Approve the Work Plan 2007-2008 of the Investment Council 2 Decrees Signed “On Measures to Improve Inspections Procedures of Economic Entities” Purpose: This decree strengthens and specifies the approved law “On the Procedure for Conducting Inspections of Entrepreneurs” and has the objective of not only streamlining inspections procedures but also to increase the transparency of the process Status: A working committee was established to determine how to implement the decree and ensure a transparent inspection procedure. The committee took the decision to exclude 5 agencies from the list of the State Controlling Bodies and exclude 7 duplicating functions. Draft regulations on the Order of Inspections Procedures of Economic Entities were also developed. “On Measures for the Optimisation of Regulatory Permits” Purpose: Currently, no state systems track administrative documents and ensure compliance with national legislation. The normative foundation for regulating entrepreneurial activities should therefore be reconsidered and improved. Status: Prime Minister Atambaev mentioned that the government intends to analyse all government and agency decisions regulating entrepreneurial activities on the basis of the Regulatory Impact Analysis system and the related “Guillotine Principle”. The working group, with the participation of the Ministry of Economic Development and Trade, the USAID “Business Environment Improvement Project” and the Secretariat of the Investment Council, developed Drafts of Regulatory Impact Analysis and a Draft Law “On Optimizing the Normative Base for Regulating Entrepreneurial Activities”. At present, the MEDT distributed the mentioned documents to all stakeholders for comments and suggestions. 1 Draft Decree Proposed “On Developing State Policy in the Foreign Trade Sector and Measures to Improve Import- Export Procedures” Purpose: The State is responsible for the safety of imported and exported goods and therefore requires documentation to ensure product quality. However, agents often demand unneccessary documents which creates an obstacle to smooth cross-border trade. Status: The Minister of Economic Development and Trade Moldokulov made recommendations on simplifying import- export procedures that would reduce administrative documentation by almost 50% and at the meeting of the Investment Council he proposed a Draft Decree of the President of the Kyrgyz Republic with the aim of continuing these efforts. The Draft Decree was agreed on by all stakeholders and has been sent to the Administration of the President for approval.

2007- 2008 Work Plan The work plan was developed by the experts of the Secretariat together with representatives of business associations and donors’ projects and stipulates the themes to be raised at further meetings of the Investment Council. The work plan will be provided upon request to all interested parties. Developed with business associations and based on 4 principles: 1 monitoring of implementing decisions 2 relevancy and urgency of issues raised 3 practicality of issues raised for the medium-term

Other Current Issues Introduction of the E-Visa Purpose: Introduction would facilitate administrative processes for tourists, business visitors, and generally encourage travel to Kyrgyzstan. Currently there are only two other countries in the world with an electronic visa system. The Minister of Foreign Affairs Karabaev noted that an electronic visa would significantly simplify administrative procedures and would contribute to Kyrgyzstan’s image as an open and democratic state. Status: A gradual introduction of the electronic visa was recommended including establishing a commission to develop the programme, determine the main stages necessary, and determine a source of funding. According to the decision of the Investment Council the Ministry of Foreign Affairs created a draft of the Government Order on setting up a commission to develop a programme for the introduction of electronic visas in the Kyrgyz Republic and sent it to the Government.

Applying Recommendations of Donor Projects At the first meeting of the IC Secretariat donors were asked to provide information on projects aimed at improving the investment climate and business environment. Based on the information obtained from donor organizations the List of Technical Cooperation Projects was drawn up, taking into account 6 priority directions of the Council’s activity. The List includes a description of the major objectives of the projects on technical cooperation and recommendations on applying the results of the projects in the activities of the Investment Council under the President of the Kyrgyz Republic.

Other Activities of the Secretariat

The United Nations Industrial Development Organization- Investment and Technology Promotion Office, Tokyo invited Mr. Koichumanov, Secretary of the Investment Council under the President of the Kyrgyz Republic, to participate in the delegate programme from 21 September to 3 October 2007.

