TITLE 2. FAIR POLITICALPRACTICES COMMISSION

NOTICE IS HEREBY GIVEN that the Fair PoliticalPractices Commission (Commission), pursuant to theauthority vested in it by Sections 82011, 87303, and87304 of the Government Code to review proposedconflict–of–interest codes, will review the proposed/amended conflict–of–interest codes of the following:

A written comment period has been established com-mencing on August 21, 2015, and closing on October 5,2015. Written comments should be directed to the FairPolitical Practices Commission, Attention Ivy Brana-man, 428 J Street, Suite 620, Sacramento, California95814.

At the end of the 45–day comment period, the pro-posed conflict–of–interest code(s) will be submitted tothe Commission’s Executive Director for her review,unless any interested person or his/her duly authorizedrepresentative requests, no later than 15 days prior tothe close of the written comment period, a public hear-ing before the full Commission. If a public hearing is re-quested, the proposed code(s) will be submitted to theCommission for review.

The Executive Director of the Commission will re-view the above–referenced conflict–of–interestcode(s), proposed pursuant to Government Code Sec-tion 87300, which designate, pursuant to GovernmentCode Section 87302, employees who must disclose cer-tain investments, interests in real property and income.

Any interested person may present statements, argu-ments or comments, in writing to the Executive Direc-tor of the Commission, relative to review of the pro-

posed conflict–of–interest code(s). Any written com-ments must be received no later than October 5, 2015. Ifa public hearing is to be held, oral comments may bepresented to the Commission at the hearing.

COST TO LOCAL AGENCIES

There shall be no reimbursement for any new or in-creased costs to local government which may resultfrom compliance with these codes because these are notnew programs mandated on local agencies by the codessince the requirements described herein were mandatedby the Political Reform Act of 1974. Therefore, they arenot “costs mandated by the state” as defined in Govern-ment Code Section 17514.

EFFECT ON HOUSING COSTSAND BUSINESSES

Compliance with the codes has no potential effect onhousing costs or on private persons, businesses or smallbusinesses.

AUTHORITY

Government Code Sections 82011, 87303 and 87304provide that the Fair Political Practices Commission asthe code–reviewing body for the above conflict–of–interest codes shall approve codes as submitted, revisethe proposed code and approve it as revised, or returnthe proposed code for revision and re–submission.

REFERENCE

Government Code Sections 87300 and 87306 pro-vide that agencies shall adopt and promulgate conflict–of–interest codes pursuant to the Political Reform Actand amend their codes when change is necessitated bychanged circumstances.

TITLE 3. DEPARTMENT OF FOODAND AGRICULTURE

The Department of Food and Agriculture (Depart-ment) amended subsection 3435(b) of the regulations inTitle 3 of the California Code of Regulations pertainingto Asian Citrus Psyllid (ACP) Interior Quarantine as anemergency action which was effective on June 24,2015. The Department proposes to continue the regula-tion as amended and to complete the amendment pro-cess by submission of a Certificate of Compliance nolater than December 21, 2015.

This notice is being provided to be in compliancewith Government Code Section 11346.4.

PUBLIC HEARING

A public hearing is not scheduled. A public hearingwill be held if any interested person, or his or her dulyauthorized representative, submits a written request fora public hearing to the Department no later than 15 daysprior to the close of the written comment period.

Following the public hearing if one is requested, orfollowing the written comment period if no public hear-ing is requested, the Department, at its own motion, orat the instance of any interested person, may adopt theproposal substantially as set forth without furthernotice.

INFORMATIVE DIGEST/POLICY STATEMENTOVERVIEW

Existing law provides that the Secretary is obligatedto investigate the existence of any pest that is not gener-ally distributed within this state and determine the prob-ability of its spread and the feasibility of its control oreradication (FAC 5321).

Existing law also provides that the Secretary may es-tablish, maintain and enforce quarantine, eradicationand other such regulations as she deems necessary toprotect the agricultural industry from the introductionand spread of pests (FAC Sections 401, 403, 407 and5322).Anticipated Benefits from This Regulatory Action

Existing law, FAC Section 403, provides that the de-partment shall prevent the introduction and spread ofinjurious insect or animal pests, plant diseases, andnoxious weeds.

Existing law, FAC Section 407, provides that the Sec-retary may adopt such regulations as are reasonablynecessary to carry out the provisions of this code whichshe is directed or authorized to administer or enforce.

Existing law, FAC Section 5321, provides that theSecretary is obligated to investigate the existence of anypest that is not generally distributed within this Stateand determine the probability of its spread, and the fea-sibility of its control or eradication.

Existing law, FAC Section 5322, provides that theSecretary may establish, maintain, and enforce quaran-tine, eradication, and such other regulations as are in heropinion necessary to circumscribe and exterminate orprevent the spread of any pest which is described inFAC Section 5321.

The existing law obligates the Secretary to investi-gate and determine the feasibility of controlling or erad-icating pests of limited distribution but establishesdiscretion with regard to the establishment and mainte-nance of regulations to achieve this goal. This amend-ment provides the necessary regulatory authority to pre-vent the artificial spread of a serious insect pest which isa mandated statutory goal.

The amendment of this regulation benefits the citrusindustries (nurseries, fruit growers, wholesalers, retail-ers, exporters) and the environment by having a quaran-tine program to prevent the artificial spread of ACPover long distances. Most all of the commercial citrusfruit and nursery stock production is located outside thisproposed quarantine boundary area.

The national and international consumers of Califor-nia citrus benefit by having high–quality fruit availableat lower cost. It is assumed that any increases in produc-tion costs will ultimately be passed on to the consumer.

The amendment of this regulation benefits home-owners who grow citrus for consumption and host ma-

terial which is planted as ornamentals in various ruraland urban landscapes.

FAC Section 401.5 states, “the department shall seekto protect the general welfare and economy of the stateand seek to maintain the economic well–being of agri-culturally dependent rural communities in this state.”The amendment of this regulation is preventing the arti-ficial spread of ACP to uninfested areas of the State.

Huanglongbing (HLB) is generally distributed inFlorida due to ACP being generally distributed there.The University of Florida Institute of Food and Agricul-tural Sciences Extension calculated and compared theimpact of having and not having HLB present in Floridaand concluded HLB had a total impact of $3.64 billionand eliminated seven percent of the total Florida work-force. The overall California economy benefits by theamendment of this regulation which is intended to pre-vent ACP from becoming generally distributed inCalifornia and resulting in a similar effect on our econo-my as to what happened in Florida. This is now criticalas HLB has been introduced into California.

There is no existing, comparable federal regulation orstatute regulating the intrastate movement.

The Department considered any other possible re-lated regulations in this area, and we find that these arethe only regulations dealing in this subject area, and theonly State agency which can implement plant quaran-tines. As required by Government Code Section11346.5(a)(3)(D), the Department has conducted anevaluation of this regulation and has determined that itis not inconsistent or incompatible with existing stateregulations.

AMENDED TEXT

This regular rulemaking action expanded the quaran-tine area for ACP in the San Jose area of Santa ClaraCounty and into Alameda County by approximately 13square miles. The effect of the amendment of this regu-lation is to provide authority for the State to performquarantine activities against ACP within this additionalarea. The total area which would be under regulation isnow approximately 51,690 square miles.

DISCLOSURES REGARDING THEPROPOSED ACTION

The Department has made the following initialdeterminations:

Mandate on local agencies and school districts: None.Cost or savings to any state agency: None.Cost to any local agency or school district which must

be reimbursed in accordance with Government CodeSections 17500 through 17630: None and no nondiscre-

tionary costs or savings to local agencies or schooldistricts.

Cost or savings in federal funding to the state: None.The Department has made an initial determination

that there will be no significant, statewide adverse eco-nomic impact directly affecting business, including theability of California businesses to compete with busi-nesses in other states.

Cost impacts on a representative private person orbusiness: Most businesses will not be affected. Thereare no citrus production nurseries in the affected areathat will be impacted. There are six retail nurseries inthe affected area. There is one citrus grower in the pro-posed area. There is no additional cost to growers whotake their fruit to a packinghouse inside the currentquarantine area. Growers choosing a packinghouse out-side the quarantine area have three options: 1. Conductpre–harvest treatments with an approved pesticidewhile fruit is still on the trees; 2. Field–clean the fruit toremove leaves and stems during harvest; 3. Send thefruit to a packinghouse within the quarantine area to becleaned. Pre–harvest treatments cost growers approxi-mately $60 per acre and the fruit is required to be cov-ered with a tarp while in transit. Tarps range in pricefrom $2,500–$3,000 apiece. Field–cleaning the fruitwill cost the grower approximately $150–$320 per acredepending on the citrus variety. Field–cleaned fruitdoes not require a tarp for transport and can be movedwithin or from the quarantined area. Cleaning at a pack-inghouse within the quarantine area will cost the growerapproximately $300–$400 per acre and the fruit mustremain within the quarantine area, although the loads donot need to be covered with a tarp. There are no citruspacking houses located within this quarantine area.

Based on the preceding above information, it was de-termined that due to the amendment of Section 3435(b),the agency is not aware of any cost impact on a repre-sentative business or private person. For the vast major-ity of businesses within the regulated area, no additionalcosts will be incurred.Small Business Determination

The Department has determined that the proposedregulations may affect small business.

