THERIAQUE OFFICE BUILDING
Issue: Vertical accessibility to differing levels in an office building.
Analysis: The applicant is requesting a waiver from providing vertical accessibility to alllevels of an office building. The structure was originally constructed as a single familydwelling and was subsequentlyenlarged by two small wings to convert it to commercialuse. When the additions were done, the resulting finish floors are not flush with the floorin the original building. The project will cost $30,000 and it is questionable whether alltoilets can be made accessible for $6,000. According to the applicant, to provide verticalaccessibility to all levels in the building would exceed construction costs approximatelythree times.

Vertical accessibility to all levels, as required by Section 553.509, Florida Statutes.
553.509 Vertical a ccessibility. Nothing in Sections 553.501-553.513or the guidelinesshall be construed to relieve the owner of any building, structure or facilitygoverned by those sections from the duty to provide vertical accessibility to alllevels above and below the occupiable grade level regardless of whether theguidelines require an elevator to be installed in such building, structure orfacility, except for:
(1) Elevator pits, elevator penthouses, mechanical rooms, piping or equipmentcatwalks and automobile lubrication and maintenance pits and platforms;
(2) Unoccupiable spaces, such as rooms, enclosed spaces and storage spaces thatare not designed for human occupancy, for public accommodations or forwork areas; and
(3) Occupiable spaces and rooms that are not open to the public and that house nomore than five persons, including, but not limited to equipment control roomsand projection booths.
Waiver Criteria: There is no specific guidance for a waiver of this requirement in thecode. The Commission's current rule, authorized in Section 553.512, Florida Statutes,provides criteria for granting waivers and allows consideration of unnecessary or extremehardship to the applicant if the specific requirements were imposed.

The upgrade will generally be moving walls and improving rest rooms. Because of the
way the building is built. to add ramps or elevators would cost more than the revisions planed.
Elevators could be at least three times the other construction costs.

According to the June 6. 2000 memorandum tfom Kathy Butler. Assistant GeneralCounsel DCA the federal disproportionate cost exception may not be applied to theFlorida vertical accessibility requirement. The renovations in this structure areconsidered an alteration to an area containing a primary function. Verticalaccessibility is required. unless waived by the Florida Building Commission due todisproportionate cost. To provide vertical accessibility to all levels in this split levelbuilding would be financially disproportionate to the overall renovation cost.

Dear Commissioners:
DEC Engineering has been requested to make modifications to the 1988plans and constructionfor the above building. The building complied with requirements at the time. This is amultilevel building with basically three sections at different grades. The changes beingrequested relate to some wall movement and rest room improvements.
Because of the site grading, different levels and layout, to achieve vertical access would requirethree elevators. Space to install these would be a major problem with expenses exceeding thebuilding upgrade cost. The total estimate for the work is $30,000. Each elevator would cost inthe area of $30,000.
Based on these comments we request a waiver from the vertical access requirements.
