ACT
To establish a Tobacco Products Control Committee to advise the Minister on
matters relating to the use of tobacco products; to provide for the consti-
tution, poers, duties and functions of the Committee; to provide for the
reduction of demand for and supply of tobacco products; to provide for pro-tection from exposure to tobacco smoke; to provide for the establishment
of the Tobacco Products Control Fund; to provide for matters relating to
the enforcement of the Act; and to provide for matters incidental thereto.

unequivocallyestablishedthatexposuretotobaccosmokecausesdeath,disease
anddisabilityandnegativelyimpactsontheeconomyandtheenvironment;
- isadevelopedhabitamongpeopleofdifferentagesinsocietyandseverelyaffects
thehealthofindividualscontrarytotheprovisionsofArticle95(b)and(j),read
togetherwithArticle13oftheNamibianConstitution;
- iscontrarytothegoals,objectivesandprinciplesoftheNamibianHealthPolicy
Framework;
- iswidelyadvertised,targetingespeciallyyoungpeople,hencetheneedtoestablish
robustprogrammestobreakthegrowinghabitofusingtobaccoproducts;

strategiesforthereductionofdemandfortobaccoproducts;
- isdependenceforming,hencetheneedforcreatingawarenessontheadverse
healthandeconomicoutcomesoftheconsumptionoftobaccoproducts;
REALISINGthat-
- theassociationof theuseof tobaccoproductswith social success, business
advancementandsportingprowessthroughadvertisingandpromotionmayhave
theparticularlyharmfuleffectsofencouragingchildrenandyoungpeopletouse
tobaccoproducts;
- everyonehasarighttoahealthyenvironmentfreeoftheharmfuleffectsofthe
smokeoftobaccoproducts;
- theGovernmentoftheRepublicofNamibiahasasitsobligationtheresponsibility
toprotectthehealthofitscitizensandtheenvironmentfromtheharmfuleffect
ofthesmokeoftobaccoproducts;
- theGovernmentmustadoptlegislationtoensurethatpersonswhoarenotsmokers
areprotectedfromthesmokeoftobaccoproducts;
- theGovernmentmustadoptlegislationtoensurethatenvironmentswherepeople
gatherasgroupsmustbefreeofallformsofsmokeoftobaccoproducts;and
RESOLVINGtoalignthehealthsystemwiththedemocraticvaluesoftheConstitution
andtheWorldHealthOrganisationFrameworkConventiononTobaccoControl,andto
enhanceandprotectthefundamentalrightsofcitizensbydiscouragingtheuse,promotion
andadvertisingoftobaccoproductsinordertoreducetheincidenceoftobacco-related
illnessanddeath,
NOw THEREFOREBE IT ENACTEDbytheParliamentoftheRepublicofNamibia,
asfollows:
PART 1
INTRODUCTORY PROVISIONS
Denitions
1. InthisAct,unlessthecontextotherwiseindicates-
“advertisement”meansanypicture,sign,symbolorothervisualimage(whetherstillor
moving),andanyothermessage(whetheraudibleorwrittenorcommunicatedinanyother
manner)aimedatthepublicanddesignedtopromoteorpubliciseatobaccoproductor
topromotesmokingbehaviour,andincludestheuseinanyadvertisementorpromotion
aimedatthepublicofatobaccoproductmanufacturer’scompanynamewherethename
oranypartofthenameisusedasorisincludedinatobaccoproducttrademark;
“brandelement”includesthebrandname,trademark,tradename,distinguishingguise, logo,graphicarrangement, design, slogan,symbol,motto, sellingmessage,
print,type-face,recognisablecolourandpatternofcolours,andanyothersymbolsof
productidentication,thatislikelytobetakenasorconfusedwithanybrandoftobacco
product;