Significant effect on housing costs: None.Results of the Economic Impact Analysis

Amendment of these regulations will not:(1) Create or eliminate jobs within California;(2) Create new businesses or eliminate existing

businesses within California; or(3) Affect the expansion of businesses currently doing

business within California.The Department is not aware of any specific benefits

the amendment of this regulation will have on workersafety or the health of California residents. The Depart-

ment believes the amendment of this regulation benefitsthe welfare of California residents by protecting theeconomic health of the entire citrus industry. In 2010the estimated value was $2.1 billion for citrus fruit and$28.5 million for citrus nursery stock without all the up-stream buyers and downstream retailers included (Ref-erence: John Gilstrap of California Citrus NurseryBoard for citrus nursery stock value and USDA–Na-tional Agricultural Statistics Service 2010 data for cit-rus fruit). This is a needed source of revenue for theState’s economic health and this amendment will helpprotect this source of revenue.

ALTERNATIVES CONSIDERED

The Department must determine that no reasonablealternative it considered to the regulation or that hasotherwise been identified and brought to its attentionwould either be more effective in carrying out the pur-pose for which the action is proposed or would be as ef-fective and less burdensome to affected private personsthan the proposed action or would be more cost–effective to affected private persons and equally effec-tive in implementing the statutory policy or other provi-sion of law than the proposal described in this Notice.

AUTHORITY

The Department proposes to amend Section 3435(b)pursuant to the authority vested by Sections 407, 5301,5302 and 5322 of the FAC.

AUTHORITY AND REFERENCE

Education Code section 44225 authorizes the Com-mission to adopt the proposed regulations. The pro-posed regulations implement, interpret, and make spe-cific Education Code section 44256 pertaining to re-quirements for supplementary authorizations. The pro-posed regulations also include amendments to theforms required during the application process.

INFORMATIVE DIGEST/POLICY STATEMENTOVERVIEW

Summary of Existing Laws and Regulations This rulemaking action proposes amendments to sec-

tions 80057 and 80089 of Title 5 of the California Codeof Regulations (CCR) related to supplementary autho-rizations as approved by the Commission at the June2015 meeting.

GENERAL PROVISIONS

Supplementary Authorizations are limited subjectarea authorizations for departmentalized instructionthat may be added to a general education teaching cre-dential (i.e., Multiple Subject, Single Subject, or olderequivalent). Supplementary Authorizations are basedon the completion of coursework (20 lower division or10 upper division/graduate semester units) in the sub-ject area from a regionally accredited college or univer-sity. These authorizations and the units required are spe-cified in statute. The Commission establishes the spe-cific content areas of study for the coursework that mustbe completed within regulations.

The proposed amendments to regulations reflect achange in focus for the Supplementary Authorization inComputer Concepts and Applications (CCA) from con-tent preparation for teaching basic computer use, key-

boarding, and software applications to more relevant21st century content inclusive of the range of ComputerScience courses taught in California public schools.The proposed amendments include revised ContentAreas of Study for the Supplementary Authorization toserve as a basis for increasing the capacity of teachersprepared to provide instruction in the range of K–12Computer Science courses in California public schools.The proposed regulations also include changing thename of the Supplementary Authorization in CCA toComputer Science as well as general clean–up of out-dated language within the same sections of theseregulations.

PROPOSAL FOR A SUPPLEMENTARYAUTHORIZATION IN COMPUTER SCIENCE

Over the past year, Commission staff has engaged in aseries of conversations with representatives from theAlliance for California Computing Education for Stu-dents and Schools (ACCESS) and the Computer Sci-ence Teachers Association (CSTA) about the currentpreparation and authorizations for teaching the range ofK–12 Computer Science classes in California schools.It is important to note that what is encompassed by thediscipline of Computer Science for K–12 students haschanged. The broad scope of Computer Science today isreflected in the following definition:

Computer Science is the study of computers andalgorithmic processes, including their principles,their hardware and software designs, theirapplications, and their impact on society.1

At the February 2015 Commission meeting(http://www.ctc.ca.gov/commission/agendas/2015–02/2015–02–6B.pdf), it was discussed how courseworkoffered in Computer Science in California publicschools has evolved rapidly in recent years while the re-quired Content Areas of Study for the SupplementaryAuthorization in CCA have remained the same sincefirst developed in 1987.

To address concerns that educators receive the ap-propriate preparation to teach a range of relevant com-puter science courses to California students beyond ba-sic computer functions and applications, Commission-ers provided staff direction to bring forward proposedamendments to Title 5 regulations pertaining to theSupplementary Authorization in CCA.

At the June 2015 meeting (http://www.ctc.ca.gov/commission/agendas/2015–06/2015–06–7B.pdf), theCommission took action to approve proposed amend-ments to Title 5 regulations pertaining to the Supple-mentary Authorization in CCA to strengthen the re-quired Content Areas of Study for the Supplementary

Authorization and to change the name of the Supple-mentary Authorization to Computer Science.

The proposed regulations strengthen the requiredContent Areas of Study for the Supplementary Autho-rization to ensure holders have the requisite contentknowledge to teach the scope of Computer Scienceclasses now offered in California public schools. To re-flect the broader approach to this content area, the pro-posed regulations include changing the name of thisSupplementary Authorization to Computer Science.

California Education Code section 44256 specifiesthe types of supplementary authorizations that may beadded to elementary and secondary teaching creden-

tials, grade level limitations, and the units required sothose specific elements remain the same as the currentrequirements. However, this section of statute also pro-vides that the Commission, by regulation, may requireevidence of additional competence as a condition forinstruction in particular subjects.

The chart below provides the scope of the currentSupplementary Authorizations in CCA and ContentAreas of Study now required and the proposed modifi-cations for the new Supplementary Authorizations inComputer Science, in the far right–hand column indi-cated by underlined text.

For the Introductory Supplementary Authorization inComputer Science, coursework completed must coverthe following content areas:

� Computational thinking: involves solvingproblems and designing systems, usingfundamental computing concepts such asdecomposition, data representation,generalization/abstraction, and algorithms.

� Computing practice and programming: includesexpertise in at least one block–based, visual(drag–and–drop) programming language (e.g.,Alice, Blockly, Kodu, Logo, Scratch, Snap!) or amodern, high–level programming language.

� Computer and communications devices: coversthe major components and functions of digitaldevices and the computing systems they compose.

� Impacts of computing: includes the social,ethical, and legal issues and impacts of computing,as well as the contributions of computer science tocurrent and future innovations in the arts, business,humanities, medicine, and science. These topicsmay be included within courses covering the othercontent areas.

For the Specific Supplementary Authorization inComputer Science, coursework completed must coverthe following content areas:� Computer Programming: includes expertise in at

least one modern, high–level programminglanguage (e.g., Python, Java, C/C++/C#).

� Data structures and algorithms: covers datarepresentation, abstraction, searching and sortingin the context of solving problems usingprogramming and computational tools.

� Digital devices, systems and networks: coverscomputer and communication devices and thesystems they compose, including the concepts andabstractions that enable stand–alone, networked,and mobile digital devices to operate andcommunicate.

� Software design: covers the process of planning,engineering and implementing a software systemto solve a problem, typically using both a designand a programming methodology, such asobject–oriented and functional approaches.

� Impacts of computing: includes the social,ethical, and legal issues and impacts of computing,as well as the contributions of computer science tocurrent and future innovations in the arts, business,humanities, medicine, and science. These topicsmay be included within courses covering the othercontent areas.

The Content Areas of Study coursework require-ments for the Supplementary Authorization in CCAcurrently in regulations specifies coursework in contentthat has now become primarily addressed within thepreliminary preparation program standards for all gen-eral and special education teaching credentials (i.e.,software evaluation and selection, hardware operationand functions, and classroom uses of computers) in Pro-gram Standard 11: Using Technology in the Classroom

(Appendix A in June 2015 agenda item 7B). The pro-posed modifications shown to the Content Areas ofStudy for the Supplementary Authorization in Comput-er Science reflect a more comprehensive preparationwith direct relevance to the range of K–12 ComputerScience courses offered in California public schoolstoday.

The chart also includes as approved at the June 2015meeting bifurcation of the required Content Areas ofStudy for both Introductory and Specific Subject Sup-plementary Authorizations in Computer Science. Pres-ently, the holder of a Single Subject Teaching Creden-tial may only obtain the Specific Subject Supplementa-ry Authorization in CCA, which authorizes depart-mentalized teaching in the subject area in grades K–12but does not require any specific Content Areas ofStudy within the semester units completed. As someSingle Subject Credential holders with the Supplemen-tary Authorization are teaching at the elementary andmiddle school level, the addition of an IntroductorySupplementary Authorization in this content area forthese teachers provides more flexibility to choose thelevel of Supplementary Authorization (Introductory orSpecific) that is most appropriate and clarifies thecoursework appropriate to each level. This additionaloption provides for a thorough but introductory level ofcontent for teaching computer science intended for stu-dents through grade 9 and also aligns with the ContentAreas of Study coursework requirements for holders ofa Multiple Subject Credential teaching computerscience to students in the same grade levels.

As specified in statute, all teachers who are currentlyauthorized to teach the range of courses in ComputerScience will remain authorized (e.g., holders of a Sup-plementary Authorization in CCA or a Single Subjectteaching credential in Mathematics, Business, or Indus-trial Technology Education) even if the proposedamendments are adopted within regulations.

