Employee Personnel Files• Beginning January 1, 2017, Employers Are Required, at least Annually, to Permit a Current or
Former Employee to Inspect and/or Obtain a Copy of His or Her Personnel File
• Does Not Require an Employer to Create, Maintain, or Retain a Personnel File for a Current or Former Employee
• What Goes into a Personnel File? Recruiting and screening documents such as applications, resumes and educational transcripts Warnings, counseling and disciplinary notices Performance evaluations and goal setting records Termination records.
• What Doesn’t Go into a Personnel File? Reference/background checks Immigration (I-9) forms Child support/garnishments Workers’ compensation claims
