Tennessee EconomicRecovery Group Subcommittee ReportsThe Tennessee Chamber has served on Governor Lee’s Coronavirus Task Force and Economic Recovery Group (ERG). In April, the Chamber was tasked by Governor Lee and ERG Director, Mark Ezell to organize 11 ERG Subcommittees for the purpose of providing direct recommenda-tions to the ERG. On April 23rd, all 11 subcommittees submitted reports in a consol-idated 85 page document to Governor Lee and Director Ezell.

The legislative trifecta of 2020 came to a close in August, providing the grand finale to nothing short of a historical year for busi-ness in Tennessee. The regular 2020 session kicked off as usual in January under the leadership of Lt. Governor Randy McNally and newly elected Speaker of the House, Cameron Sexton, but abruptly came to a halt in mid-March when the General Assembly recessed due to the growing presence of COVID-19 in Tennessee. In the days leading up to the recess, members approved a bare-bones version of Governor Bill Lee’s originally proposed budget, stripping nearly all increased funding. Despite the unexpected abbreviated session, the Tennessee Chamber was able to make significant strides for the Tennessee business community.

Prior to the General Assembly’s return in June, disagreement between the upper and lower chambers created uncertainty regard-ing the scope of legislation that would be considered when members returned as well as the level of public access that would be available for legislative proceedings. In turn, many bills were shelved for the year despite forward motion by the House due to the Senate’s decision to only hear COVID-19 and time-sensitive legislation. In addition, the Senate greatly restricted public access to legislative proceedings by limiting committee hearings and floor sessions to members, staff, and press. Despite these challenges, the Chamber was able to advance additional legislative priorities.

The General Assembly revisited the state’s budget in June, resulting in approximately $1.5 billion in total budget cuts. A compro-mise between the two houses proposals manifested itself in a $25 million expanded sales tax holiday and $210.5 million for grants to city and county local governments. The funds are unrestricted and will be distributed by population, with a maximum award of $10 million per entity. The budget additionally provides for a $50 million employee buyout program to be implemented by Gover-nor Bill Lee as well as authorization to shift dollars from numerous state agency funds if needed.

Perhaps most important to the business community was the General Assembly’s enactment of liability protection for unsubstan-tiated claims related to COVID-19. In early August, Governor Bill Lee called a special session to take up three administration bills, including COVID-19 liability protection. While this bill took a different approach than the regular session bill, it achieved the liability protection so desperately needed by the Tennessee business community. The Tennessee Chamber appreciates the hard work of Governor Bill Lee and his team, Senate and House leadership, and all of you who participated in the grass roots efforts culminating in the enactment of Public Chapter 1 of the Second Extraordinary session.

2020 has been nothing short of extraordinary. In addition to legislative efforts, the Chamber has continued its regulatory advocacy in several areas including worker’s compensation, unemployment benefits, environmental policy, tax policy, human resources and more. The Chamber continues to represent the business community as a member of Governor Lee’s Economic Recovery Task Force and maintains conversation with key policy leaders on behalf of the Tennessee business community. We thank you for your continued partnership and look forward to representing you in the months and years ahead.

Despite the unexpected and abrupt halt in the session during the week of March 16, the Tennessee

Chamber made significant headway in advocacy efforts, advancing all of its 2020 legislative agenda

(eligible for consideration) and defeating a number of anti-business bills. Here is short summary of

our successes. (SEE LISTING ON PAGE 9.)

CHAMBER COVID-19 RELIEF INITIATIVES: Headlining the Chamber’s revised 2020 legislative agenda was critical legislation to provide liability protections to businesses, schools, hospitals, and other entities who may be subject to frivolous COVID-19 related lawsuits. Beginning in April, the Chamber led efforts to enact liability protection policies as it became clearer that unwarrant-ed actions may be taken against members of the Tennessee business community. Leading up to the June legislative session, the Chamber organized one of the broadest coalitions the state has seen to tackle the issue of safe harbor protections. While legislation did not pass during the legislature’s June session, Governor Bill Lee and legislative leaders, called legislative members back to Nashville for a special session. The move came following the strong urging and effort of the Chamber and advocacy from Chamber members. The call by Governor Bill Lee, Lieutenant Governor Randy McNally and House Speaker Cameron Sexton was unprecedented and showed their support and commitment to business recovery. Nearly 75% of House and Senate members voted to pass liability protections and on August 18th, Governor Bill Lee signed the legislation into law, creating Public Chapter 1 of Second Extraordi-nary Session.

