Mediation and arbitration or: the systematic furtherance of effective traditions Justices of the peace, judges and state arbitration bodies are not the only ones able to help relieve the burden on the courts. Rather, in Switzerland, mediation is growing in importance as the most consistent option for out-of-court dispute resolution, especially for family and business mediation. This trend should be noted and encouraged. Mediation will increasingly be able to contribute to relieving the courts, especially in complex cases. The draft is more open to mediation ..., without wishing to regulate this institute in detail or definitively. The basic idea is to provide the parties with mediation as an equivalent alternative to state arbitration.
