New Market Planning Commission

September 2, 2014

The regular monthly meeting of the New Market Planning Commission was held on September 2, 2014.

Members in attendance were: Greg Bair; George Daugharty; Ron Gore; Tom Linski, Jr.; and Sonny

Mongold. Chairman Bair called the meeting to order at 7:30 p.m. and declared that a quorum was

present.

George Daugharty made a motion to approve the minutes of June 2, 2014 as presented. Tom Linski, Jr.

seconded. The motion carried on a voice vote.

OLD BUSINESS

Mr, Neese gave the Zoning Administrator's report. Staff has continued to keep our GPS system updated.

Quite a bit of t ime has been spent researching and answering questions relating to the proposed

assisted living facility as well as other properties that were up for auction. Shenandoah County provided

a draft of their proposed land use chapter update for their comprehensive plan. Staff reviewed this

draft and offered comments back to County staff. Easements for the Clark Street water loop project

were obtained. Lots of yard sale signs have been removed from around town.

Mr. Linski inquired about the coffee roasting facility. Mr. Neese stated that he was of the understanding

that they have received approval from the Building Inspections office to proceed. It will take a little bit

of time as they have some improvements they need to make to the building and the new roaster will

also need to be ordered.

NEW BUSINESS

Mr. Neese invited the Planning Commission outside to provide a brief demonstration on how the GPS

unit works and to answer any questions that they may have.

Sonny Mongold inquired about economic development in New Market. Mr. Neese stated that staff has

contact various businesses in the past to discuss the possibility of locating in New Market. Staff has also

provided a lot information to businesses who contact the Town on behalf of developers.

As you are aware, the New Market Town Council voted to approve your request for a conditional use permit at its meeting last night, Specifically, this permit will allow you to operate more than one main use at your property, located at 213 Old Cross Road, These uses are as follows:

1. ) Mail order, wholesale and retail sales of automobile parts for classic cars; 2. ) Sales and showroom for not more than twenty-five vehicles on the exterior of the lot; 3. ) Light manufacturing of specialty items; and 4. ) An automobile wrecking yard for the salvaging of parts, as defined in Section 70-10 of the New Market zoning ordinance, and subject to the following conditions:

a, A maximum of thirty (30) vehicles shall be allowed in the wrecking yard at any one time; h. No vehicle may he stored on the property for more than sixty (60) days; c, Fencing must be provided in accordance with the approved fencing plan that was ubmitted with your conditional use permit application; d, The facility shall meet all requirements of the Virginia Division of Motor Vehicles; e, All disassembly and other work on the vehicles shall be conducted within an enclosed building; and f, All fluids, tires and unused parts shall be properly disposed of and shall not remain on the site for more than thirty (30) days.

Please note that your conditional use permit will expire one (1) year after the date of its approval in the event that the use for which it was granted has not commenced to a degree that clearly establishes the intent to utilize the permit, Upon written request, a one time, six month extension may be granted by the Town Council.

Prior to conducting business at this location the following items must be completed: 1, Paving of the unpaved portion of the required parking area with a permanent hard surface OR submission of a letter to the Planning Commission requesting a

or the surrounding neighborhood.

Article XV "Conditional Use Regulations"

Special Information

Public Utilities: The property is currently served by public water and sewer service.

Access and Parking: The property contains ample parking in accordance with the zoning

ordinance and is accessed from E. Old Cross Road.

Analysis

Storage warehousing is permitted by right in the M- l District. However, as the use is being combined

with other existing main uses on the same property a conditional use permit for more than one main

use is required.

The applicant is proposing to utilize a portion of the existing Auto Krafters building for storage

warehousing of home furnishings initially and then over t ime the use will expand to include the entire

building and accessory building as Auto Krafters phases out of the building. The applicant anticipates

that delivery traffic will be similar to that which Auto Krafters currently experiences. There will be trucks

bringing in shipping containers f rom t ime to time but most deliveries are expected to be handled by UPS

and FedEx vehicles. It is staf fs understanding that Auto Krafters has discontinued the use of an

automobile wrecking yard for the salvaging of parts. This use was previously approved in 2002 and

required a fence to be constructed for screening purposes. This fence is still in place.

