The safe driving speed (above which we can be charged with negligent or dangerous driving) is deter- mined by factors such as weather conditions, traffic, driver, vehicle and road con- ditions at any given moment. This safe driving speed is not determined by the posted maximum speed, be it 15, 40, 60km/h or whatever, includ- ing derestricted zones. At a given place, the posted maximum speed might be 60, for example, but driving at 40 could be deemed reckless and therefore negligent, if the conditions mean that such a driving speed is unsafe. I don’t understand what is complicated about this. If the posted maximum speed is not specified (‘‘open’’), there is no exemp- tion for driving dangerously, exactly as it applies in any other posted speed zone, be it 40 or 130. In fact, if I am driv- ing in a school zone and weather and traffic dictate, I might drive at 30. If I’m driving in a 130 zone, I might feel comfortable at 100, but feel pressed to drive at 130. If I’m driving in an open (derestricted) zone, I drive at 70-185, absolutely de- termined by all conditions in that time and place. Do we need to be fright- ened and suspicious of each other to do the wrong thing? Or do we need Nanny to hold our hand? Oh, and with no responsib- ility, by the way, because the posted speed limit cuts down the paperwork and cuts down on discretion and intel- ligence.