The major objective was to present selected investment opportunities to Japanese companies. During the trip Mr. Koichumanov met with over 20 companies and 10 organizations, including the Ministry of Foreign Affairs, and the Ministry of Economy, Trade and Industry. The companies included major trading houses; engineering, mining, consulting companies; banks and small and medium enterprises. Results of the trip:

- confirmed the Trade and Investment Seminar of the Kyrgyz Republic in Tokyo on 16 November 2007 - developed a protocol of agreement of future mutual collaboration with Advanced Material Japan Corporation - received an offer from Space Energy Co. Ltd. to present how to develop a polysillicon plant in the Kyrgyz

Republic - various other results were achieved…. The Secretariat of the Investment Council signed a Memorandum with the South Korean consulting company

E.P.I. CО Ltd. on the attraction of investment to the Kyrgyz Republic. Within the parameters of its authority the Secretariat of the Investment Council will support the promotion of investment projects with the objective of improving the social and economic environment in the Kyrgyz Republic.

The Secretariat of the Investment Council updated the flash presentation about the investment climate of the

Kyrgyz Republic. The presentation also includes the description of the four sectors of the economy: agriculture, electricity, transport and tourism.

Issues to be Presented at the Next Meeting

Customs Administration The Secretariat of the IC held several meetings with representatives of business associations working in the customs field and the USAID projects on “Business environment improvement” and “Trade promotion,” to determine the most important issues for simplification of customs administration procedures. Business associations raised several issues including customs procedures, the problem of pre-customs services, risk management, simplification of the customs transit system, post customs audit, etc. It was suggested to raise these problems at the next meeting of the IC during which a working group for the simplification of customs procedures will likely be created with the mandate of developing concrete solutions on the simplification and improvement of customs procedures. The Building Process: Analyzing Necessary Procedures A working group will be created with the participation of government officials and representatives of business associations to analyse issues regarding the improvement of the procedures involved in construction. The group will prepare proposals and recommendations for next meeting of the Investment Council.

Issues to be Presented at the Next Meeting

Resolution of the Government of the Kyrgyz Republic «Methodology for regulatory impact analysis of normative legal acts affecting businesses’ activities»

The Government of the Kyrgyz Republic supported the initiative of the Investment Council under the President of the Kyrgyz Republic and approved “Methodology for regulatory impact analysis of normative legal acts affecting businesses’ activities”. It is important to note that this Government’s document will reduce opportunities for the adoption of agencies’ interests-serving normative legal acts (NLAs) and private lobbied decisions. The methodology allows assessing in both monetary and qualitative expression future or current effect resulting from the impact of an NLA and estimate in advance what costs and benefits businesses, the state, and society will receive and sustain respectively.

In the near future, in order to implement the practice of regulatory impact analysis, the methodology developers will administer a series of trainings for the government employees, a training program will be adopted and training materials will be prepared. The training program will be systemic and aimed not only as a complementary training for government employees but also as a part of curriculum of higher education institutions. The next step involves the introduction of the guillotine principle where the findings of analysis of regulatory impact of NLAs will be used to repeal in an established manner unsubstantiated and economically unsound documents issued by state bodies and local self-governance bodies and regulating businesses’ activities.

On implementation of the Order of the Government of the Kyrgyz Republic «On creation of interdepartmental commission to develop phased introduction of e-visa in the Kyrgyz Republic» According to the minutes of the first meeting of the Interdepartmental commission to develop phased introduction of e-visa in the Kyrgyz Republic on 3 December, 2007 the representatives of working group from MFA, SCNS and SAIRT visited Armenia to learn its experience in introduction of e-visa. Preliminary analysis of the materials on introduction of e-visa in Armenia showed that the dynamics of entries of foreigners from the period of introduction of e-visa raised and created favorable implications of development of tourist infrastructure and creation of positive image. Representatives of working commission visited Armenia directed detailed report to all members of the commission.

Resolution of the Government of the Kyrgyz Republic “On certain measures of optimization of permissive and regulatory system in the Kyrgyz Republic” The Government of the Kyrgyz Republic approved the draft Law on certain measures of optimization of permissive and regulatory system in the Kyrgyz Republic. The Draft Law will be sent to Zhogorku Kenesh of the Kyrgyz Republic for approval. The Law establishes basic principles on review of normative legal base in sphere of regulation of entrepreneurship activities for elimination and exclusion of regulations which mismatch with the draft law and not oriented to market economy. Law also directed on creation legal base, favorable for entrepreneurship and investment climate, which encourage social and economic development of the country.