As of the date of this report, staff has only been contacted by one of the adjoining property owners for

additional information.

The applicant will need to work with Shenandoah County Building Inspections and the Fire Marshal to

ensure compliance with any applicable codes due to the change in use. VDOT officials have indicated

that the entrance off of E. Old Cross Road is sufficient at this t ime but if the building is expanded then

they would want to revisit the matter.

In reviewing the request and offering a recommendation, it shall be found that the proposed use would

meet the following standards as outlined in Sec. 70-154 of the Zoning Ordinance:

a. Such use shall be consistent with health, safety, convenience and general welfare of the

persons residing or working in the neighborhood of the proposed use.

b. Such use shall be found to be in harmony with the general purposes and intent of this

chapter.

c. Such use shall not have undue adverse impact on the surrounding neighborhood or be

unduly injurious to property values or improvements in the neighborhood. Among

matters to be considered in this connection are traffic congestion, noise, light, dust,

odor, fumes and vibration with due regard for hours of operation, screening, or other

matters which might be regulated to mitigate adverse impact.

d. Adequate public services, including streets and other traffic ways, utilities, police and

fire protection, are or reasonably will be available to support the proposed use.

e. Such use shall be of such size and so located and laid out in relation to its access streets

that vehicular and pedestrian traffic to and from such use will not create undue

congestion or hazards prejudicial to the general neighborhood.

f. Such use shall not be in conflict wi th the policies and principle of the Town's

Comprehensive Plan.

In addition, Town Council may attach such conditions to its approval of a conditional use permit as it

deems necessary to bring the proposal into conformity with the purposes and standards of the zoning

ordinance, according to Sec. 70-157. Such conditions wil l be designed to:

a. Abate or restrict noise, smoke, dust or other elements that may affect surrounding

property;

b. Establish setback, side and front yard requirements exceeding the minimum as may be

necessary for orderly expansion and to prevent traffic congestion;

c. Provide for adequate parking, ingress and egress to public streets and roads;

d. Provide adjoining property with a buffer or shield from view of the proposed use as such

use is considered to be detrimental to adjoining property;

e. Prevent such use and its external appearance from substantially changing the character

and established pattern of development of the community; and

f. Establish hours of operation of a business use if such action is deemed necessary to

prevent or limit particular noise, traffic, or other objectionable effects.

Re: Capital Improvement Program

The Capital Improvement Program (CIP) is a five (5) year capital budget to provide both elected and appointed town officials a road map for significant acquisition or improvement of equipment, hardware, software and infrastructure. The CIP is not intended to be an all-inclusive document. Unanticipated capital expenditures can and wil l necessitate mid- year funding. In addition while the CIP identifies a projected cost and year of appropriation, fund balances, debt capacity, political leadership and other influences can change the scope and urgency of a capital project. Finally, the CIP does not commit the Town Council, current or future, to appropriate money to a project. It does, however, identify those priority projects of the Town for which future spending is likely.

The Commonwealth of Virginia requires that the CIP be reviewed by the local planning commission before being considered by the town council.

Capital Improvement Plan (CIP)

GENERAL FUND

496-000 Administrative

ETVAC Replacement municipal offices $20,000 FY 16-17: The heating/air conditioning units serving the town hall are all original to construction circa 1992 with the exception of two units which required replacement in May 2011 and 2013 respectively due to their failure. The replacement includes the exterior heat pumps (3) and the air handling units located in the attic space of the municipal building.

Audio Visual Upgrade-Council Chambers $8,500 FY 15-16: This allocation would provide for the installation of two (2) overhead projectors and two (2) mechanized screens, or equivalent visual aid, to facilitate electronic presentations to both the Town Council and public. The layout would allow audience members to remain seated without rearranging the meeting room and facilitate a second screen for the Town Council to view. Note: One overhead projector has already been installed.