Throughout the pandemic, a myriad of states have added or attempted to create a rebuttable presumption for access to Worker’s Compensation benefits for those who believe they contracted the virus during work activities or those whose employment requires them to work outside of their home. Efforts to add COVID-19 as a presumption under Tennessee’s Worker’s Compensation laws were attempted during the August special session and were handily de-feated as a result of efforts by the Chamber.

TAX POLICY: Beginning in October of 2020, Public Chapter 646 requires marketplace facilitators to collect and remit sales tax on behalf of third party marketplace sellers. This will ensure that significant previously uncollected sales tax revenue will now be remitted to the state of Tennessee, leveling the playing field for businesses. It is likely already having a significant impact on voluntary compliance as sales and use collections in Tennessee in the catalogue and internet category show significant increase. Public Chapter 759 is the result of legislation from the June legislative session which lowers the tax collection threshold for marketplace facilitators on remote sellers from $500,000 to $100,000. Combined, all marketplace facilitator related legislation from all 2020 sessions is projected to produce nearly $200 million in new revenues.

RIGHT TO WORK: A constitutional resolution (Senate Joint Resolution 648) to allow citizens to vote to embed the right-to-work into the state constitution was passed on June 17th and signed by both speakers. The 112th General Assembly will now be required to adopt an identical resolution before the constitutional initiative is placed on Tennessee ballots in 2022.

ENVIRONMENT & ENERGY: The Chamber shepherded the enactment of Public Chapter 712 which clarifies the regulatory status of soil, an issue that can have a significant impact on urban development. Because of the imminent creation of a regulatory scheme by the Department of Environment and Conservation, the Senate recognized the urgency of this issue and advanced the bill.

The Chamber played a significant role in ensuring that an attempt to ban the use of single-use plastic and paper bags by retail, grocery, and food service establishments failed to become law. Instead, lawmakers voted to discuss the issue in more detail in the form of a summer study. At the time of this publication, no summer study has yet been scheduled.

Public Chapter 591, which ensures that local governments cannot prohibit the use of existing energy sources, be-came law and mitigates efforts in states like California where local governments have sought to ban the connection of natural gas.

ANTI-BUSINESS LEGISLATION: The Tennessee Chamber worked to either amend or defeat a number of other mandate bills that, if enacted, would have significantly impacted businesses in Tennessee. These bills include several employer mandates that would have increased cost and regulation in a number of areas. You have proven that a strong business climate is important to you. What do you believe is one of the Tennessee General Assembly’s most pro-business accomplishments during your service?

Although the two sales tax clarification bill of 2019 were significant, they have been overshadowed by the COVID Liability Act.

Please describe the business community within your district.

A good portion of my district area is agriculture, but small businesses of every kind certainly make up the majority. Many large manufacturing companies thrive there as well.

What do you believe the economic development/pro business priorities of the next General Assembly should be?

We should maintain a unique sensitivity to how the COVID-19 mandates and restrictions have negatively impacted small busi-nesses especially. Maintaining pro-business policies to encourage new opportunities to replace establishments that close for good is imperative.

What do you believe the legislature’s role in interacting with the business community be?

We should always be attentive to the concerns and complaints of the business community in order to actively pursue an environ-ment and atmosphere that facilitates entrepreneurship and business expansion across the state, both in urban and rural areas.

The Champion of Commerce award is the Tennessee Chamber of

Commerce & Industry’s most prestigious state legislator award. The

process for selecting award recipients is extremely deliberative and is

based heavily on recorded key votes with final oversight from a

committee of Tennessee business leaders. Champions of Commerce

are a rare distinction and overall are based on exemplary voting re-

cords and other applicable factors. Strong scores represent extraordi-

nary support for business and manufacturing in the Volunteer State.



By rolling back privilege taxes on fifteen of the twenty-two licensed professions in Tennessee is one more demonstration that our State values work and honors that right of Tennesseans.