Only teachers initially earning one of these supple-mentary authorizations in the future would be requiredto satisfy the revised Content Areas of Study and be is-sued the Supplementary Authorization in ComputerScience. The proposed regulations include an effectivedate of April 1, 2016 in order to provide transition timefor teachers currently pursuing a Supplementary Au-thorization in CCA.

Objectives and Anticipated Benefits of the ProposedRegulations

The objectives of the proposed regulation amendmentsare to:

� change the name of the SupplementaryAuthorization in Computer Concepts andApplications to Computer Science

� specify the required content areas of studyeducators must complete to obtain theSupplementary Authorization in ComputerScience

The Commission anticipates that the proposedamendments will benefit the welfare of students attend-ing public schools in the State of California by assuringteachers seeking to teach Computer Science courseswill have completed the comprehensive preparation re-quired to provide meaningful instruction in the range ofK–12 Computer Science courses available in Californiapublic schools. The proposed regulations will promotefairness and prevent discrimination by ensuring unifor-mity in the requirements individuals are held to whenproviding instruction to students in the content area ofComputer Science. The Commission does not antici-pate that the proposed regulations will result in theprotection of public health and safety, worker safety, orthe environment, the prevention of social inequity or anincrease in openness and transparency in business andgovernment.

Determination of Inconsistency/Incompatibility withExisting State Regulations

The Commission has determined that the proposedregulation amendments are not inconsistent or incom-patible with existing regulations. After conducting a re-view for any regulations that would relate to or affectthis area, the Commission has concluded that these arethe only regulations that concern the supplementaryauthorization in Computer Science in California.

The proposed regulations will promote fair-ness and prevent discrimination by ensuring uniformityin the requirements individuals must meet to obtain theSupplementary Authorization in Computer Science.The Commission does not anticipate that the proposedregulations will result in the protection of public healthand safety, worker safety, or the environment, the pre-vention of social inequity or an increase in openness andtransparency in business and government.

Effect on small businesses: The proposed regulationswill not have a significant adverse economic impactupon business. The proposed regulations apply only to

AUTHORITY AND REFERENCE

Section 333:Labor Code sections 54, 55 and 6319 authorize the

Director to adopt the Proposed Regulations. The Pro-posed Regulations implement, interpret, and make spe-cific Sections 6319, 6320, and 6625 of the Labor Code.Section 336:

Labor Code Sections 54, 55, 6319, 6319.3, 6401.7and 9060 authorizes the Director to adopt the ProposedRegulations. The Proposed Regulations implement, in-terpret, and make specific Sections 6314.5, 6318, 6319,6320, 6401.7, 6409.1, 6427–6432, 6434, 6625, 7320,7321, 7321.5, 7381 and 9060 of the Labor Code.

INFORMATIVE DIGEST/POLICY STATEMENTOVERVIEW

The Department is the state agency responsible foradministering California’s state plan for occupational

safety and health. The Department is under the controlof the Director, who performs all duties and exercisesall powers and jurisdiction vested by law in the Depart-ment, including the promulgation of regulations neces-sary to carry out the provisions of the Labor Code.

The Division of Occupational Safety and Health(“the Division”) within the Department is charged withthe administration and enforcement of the provisions ofthe California Occupational Safety and Health Act,commencing with Labor Code section 6300, as well asother provisions of law impacting upon the health andsafety of employees in the State of California. The Divi-sion has jurisdiction over every employment and placeof employment in California to enforce all laws or spe-cial orders requiring such employment and place of em-ployment to be safe.

After inspecting an employer’s work place, the Divi-sion is authorized to issue citations to that employer forviolations of Title 8 discovered during the inspection.The Division also has authority to impose civil penal-ties with the citations it issues. The Division calculatesthe amount of the civil penalties according to Title 8regulations promulgated by the Director.

One factor in calculating a civil penalty is abatement;employers who abate cited violations may be eligiblefor a 50% penalty reduction as an “abatement credit.”

Prior to February 2015, the Division granted the 50%abatement credit to employers at the time of issuance,on the presumption that the employers would abateviolations by the date the Division fixed for abatementon the face of the citations. In other words, the Divisiongranted the abatement credit prospectively, before theemployers were even required to abate the citedconditions.

Effective January 1, 2015, the Legislature amendedLabor Code sections 6319 and 6320 to prohibit the Di-vision from granting an abatement credit unless the em-ployer has either abated the violation while the Divi-sion’s inspection is ongoing, or submitted evidence ofabatement within 10 working days after the end of theperiod the Division fixes for abatement in a citation.(Stats 2014 Ch. 497 § 1 (AB 1634).)

The Director promulgated emergency regulations,effective February 12, 2015, to implement the require-ments of AB 1634 (“the Emergency Regulations”.) TheEmergency Regulations made the following changes toSections 333 and 336 of Title 8:1. Under Section 333, if an employer fails to notify

the Appeals Board in writing of its intention tocontest a citation within 15 working days from thedate it receives a citation and civil penalty, then thecitation and civil penalty are deemed a final orderof the Appeals Board, not subject to review by anycourt agency. The Emergency Regulations addedthe words “Final Order” to the title of Section 333.

In addition, the Emergency Regulations created anexception in the “final order rule” of Section 333 toallow the Division to modify the civil penalty of acitation pursuant to Section 336(e)(2) even if thecitation has become a final order by operation oflaw, and further specified that any suchmodification to the civil penalty would not beappealable to the Appeals Board.

2. The Emergency Regulations divided Section336(e) into subsections (e)(1), relating toabatement credits for General violations andsubsection (e)(2), relating to abatement credits forSerious violations. The Emergency Regulationsdeleted provisions relating to the abatement ofSerious violations from Subsection (e)(1).

3. The Emergency Regulations added Subsection(e)(2) to govern abatement credit for Seriouscitations. It provides that, for Serious violationsnot listed in Subsection (e)(3), the Division willnot grant an abatement credit unless the employerhas either: (a) abated the violation during thecourse of the Division’s inspection and before theissuance of a citation; or (b) submitted to theDivision a signed statement with supportingevidence showing abatement of the Seriousviolation within 10 working days after the end ofthe period the Division fixed for abatement in thecitation.

4. Subsection (e)(3) of the Emergency Regulationslisted the types of Serious violations that wouldnot be subject to an abatement credit, including:(a) Serious citations with high Extent andLikelihood modifiers; (b) citations classified as“Repeat Serious” and “willful Serious;” (c)Serious violations respecting the use of acarcinogen; and (d) Serious violations causingdeath or serious injury, illness, or exposure asdefined in Labor Code section 6302.

The Emergency Regulations will be in effect untilAugust, 2015. Before that time, the Director proposes topromulgate the Proposed Regulations, which are sub-stantially similar to the Emergency Regulations,through the regular rulemaking process so that they willcontinue in effect after August. However, as set forthbelow, the Director proposes to make some changes tothe language of the Emergency Regulations, as follows:

The Proposed Regulations would add the words “Fi-nal Order” to the title of Section 333 to alert the regu-lated public as to the subject matter of that section. Se-cond, the Proposed Regulations would divide Section333 into Subsection 333(a) and Subsection 333(b).Subsection 333(a) would enunciate the existing generalrule that, if an employer fails to notify the AppealsBoard in writing of its intention to contest a citation

within 15 working days from the date it received a cita-tion and civil penalty, then the citation and civil penaltyare deemed a final order of the Appeals Board, not sub-ject to review by any court or agency.

In addition, under new Subsection 333(b), the Pro-posed Regulations would create an exception in the “fi-nal order rule” of Subsection 333(a) to require the Divi-sion to modify the civil penalty of a citation pursuant toSection 336(e)(2) if an employer timely submits satis-factory proof of abatement, even if the citation has be-come a final order by operation of law. Subsection (b)also allows employers to appeal the Division’s denial ofabatement credit if there is a dispute about the sufficien-cy of timely submitted abatement measures or if there isa dispute about the correct calculation of the 50%abatement credit.

The Proposed Regulations would amend Section 336 asfollows:

1. Existing section 336(e) governs abatement creditfor General and Serious violations. The ProposedRegulations would divide Subsection (e) intosubsections (e)(1) and (e)(2). Subsection (e)(1)would govern abatement credits for Generalviolations, while Subsection (e)(2) would governabatement credits for Serious violations. TheProposed Rulemaking would delete provisionsrelating to the abatement of Serious violationsfrom subsection (e)(1). It would also specify that“Repeat General” and “Willful General” citationswould not be eligible for an abatement credit.

2. The Proposed Regulations would add subsection(e)(2) to Section 336 to govern abatement creditfor Serious citations. It would provide that, forSerious violations not listed in subsection (e)(3),the Division will only grant an abatement credit ifthe employer has either: (a) abated the violationduring the course of the Division’s inspection andbefore the issuance of a citation; or (b) submittedto the Division a signed statement with supportingevidence showing abatement of the Seriousviolation within 10 working days after the end ofthe period the Division fixed for abatement in thecitation.

3. Subsection (e)(3) of the Proposed Regulationswould list the types of Serious violations thatwould not be subject to an abatement credit,including: (a) Serious citations with high Extentand Likelihood modifiers; (b) citations classifiedas “Repeat Serious” and “Willful Serious”; (c)Serious violations respecting the use of acarcinogen; and (d) Serious violations causingdeath or serious injury, illness, or exposure asdefined in Labor Code section 6302.

