1 The Virginia Voice Spring 2011 Message from the President Dear Unified VCA Colleague: N ow is the time we must begin planning for the 2012 Virginia Legislative Session. The ACA, the ICA and COCSA have repeatedly informed our profession that most of the major initiatives for the upcoming National Healthcare Reform will be negotiated and voted on at the state level next year. We must have our ducks in row if we are going to have a seat at the table as major changes to our healthcare system are made. If we want to be successful, the UVCA needs your help! We need to raise sufficient monies and be able to depend on you to contact your legislators when asked. Our legislative committee co-chairs, Dr. Bill Thesier and Dr. Joe Foley, and our legislative consultant/lobbyist, Bruce Keeney, will help the UVCA Board coordinate our efforts. In addition to state initiatives, we will also be coordinating our efforts with our national associations. Now is the time that we start accumulating critical money for our lobbying efforts. This is where the Virginia CPAC comes in. CPAC stands for Chiropractic Political Action Committee. CPAC is a separate entity from the UVCA, but is the driving force for collecting and distributing campaign contributions to the appropriate state level candidates running for election next summer and fall. Estimates of our needs range from $65,000 to $85,000 this year. We currently have $15,000 pledged for this year. If we are going to make an effective push to be included in the mandated essential benefits package, we need to be active at both the national and state levels. WE NEED YOU! Your contributions and efforts will go a long way in establishing and solidifying relationships with the elected officials who will decide our inclusion or exclusion in any healthcare package. Traumatic Brain Injury (TBI) and severe posttraumatic stress.

• We have an all volunteer Military that includes significant numbers of National Guard members and Reservists.

• Nearly half of all active and reserve members experience multiple deployments.

• In this era of high-tech and constant communication, service members remain in constant contact with their families, even when deployed.

• We are involved in unconventional warfare: no front line, improvised explosive devices (IEDs), no down time, constant vigilance.

The program invites DCs to learn about the stresses and challenges our service members and their families are facing. Three free Type 1 online courses addressing “the invisible wounds of war” have been developed in conjunction with Cleveland Chiropractic College: Posttraumatic Stress Disorder, Traumatic Brain Injury, and Issues of Women Returning from Combat. All Chiropractors who complete the training will receive CEU documentation. Unified VCA Members who complete the training will also receive a certificate of completion, artwork for a

CAD injuries or Cervical Acceleration Deceleration injuries, also known as whiplash, are the common result of a person being

in a vehicle that is struck from behind. The cervical sprain strain that results injures many of the supporting soft tissues in the neck, which leads to a myriad of symptoms that can begin immediately or take weeks or longer to manifest. The results of the injuries often result in permanency. One of the most common diagnostic tests used is x-ray. Since it’s discovery over 115 years ago, x-ray is used primarily to screen for pathology including tumors, fractures and dislocations. Fortunately, most whiplash cases do not reveal any of those, which is a good thing for the patient -- but the static films can overlook the damage to the ligamentous structures that hold the bones together. Often overlooked is the fact that these injuries occur along an arc of motion in the presence of shearing and compressive forces. The results of this physical insult is often unseen unless the tissue is imaged in the position of injury. When x-rays, MRI and CT scans are done, they are done in a non-moving, neutral position which give a very limited perspective of the anatomy involved. X-rays can also provide biomechanical information to guide in the restoration of a proper cervical curve through Chiropractic adjustments and therapeutic rehabilitation; but generally speaking, plain film x-rays give us a limited amount of information. The complexity of whiplash injuries can result in a slow resolution of the symptoms, which can be frustrating to the patient and doctor alike. In the situations where additional imaging procedures are requested, the outcomes often fail to provide any helpful insight. MRI and CT studies are often characterized as “unremarkable” or “a negative study” which is often seen as a negative thing in that it suggests that there is nothing wrong with the patient. The absence of findings on x-rays or MRI studies does not suggest that there are no soft tissue injuries -- it’s just that those modalities are not capable clearly identifying them. Digital Motion X-ray (DMX) utilizes x-ray technology and couples it with digital and optic technology in an image intensifier to create high-resolution images of the spine and skeletal system in real-time motion. The system, housed in a mobile clinic, records 30 images per second, which provides superior diagnostic detail.