Computer Upgrades $1,500 FY 15-16, FY 17-18 and FY 19-20 It is proposed to maintain a schedule of replacement of computers used by Town staff to help avoid large expenditures at one time.

Public Works Vehicle $40,000 FY 15-16 allocation wil l be used for the acquisition of a utility work truck (1) ton to replace a 2000 GMC.

Public Works Vehicle $75,000 FY 18-19 this allocation wil l be used to fund the replacement of a single axel dump truck. The current unit was acquired in 1989 and at the time of proposed replacement wil l be 30 years old.

Public Works Equipment $45,000 FY 16-17 provides funding to replace a 1990 CASE skid steer loader.

Public Works Equipment Mower Replacement $15,000 FY 17-18 and FY 19-20 The mowers operate many hours each season and regular replacement is necessary to maintain reliable equipment.

Sidewalk installation on U.S. 211 East $356,000 FY 15-16: This project would provide design, permitting and construction funding for a comprehensive sidewalk project along 211 East between Congress Street and a terminus near the current Life Care facility. Recent residential and commercial development projects along the 211 E. corridor, combined with the Town's adopted future growth area delineates this area for additional expansion. The town has been approved for revenue sharing funding through the Virginia Department of Transportation which would provide state matching dollars on a 1:1 ratio. The Town of New Market's out of pocket costs for the project are projected to be $177,000.

Click's Lane Pedestrian Improvements $25,000 FY 19-20: Funding would provide preliminary engineering report and design related expenses for a pedestrian improvement(s) project on state route 823, Click's Lane.

John Sevier Road Drainage $25,000 FY 19-20: Allocation wil l be used to begin professional design work to address a comprehensive road reconstruction to address drainage issues on John Sevier Road.

Police Vehicle Funding $21,000/FY: Each fiscal year an appropriation is made to a "restricted" savings fund, which is used to make a police vehicle acquisition every other budgeted fiscal year. Each patrol vehicle wi l l have an active service life of ten years.

In Car Computer Program $30,000 FY 17-18: The traditional method of communication for law enforcement is to communicate with a 911 dispatcher over a radio. Law enforcement communication is transitioning to computer automated devices which allow police officers to receive calls for service, perform background checks and enter reports from the console of a police cruiser or mobile device. In 2012 the New Market Police Department was given four (4) used in-car computer systems by the Shenandoah County Sheriffs Office. Like all technology based services the expected life of both hardware and software necessitates planning for eventual replacement. It is anticipated that the computer system wil l be comprehensively upgraded and replaced in FY 17-18.

In car camera replacements) $5,000/FY 15-16 and FY 16-17: Police dash cameras provide documented evidence at traffic stops. They can be used as training aides or subject of administrative investigations into accusations by members of the public. Each police cruiser is outfitted with a camera which begins recording data during the activation of emergency lights or sirens. The town's in-car cameras were upgraded approximately 10 years ago. The replacements in FY 15 wil l provide two (2) new cameras to the units in most need of replacement. The appropriation wil l also include new software and docking stations for the camera system. Appropriations made in successive fiscal years wi l l provide additional replacements for all the police vehicles.

Trailer mounted light tower $10,000 FY 15-16 Light wi l l provide officer safety while directing traffic during special events and during checking details as required by DMV for grant funds we receive. The light tower and generator could also be utilized by public works for use during night repairs of water/sewer lines.

Community Park 496-005

Fitness Trail Upgrade $10,000/FY 15-16: These acquisitions would consolidate 20+ year old fitness equipment located along the community park's walking trail and replace them with more modern, multi-use work-out stations. This project is tentatively scheduled to begin in FY 14-15 and conclude the following fiscal year.

Pool bathhouse upgrades $10,000 FY 15-16: The community pool male and female bathroom/bathhouse facilities were last upgraded in 1998. The appropriation would provide funding for modifications and upgrades to the facilities.