4. The Proposed Regulations would amendSubsection (f) to specify that the requiredstatement of abatement must be signed.

Anticipated Benefits of the Proposed Regulations:The Proposed Regulations will immediately further

the goal of A.B. 1634 to promote safe and healthfulworkplaces by encouraging employers to correct seri-ous unsafe and unhealthy working conditions — i.e.,those conditions which have a reasonable possibility ofcausing serious injury or death — within days after re-ceipt of a citation in order to receive the 50% civil pen-alty reduction, rather than potentially waiting up to sev-eral years to abate once all appeals of a citation havebeen exhausted.Determination of Inconsistency/Incompatibility withExisting State Regulations:

The Director has determined that the Proposed Regu-lations are not inconsistent or incompatible with exist-ing regulations. After conducting a review for any regu-lations that would relate to or affect this area, the Direc-tor has concluded that these are the only regulations thatconcern the calculation of abatement credit for the Divi-sion’s citations and civil penalties.

DISCLOSURES REGARDING THEPROPOSED REGULATIONS

The Director has made the following initialdeterminations:

not aware of any costs or savings that a State agency willincur in reasonable compliance with the ProposedRegulations.

Businesses: The Director is not aware of any cost im-pacts that a representative private person or businesswould necessarily incur in reasonable compliance withthe Proposed Regulations.

Under existing regulations, the Division prospective-ly grants a 50% abatement credit to the proposed civilpenalty for eligible citations at the time of issuance, onthe presumption that the cited employer will timely

abate the cited condition. If an employer fails to timelyabate a given citation, the Division is authorized to re-scind the 50% abatement credit, re–inspect the workplace, and/or issue a failure–to–abate citation with en-hanced civil penalties. Thus, an employer ultimatelydoes not retain the 50% abatement credit unless it cor-rects a cited hazard.

The Proposed Regulations have a similar effect, withless administrative work for the Division. The Divisionwill not grant the 50% abatement credit for Serious cita-tions unless and until the employer has abated the citedserious hazard. Thus, employers who comply with theabatement requirements will receive abatement creditfor timely–submitted proof of abatement. Only thoseemployers who fail to timely submit proof of abatementwill forfeit the 50% abatement credit, even if they latersubmit satisfactory evidence of abatement.

Statistics from the Integrated Management Informa-tion System (“IMIS”) show that approximately 40% ofSerious citations are not abated at the time of issuance.However, it is not possible to extract from IMIS thenumber of Serious citations out of that 40% for whichthe Division does not receive timely proof of abate-ment. Therefore, the Director cannot estimate what theaggregate cost impact will be to employers who choosenot to timely abate Serious citations.

Statewide adverse economic impact directly affect-ing businesses and individuals: Although the ProposedRegulations will directly affect businesses (that haveemployees) statewide, the Director anticipates that theadverse economic impact, including the ability ofCalifornia businesses to compete with business in otherstates, will not be significant.

Significant effect on housing costs: The ProposedRegulations will not significantly affect housing costs.

Results of the Economic Impact Analysis/Assessment:

The Director concludes that it is (1) unlikely that theProposed Regulations will eliminate any jobs for em-ployers, (2) unlikely that the Proposed Regulations willcreate a significant number of jobs for employers, (3)unlikely that the Proposed Regulations will create a sig-nificant number of new businesses employing workers,(4) unlikely that the Proposed Regulations will elimi-nate any existing businesses, and (5) unlikely that theProposed Regulations will result in the expansion ofbusinesses currently doing business within the state.

Benefits of the Proposed Action: The Proposed Reg-ulations will benefit California workers because it willinduce employers to abate occupational safety andhealth violations within days of the issuance of citationsin order to receive an abatement credit. The faster em-ployers abate unsafe conditions, the less time their em-ployees are exposed and at risk of injury or illness on thejob. The anticipated decrease in injuries will have atten-

dant economic benefits, including fewer work days lostto occupational injuries and illnesses and fewer work-ers’ compensation claims.

Small Business Determination: The Director has de-termined that the Proposed Regulations affect smallbusiness.

CONSIDERATION OF ALTERNATIVES

In accordance with Government Code section11346.5, subdivision (a)(13), the Director must deter-mine that no reasonable alternative it considered or thathas otherwise been identified and brought to her atten-tion would be more effective in carrying out the purposefor which the action is proposed or would be as effectiveand less burdensome to affected private persons thanthe Proposed Regulations or would be more cost–effec-tive to affected private persons and equally effective inimplementing the statutory policy or other provision oflaw.

AUTHORITY AND REFERENCE

The authority of this regulation is found in Militaryand Veterans Code (M&VC) 1455(a) and 1455(d) andthe reference is Military and Veterans Code Sections1400, 1410, and 1455. The proposed adoption removesunnecessary language, implements a standardized in-terment fee for veterans’ spouses and eligible depen-dents at current and future State Veterans Cemeteries,

provides for the perpetual maintenance of these grave-sites by increasing the fee established for their inter-ment, and implements a policy and fee required for dis-interment of a decedent from a State Veterans Ceme-tery.

INFORMATIVE DIGEST/POLICY STATEMENTOVERVIEW

The specific objective of this regulation is to removelanguage that is unnecessary and add required docu-mentation for eligibility. This regulation will create acommon spouse and dependent burial fee for all currentand future State Veterans Cemeteries which will pro-vide for the ongoing perpetual maintenance of the cem-eteries until such time as the cemeteries are deemed“closed.” This regulation will also create a fee for thework required for the disinterment of a decedent from aState Veterans Cemetery.

Current California Military and Veterans Code Sec-tion 1455(a) states that the California Department ofVeterans Affairs shall adopt regulations to specify theappropriate fees to be charged for interment or burial ofspouses and dependent children of honorably dis-charged veterans, and appropriate fees for the disinter-ment of remains. At this time the burial fee is not con-current with the federal reimbursement rate for veter-ans’ burials, and there is not an established fee for theCalifornia Central Coast Cemetery (opening July2016). There are no fees currently for disinterment.

This regulation will allow CalVet to standardize thespouse and dependent burial fee for all State VeteransCemeteries. The proposed regulation will establish theguidelines for the burial fees to be concurrent with theU.S. Department of Veterans Affairs veteran reim-bursement rate including a cost of living adjustment(COLA) which is established at the beginning of eachfederal fiscal year. This regulation will establish the feefor disinterment of a casketed burial, an in–groundcremation burial, and burial in the columbaria.Anticipated Benefits of the Proposed Regulations

By providing the State Veterans Cemeteries a stan-dard interment fee based on the federal reimbursementrate CalVet will be able to more effectively provide forthe perpetual maintenance of the State Veterans Ceme-teries into the future until such time as the cemeteriesare “closed.” The State Veterans Cemeteries will nothave to rely as heavily on State General Funds for op-eration. As the cost of living allowance rises the burialfee will rise with the standard of the federal reimburse-ment rate. The burial fees will continue to be depositedinto the appropriate State Veterans Cemeteries Endow-ment Fund or Perpetual Maintenance Fund. These En-dowment Funds will continue to grow with interest over

time and allow for the cemeteries to become self–sustainable once they are closed for burials.Determination of Inconsistency/Incompatibility withExisting State Regulations

CalVet has determined that this proposed regulationis not inconsistent or incompatible with existing regula-tions. After conducting a review for any regulations thatwould relate to or affect this area, CalVet has concludedthat the only legal reference that concerns a fee forspouses and eligible dependent burials was establishedin M&VC Section 1400(b)(1) for the Northern Califor-nia Veterans Cemetery in 1999. M&VC Section 1455was adopted in 2010, so supersedes Section 1400(b)(1).

TITLE 14. FISH AND GAMECOMMISSION

NOTICE IS HEREBY GIVEN that the Fish andGame Commission (Commission), pursuant to the au-thority vested by Sections 8403 and 9022 of the Fishand Game Code and to implement, interpret or makespecific Sections 8403, 9001.6, 9001.7 and 9022 of saidCode, proposes to amend Section 180.6, Title 14,California Code of Regulations (CCR), relating to com-mercial hagfish traps.

INFORMATIVE DIGEST/POLICY STATEMENTOVERVIEW

Current statutes provide that Pacific hagfish, Eptatre-tus stoutii, (hagfish) may be taken by Korean style trapsor 5–gallon bucket traps; specify the maximum numberof traps allowed by trap type; require a general trap per-mit; prohibit possession of other species or gear whiletargeting or having in possession hagfish, and prohibit

the use of popups on buoy lines for bucket and Koreantraps (Sections 9000.5, 9001, and 9001.6, Fish andGame Code). Fish and Game Code subsection9001.6(a) is only a limitation on the use of Korean andbucket traps, not a limitation on the type of gear thatmay be used to take hagfish. Current regulation pro-vides that all escapement holes, except for the entrancefunnel, must have a minimum diameter of 9/16 inch(Section 180.6, Title 14, CCR) to minimize take of im-mature hagfish.

PROPOSED REGULATION

The proposed changes to Section 180.6, Title 14,CCR, will allow hagfish to be taken in 40–gallon barreltraps and will allow the use of up to two ground linesand up to 25 barrel traps per vessel. The proposed regu-lation specifies that if using barrel traps, no other traptype may be used or possessed aboard the vessel, andpopups are not authorized for use with buoy linesattached to barrel traps.