The business community of TNHD26 is a terrific mix of small, locally owned businesses, employees of larger corporate entities as well as individuals working in the public sector. The business community in TNHD26 is a terrific sampling that reflects the need to have public policy that serves workers as well as employers.


Currently, our focus has to be to serve as diligent stewards of the funds Tennesseans entrust to be spent on essential services. The budgets of every Tennessean is strained and damaged by the response to COVID. While Tennesseans sacrifice, the plans and actions of the General Assembly must mirror the same.

I think our response that provides protection to businesses from frivolous litigation regarding covid-19 is one of the most important pieces of legislation that we have done during the 111th General Assembly.


The business community within the 46th House District is very strong and diverse. We have several manufacturing businesses ranging from automotive to an international company that manufactures a variety of wheelchairs and other personal mobility devices. We have a large number of distribution centers including Amazon. Also, the corporate headquarters for Cracker Barrel is located in Lebanon. We have a private university and a very strong small business community as well.

I believe that the successful effort to keep our state income tax-free has had enormous pro-business implications. It attracts not only large corporations to move here but also allows small and homegrown businesses to thrive -- and encourages them to expand. Secondarily, I think our regulatory environment attracts entrepreneurs and talent from across the globe. Businesses know that they will have a friendly, consistent environment here and that encourages growth and investment.


The business community in my community is quite diverse. They are also very engaged and active. Representing Oak Ridge means much of the community centers around science and technology but that is far from the focus. My district is a mix of subur-ban and rural. It has small and large businesses of many different varieties and I try to serve their interests in any way I can.


The priority of the next General Assembly will be to find ways to assist businesses in recovering from the economic hardships of the pandemic. The virus has created a new normal and business will need assistance in navigating it. The best thing we can do as a state is continue to be good fiscal stewards of the taxpayer’s money. Despite the pandemic, the state has significant resources which have been amplified by federal spending. We need to make sure all those dollars go towards protecting our business community from the effects of the virus as much as possible. Owning and operating a business is tough enough under normal conditions. The pandemic has added an extra burden and we must do what we can to relieve it.


The legislature’s role should be first to do no harm. Our businesses are the bedrock of our economic growth. Government’s first job is to get out of the way of our people and allow them to reach their full potential. After being good stewards of taxpayer money and creating a positive regulatory environment, our job as legislators is to be active listeners and advocates. Businesses large and small often run into problems with their interactions with government. Our job is to listen to their concerns and intervene if necessary. Often that involves speaking to officials at a department. Sometimes it requires proposing legislation. But our primary function should be as listener and advocate.

The worker’s compensation reform bill enacted by our General Assembly seven years ago is probably the most important pro-busi-ness legislation passed during my Senate tenure. It was a significant step toward improving our business climate and growing jobs, bringing clarity, efficiency and fairness to our worker’s compensation system. As a result, our state consistently ranks in the top three states in the nation with the best business climate, attracting record new jobs and capital investment. Our recently-passed Tennessee COVID-19 Recovery Act is a very close second and will have a significant impact on Tennessee businesses struggling to recover during these economically difficult times. Providing reasonable liability protections against friv-olous COVID-19 lawsuits on businesses, proprietors, health care providers and other entities so they can resume operations with legal clarity and actively participate in Tennessee’s economic recovery is vital to our state’s economic strength. I was pleased to sponsor it on behalf of Governor Lee.


Senate District 9 is comprised of a wide variety of businesses, with heavy emphasis on manufacturing. We have a strong auto supply and appliance industries, which employ many local workers.


The first priority of the 112th General Assembly is continued economic recovery from the effects of COVID-19. We need to ensure a stable environment for Tennessee businesses as our economy strengthens. We must also continue efforts to roll back job-killing regulations and burdensome mandates that stifle innovation and increase the cost of doing business in a very competi-tive global market. This will help grow Tennessee businesses and attract new ones.


We should always reach out to our business community and listen to their concerns about how we can improve our state’s business climate. Tennessee is competing at a high level, as evidenced by many new jobs coming to our state over the past several years. But we can always do better and must continually improve our competitive position.

