointed by the Authority for that purpose.

(3) The Authority shall, where it is practicable to do so, hold at leastone session of a public hearing in the community nearest to or within thearea in which the proposed project or subject matter is to be located.

(4) A public hearing shall not be a judicial or quasi-judicial hearingand as such, the rules of procedure in courts of laws shall not apply.

(5) The Authority shall apply the rules of natural justice and give afair hearing to any stakeholder and to any person wishing to give views,comments or submissions on the project or subject matter of the hearing.

(6) Where a public hearing is held in more than one session indifferent places, the Authority shall consider all submissions andpresentations as if they were made or presented at the same location andno person shall be allowed to reappear before the Authority to submit thesame facts or complaints.

(7) The Authority shall not entertain irrelevant, repetitive,embarrassing or abusive questions, presentations or answers at a publichearing.

(8) Subject to subregulation (7), the Authority may regulate theprocedure at a public hearing.

20. Presentation of application at public hearing.(1) The applicant shall orally present the application before a public

hearing, giving the economic and social benefits to the community or thepeople of Uganda in granting the application.

(2) The applicant shall be represented at a public hearing by anauthorised representative and any number of persons as the applicantmay consider appropriate to present the interests of the applicant andanswer questions that may be addressed to the applicant.

(3) The Authority shall provide a reasonable period of time to theapplicant to enable the applicant to effectively present their case.

21. Presentations by stakeholders and the public.(1) Any stakeholder or other interested person wishing to make a

formal presentation before a public hearing shall register their interestwith the Authority at least two days before the hearing, providing thename, address and affiliation of the stakeholder or interested party.

(2) There shall be two categories of presentations at a publichearing—

(a) formal presentations, given through a written statement orquestion submitted to the Authority at the time of registrationor at least two days before the hearing; and

(b) informal presentations which shall not be in writing.

(3) The written statement or question referred to in subregulation(2)(a) shall be in English.

(4) A person registered for a formal presentation shall be givensufficient time to develop his or her case at a public hearing and shallmake his or her presentation immediately after the initial presentation bythe applicant.

(5) A person registered for an informal presentation shall give hisor her presentation within a period not exceeding ten minutes and shallmake his or her presentation after persons registered for formalpresentations have made their presentations.

(6) A person registered for an informal presentation may give his orher presentation in a local language, except that the presenter shallprovide a person to translate the presentation into English, at thepresenter’s cost.

(7) Interested parties and stakeholders may present their views as agroup.

(8) The applicant may raise any question or questions to anystakeholder or interested person after the presentations of the interestedparties and stakeholders.

22. Reference to journals, studies and reports.(1) The Authority may, at a public hearing, accept written

references including journals, studies or reports as part of the submissionof the applicant, stakeholder or interested party.

(2) Where a written reference is provided under subregulation (1),the text shall not be read word for word but highlights may be given todevelop a point.

(3) Any journal, study or report submitted under subregulation (1)shall form part of the record of the proceedings of a public hearing.

23. Closing response by applicant.The applicant shall, before the close of a public hearing, be given anopportunity to—

(a) answer questions raised during the hearing;

(b) clarify on or correct any issue or matter raised during thehearing; and

(c) conclude his or her case on the application.

24. Overview of public hearing.At the conclusion of a public hearing, the Authority shall, for the benefit ofthe public, present an overview of the proceedings, including presentationsand responses made during the hearing, but may not make decisions.

25. Adjournment.(1) The Authority may, on its own motion or on the application of

the applicant, a stakeholder or interested person, adjourn a publichearing to a specified date.

(2) Where the hearing is adjourned for more than four weeks, theAuthority shall, at least two days before the date on which the hearing isto be resumed, communicate to the public through the media, the date,time and venue of the hearing.

26. Media coverage.(1) The Authority may permit the media to cover a public hearing

or part of a hearing, but interviews of the participants or members of theAuthority shall not be conducted at the public hearing during theproceedings of the hearing.