BENEFITS OF THE PROPOSED REGULATIONS

The proposed regulations could reduce or eliminatenegative interactions with cetaceans and other fishinggear, and lost fishing gear, particularly in areas utilizedby multiple fisheries. The larger capacity of this traptype could reduce stress or mortality of captured hag-fish due to crowding.

Adoption of sustainable fishing regulations includinggear type provides for the maintenance of sufficient fishpopulations and ensures their continued existence.

EVALUATION OF INCOMPATIBILITY WITHEXISTING REGULATIONS

Section 20, Article IV, of the State Constitution speci-fies that the Legislature may delegate to the Fish andGame Commission such powers relating to the protec-tion and propagation of fish and game as the Legislaturesees fit. The Legislature has delegated to the Commis-sion the power to regulate the commercial take of fin-fish using traps (Sections 8403 and 9022, Fish andGame Code). No other State agency has the authority topromulgate commercial fishing regulations. The pro-posed regulations are compatible with Sections 180,180.2, 180.4 and 180.5, Title 14, CCR, which addressother aspects of commercial take of finfish using traps.The Commission has searched the CCR for any regula-tions regarding the use of traps for the commercial takeof hagfish and has found no such regulation; therefore

the Commission has concluded that the proposed regu-lations are neither inconsistent nor incompatible withexisting State regulations.

Annual fishing quotas are necessary to provide for asustainable fishery. The proposed regulatory changes inSection 163 will establish the fishing quota for the2015–16 season in San Francisco Bay:� Set the San Francisco Bay quota for the 2015–16

season from zero (0) to five percent of the 2014–15San Francisco Bay spawning biomass estimate forPacific herring as provided in the 2015 DraftSupplemental Environmental Document. TheDepartment is recommending a quota of fivepercent or 834 tons.

The proposed regulatory changes in Section 164 willestablish the herring eggs on kelp (HEOK) fishing quo-ta and amend the permit renewal date and form for theSan Francisco Bay fishery:� A minor editorial change will be made to Section

164 indicating a change in the revision date (Rev.2/14) to (Rev. 06/04/15) on the HEOK RoyaltyReport Form.

� A minor change will be made to Section 164indicating that renewal of all HEOK permits are tobe received by the Department, or if mailed,postmarked, on or before the first Friday ofOctober each year. The revision is necessary toupdate the “permit application date” and alignwith the renewals dates for all other herringpermits.

� Increase the San Francisco Bay HEOK quotaallocation for individual HEOK permits from 0.79to 1.0 percent of the overall quota as specified inSection 163 for harvest of herring.

BENEFITS OF THE REGULATION

The Commission anticipates benefits to the State’senvironment and the health and welfare of Californiaresidents. The proposed regulation changes are in-tended to set annual harvest quotas within a range thatwill maintain sustainable herring populations for theirecological values and commercial use. Maintaining asustainable herring fishery also encourages consump-tion of local seafood.

CONSISTENCY WITH STATE ORFEDERAL REGULATIONS

Directly Affecting Businesses, Including theAbility of California Businesses to Compete withBusinesses in Other States:Herring roe prices are set on the internationalmarket and not directly impacted by Californiaregulations and quotas. Recently, herring roe hasdeclined in value due to a market oversupply and adecline in overall demand. As a result, no adverseincremental economic impact to businesses,including the ability of California businesses tocompete with businesses in other states, isanticipated to occur with a quota allocation of 50tons or more. However, a zero ton quota wouldeliminate any revenues from the Californiaherring fishery. This impact could be mitigated tothe extent that fishermen can pursue other species;the total economic impact should not besignificant.

(b) Impact on the Creation or Elimination of JobsWithin the State, the Creation of New Businessesor the Elimination of Existing Businesses, or theExpansion of Businesses in California.Due to poor market conditions and lowparticipation by the herring fleet during the2014–15 season, any quota option over 50 tonswill likely result in positive incrementalcontributions to employment for the State: forexample, an increase of about 71 jobs for a quota of834 tons (see section VII of the Initial Statement ofReasons). Conversely, a zero (0) ton quota couldadversely impact about four jobs in the fishing

industry and related industries. This is based on anemployment multiplier of 27 jobs per each milliondollar change in direct output from commercialherring fishing activities.

Most commercial herring industry participants aresmall businesses (as defined under CaliforniaGovernment Code Section 11342.610), whichmay incur a detriment under a quota option lessthan 50 tons for San Francisco Bay. The totalharvest of Pacific herring landed during the2014–2015 season was 46 tons, though theallowable quota was 2,500 tons. This lowexploitation rate and participation level by theherring fleet was driven by poor internationalmarket conditions. Due to the small scale andseasonality of the California herring fishery it isunlikely that any of the proposed quota optionsalone would cause the elimination/expansion ofexisting businesses in the State.

Benefits of the Proposed Regulatory Action:

The Commission anticipates benefits to the State’senvironment and the health and welfare ofCalifornia residents. The proposed regulationchanges are intended to set annual harvest quotaswithin a range that will maintain sustainableherring populations for their ecological values andcommercial use. Maintaining a sustainableherring fishery also encourages consumption oflocal seafood.

The Commission does not anticipate anynon–monetary benefits to worker safety as a resultof the proposed regulation.

INFORMATIVE DIGEST/POLICY STATEMENTOVERVIEW

Under existing law, Dungeness crab may be taken forrecreational purposes with a sport fishing license sub-ject to regulations prescribed by the Fish and GameCommission (Commission). Current regulations speci-fy seasons, size limits, bag and possession limits, closedfishing areas, and gear restrictions.

Recreational fishing groups and constituents, includ-ing the Coastside Fishing Club, the Golden Gate Fisher-men’s Association, and one Commercial PassengerFishing Vessel (CPFV) Captain, sent letters to the De-partment of Fish and Wildlife (Department) and theCommission requesting several changes to Dungenesscrab recreational fishery regulations. They proposedmaking the current Dungeness crab daily bag limits andsize limits uniform statewide at ten crab that are a mini-mum of 5.75 inches carapace width, in order to elimi-

nate the unfairness to fishers aboard CPFVs in Sonoma,Marin, San Francisco, San Mateo, Santa Cruz, andMonterey counties, who are only allowed to take sixcrab that are 6 inches or greater under current regula-tions. The Department has reviewed landings data forthe commercial fleet in this region for the past ten sea-sons and recent recreational catch estimates. Whilethere is no resource allocation between sectors, the datasuggest that the increase in CPFV bag limit and de-crease in minimum size limit would not significantly al-ter use patterns between sectors, and that maintainingdifferent bag and size limit for CPFVs in these countiesis not warranted. Therefore the Department is propos-ing that the separate CPFV regulatory language beremoved.

The Coastside Fishing Club also requested that recre-ational crab traps be required to contain a destruct de-vice to prevent ‘ghost fishing’ by lost traps, and that thetrap buoys must contain the contact information of thecrab trap operator to deter theft of crabs from traps. TheDepartment is proposing that each crab trap possess adestruct device similar to commercial crab traps, andthat each crab trap buoy must display the trap owner’sGO ID number located on his/her sport fishing license.

Lastly, the Department proposes a seven–day waitingperiod prior to the start of the Dungeness crab recre-ational season for deploying crab traps. This would pro-hibit the covert targeting of Dungeness crab under theguise of rock crab fishing before the start of the season.

In addition to these changes, the Department is pro-posing to add clarifying language to subsection (e) ofSection 29.80, Title 14, CCR, specifying that Point Ar-guello is located in Santa Barbara County.

The following Title 14, CCR, regulation changes areproposed to become effective prior to the start of the2015–16 Dungeness crab season (i.e., November 7,2015, the first Saturday in November):1. Remove the bag and minimum size exception

language in subsections (a)(3) and (a)(7) ofSection 29.85 that limits CPFVs in Sonoma,Marin, San Francisco, San Mateo, Santa Cruz, andMonterey counties to the take of six Dungenesscrab that are 6 inches in carapace width or greater.

2 Add Santa Barbara County as the location of PointArguello under subsection (e) of Section 29.80.

The following Title 14, CCR, regulation changeswould specify an effective date of August 1, 2016,which immediately follows the close of the 2015–16Dungeness crab season:3. Add language to subsection (c) of Section 29.80

that requires, as of August 1, 2016, crab traps tohave one destruct device of a single strand ofuntreated cotton twine size No. 120 or less thatcreates an unobstructed escape opening in the top

or upper half of the trap of at least five inches indiameter when the destruct attachment materialcorrodes or fails.

5 Add language to subsection (c) of Section 29.80that prohibits, as of August 1, 2016, crab trapsfrom being deployed in ocean waters seven daysprior to the opening of the Dungeness crab season.

The Department is proposing the following changesto current regulations:

Snagging DefinitionSubsection 2.00(b) would be amended to further de-

fine snagging. Currently, the snagging definition statesthat it is illegal to impale a fish in any part of its bodyother than the mouth. This makes it legal for anyoneto keep a fish that has been hooked on the outside of themouth, such as a hook that enters from the lower jawinto the mouth or nose into the mouth. The proposal is toreword the definition to say other than inside themouth. Subsections 2.00(b) and (c), and Section 1.05will need to be amended for consistency.

Proposal: Amend Section 1.05, Angling, andsubsections (b) and (c) of Section 2.00, FishingMethods — General

Amend the regulations to clarify that it is illegal totake a fish not hooked on the inside of the mouth.