2020 TENNESSEE CHAMBER & MANUFACTURINGNON-LEGISLATIVE ACCOMPLISHMENTS

The pandemic has brought on challenges that the business community never thought it would have to face. The Tennessee Cham-ber of Commerce & Industry quickly pivoted to meet members’ needs and assist and support businesses during this unprecedent-ed time. The Chamber modified operation strategies and produced timely communications with the most relevant information forthe Tennessee business community. Along with communicating constantly evolving information, the Chamber promptly created a COVID-19 resource page which housed the latest guidance and information. Like all businesses working hard and trying to navigate the pandemic, the Chamber worked overtime to ensure members were up to date with the latest crucial information.

The Tennessee Chamber provided representation of the business community as a member of Governor Lee’s influential Economic Recovery Group (ERG). ERG is responsible for providing feedback to Governor Lee and his team regarding actions taken by the administration.

TN Creators RespondThe Chamber launched TN Creators Respond to help create a pipeline for much needed medical equipment and personal protec-tive equipment to Tennessee’s hospitals and healthcare providers. This program was created to help connect manufacturers with the capability of producing personal protective equipment and needed medical supplies with hospital systems and medical centers in need. At the beginning of the pandemic, there was a nationwide shortage of testing, N95 masks, and other tools healthcare pro-viders needed to protect themselves and their patients against the spread of COVID-19; TN Creators Respond provided a manufac-turing pipeline that fills the gap between producers and healthcare providers. > > >

A SEASONOF MEASURED SUCCESS

Economic Recovery Group SubcommitteesIn April, the Tennessee Chamber of Commerce and other business trade associations put together eleven subcommittee groups to help determine best reopening practices for specific industries. These subcommittees were led by some of Tennessee’s most prom-inent business and industry leaders from across the Volunteer State, representing a diverse group of individuals and companies large and small. Hundreds of hours of collaborative work was put into industry-specific recommendations and sent to the gov-ernor and was used as guidance for best practices for reopening for Governor Lee’s Tennessee Pledge. The subcommittees were divided into agriculture, community outreach, construction/infrastructure/transportation, essential businesses/critical infrastruc-ture, healthcare, local government, manufacturing, retail, small business, and staffing/headquarters.

Unemployment Insurance Entering the January 2020 legislative session, the state’s unemployment trust fund was nearing record solvency levels with a bal- ance of nearly $1.3 billion. According to the Tax Foundation, Tennessee’s fund solvency is ranked 19th in the U.S., behind neigh- boring states like North Carolina and Arkansas. Since March, the unemployment rate has decreased by 7% from 15.5% to 8.5%. Tennessee has paid 264,202 claims for the year, which the state has paid portions of through the Coronavirus Relief Fund. During the June legislative session, the legislature passed the Tennessee Pregnant Workers Act (SB2520/HB2708). This piece of legislation carried an amendment to clarify that an employer would not be penalized with higher unemployment insurance pre-miums due to layoffs that are no fault of their own during the pandemic, saving employers a significant amount of money. Under Governor Lee’s and the Financial Stimulus Accountability Group (FSAG) leadership, Tennessee’s business have saved millions of dollars. Gover- nor Lee and the FSAG used Coronavirus Relief Fund dollars to backfill our unemployment trust fund to protect the unemployed and businesses during the pandemic. If it were not for the quick action taken to add Coronavirus Relief Funds to the unemployment trust fund, the state’s employers would have increased tax premiums by at least 300% in 2021. This would have been an $837 million unemployment tax raise on businesses with elevated premiums for several years.

Workers Compensation Since the 2013 reforms, Tennessee’s Workers’ Compensation program has been a strong business attraction to our great state. During the August special session, a proposed workers’ compensation presumption bill was introduced. This proposed legislation would have allowed any employee who worked at a business deemed essential to be covered by workers’ compensation if they contracted COVID-19. The bill was very broad; it covered all essential employees. In Tennessee, essential businesses include manufacturers, construction, banking, retail, grocery, fuel and convenience, and many other various indus tries, whereas in other states, essential employee is defined only with healthcare and first responders. This bill was opposed by the Tennessee Chamber and was not advanced in the Senate and House Chambers. The Tennessee Chamber will continue to monitor workers’ compensa-tion legislation next session as we believe similar legislation will be filed again.