Playground Equipment Replacement $10,000 FY 17-18 and 15,000 FY 19-20 to replace original wooden frame equipment that is being removed for safety reasons.

Re-coat Tennis and Basketball courts $20,000 FY 16-17 The courts were last surfaced in 2007 and are quite worn.

Re-seal asphalt lots and paths. $25,000 FY 18-19 This is preventative maintenance to increase the lifespan of the asphalt lots in the Community Park.

WATER-SEWER FUND

Water Department 771-000

Valve/ Hydrant/Meter Replacement $30,000/FY: The Town's water assets require replacement after their serviceable life, in most cases decades, have expired. This program identifies those hydrants, meters and valves which are no longer functioning properly or are in need of upgrade/upsizing and targets them for replacement. Depending upon the location and complexity of the infrastructure project the Town may use public works staff or contracted labor. This allocation wil l provide annual funding for asset management in the Town; actual funding may depend on annual budget restrictions.

Water Storage Tank-New $35,000 FY 15-16: A combination of projected growth as well as age of existing infrastructure wi l l necessitate the construction of a second water storage facility. The Comprehensive Utility Study under development in FY 14 wil l provide conceptual placement and pricing. The appropriation proposed in FY 16 wi l l be utilized for preliminary design, engineering and permitting. Not included in this CEP is

the construction cost of a new water storage tank which is projected to be in the $1 million range.

Water Storage interior maintenance $115,000 FY 17-18: The existing 500,000 gallon water storage tank is over 40 years old. In October 2011 the exterior of the water storage tank was repainted and minor repairs made. The 2011 project included an analysis of the interior of the tank. The interior is in satisfactory to good structural condition but does show signs of needed repairs/interior repainting etc. The allocation would provide for this preventative maintenance activity.

Department Vehicle Replacement $40,000: A 2001 Dodge Ram % ton pick up wi l l be replaced with a similar sized vehicle with snow plow capability. The department vehicle is tentatively scheduled to be replaced in FY 2016-17.

Water Treatment Plant Instrumentation $20,000 FY 15-16: This allocation wi l l replace a combination of frequency drives, motor controllers and processors associated with pumps at the water treatment plant. The devices are original to construction in 1998 and are in need of replacement.

Shenandoah Drive entrance $35,000 FY 16-17: The exclusive entrance and exit to access the Town's water treatment plant is located off of the north side of 211 West located diagonally across from the 7-11 complex. The entrance is narrow and provides limited site distance. It is also located in close proximity to the deceleration lane where two west bound lanes converge into one lane. This entrance poses problems for those entering and exiting the complex. In addition, the narrow entrance and grade make it particularly difficult for semi trailers and other delivery vehicles to negotiate the driveway. The revised concept would utilize property owned by the town on Shenandoah Drive as a primary entrance and exit for the complex.

Turbidity Analyzers $12,000 FY 15-16 Required process control equipment at the water micro filtration plant. Both units were installed in 1998 and are at the end of their service life.

Sewer Department

Enclose Maintenance Facility $13,000 FY 16-17: The existing open air pole barn at the former site of the sewer treatment plant wi l l be enclosed to provide storage for equipment and materials for multiple departments. The enclosure wi l l provide approximately 2400 square feet of additional, covered storage for public works and police. The labor wi l l be provided in house. The enclosure project is tentatively scheduled for FY 2014-2015.

Collection System Improvements $50,000/FY 16-17 and FY 18-19 The Town completed a $ 1.5 million inflow and infiltration proj ect in 2010. The proj ect replaced or relined approximately 15,000 linear feet of sanitary sewer pipe to reduce the volume of non wastewater infiltrating the sanitary sewer system. Another smaller I & I proj ect was completed in 2011 with approximately 4,000 I f replaced or relined to date. This capital

improvement item wil l provide funding for continuing improvements/replacements/upsizing within the Town's collection system. The focus of the next collection system project wil l be manhole rehabilitation.