Landlocked Salmon DefinitionCurrent regulations incorporate kokanee (Oncorhyn-

chus nerka) into the definition of “Trout,” and stocked,landlocked Chinook salmon into the definition of“Salmon,” which includes anadromous forms of salm-on. Scientific evidence, including life history variationand behavioral differences, suggests the need for differ-ing management strategies for these species. Theyshould be separately defined and addressed in the fresh-water sport fishing regulations. In addition, these newspecies definitions need to have associated bag andpossession limits.

Proposal: Amend Section 1.86, Trout; Section 7.00,District General Regulations; add, sections 1.57 and5.41, Landlocked Salmon

Create a new definition for landlocked salmon whichwill include kokanee and landlocked Chinook salmon.New daily bag and possession limits for landlockedsalmon are proposed in a new Section 5.41. The newbag limit will be 5 fish and the possession limit will be10 fish. Amend the District General Regulations in Sec-tion 7.00 to revise the references to trout and salmon tojust trout except for daily bag and possession limitswhich means the total number of trout or landlockedsalmon in combination. This change is proposed to re-duce public confusion with landlocked salmon versusanadromous salmon that are allowed only in the Section

Correct the numbering errors in this section to reducepublic confusion and enforcement issues.Sturgeon Fishing Closure

Green sturgeon and white sturgeon (subadults andadults) are often stranded for long periods in the YoloBypass as well as the Toe Drain and Tule Canal up-stream of Lisbon Weir. Some of those fish escape whenenvironmental conditions change but others are rescuedor succumb. Through catch–and–release, legal harvest,and poaching, anglers could take both species whenstranded. The legal fishery on stranded fish is not sport-ing, reduces the benefit of rescue efforts, and reducespopulation spawning potential. Because green sturgeonis a threatened species and white sturgeon is a substan-tial management concern, addressing this issue is rela-tively urgent. Therefore, the Department is proposing toprohibit the take and possession of sturgeon in the YoloBypass as well as the Toe Drain and Tule Canal up-stream of Lisbon Weir at any time.

Current regulations in subsection (d) of Section 5.80state that a sturgeon must voluntarily take the bait orlure in its mouth. This language is proposed to be re-vised to read inside its mouth, to be consistent with pro-posed revisions to the snagging definition in Section2.00.Proposal: Add subsection (j) to Section 5.80 and amendsubsection (d), White Sturgeon, Methods of take.

Prohibit fishing for sturgeon in the Yolo BypassFlood Control System to protect green and whitesturgeon.

Amend the regulations to clarify that it is illegal totake a fish not hooked on the inside of the mouth foralignment with the proposed snagging definitionchanges to Section 2.00.Green Sturgeon Revision for Brevity

Current regulations restrict fishing from 500 feet up-stream to 150 feet below Red Bluff Diversion Dam(RBDD). RBDD is no longer operated as an irrigationdiversion so the current restrictions about fishing near adam are no longer needed. Boaters, and recreationists,and fish are free to pass up and downstream of the areaat will. The angling public is very interested in anglingin the immediate vicinity of the RBDD now that it is nolonger in operation and the Sacramento River is not im-pounded by its gates. The proposal is to allow shore andboat angling above and below RBDD on the Sacramen-to River.Proposal: Amend Special Fishing Regulationssubsection (b)(156.5), Sacramento River

Remove the current fishing restriction above and be-low RBDD on the Sacramento River to increase anglingopportunities in Tehama County.Solano Lake

The proposal is to add Solano Lake to Section 7.50,Alphabetical List of Waters with Special Fishing Regu-lations. The original intent was for Solano Lake to beincluded in the Putah Creek special fishing regulations.That regulation applies to the stream reach from SolanoLake to Monticello Dam and does not include SolanoLake. Therefore, a new subsection needs to be added toSection 7.50.Proposal: Add subsection (b)(180.6), Solano Lake, tothe Special Fishing Regulations

Add a new regulation for Solano Lake to the SpecialFishing Regulations. The daily bag and possession limitwill be 0 (zero).San Francisco and San Pablo Bays Clarification

Currently there are three sections dealing with theOcean and San Francisco Bay District which describeregulations in different manners causing confusion foranglers and making enforcement of the regulationsmore difficult:� Section 27.00 defines the Ocean and San

Francisco Bay District as waters of the open coastand includes San Francisco and San Pablo Bays“plus all their tidal bays, tidal portions of theirrivers and streams, sloughs and estuaries”between the Golden Gate Bridge and theCarquinez Bridge.

� Section 1.53 defines inland waters as all fresh,brackish and inland saline waters of the state,including lagoons and tidewaters upstream fromthe mouths of coastal rivers and streams. Inlandwaters exclude the waters of San Francisco andSan Pablo Bays downstream from the CarquinezBridge, the tidal portions of rivers and streamsflowing into San Francisco and San Pablo Bays,and the waters of Elkhorn Slough, west of ElkhornRoad between Castroville and Watsonville.

� Section 28.65(a) (which describes gearrestrictions for fin fish). Defines the area as SanFrancisco and San Pablo Bays between the GoldenGate Bridge and the west Carquinez Bridge, whereonly one line with not more than three hooks maybe used.

The different definitions of the same geographic areacause confusion as to applicable method of take as wellas which set of regulations apply to the waters beingfished.

An angler is allowed to use any number of hooks andlines in the ocean waters (Section 28.65). In Inland wa-ters only one closely attended line with no more thanthree hooks may be used (Section 2.00). Under currentregulations, a person could argue that tidal portions ofthe Napa River were not Inland Waters since Section28.65(a) did not include the tidal portions of river flow-ing into San Francisco and San Pablo Bays. Under thisinterpretation, they could use any number of lines andhooks to fish in the Napa River. This would restrict wa-ters of San Francisco and San Pablo Bay to one line,then allow unlimited lines in the Napa River waterswhich were tidally influenced even though all inlandwaters are restricted to one line.

In addition, fishing regulations for Ocean Waters de-fined in Section 27.00 are different from Inland Watersas defined in Section 1.53. Since tidal influence cannoteasily be determined, it is almost impossible to knowwhich set of regulations apply in the tidally influencedwaters. For instance is an undersized sturgeon caught inthe Napa River a violation of section 5.80 or Section27.90?

To simplify the regulations and make all of the regu-lations consistent, all three sections must use the samereference.

The proposal is to amend sections 27.00 and 1.53 toalign with Section 28.65(a) and remove the reference totidal bays and tidal portions of rivers and streams fromthese two sections. As a result, inland waters will nowinclude the tidal portions of rivers and streams flowinginto San Francisco and San Pablo Bays which will besubject to the gear restrictions for inland waters whereonly one closely attended rod and line with no morethan three hooks may be used.

Amend the two regulations that define the San Fran-cisco and San Pablo Bays to be consistent, reducingpublic confusion and enforcement issues. Remove ca-pitalized text before the note which is a printing error.Fishing Contest Draw Dates

The current wording of subsection 230(b)(1)(A) des-ignates specific dates for a drawing that is conductedannually by Department personnel to allocate Type Afishing contest permits in a fair manner. Dates are thesecond Friday of July for bodies of water north of theTehachapi Mountains and the third Friday of July forwaters south of the Tehachapi Mountains.

Specific designation of these dates can conflict withmajor fishing–related events that contest sponsors oftenneed to attend (e.g., International Convention of AlliedSport fishing Trade — ICAST). Sponsors who must at-tend the ICAST show — an international conference offishing gear manufacturers, media, and many others —cannot simultaneously attend the contest drawing, hin-dering the conflict resolution process for which thedrawing is held.

The Department is proposing to amend the regula-tions to state that the contest drawings will be conductedin July and the dates will be determined by Departmentstaff.Proposal: Amend subsection (b)(1)(A) of Section 230,Issuance of Permits for Contests Offering Prizes for theTaking of Game Fish

Amend the regulations to change the current contestdrawing dates to unspecified dates in July which will bedetermined by Department staff.Minor Editorial Corrections for Clarity

Additional editorial corrections are proposed to cor-rect typographical errors and to improve regulationclarity.Benefits of the Proposed Regulations

It is the policy of this state to encourage the conserva-tion, maintenance, and utilization of the living re-sources of the ocean and inland waters under the juris-diction and influence of the state for the benefit of all thecitizens of the State. In addition, it is the policy of thisstate to promote the development of local Californiafisheries in harmony with federal law respecting fishingand the conservation of the living resources of the oceanand inland waters under the jurisdiction and influenceof the State. The objectives of this policy include, butare not limited to, the maintenance of sufficient popula-tions of all species of aquatic organisms to ensure theircontinued existence and the maintenance of a sufficientresource to support a reasonable sport use. Adoption of

scientifically–based trout and salmon seasons, size lim-its, and bag and possession limits provides for the main-tenance of sufficient populations of trout and salmon toensure their continued existence.

The benefits of the proposed regulations are concur-rence with Federal law, sustainable management ofCalifornia’s trout and salmon resources, and promotionof businesses that rely on recreational sport fishing inCalifornia.

Evaluation of Inconsistency/Incompatibility withExisting State Regulations

The Commission has evaluated the proposed regula-tion and has determined that these are the only regula-tions dealing with inland sport fishing. Therefore, theproposed regulations are neither inconsistent nor in-compatible with existing state regulations.

