MrScottRogersManager,CompetitionPolicyUnitTheTreasuryLangtonCrescentParkesACT2600Viaemail:[email protected] you on behalf of the Motor Trades Association of Australia Limited (MTAA) Board andMembersfortheopportunitytomakeafurthersubmissioninregardtomisuseofmarketpower.MTAA, representing the nation’s retail, service, repair, recycling and associated industries of theAustralianautomotivesectorrequeststheGovernmentincludetheHarperCompetitionPolicyReviewPanel recommendation for change to Section 46, as is and in its entirety; as part of reforms ofcompetitionandconsumerlaw.Whileultimately theHarperReviewPanelrecommendation isnotasstrongasMTAAandmembersoriginally sought,MTAA is comfortable that ‘Option F’ as outlined in the ‘Options to strengthen themisuseofmarketpower’DiscussionPaper,deliversaworkablecompromise.However,anychangestotherecommendationwould,intheopinionofMTAA,diluteitsintenttothepointofstatusquo.It isnotacceptabletodonothing.MTAAagreeswithmanyofitskindredassociations,theACCCandothersthatthecurrentSection46doesnotfulfiltheintendedpurpose.
MTAAandMembersseekan‘EffectsTest’andotherchangestoSection46nottopunishbigbusinessorstiflecompetition,buttoprovidethenecessarytoolstodivedeeperintohighlycomplexmarketsordiscretemarketswithin thosemarkets. Thiswillprovide increasedcapabilityandcapacity tobringpotentialmisusesofmarketpowerbyadominantplayertolight.Itwillalsoenableincreasedpowerstothoseaccountabletoinvestigate,whoarecurrentlyhamperedbyinefficientdrafting.This will ensure consumer protection remains as important as the promotion of competition byensuringthecompetitionprocessispreserved.
MTAA Member, the Victorian Automobile Chamber of Commerce (VACC), has provided in itssubmission to this Discussion Paper consultation, details of the concerns of various automotiveindustriesincludingexamples,underpinningtheseconcerns.SimilarsubmissionsandexamplesfromotherMTAAmemberspaintasimilarpicture.Previous submissions byMTAApredecessor, theAustralianMotor Industry Federation (AMIF) alsoraisedtheseimportantdifferencesasthecompetitionprocesshasmaturedandbecomemorecomplexthroughverticalintegrationandthearrivalofotherbusinessmodels.

The adoption of the Review Panel recommendation will bring Australian competition policy intoalignmentwithbestpracticeinotherinternationaljurisdictions.Itisthesejurisdictionsthatappeartohaverecognisedtheimportanceofallbusiness,aprotectedandunambiguouscompetitionprocesstoenablegrowth,andthemechanismstoaffordallbusinessthatopportunity.
MTAAanditsmembersrepresentbusinessesthatconstitutethenation’slargestsingleindustrysmallbusinessgroupwithcloseto100,000businesses,employingmorethan320,000Australianswithanaggregateannualturnoverof$208b.Many of these businesses are strong and successful and making enormous contributions to theircommunities,theirnationanditsconnectivitythroughroadtransport.Suggestionsbysomesuggestingcompetitioncould‘chill’asaresultofaneffectstestbeingintroducedfailtorecognisethatfreezingoutandforcingtheclosureofsmallbusinessthroughmisuseofmarketpower; and an inability of small business to ‘call out’ and prove such behaviour through existingprovisions;willultimatelycausewinterwastelandforallbusiness.PleasedonothesitatetocontacttheMTAASecretariatshouldyourequireanyadditionalinformation.YoursSincerelyMTAANationalSecretariatCanberra12February2016
