AN ACT to amend the correction law, in relation to establishing a pilotprogram for the use of body-worn cameras on certain correction offi-cers

1 Section 1. The correction law is amended by adding a new section 1352 to read as follows:3 1--13-5--2—nni—t-Ongiarania-C2ffigg-31

The personal video recording device shall record all the 13 interactions of a correction officer and inmates under his or her care, 14 custody and control. The recording shall include hoth aud i o and video. •15 2. All such eauipment shall be installed on or before six months after 16 the effective date of the chapter of laws of two thousand sixteen that 17 added thi s section. The commissioner shall promulgate all rules and 18 regulations necessary to implement the provisions of th's section. Such 19 rules and regulations shall reauire that all video recordings pe cata-20 loaued and maintained as a record by the department for not less than21 six months and shall establish minimum standards for the personal video22 recording devices, and recording eaui Pment to be used and furthermore23 shall provide for the Protection of personal privacy for those persons 24 whose actions may be recorded No personal video recording devices may

I enclose information about brutality by corrections officers. I also enclose aquestionnaire as part of our investigation to determine the extent of this problem. Our officedoes not have any current litigation about staff violence, and we focus on class action litigationseeking changes in policies and procedures to try to help the largest numbers of incarceratedpeople at any one time. Please understand that our asking for this information does not mean wewill be able to follow up on your behalf, and it is certainly not a promise that we will bringlitigation about staff violence. Any information you could provide us about the incidents youmentioned in your letter, however, would be a great help to our investigation.

You explained. that mental health and medical staff are covering up an incident in whichyou were attacked on November 12,,2015. You asked DRNY to come to the facility to retrieveevidence. Unfortunately, due to DRNY's limited staff and resources, DRNY is unable to do this.
In one of your letters, you copied a private attorney. If you have legal assistance on thismatter from a private attorney, I recommend that you share information about these incidents withthat attorney. If you do not have a private attorney, I recommend that you contact Prisoners' LegalServices, 237 Main Street, Suite 1535, Buffalo, NY 14203, for legal assistance.
Because of your complaint of staff misconduct and brutality, I recommend that you submita complaint to the Office of Special Investigations (formerly the "Inspector General"). The Officeof Special Investigations is charged with investigating complaints about misconduct by correctionsstaff. This office has the ability take action against corrections staff or recommend that someaction be taken. :When you write to OSI, you shoulcl describe-any incidents of misconduct bycorrections staff with as much detail as possible, including the time, date, and location of theincident, the names of people involved, and the names of witnesses. If OSI decides to investigate,OSI sta ff may come to interview you. OSI may not immediately take action againstdievoriections

Dear Mr. Cruz:
We are writing to thank you so much for your wonderful contribution to this year'sAdvocacy Day to end the torture of solitary confinement in New York. We received creativepieces from over 100 people currently incarcerated in New York prisons. People submitted over120 pieces of poetry, origami, drawings, statements, and other artwork. Thank you so much forsubmitting something for this effort. We were so incredibly impressed by your submission andeverything we received. Your efforts had a tremendous impact and contributed greatly to apowerful day in Albany and beyond.
To give you more information about the day itself, on April 12 around 200 peopleconverged in Albany from all across New York State — including from NYC, Albany, Buffalo,Ithaca, Cortland, Poughkeepsie, Beacon, Lake Placid, Binghamton, Long Island, Saratoga Springs,and more. All of these people came to Albany to advocate for passage of the HALT SolitaryConfinement Act, A. 4401 / S. 2659, which would end the torture of solitary and create morehumane and effective alternatives. The day started out with a press conference involvingcosponsors of HALT and survivors of solitary. The press conference took place outside of areplica solitary confmement cell that was in the lobby of the Legislate Office Building — a locationwhere almost every person who was there that day (legislators and members of the public) had topass by and see. The cell was covered with artwork, writings, poetry, and letters that you andothers from inside sent. Throughout the day, public officials and members of the public stopped byto observe your creations and to go inside the cell.
Following the press conference, there was an educational event for policy-makers, thepress, and the public with speakers:who survived solitary, a mother whose son lost his life insolitary in NY, the lead legislative sponsors of HALT — Assembly Member Aubry and SenatorPerkins, and a representative from the U.S. State Department who spoke about the United NationsMandela Rules (which the US government supported and which state that there should be a limitof 15 consecutive days in solitary).
After the morning event, all of the people who came to Albany were divided up into 32teams. Each team met with three or four lpgislators or their staff, for a total of 98 legislativeappointments. In these meetings many formerly incarcerated people and loved ones of those whoare currently in solitary, along with allies, faith' leaders, and other community members, greatlyimpacted these public officials with the incredibly personal, traumatic stories of solitary and theneed for HALT. At each of these meetings, we provided each legislator with a piece of creativework that was submitted by you or someone else who is currently incarcerated in NY and is eitherin solitary now or recently. Your and others' creative works visibly moved legislators and theirstaff, and we are so appreciative of your tremendous contribution.

The day ended with a Hip Hop 4 Human Rights concert that not only drew Campaign forAlternatives to Isolated Confinement (CAIC) participants and officials, but also pedestrians off thestreet and other people in Albany. Many people who have been directly impacted by solitaryshared their experiences in the box through hip hop, art and song.
As a result of the Advocacy Day, including your tremendous efforts, already eight newlegislators are officially sponsors of HALT, which means there are a total of 67 total legislatorswho are now officially sponsors of this legislation (51 representatives in the Assembly and 16 inthe Senate). And the number is growing. Also, there was substantial press coverage of the day,with over a dozen different news stories. Although you could not physically be in Albany atAdvocacy Day, your and others' writings and art provided a vital presence that has undoubtedlyimpacted those who are in positions of power to pass the HALT Solitary Confinement Act.Your efforts were not only felt in Albany on the 12 th but state and nationwide as well! In caseit is of interest to you, attached are two news stories highlighting the Advocacy Day.Additionally, we have sent some of the photos that were taken throughout the event to give youmore of a sense for how the day looked. Lastly, we have included some additional materials thatwere used by participants and given to public officials throughout the day.
Our work is far from over. Thanks in panto your contributions, we together made atremendous impact. Yet, thousands of people are still being subjected to the torture of solitaryconfinement in New York every day. Moving forward we will continue our efforts to advocate forthe passage of the HALT Solitary Confinement Act and other mechanisms to end the torture ofsolitary. We will do this by continuing to advocate toward legislators, hold monthly Together toEnd Solitary actions on the 23'd of every month across the state, and conduct film screenings, playperformances, virtual reality demonstration; and other education events to organize more supportin communities throughout the state. The work that you and others contributed will continue to beutilized in these efforts.