At its Spring Convention on Saturday, April 30 in northern Virginia, the Unified VCA will conduct a Community Covenant Signing with Army OneSource to officially launch the program. Convention attendees, other members, military leaders, officials, legislators, and the press are being invited to attend this historic ceremony. The event will launch a statewide commitment by the Unified VCA and its Members to ensure that our returning veterans and their families receive the proper health care they deserve. The ceremony is scheduled from 5:00-6:00 p.m. at the Dulles Airport Hilton in Herndon. There is no fee to attend the ceremony, but an RSVP is requested.

Many of us have experienced the frustration of caring for patients that were injured in automobile accidents, but because we could not clearly prove soft tissue injuries, we could not provide the information to justify the necessity of continued care. This is exciting technology for those situations. Often times, the patient’s attorney doesn’t have adequate information to get an appropriate settlement for their injuries and future care. It is these people that seek care 20 years after an accident that wasn’t “a big deal” when it happened, but the injury turned into degenerative disc disease and chronic pain over the years. The most common intended use for DMX is to visualize suspected intersegmental joint dysfunction and instability in the cervical spine by evaluating all 22 major cervical ligaments. There are two types of Ligament Injuries:1. Sub-failure: When a ligament stretches or partially tears and2. Complete failure: When a ligament is completely severed. DMX detects sub-failure ligament injuries which are common in acceleration/deceleration injuries such as an automobile crash. MRI does not have the resolution to detect the stretching or an elongation of a ligament. MRI can detect a complete failure, which are commonly seen in the knee and shoulder but not the cervical spine. Sub-failure ligament injuries are most commonly seen in the cervical spine, TMJ, and wrist. While DMX can provide valuable information about the stability of all 22 major ligamentous structures in the cervical spine, it can be especially important in the the upper 30% of the cervical spine, which gets its stability from ligaments only since there are no discs between Occiput, C1, and C2. Digital Motion X-ray is used in demonstrating post-traumatic instability in the neck that may be responsible for posterior neck pain, headaches, referred pain and TMJ dysfunction. The benefits of this technology are numerous but most importantly, it helps the physician accurately document the specific structures involved in the injury allowing for a very specific and accurate diagnosis ensuring optimal treatment.

TRUE OR FALSE? Discounting Your Fees is Illegal.

A simple true or false would be nice. Unfortunately, it depends on who you ask, what state you practice in, if the patient is

federally insured, AND their particular circumstances. So much for straight answers to a simple question! When someone does answer questions about discounting, it is usually followed by, “consult with your health care attorney before offering any type of discounts”. This would be great advice, except most of us do not have a health care attorney. Others will tell you discounting is perfectly legal as long as it is done consistently, and in accordance with your written compliance program. This is more great advice, but the reality is many of us still have not put a full compliance plan in place. So who cares if the answer is True or False? What’s all the fuss about discounting, anyway? Can’t you charge what you want to whomever you want? Can’t you just down-code your adjustments, exams or x-rays to save a patient some money? What’s the big deal in charging more for PI, Workers Comp and insurance patients than you do for cash? All you are doing is trying to help a patient, right? It’s no big deal, right? WRONG! In the days before insurance, third party reimbursement, and state and federal payers, things were simpler. When someone else is paying part or all of the costs for health care, especially the government, rules change and regulations apply. This is when discounting the wrong way can cost you. It’s called doing the right thing the wrong way. You may be trying to help an uninsured or underinsured patient by offering discounts, but many doctors end up putting themselves at risk in the process. Dual fees schedules (charging more to insurance companies than you do to your cash patients) and improper

