Substance and Purpose of the Proposed Amendments The Proposed Amendments are part of the CSA’s initiative toenhance investor protection by addressing issues of financialexploitation and diminished mental capacity among older andvulnerable clients.

The Proposed Amendments will require registrants to take rea-sonable steps to obtain the name and contact information of atrusted contact person, as well as the client’s written consent tocontact the trusted contact person in prescribed circumstances.The trusted contact person is intended to be a resource for reg-istrants to assist in protecting their clients against possible fi-nancial exploitation or if there are concerns about a client’smental capacity. The Proposed Amendments will not preventregistrants from opening and maintaining an account if a clientrefuses or fails to identify a trusted contact person as long as theregistrant takes reasonable steps to obtain the information.

We believe that the Proposed Amendments provide an appropri-ate balance between a client’s autonomy and investor protec-tion, given that registered firms must have a reasonable belief offinancial exploitation of a vulnerable client or lack of mental ca-pacity of a client before placing a temporary hold. We also be-lieve that the Proposed Amendments clarify how firms mustproceed if they do place a temporary hold in such circum-stances, and that these are steps they must
