The key is toknowyour limitWE are confused about speedlimits. The safe driving speed(above which we can becharged with negligent ordangerous driving) is deter-mined by factors such asweather conditions, traffic,driver, vehicle and road con-ditions at any given moment.
This safe driving speed isnot determined by the postedmaximum speed, be it 15, 40,60km/h or whatever, includ-ing derestricted zones.
At a given place, the postedmaximum speed might be 60,for example, but driving at 40could be deemed reckless andtherefore negligent, if theconditions mean that such adriving speed is unsafe.
I don’t understand what iscomplicated about this.
If the posted maximumspeed is not specified(‘‘open’’), there is no exemp-tion for driving dangerously,exactly as it applies in any
other posted speed zone, be it40 or 130. In fact, if I am driv-ing in a school zone andweather and traffic dictate, Imight drive at 30.
If I’m driving in a 130 zone,I might feel comfortable at100, but feel pressed to driveat 130. If I’m driving in anopen (derestricted) zone, Idrive at 70-185, absolutely de-termined by all conditions inthat time and place.
Do we need to be fright-ened and suspicious of eachother to do the wrong thing?Or do we need Nanny to holdour hand?
Oh, and with no responsib-ility, by the way, because theposted speed limit cuts downthe paperwork and cutsdown on discretion and intel-ligence. Yet we feel free totake the trouble to fine a lassfor having an unrestrainedpuppy in her car.