(2) During the recording of the proceedings, interruptions byjournalists shall not be allowed and the Authority may restrict therecording of all or any part of the hearing if the Authority finds that therecording may disrupt the hearing.

(3) Members of the press may, with the permission of theChairperson of the public hearing, ask any person making a presentationat the hearing to make any clarification on his or her presentation andsuch a question or request shall be short, clear and to the point.

27. Decision on application by Authority.The Authority shall make a decision on the application within areasonable period after the close of the hearing.

28. Report of public hearing.(1) The Authority shall, within a reasonable period after the close

of the hearing, make a full report of the public hearing which shallinclude—

(a) all the relevant views presented;

(b) factual findings; and

(c) the decision of the Authority on the application.

(2) A list of all persons, bodies, institutions and organisations thatmade contributions and presentations and all persons that attended thepublic hearing shall be attached to the report.

(3) The report of the public hearing shall be open for inspection atthe offices of the Authority during office hours and copies may be madeavailable to any person at a fee prescribed by the Authority.

(4) A public hearing shall not be re-opened after a report is issuedby the Authority.

Regulations, 2007.

(Under sections 82D, 82E, 82F, 95A and 128 of the Universities and OtherTertiary Institutions Act 2001, Act No. 7 of 2001)

IN EXERCISE of the powers conferred upon the National Council forHigher Education by sections 82D, 82E, 82F, 95A and 128 of theUniversities and Other Tertiary Institutions Act, 2001 and with theapproval of the Minister, these Regulations are made this 26th day ofFebruary, 2007.

PART I—PRELIMINARY

1. Title.These Regulations may be cited as the Universities and Other TertiaryInstitutions (Letters of Interim Authority for Private Universities andProvisional Licences for Private Other Degree Awarding Institutions)Regulations, 2007.

2. Interpretation.In these Regulations, unless the context otherwise requires—

“Act” means the Universities and Other Tertiary Institutions Act,2001;

“currency point” has the value given to it in Schedule 1;

“National Council” means the National Council for HigherEducation established by section 4 of the Act;

“private other degree awarding institution” means a privateinstitution or private centre of higher learning other than auniversity, one of the objects of which is the provision of postsecondary education, offering courses of study leading to theaward of certificates, diplomas and degrees and conductingresearch and publishing the results of the research;

“promoter of a private university” means a person intending orproposing to establish and operate a private university inUganda.

PART II—LETTER OF INTERIM AUTHORITY

3. Application for letter of interim authority.(1) A promoter of a private university shall apply to the National

Council for a letter of interim authority to establish and operate a privateuniversity.

(2) An application for a letter of interim authority shall be in Form7 set out in Schedule 2 and shall be accompanied by the prescribed fee.

4. Issue of letter of interim authority.(1) The National Council may, on being satisfied that the

requirements specified in regulation 3 are complied with, issue a letterof interim authority to a promoter of a private university.

(2) A letter of interim authority shall be valid for a period of up tothree years during which the holder of the authority shall not admitstudents into the university but shall—

(a) mobilise funds;

(b) acquire requisite infrastructure and academic facilities;

(c) organise academic and administrative human infrastructure; and

(d) do any other thing that may further the development of theproposed university to maturity.

(3) The National Council shall, within the three year periodprescribed under subregulation (2), monitor the private universityproject to establish its viability for grant of a provisional licence.

5. Refusal to issue letter of interim authority.The National Council may reject an application for a letter of interimauthority where it is satisfied that the promoter of the proposed privateuniversity is not likely to procure the academic, physical or otherresources necessary for the establishment and operation of theuniversity.

6. Suspension of letter of interim authority. (1) The National Council may suspend a letter of interim authority

issued to a promoter of a private university where—

(a) if after two years from the issuance of the letter of interimauthority, no substantial progress has been made to developthe private university project;

(b) the promoter of a private university is unable to meet thestandards set for operation as a private university;

(c) the promoter of a private university does not fulfill the purposefor which the letter of interim authority was granted;

(d) the promoter of a private university is in breach of the Act;

(e) the National Council, for any other reason deems it fit tosuspend the letter of interim authority.