time of service discounts (reductions that are really MORE than a reasonable bookkeeping reduction) are illegal in many states. Offering discounts that do not fall into one of Medicare’s safe harbors is a clear violation of federal regulations in EVERY state. Violation of state and/or federal regulations against inducements or triggering anti-kickback statutes can lead to serious fines and career-ending penalties. So what is the right answer to the True or False question? Discounting your fees CAN be illegal if you do not know the rules and if you do it the wrong way! To offer discounts the RIGHT way, in every state and for any patient group, follow the rules: 1. Document correctly. The rules in this area are quite clear

and there are many resources and guidelines to follow. 2. Code correctly. Again, follow the rules. Do not up-code for

more reimbursement when insurance is available and do not down-code to reflect lower charges as a means to offer discounts. It is just as improper and illegal as up-coding.

3. Discount correctly. That is a new one for most doctors. Here is how you do it. Hire a health care attorney if you’d like, put your compliance plan in place…AND if you don’t do anything else, consider joining and encourage your patients to join a Discount Medical Plan Organization (DMPO). DMPOs are typically regulated by the Department of Insurance in most states and have been around for years. Why a DMPO? Simple. These plans use the contract model you use now with insurance companies. The contract allows you to legally accept different rates on the same codes, without it being a “dual fee schedule”. Using a DMPO, you can still bill your UCR fees and have the protection of a “contract” that allows you to offer network-based discounts Continued on page 8

There’s No “Me” in Practice

It’s a common tale. For a time, you’re so busy each day is a blur. You’re in the zone. You’re on top of the world, trusting your

intuition; you’re practically a wizard. This is SWEET! And then the numbers fall off. There are empty slots in the appointment book. There are disconcerting lulls between patients. There’s enough time to distract the front desk CA with questions about who’s next. Your confidence erodes. You have time to ruminate on what you should have said and should have done with that patient who didn’t show up for your report. Welcome to the roller-coaster practice. One moment you’re giddy with confidence as everything you touch practically glows. The next thing you know you’re surfing the Internet, reading the chiropractic rags and wondering if anyone loves you. What you do about this determines if this is a one-time anomaly or a lifetime sentence until you retire. First acknowledge you created this. I know. It’s tempting to blame the economy, the confusion about ObamaCare, the weather, high unemployment, the resetting of first-of-the-year deductibles and all the other convenient scapegoats. As uncomfortable, even incorrect as it may seem, you created this. True, you don’t control the world. But those you encounter react to you, which in turn shape their perceptions and behaviors. So in a sense, you contribute to a version of reality that manifests in this thing called your practice. One of the common denominators of under-performing practices is a chiropractor who has made the practice about him or herself. How? Here are some of the more common ways: Wanting new patients for your reasons. Practices with a lack of new patients are often guilty of wanting new patients for

less than honorable reasons. Among them, to:1. Be busier2. Increase income3. Reach a statistical goal4. Win over a convert5. Seek patient admiration These are largely selfish reasons, which emit an odor that patients and prospective patients are especially skilled at detecting. Action Step: Remind yourself that your needs will be met only (and after) you help others get what they want. Seek new patients to help them avoid needless surgery or side effect laden drugs. Introduce new patients to chiropractic so they know the truth. Desire new patients so you can offer them hope and greater possibilities. Monopolizing conversations. Fact is, most chiropractors talk too much. It’s often justified as “patient education,” but it’s rarely a back and forth volley and thus rarely effective at making significant change. Action Step: Show up curious. Be slow to speak. Be of few words. Like grains of sand, things in abundance are rarely valued. Become a legendary listener. Not being present. If you have the habit of attempting to eavesdrop in on front desk conversations, going through the motions as you daydream about trout fishing or worse, doing the math to determine your expected services for day, you’re stealing from patients. Action Step: Surrender your full attention to each patient. Avoid being distracted by those who don’t show, and instead, “Love the one you’re with,” as Steven Stills warbled 40 years ago.