IMPACT OF REGULATORY ACTION/RESULTSOF THE ECONOMIC IMPACT ANALYSIS

The proposed regulations will revise and update in-land sport fishing regulations starting in 2016. Current-ly, the seasons, size limits, and bag and possession lim-its for sport fishing are periodically reviewed by the De-partment of Fish and Wildlife and the Commission.This set of amendments will clarify regulations forsnagging, landlocked salmon, San Francisco and SanPablo Bay, Solano Lake, and reptiles, to reduce publicconfusion and improve regulatory enforcement. Addi-tionally, this proposal will add a new fishing restrictionto protect sturgeon, and increase fishing opportunitieson the Sacramento River.

Inland sport fishing regulation’s affected parties in-clude recreational anglers, commercial passenger fish-ing vessels and a variety of businesses that support an-glers. The economic impact of regulatory changes forsport fisheries are estimated by tracking resultingchanges in fishing effort, angler trips and length of stayin the fishery areas. Distance traveled affects gas andother travel expenditures. Day trips and overnight tripsinvolve different levels of spending for gas, food and

accommodations at area businesses as well as differentlevels of sales tax impacts. Direct expenditures ripplethrough the economy, as receiving businesses buy inter-mediate goods from suppliers that then spend that reve-nue again. Business spending on wages is received byworkers who then spend that income, some of whichgoes to local businesses. Recreational fisheries spend-ing, thus multiplies throughout the economy with theindirect and induced effects of the initial directexpenditure.

The adoption of scientifically–based regulations pro-vides for the maintenance of sufficient populations ofinland sport fish to ensure their continued existence andfuture sport fishing opportunities that in turn supportbusinesses related to the fishery economy.

The most recent 2011 U.S. Fish and Wildlife nationalsurvey of fishing, hunting, and wildlife associated rec-reation for California reports about 1.35 million resi-dent and nonresident inland sport fish anglers contrib-uted about $1.2 billion in trip and equipment expendi-tures to the State’s economy. Adding the indirect and in-duced effects of this $1.2 billion direct revenue con-tribution the total economic benefit to California’seconomy is estimated to be about $2.03 billion. Thiscorresponds with about $960 million in total wages toCalifornians and about 16,000 jobs in the Stateannually.

This regulatory action may impact businesses thatprovide services to sport fishermen but these effects areanticipated to range from none to small positive im-pacts, depending on the regulations ultimately adoptedby the Commission. Sport fishing business owners,boat owners, tackle store owners, boat manufacturers,vendors of food, bait, fuel and lodging, and others thatprovide goods or services to those that sport fish inCalifornia may be positively affected to some degreefrom increases to business that may result under therange of proposed regulations. These anticipated im-pacts may vary by geographic location. Additionally,economic impacts to these same businesses may resultfrom a number of factors unrelated to the proposedchanges to inland sport fishing regulations, includingweather, fuel prices, and success rates in other recre-ational fisheries that compete for angler trips.(a) Effects of the Regulation on the Creation or

Elimination of Jobs Within the State:

The cumulative effects of the changes statewideare estimated to be neutral to job elimination andpotentially positive to job creation in California.No significant changes in fishing effort and sportfishing expenditures to businesses are expected asa direct result of the proposed regulation changes.

(b) Effects of the Regulation on the Expansion ofBusinesses Currently Doing Business Within theState:The cumulative effects of the changes statewideare expected to be neutral to positive to theexpansion of businesses currently doing businessin California. No significant changes in fishingeffort and inland sport fishing expenditures tobusinesses are expected as a direct result of theproposed regulation changes.

(c) Benefits of the Regulation to the Health andWelfare of California Residents:The Commission anticipates benefits to the healthand welfare of California residents. Trout andsalmon are a nutritious food source and increasinginland sport fishery opportunities encouragesconsumption of this nutritious food. Sport fishingalso contributes to increased mental health of itspractitioners as fishing is a hobby and form ofrelaxation for many. Sport fishing also providesopportunities for multi–generational familyactivities and promotes respect for California’senvironment by younger generations, the futurestewards of California’s natural resources.

(d) Benefits of the Regulation to Worker Safety:The proposed regulations are not anticipated toimpact worker safety conditions.

(e) Benefits of the Regulation to the State’sEnvironment:It is the policy of the state to encourage theconservation, maintenance, and utilization of theliving resources of the inland waters under thejurisdiction and influence of the state for thebenefit of all its citizens and to promote thedevelopment of local California fisheries. Theobjectives of this policy include, but are notlimited to, the maintenance of sufficientpopulations of all species of aquatic organisms toensure their continued existence and themaintenance of a sufficient resource to support areasonable sport use, taking into consideration thenecessity of regulating individual sport fisherybag limits in the quantity that is sufficient toprovide a satisfying sport. Adoption ofscientifically–based inland trout and salmonseasons, size limits, and bag and possession limitsprovides for the maintenance of sufficientpopulations of trout and salmon to ensure theircontinued existence.

IMPACT OF REGULATORY ACTION

The potential for significant statewide adverse eco-nomic impacts that might result from the proposed reg-ulatory action has been assessed, and the following ini-tial determinations relative to the required statutorycategories have been made:(a) Significant Statewide Adverse Economic Impact

Directly Affecting Businesses, Including theAbility of California Businesses to Compete withBusinesses in Other States:The proposed action is not anticipated to have asignificant statewide adverse economic impactdirectly affecting business, including the ability ofCalifornia businesses to compete with businessesin other states because the expected impact of theproposed regulations on the amount of fishingactivity is anticipated to be minimal relative torecreational angling effort statewide.

(b) Impact on the Creation or Elimination of JobsWithin the State, the Creation of New Businessesor the Elimination of Existing Businesses, or theExpansion of Businesses in California; Benefits ofthe Regulation to the Health and Welfare ofCalifornia Residents, Worker Safety, and theState’s Environment:The expected impact of the proposed regulationson the amount of fishing activity is anticipated tobe minimal relative to recreational angling effortstatewide. Therefore the Commission does notanticipate any impacts on the creation orelimination of jobs, the creation of new business,the elimination of existing business or theexpansion of businesses in California.The Commission anticipates benefits to the healthand welfare of California residents. Providingopportunities for a salmon and trout sport fisheryencourages consumption of a nutritious food.The Commission does not anticipate anynon–monetary benefits to worker safety.The Commission anticipates benefits to theenvironment by the sustainable management ofCalifornia’s sport fishing resources.

(c) Cost Impacts on a Representative Private Personor Business:The agency is not aware of any cost impacts that arepresentative private person or business wouldnecessarily incur in reasonable compliance withthe proposed action.

EFFECT ON SMALL BUSINESS

It has been determined that the adoption of these reg-ulations may affect small business. The Commissionhas drafted the regulations in Plain English pursuant toGovernment Code Sections 11342.580 and11346.2(a)(1).

CONSIDERATION OF ALTERNATIVES

The Commission must determine that no reasonablealternative considered by the Commission, or that hasotherwise been identified and brought to the attention ofthe Commission, would be more effective in carryingout the purpose for which the action is proposed, wouldbe as effective and less burdensome to affected privatepersons than the proposed action, or would be morecost–effective to affected private persons and equallyeffective in implementing the statutory policy or otherprovision of law.

TITLE 14. FISH AND GAMECOMMISSION

NOTICE IS HEREBY GIVEN that the Fish andGame Commission (Commission), pursuant to the au-thority vested by Sections 200, 202, 205, 210, 220, 395,396, 398, 713, 1002, 1050, 1053, 1745, 2116, 2116.5,2117, 2118, 2120, 2122, 2125, 2150, 2150.2, 2150.4,2151, 2157, 2190, 2193, 2271, 3005.5, 3007, 3503,3503.5, 3511, 3513, 3950, 10500, 12000 and 12002,Fish and Game Code and to implement, interpret ormake specific Sections 1050 and 2271 of said Code; andTitle 50, Code of Federal Regulations, Parts 21.29 and21.30, proposes to amend Sections 1.92 and 703, Title14, California Code of Regulations, relating to Trans-genic Definition; Application and Fee Regulations.

INFORMATIVE DIGEST/POLICY STATEMENTOVERVIEW

Current law provides for a definition of “transgenic”as:

“Genetically altered by introducing DNA (1) fromanother species or (2) through engineeredendogenous constructs by means such as but notlimited to recombinant DNA and RNA techniquesto produce, gene addition, deletion, and doubling,or changing the position of the gene. Thisdefinition excludes DNA vaccines, individualsproduced by the techniques of whole genomeploidy manipulation, and hybridization betweenclosely related species, as in traditionalhybridization.” — Section 1.92, Title 14, CCR

The Department’s review of the current definition oftransgenic in Section 1.92 has revealed several vulnera-bilities that could prevent the Commission and the De-partment from adequately protecting native fish, wild-life, and plants from the threat of predation by, competi-tion with, or hybridization with potentially threateningtransgenic animals. First, the definition is structuredaround a finite list of prohibited methods of genetic ma-nipulation coupled with a finite list of exceptions to thatprohibition.

A producer of transgenic animals could evade theprotections set forth in Title 14, sections 671 and 671.1(relating to restricted species permits), which incorpo-rate the transgenic definition in Section 1.92, by with-holding the first generation of animals subject to directgenetic manipulation and by importing, distributing,and selling only the progeny of that first generation.