The Secretariat of the Investment Council Under the President of the Kyrgyz Republic

European Commission Project «Support to the Secretariat of the Investment Council under the President of the Kyrgyz Republic» European Commission launches the project “Support to the Secretariat of the Investment Council under the President of the Kyrgyz Republic». The objective of the project is assistance to the Secretariat of the Investment Council under the President of the Kyrgyz Republic in elaborating and introducing new state administration procedures aimed at better service rendering to investors, and increasing expert potential of the Secretariat of the Investment Councilа. This project aimed at creation of more favorable conditions for business activities and improvement of investment climate. Project implementation let to creation of preconditions for the decreasing regulations and interferences of state agencies to the business activities of entrepreneurship subjects, and start the reformation process of normative-legal base in the area of licensing and regulative policy in order to remove subjective factor during the decision making process and first of all decreasing corruption.

Other Activities of the Secretariat

Experts of the Secretariat of the Investment Council under the President of the Kyrgyz Republic took active part in conference “Information session of the programme Central Asia Invest 2007».

Mr. Koichumanov, head of the Secretariat, participated at the teleprogramme “Open Kyrgyzstan” dedicated to

investment climate in Kyrgyz Republic. The programme will be transmitted on first channel of the National Television on January, 2008.

Under support of the Secretariat of the Investment Council businessmen from South Korea (“Arhat – Trans”

company) began the delivery of buses for the Bishkek mayor's office. Within the framework of other projects it is planned to build Datka substation, reconstruct Uch-Kurgan hydropower station, resume coal mining in Sulukta, Kok-Yangak and Tash-Kumyr cities, and implement several agricultural projects. As a whole it is planned to attract South Korean foreign investments in the volume of 1 billion USD.

On 17 – 18th December 2007 a Conference of Heads of the Secretariats of the Investment Councils of Armenia, Georgia, Kyrgyz Republic, Mongolia and Tajikistan was held in Almaty.

Heads of the Secretariats of the Investment Councils, exchanged the experiences of their countries in improving of business environment and investment climate and activities of relevant countries Councils and Secretariats considering issues of interaction between business communities and state structures.

On result of meeting the resolution, considering the ways of the future cooperation of investment councils of the countries was adopted (attached). The resolution notes that the activities of investment councils and other similar mechanisms for partnership between business and the government play an important role in improving the business environment and investment climate, the positive work experience of the Secretariat of the Investment Council under the President of the Kyrgyz Republic is noted. Participants came to the conclusion about the necessity to increase donor participation in the Investment Council’s activities.

It is necessary for the cooperation of state agencies and business communities with the international financial organizations.

Participants agreed to organize such meetings on regular basis.

On 25 January 2008 the meeting of the Investment council under the President of the Kyrgyz Republic was held at the Oval Hall of the White House.

According to the Agenda of the meeting there were considered the issues of the improvement of the tax administration, license and permissive procedures of the investment and building process and introducing of the e-visa. Also the Secretary of the council reported on implementation by the state agencies the decrees of the President of the Kyrgyz Republic On measures of improvement of inspections procedures of entrepreneurship subjects and On certain measures of optimization of permissive and regulatory system in the Kyrgyz Republic.

At the meeting of the Council the President noted that first of all, the Council should work more on those principal

changes in economic policy, about which the President spoke during his speech to the new Kyrgyz Parliament and Government. First of all, it is a question of implementing a package of measures to eliminate bureaucracy in the economy in general. When considering issues at the Council’s meetings there is an opportunity to repeatedly make sure that the roots of many problems that have not been resolved for many years and are hidden in administrative barriers created by the state are brought into the open.

Once again, the President focused the attention of all government leaders on qualitative and timely implementation of their direct duties. Control of implementation is the weakest link in government structures’ activities.

