Case No: 2300317/2017 10.1 Judgment – no hearing - rule 60 March 2017 EMPLOYMENT TRIBUNALS Claimant: Miss N Thomas Respondent: TFL- London Underground Ltd JUDGMENT The Claimant is to pay to the Respondent costs in the sum of £7,632 pursuant to Rule 78 REASONS 1 This case was heard on 26 May 2017. The Claimant did not attend. The Claim was unsuccessful. In the Reasons for the Judgment Employment Judge Webster identified that the claimant had been dismissed for claiming sick pay when absent while at the same time going on holiday to Morocco. The Respondent found that the Claimant falsely argued she had not been in Morocco and had damaged her passport to efface the entry stamp. 2 The Respondent applied promptly for costs incurred. 3 I caused a letter to be sent to the Claimant on 4 July 2017 inviting her to show cause why an order in costs should not be made in favour of the Respondent in the sum sought. The Claimant has indicated no objection to the principle of the order, the amount sought or identified any reason for mitigating the effect of the order as a result of her financial situation. 4 The order is therefore made in the sum claimed which appears to be a reasonable figure given the work involved in defending a claim, preparing for hearing and attending the trial.