Also, as currently written, the definition excludes“hybridization between closely related species” butdoes not expressly indicate that to qualify for the ex-emption such hybridization cannot involve transgenicanimals. If this interpretation were to prevail it wouldundermine the entire regulatory program by allowingany producer of transgenic animals to evade regulatoryprotections merely by importing, distributing, and sel-ling only those transgenic animals that had been hybrid-ized with other lines of transgenic animals.

Current law also provides for regulatory protectionsof the state from detrimental animals as set forth in Title14, Section 671:

671(a): “It shall be unlawful to import, transport,or possess live animals restricted in subsection (c)below except under permit issued by thedepartment.”

671(b): “. . . Those species listed because theypose a threat to native wildlife, the agricultureinterests of the state or to public health or safetyare termed “detrimental animals” and aredesignated by the letter “D . . .”

671(c)(11): “Transgenic Aquatic Animals.

Includes freshwater and marine fishes,invertebrates, amphibians, and reptiles (D).

Note: Unpermitted transgenic aquatic animals aredetermined to be detrimental to native wildlife,therefore the exemption provided for in Fish andGame Code Section 2150(e) is not applicable.”

Fish and Game Code, §2150(e) “Any university, col-lege, governmental research agency, or other bona fidescientific institution, as defined in regulations adoptedby the commission, engaging in scientific or publichealth research is exempt from any permit requirementpursuant to this chapter except for animals whose im-portation, transportation, or possession is determinedby the department, in cooperation with the Departmentof Food and Agriculture, to be detrimental or causedamage to agriculture, native wildlife, or the publichealth or safety.”

The Department’s proposed revision to the definitionof transgenic addresses each of these vulnerabilitiesand, in doing so, seeks to enhance the ability of theCommission and the Department to protect native fish,wildlife, and plants.

It also includes an exemption process for a deter-mination to be made by the Department to render a deci-sion to label a particular transgenic aquatic animal(aquarium fish) as “not detrimental” and therefore notsubject to Section 671 and subsection 671.1(a)(8), Title14, CCR.

The Department is proposing the following regulato-ry changes:� Delete the present definition of transgenic in

Section 1.92.

� Add a new subsection (a) to Section 1.92 definingtransgenic to include all animals “whose genomehas been deliberately altered, modified, orengineered through means not possible undernatural conditions, by insertion of a foreign geneor genes using genetic engineering methods.” Thisdefinition is supplemented by four subsectionsfurther defining the scope of the definition, whichinclude the following:

� Subsection (a)(1) clarifies that an animal istransgenic if it contains any artificiallytransferred genetic material, even if thatmaterial is not directly “from anotherspecies.”

� Subsection (a)(2) includes a non–exclusivelist of examples designed to address some ofthe most common methods for geneticmanipulation.

� Subsection (a)(3) includes an explicitstatement that the “progeny of a transgenicanimal or any animal that is the result ofbreeding involving transgenic animals istransgenic within the meaning of thissection.”

� Subsection (a)(4) reiterates and refinesprovisions in the existing definition thatindicate that animals subject to standardbreeding and hybridization practicescommonly used by fish hatcheries (when notransgenic animals are involved), wholegenome ploidy manipulation, andtherapeutic treatment with DNA vaccine arenot transgenic.

� Add a new subsection (b) to Section 1.92 whichincludes a narrowly circumscribed exemption tocover certain transgenic aquarium animals subjectto the following restrictions:� The transgenic animals will be maintained in

closed systems and not placed in the waters ofthe state; and

� the Department has determined thetransgenic animals are “not detrimental” andpose no risk to native fish, wildlife, or plants;and

� to qualify for this exemption, the person orentity seeking to import, possess, distributeand sell transgenic aquatic animals withinCalifornia must submit a letter of application,based on credible science; and

� to qualify for this exemption, the person orentity seeking to import, possess, distribute,and sell individual transgenic aquaticanimals within California must pay anonrefundable application fee.

� Amend Section 703 by adding a new subsection703(a)(3) which describes the application process,requirements, and nonrefundable fee of $4,790 tocover the Department’s costs incurred inprocessing the application, and the Department’sfindings.

BENEFITS OF THE PROPOSED REGULATIONS

The proposed revisions to the definition of transgenicwill improve the protection of the environment and thestate’s fish, wildlife, and plant resources by providing amodern definition that accounts for future changes in

genetic methods and eliminates potential loop holesassociated with the progeny of transgenic animals oranimals resulting from hybridization with transgenicanimals. The new application and approval process forcertain transgenic aquatic animals will allow the De-partment to thoroughly review relevant scientific datato determine there is no reasonably foreseeable risk tonative fish, wildlife, or plants. If supported by crediblescientific evidence, the Department may make a deter-mination that the animal is not detrimental and there-fore not subject to Section 671 and subsection671.1(a)(8).

EVALUATION OF INCOMPATIBILITY WITHEXISTING REGULATIONS

The proposed regulations are neither inconsistent norincompatible with existing State regulations. The Leg-islature has delegated authority to the Commission toadopt regulations for ornamental marine or freshwaterplants and animals that are not utilized for human con-sumption or bait purposes and are maintained in closedsystems for personal, pet industry, or hobby purposes(Fish and Game Code, Section 2271). The proposedregulations are consistent with current restricted spe-cies regulations in Section 671, Title 14, CCR. Com-mission staff has searched the California Code of Regu-lations and has found no other State regulations relatedto the use of transgenic species.

PROPOSED RESEARCH ON A FULLYPROTECTED SPECIES

Research on the Salt–Marsh Harvest Mouse

The Department of Fish and Wildlife (Department)received a proposal on August 7, 2015 from AnastasiaG. Ennis, on behalf of Olofson Environmental Inc.,Oakland, California, requesting authorization to takethe salt–marsh harvest mouse (Reithrodontomys ravi-ventris) (mouse), a Fully Protected mammal, for scien-tific research purposes consistent with the protectionand recovery of the species. The mouse is listed as En-dangered under the California Endangered Species Actand Endangered under the federal Endangered SpeciesAct.

Ms. Ennis is planning to continue her previously ap-proved research throughout the range of the mouse inCalifornia, in accordance with methods approved bythe Department and the U.S. Fish and Wildlife Service(Service, under a current Recovery Permit). The pro-posed research activities include capture using baitedcage traps, handling, measuring and weighing, collec-tion of follicular tissue samples from plucked hair,collection of fecal samples, marking with non–toxicblack ink or dye on the ventral surface or by hair clip-ping, marking by ear tagging, release at the site of cap-ture, and other methods approved by the Departmentand the Service. These activities are performed duringlive–trapping sessions, including during trapping ses-sions by other permitted mouse researchers. If any miceare found dead, they will be salvaged (including anyparts thereof) and donated to a scientific institutionopen to the public, as designated by the Department andthe Service. Tissue samples may also be taken from sal-vaged mouse carcasses when available, and from mu-seum specimens. No adverse effects on individual miceor mouse populations are expected.

The Department intends to issue, under specifiedconditions, a Memorandum of Understanding (MOU)that would authorize qualified professional wildlife re-searchers, with Ms. Ennis as the Principal Investigator,to carry out the proposed activities under any necessaryaffiliation, or independently. The applicant is also re-quired to have a valid federal Recovery Permit for the

mouse, and a Scientific Collecting Permit (SCP) to takeother terrestrial mammal species in California.

Pursuant to California Fish and Game Code (FGC)Section 4700(a)(1), the Department may authorize takeof Fully Protected mammal species after a 30–day no-tice has been provided to affected and interested partiesthrough publication of this notice. If the Department de-termines that the proposed research is consistent withthe requirements of FGC Section 4700 for take of FullyProtected mammals, it would issue the authorization onor after September 21, 2015, for an initial and renew-able term of up–to, but not to exceed four years. The criteria used by OEHHAfor the listing of chemicals under the “authoritative bo-dies” mechanism can be found in Title 27, Cal. Code ofRegs., section 25306.

It pertains to a regulatory requirementfor an annual health examination for all persons work-ing in a primary care clinic that is more stringent thanstatute.

Pursuant to Government Code (GC) §11340.6,CDPH is treating your request as a petition. You are re-questing CDPH to “justify the existing regulation’s ru-lemaking authority, and the rationale for being “morestringent” than described in statute, or take steps to re-move the regulation from the Code of Regulations.”

CDPH’s Center for Health Care Quality has givenconsideration to your request. We agree the require-ments in 22 CCR, §75051 are more stringent than inHSC §1226.1. This action re–adopts emergency regulationsadopted in emergency action 2015–0203–01 to imple-ment statutory changes which took effect January 1,

2015. Existing statutes allow the Department of Indus-trial Relations (DIR), within certain statutory parame-ters, to issue citations, impose civil penalties, and re-quire abatement for violations of occupational healthstandards. DIR adopted regulations to implement thestatutes and clarify the parameters. The legislaturemade recent statutory changes to the parameters, caus-ing inconsistencies with portions of the existing regula-tions. The regulatory changes bring the DIR regulationsback into conformity with the amended statutes. Toconform to statute, DIR amends the regulations to (1)condition abatement credits upon an employer showingproof of abatement for serious violations; and (2) allowDIR flexibility to adjust earned abatement credits aftera citation becomes a final order by operation of regula-tory law when an employer provides sufficient proof oftimely abatement.

The increased applicationfees will ensure that the total collected revenue for the