At the next meeting of the Council there was proposed to submit the report made by the Government of the KR on the implementation of all decisions approved by the Investment Council.

Main Decisions of the Investment Council Meeting - To take notice of the Roundtable’s Resolution on improving the investment climate and the draft Action Plan

drawn up as a result of the Roundtable’s work on the issues related to improving the investment climate held on November 9, 2007.

Recommend the Government of the KR approve the above-mentioned Draft Action Plan under the established procedure taking into consideration the expressed notes and proposals from the President of the KR.

- In general, approve the Draft Main Directions for Developing Government Policy in the Construction Sector. The Government of the KR should create a working group headed by the Minister for Economic Development and Trade that includes all stakeholders. Taking into consideration the notes, the working group should develop an appropriate regulatory legal document and submit it for approval under the established procedure.

Special attention should be paid to the detailed design of the following directions of government policy: - Create a transparent licensing system in the construction process that would help attract investments; - Develop the utilities infrastructure for the construction sector; - Create market tools for providing land plots; - Develop a policy aimed at overcoming the shortage of qualified construction professionals. As a result of the working group’s activities, the Government of the KR should conduct a national

Roundtable to discuss the issues related to the Main Directions of State Policy on the Construction Sector. - To take into account the information of the International Business Council and recommend to the Government

Recommend the Government of the Kyrgyz Republic consider the issue of the current coefficients for establishing the rent for foreign persons for using land in settlements.

- To take into account the information of the Association of Kazakh Investors and recommend to the Government consider the issue of creating equal conditions for cement producers.

- In concluding remarks the President of the Kyrgyz Republic the President asked the Council members who are representatives of donor organizations to provide as much assistance as possible to the Council’s Secretariat in working out a programme for undertaking clear and efficient steps to raise Kyrgyzstan’s standing in these ratings.

President of the European Bank of Reconstruction and Development will participate at the next meeting of the Investment Council

President of the European Bank for Reconstruction and Development will participate at the next meeting of the Investment Council which will be on 14 March 2008. According to the Agenda of the Meeting there will be considered the reports of the Government and General Prosecutor’s Office of the Kyrgyz Republic on implementation of the early taken recommendations and decisions of the Investment Council. Besides there will be considered main directions of the state policy in building complex, measures on mortgage of the agricultural lands and issues with improvement of international rating of country.

National Trade and Transport Facilitation Council of the Kyrgyz Republic

In accordance with the Article 2 of the Presidential Decree of the Kyrgyz Republic “About developing the state policy in the field of external trade and improving the export-import procedures” #464 dated from 23 October 2007, with the aim of simplification of trade and transport procedures, coordination of activities of the ministries, state committees and administrative departments, connected to the rationalization of export and import procedures, the Government of the Kyrgyz Republic established a National Council of the Kyrgyz Republic on trade and transport facilitation. The Resolution was signed by the Prime-minister of the Kyrgyz Republic on 29 January, 2008.

National Council of the Kyrgyz Republic on trade and transport facilitation is a joint body coordinating activity of

the ministries, the state committees and administrative departments, in sphere of regulation of export-import procedures.

The implementation of the results of the trips of the President of the Kyrgyz Republic to Japan and Prime-Minister to South Korea in November, 2007 Visit of the businessmen from Japan for negotiating on launching of the production of polysilicon By the initiative of the Secretariat if the Investment Council businessmen from Japan visited Kyrgyzstan for negotiating on launching the production of the polysilicon. There were carried out the number of the meetings with the owners of the factory “Kristall” regarding the reconstruction of the production. Negotiations with businessmen from South Korea There are under negotiating the signing of the agreement with Businessmen from South Korea on building Datka – 500 power transmission line and modernization of the Uch-Kurgan Hydro electro station. Other Activities - 25 January 2008 Head of the Secretariat held a meeting with Umar Shavurov, representative of the development team of the Doing Business indicators of the World Bank. - From 11 to 22 January the team of the researchers from Columbia University visited Kyrgyzstan with first mission. They held a number of the meetings with representatives of the international donors’ organizations, ministries and business associations.