Pump Station Upgrades $35,000 FY 15-16: The Town operates five (5) sewer pump stations. This allocation wi l l be used to upgrade mechanical and electrical equipment to the Stirewalt pump station which was brought on line in 1974. This pump station services the north end sanitary sewer collector.

Sewer Jet Cleaner $50,000 FY 19-20 Replacement for the current unit which wil l have been in service for over 25 years at time of replacement.

Roof Replacement $22,000 FY 15-16 The lab and garage buildings at the North Fork Pump Station site have developed several leaks. Both buildings have rubber membrane roofs and were constructed in 1989 as part of the wastewater treatment plant.

BYLAWS TOWN OF NEW MARKET, VIRGINIA

PLANNING COMMISSION ADOPTED August, 6, 1990

ARTICLE I - AUTHORIZATION

1-1. This planning commission is established in conformance with a resolution adopted by the New Market Town Council, Virginia on November 21, 1977; and in accordance with the provisions of Section 15.1-427.1, Code of Virginia (1950), as amended.

1- 2. The official title of this planning commission shall be "New Market Planning Commission", hereinafter referred to as the "Commission".

ARTICLE I I - PURPOSE

2- 1. The purpose of the Commission is to assist the Town Council to anticipate and guide future development and change by preparing plans, ordinances, capital improvements programs, studies, reports, and other documents for consideration by the Town Council.

ARTICLE I I I - MEMBERSHIP

3- 1. The Commission shall consist of seven (7) members appointed by the Town Council. A l l members shall be residents of the Town of New Market and qualified by knowledge and experience to make decisions on questions of growth and development. At least one-half of the members shall be freeholders. One member shall be a member of the Town Council and one member may be an administrative official of the Town government.

3-2. The terms of office for the members of the Town Council and the administrative official shall be co-extensive with their terms of office, unless the Town Council appoints others in their stead. The terms of

the other original members shall be for one (1), two (2), three (3), and four (4) years. Subsequent members shall be appointed for terms of four (4) years.

3-3. Any vacancy in membership shall be filled by appointment of the Town Council and shall be for the unexpired portion of the term only.

3-4. Any member of the Commission shall be eligible for reappointment.

3-5. Any member of the Commission may be removed by the Town Council for inefficiency, neglect of duty, or malfeasance in office.

3-6. The term of a Commission member shall expire immediately prior to the beginning of the regular January meeting at which meeting his successor's term of office shall begin.

3- 7. The Town Council may provide for the payment of the expenses incurred by Commission members in the performance of their official duties and compensation for services.

ARTICLE IV - SELECTION OF OFFICERS

4- 1. Officers of the Commission shall consist of a chairman, vice-chairman, and secretary. The chairman and vice-chairman shall be elected by the membership. The secretary shall serve at the request of the Commission and may be a member of the Commission, an employee of the Town government, or a citizen volunteer.

4-2. Nomination of officers shall be made from the floor at the regular January meeting each year. Election of officers shall follow immediately. A candidate receiving a majority vote of the entire membership shall be declared elected.

4-3. The term of office shall be for one (1) year.

4- 4. Any vacancies in office shall be filled for the unexpired portion of the

term in the same manner as the officers are originally chosen.

ARTICLE V - DUTIES OF OFFICERS

5- 1. The chairman shall be a member of the Commission and shall:

5-1-1. Preside at all meetings.

5-1-2. Appoint all committees.

5-1-3.Rule on all procedural questions (subject to a reversal by a two-thirds (2/3) majority voted by the members present).

5-1-4. Be informed immediately of any official communication, and report same at the next regular meeting.

5-1-5. Certify all official documents involving the authority of the Commission.

5-2. The vice-chairman shall be a member of the Commission and shall:

5-2-1. Act in the absence or inability of the chairman to act, with the full powers of the chairman.

