Section 144 Legal Aid, Sentencing and Punishment of Offenders Act (2012)

Introduces offence of squatting (criminal)

Criteria

A person is in a residential building as a trespasser having entered into such;

The person knows or ought to know that they are a trespasser; and

The person is living in the building or intends to live there for any period

N.B. Doesn’t cover persons holding over after e.g. a tenancy

Penalties (triable summarily – maximum 6 months in prison, fine or both