(2) Where the National Council intends to suspend a letter ofinterim authority, the National Council shall notify the promoter of theproposed private university of its intention in writing and shall publishthe notice in the Gazette and in print media or newspapers.

(3) A notice of intention to suspend a letter of interim authorityshall be in Form 8 set out in Schedule 2.

(4) Where the National Council notifies a promoter of a privateuniversity of its intention to suspend a letter of interim authority, thepromoter of the proposed private university may, within two monthsafter the date of publication of the notice of intention to suspend theletter of interim authority, show cause why the letter of interim authorityshould not be suspended.

(5) The National Council shall suspend a letter of interim authorityfor six months where—

(a) the promoter of the proposed private university does notchallenge the suspension;or

(b) the National Council is not satisfied with the explanation givenby the Promoter of the concerned private university.

(6) Where the National Council suspends the letter of interimauthority, the promoter of the private university shall, during the periodof suspension, address the concerns which led to the suspension.

(7) A promoter of a private university who operates the universitywhile the letter of interim authority is suspended commits an offence andis liable on conviction to a fine not exceeding one hundred currencypoints.

7. Revocation of letter of interim authority.(1) The National Council shall revoke a letter of interim authority

within six months after its suspension if the promoter of the proposedprivate university has not substantially addressed the matters which ledto the suspension of the letter of interim authority.

(2) The National Council shall before it revokes a letter of interimauthority notify the promoter in writing of the proposed privateuniversity of the intention to revoke its letter of interim authority, andshall publish the notice in the Gazette and in print media or newspapers.

(3) A notice of intention to revoke a letter of interim authority shallbe in Form 9 set out in Schedule 2.

PART III—ESTABLISHMENT AND OPERATION OF PRIVATE OTHER DEGREEAWARDING INSTITUTION

8. Application for provisional licence. (1) A person who proposes to establish and operate a Private Other

Degree Awarding Institution shall apply to the National Council for aprovisional licence.

(2) An application for a provisional licence shall be in Form 10 setout in Schedule 2, and shall be accompanied by the prescribed fee.

9. Verification of application. The National Council shall, on receipt of an application made underregulation 8, organise a meeting or series of meetings with the applicantto verify the resources and information given in the application.

10. Issue of provisional licence. (1) The National Council may issue a provisional licence to the

applicant to establish and operate a Private Other Degree AwardingInstitution where it is satisfied that—

(a) the resources declared are available or are likely to beestablished;

(b) the applicant is following realistic plans to achieve the objectsof the Private Other Degree Awarding Institution;

(c) the Private Other Degree Awarding Institution is likely to attainand maintain the academic standards prescribed by theNational Council; and

(d) the establishment of the Private Other Degree Awardinginstitution is in the interest of the public in relation to highereducation.

(2) The National Council shall publish the name and particulars ofthe Private Other Degree Awarding Institution issued with a provisionallicence in the Gazette and in print media or newspaper.

(3) A provisional licence shall be valid for at least three years fromthe date of publication of the name of the institution in the Gazette,within which period the National Council shall monitor the institution toestablish its viability for accreditation.

(4) A person who operates a Private Other Degree AwardingInstitution without a provisional licence commits an offence and is liableon conviction to a fine not exceeding one hundred currency points.

11. Refusal to grant provisional licence.The National Council may reject an application for a provisional licencewhere the National Council is satisfied that the proposed institution is notlikely to procure the academic, physical or other resources necessary for theestablishment and operation of a Private Other Degree Awarding Institution.

12. Suspension of provisional licence. (1) The National Council may suspend a provisional licence where—

(a) if after two years from the issuance of the provisional licence,no substantial progress is made to establish the institution;

(b) the Private Other Degree Awarding Institution is unable to meetthe standards prescribed the National Council;

(c) the Private Other Degree Awarding Institution does not fulfillthe purposes for which the provisional licence is issued;

(d) the Private Other Degree Awarding Institution is in breach ofthe Act;

(e) the National Council, for any other reason deems it fit tosuspend the provisional licence.