5-3. The secretary shall:

5-3-1. Record attendance at all meetings.

5-3-2. Record the minutes of the Commission meeting.

5-3-3. Notify all members of all meetings.

5-3-4. Maintain a file of all official Commission records and reports.

5-3-5. Certify all maps, records and reports of the Commission.

5-3-6. Give notice and be responsible for publishing public notices of all Commission public hearings and public meetings.

5- 3-7. Attend to the correspondence necessary for the execution of the duties

and functions of the Commission.

ARTICLE V I - COMMITTEES

6- 1. The following committees may be appointed by the chairman to serve as needed:

6-1-1. Comprehensive Plan Committee. It shall develop, update, and revise the Comprehensive Plan and coordinate the work of other committees which relate to the overall plan development.

6-1-2. Land Use Committee. It shall prepare and maintain an inventory of land uses within the Town, and be responsible for the preparation of land use maps.

6-1-3. Subdivision Committee. It shall draft subdivision regulations and subsequent amendments. It shall examine all subdivision applications, receive staff comment on them, and make recommendations on them to the Commission.

6-1-4. Zoning Committee. It shall draft a zoning ordinance and subsequent amendments. It may review applications for rezoning, conditional use permits, and variances and submit its recommendations to the Commission.

6-1-5. Capital Improvements Committee. It shall prepare and annually update a capital improvements program (CIP) in conjunction with Town administrative officials, and submit its recommendations to the Commission. It will assure that the CIP is in conformance with the Comprehensive Plan.

6-2. Special committees may be appointed by the chairman for purposes and terms approved by the Commission.

6- 3. The chairman shall be an ex-officio member of every committee.

ARTICLE V I I - MEETINGS

7- 1. Regular meetings of the Commission shall be held on the first

Monday of the month at 7:30 p.m. Special meetings shall be called as needed. When a meeting date falls on a federal holiday, the meeting shall be held on the day following unless otherwise designated by the Commission.

7-2. Special meetings may be called at any time by the chairman or by four (4) members of the Commission; provided that the chairman and all Commission members are duly notified a reasonable period of time prior to such meeting, and no business shall be transacted at a special meeting thereof, except that for which it shall be called. I f all members are present, this provision may be waived by a majority vote of the Commission.

8 - 1 . A maj ority of members shall constitute a quorum.

8- 2. No action of the Commission shall be valid unless authorized by a

majority vote of those present and voting.

ARTICLE IX - ORDER OF BUSINESS

9- 1. The order of business for a regular meeting shall be:

9-1-1. Call to order and establishment of quorum.

9-1-2. Approval of minutes.

9-1 -3. Public hearings.

9-1-4. Old business.

9-1 -5. New Business.

9-1-6. Adjournment.

9-2. The Commission shall keep a set of minutes of each meeting, and these minutes shall become a public record.

9-3. The order of business may be changed with the concurrence of a majority of those members present at the meeting.

9- 4. Any individual wishing to comment on a matter before the Planning Commission will have up to five (5) minutes available, whether speaking as an individual or as a representative of one or more firms, groups or organizations. This time limit may be extended upon approval by a majority of the Planning Commission members present. The presiding officer shall enforce the time limit as appropriate.

ARTICLE X - PUBLIC HEARINGS

10- 1. In addition to those required by law, the Commission may hold public hearings on any matter which it deems to be in the public interest.

10-2. Notice of public hearing shall be published once a week for two consecutive weeks, in a newspaper of general circulation in the area, at least seven (7) days before the day of the public hearing.

10-3. The chairman or his/her designated representative shall summarize the matter before the Commission, allow interested parties to address the Commission, and accept written statements and other documentation pertinent to the matter before the Commission.

10- 4. An accurate, written record shall be made of the proceeding of a public hearing and maintained as a part of the Commission's files.

ARTICLE X I - AMENDMENTS

11- 1. These bylaws may be amended by a majority vote of the members present after thirty (30) days prior notice.