Cheating the first patients of the day. Scripture reminds us of the value of “first fruits” and the “first born.” Do your first couple of patients of the day get the same quality of adjustment as those toward the end? Shortchanging even one patient reduces your moral (and clinical) authority. Patients may not know, but you do. Action Step: Get to the office at least 20-30 minutes before your first patient of the day. Review the files of those you expect to see. Imagine what’s going on in their lives. Pray that you can serve each one in some extraordinary way—beyond simply adjusting their spine. Moody and distant. When the numbers are up, you’re up. When the numbers are down, you’re down. Sound familiar? It’s usually a sign that you feel inappropriately responsible for what a patient’s body does (or doesn’t) do with the energy that your adjustments add at opportune times and places along their spine. Investing your life spirit in effects or outcomes is risky. It forces you to bluff or fake your confidence and certainty. Patients (and team members) are rarely fooled. Action Step: You are not your practice. You are not the economy. You are not their insurance carrier. You are not responsible for their relief. Set clear boundaries for what you are responsible for. (It’s not much.) Refuse to get sucked into thinking their problem is your problem. Instead, become a conduit, an encourager, a hope giver and a masterful adjuster. Imagining success is what you do instead of who you are. Think twice before you’re tempted to acquire some new gizmo or push some new adjunctive procedure onto patients. The motive behind such acquisitions is often a way of avoiding a far more painful solution. That involves a mirror. Action Step: True success is almost always a stripping-away process, not an adding-to process. Look for ways of reducing clutter, streamlining procedures and simplifying your practice. Complexity breeds confusion. Success avoids chaos

and ambiguity. Simple things last. Less is more. Lack of gratitude. This goes beyond remembering to say “Please” and “Thank you” as you ask patients to assume new positions on your adjusting table. It’s far deeper. Many chiropractors see themselves as victims and rarely appreciate the significance of the skills they have and the truth that they know. Action Step: Find (or set one up yourself) a mastermind group of upbeat, optimistic chiropractors and participate. When you stay holed up in your office, battling insurance companies and hypnotized patients seduced by the drug-soaked media, it’s easy to feel alone, becoming an easy target for discouragement and fear. You are not alone! You’re merely an easy target. Yes, it’s your practice, your name on the license and your name on the bank loan. But making it about you is optional.

8 Reasons NOT to Visit a Chiropractor

If you’re looking for reasons not to visit a chiropractor, here are eight of them!1. You don’t have a spine. If you’re born sans spine, there’s

really no need to worry about spinal degeneration, is there?

2. If you can’t see it, it must be fine. Skin, eyes, hair, teeth… These front-facing body parts are important because other people can see them. If a healthy spine was really that important, it wouldn’t be in the back.

3. You love taking medication. Taking risks makes life more enjoyable! Dizziness, headaches, dry mouth, constipation, seizures, cancer, death… What’s not to like about side effects?

4. Your insurance doesn’t pay for it. Money is for important stuff like Netflix, cigarettes, and gambling. If your insurance plan doesn’t cover it, maybe chiropractic care just isn’t necessary?

5. They don’t prescribe drugs. Why would you want to go to a doctor who doesn’t think you need another prescription? (See #3.)

6. They think lifestyle “stress” can make you sick. Apparently they’re not aware of bad genes. Everybody knows you only get sick because certain diseases just run in the family.

7. They expect you to do stuff at home. They want you to make time for rest, exercise, and stretching. On top of that, they think you should change your diet. Evidently

they don’t understand how busy you are…8. Besides, you’re impervious to mistakes. You eat just

fine, and there’s nothing wrong with the way you’re living. Even if your “habits” are making you gain weight and age prematurely, that’s none of the doctor’s business! Their job is to get you out of pain so you can get back to doing the things that brought you there in the first place.