The Universities and Other Tertiary Institutions (Equating of Degrees,Diplomas and Certificates) Regulations, 2007.

(Under sections 5(i),5(k) and 128 of the Universities and Other TertiaryInstitutions Act, 2001, Act No. 7 of 2001)

IN EXERCISE of the powers conferred upon the National Council forHigher Education by sections 5(i), 5(k) and 128 of the Universities andOther Tertiary Institutions Act, 2001, and with the approval of theMinister, these Regulations are made this 28th day of February, 2007.

1. Title.These Regulations may be cited as the Universities and Other TertiaryInstitutions (Equating of Degrees, Diplomas and Certificates)Regulations, 2007.

2. Interpretation. In these Regulations, unless the context otherwise requires—

“Act” means the Universities and Other Tertiary Institutions Act, 2001;

“currency point” has the value given to it in Schedule 1;

“National Council” means the National Council for HigherEducation established by section 4 of the Act.

3. Application for equating of degree, diploma or certificate.An application to the National Council for equating of a degree, diplomaor certificate under sections 5(i) and 5(k) of the Act shall be in the formset out in Schedule 2.

4. Guidelines for equating of degree, diploma or certificate.The National Council shall, in determining the equivalence of anacademic or professional qualification of a degree, diploma or certificateobtained in or outside Uganda, comply with the guidelines prescribed inParts I, II and III respectively of Schedule 3.

5. Council to issue only one certificate.(1) The National Council shall issue only one certificate of

equivalence for a diploma, certificate or degree respectively, in respectof each successful applicant.

(2) A person who has previously been issued with a certificate ofequivalence for a diploma, certificate or degree and who applies foranother certificate of equivalence for a diploma, certificate or degreebased on different qualifications from those for which the first certificatewas issued, shall submit, together with the application, the firstcertificate of equivalence issued to him or her.

6. Fees for equating of qualifications.An application to the National Council for equating of qualifications

shall be accompanied by the fee prescribed in Schedule 4.

7. Revocation and savings.(1) The Universities and Other Tertiary Institutions (Equating of

Degrees, Diplomas and Certificates) Regulations, 2005 are revoked.

(2) Notwithstanding the revocation under subregulation (1), anyaction, appointment or programme made under the revoked regulationsshall continue in force as if made under these Regulations.

GUIDELINES FOR EQUATING OF DEGREE QUALIFICATIONS(Bachelor’s, Master’s and Doctoral Degree)

1. The institution must be accredited or recognised by the National Councilor the accrediting agency in the country of origin.

2. Minimum entry requirements for Uganda Bachelor’s degree—

(a) Direct entry from schools – Uganda Certificate of Education (UCE)with at least 5 credits and at least two principal passes at UgandaAdvanced Certificate of Education (UACE) or its equivalentobtained at the same sitting;

(b) Mature age entry – aged 25 years and above and has passed matureage entry examinations with 50% mark and above. The mature ageentry examinations have to be accredited by the National Council;

(c) Diploma entry – obtained at credit/distinction level in the relevantfield from a recognised institution;

(d) Bridging/access/remedial courses for students who have done theirsecondary education outside Uganda. The National Council mustaccredit the courses.

MINIMUM ENTRY REQUIREMENTS FOR ADMISSION TO AUNIVERSITY OR OTHER TERTIARY INSTITUTION

PART I—BACHELOR’S DEGREE PROGRAMME

The minimum entry requirements for admission to a bachelor’s degreeprogramme are—

(a) For direct entry—

(i) Uganda Certificate of Education (UCE); and

(ii) At least 2 principal passes at Uganda Advanced Certificate ofEducation (UACE) obtained at the same sitting or its equivalent.

(b) For mature age entry—

(i) 25 years of age and above; and