“Committee”meanstheTobaccoProductsControlCommitteeestablishedbysection2;
“composition”meansthecontent,arrangementorcombinationofsubstancesincluded
intheprocessingandmanufactureofatobaccoproduct;
“constituent”, inrelation toany tobacco product,meansnicotine,tarandanyotherconstituentofatobaccoproductoroftobaccosmokewhichtheMinistermaybynotice
intheGazettedeclaretobeaconstituentforthepurposesofthisAct;
“emission”meansanysubstancethatisproducedwhenatobaccoproductisused;
“employment”meansemploymentascontemplatedinthedenitionsof“employee”and
“employer”containedinsection1oftheLabourAct,2007(ActNo.1lof2007);
“Fund”meanstheTobaccoProductsControlFundestablishedbysection23;
“indoor,enclosedorpartiallyenclosed,area”includesanyspacecoveredbyaroofor
enclosedbyoneormorewallsorsides,regardlessofthetypeofmaterialusedforthe
roof,wallorsides,andregardlessofwhetherthestructureispermanentortemporary;
“ingredient”meansanyproductcomponent,materialusedtomanufacturesuchcomponent,
residualsubstancefromagriculturalpractices,storageandprocessingandsubstancesthat
canmigratefrompackingintotheproduct;
“levy”meansalevyimposedundersection36(1);
“localauthority”meansalocalauthoritycouncilasdenedinsection1oftheLocal
AuthoritiesAct,1992,and,inrelationtoasettlementareaasdenedinsection1ofthe
RegionalCouncilsAct,1992(ActNo.22of1992),theregionalcouncilconcerned,asthecasemaybe;
“localauthorityarea”meansalocalauthorityareaasdenedinsection1oftheLocal
AuthoritiesAct,1992,andinrelationtoasettlementareaasdenedinsection1ofthe
RegionalCouncilsAct,1992,theareawithintheboundariesdeterminedascontemplated
insection31(1)oftheRegionalCouncilsAct,1992,asthecasemaybe;
“manufacturer”includes,wherethemanufactureris-
(a) acompany,itsholdingcompanyoranysubsidiaryandanysubsidiaryofits
holdingcompany;
(b) an entity otherthan acompany,anentity that controls or is controlled by
suchmanufacturerorthatiscontrolledbythesameentitythatcontrolssuch
manufacturer;
“Minister”meanstheMinisterresponsibleforhealth;
“Ministry”meanstheministryresponsibleforhealth;
“nicotine”meansnicotinealkaloids;
“organisedactivity”meansanyactivityorevent-
(a) whichanymemberofthepublicattendsorinwhichheorsheparticipates;

(b) whichisorganisedforthepurposesofentertainment,sportorrecreationorfor
educationalorculturalpurposes;and
(c) whereatobaccoproduct,brandelementortobaccomanufacturer’scompany
nameisusedinthenameoforportrayaloftheactivityorevent;
“owneroforpersoninchargeof”means-
(a) inthecaseofapublicplaceownedbytheStateoroccupiedbystaffmembers,the
PermanentSecretaryofaMinistry,ofceoragencyascontemplatedinsection
3(3)ofthePublicServiceAct,1995(ActNo.13of1995);
(b) inthecaseofanyotherpublicplace,theownerthereof,andincludes-
(i) iftheownerisdeceased,theexecutorofhisorherestate;
(ii) iftheestateoftheownerhasbeensequestrated,thetrusteeofhisorherinsolventestate;
(iii) if t he owner i s u nder a ny l egal d isability, h is o r h er l egal
representative;
(iv) iftheownerisacompanyorclosecorporationwhichisbeingwound
up,theliquidatorofsuchcompanyorclosecorporation;
(v) thepersoninwhomtheownershipoflandisvestedbystatute;
(vi) inthecaseoflandwhichhasbeenallotted,granted,soldorotherwise
alienated bytheState toanyperson, butwhichhasnotyetbeen
transferredinsuchperson’sname,thatperson;and
(vii) thelesseeoflandheldunderaleaseregisteredinthedeedsregistry;
“package”meansanypacking,cartonwrappingoranyothercontainerinwhichtobacco
productsaregenerallysoldbyretailorwholesale;
“PermanentSecretary”meansthePermanentSecretaryoftheMinistry;
“prescribe”meansprescribebyregulationmadeundersection37;
“privatedwelling”meansanypartof-
(a) anyroomorapartmentofabuildingorstructurewhichisoccupiedasaresidence;
or
(b) anybuildingorstructureoroutdoorlivingareawhichisaccessoryto,andused
whollyorprincipallyfor,residentialpurposes;
“publicconveyance”includestransportingpeoplebymeansofanycommercialchartered
aircraft,ship,boat,train,bus,mini-busortaxi;
“publicplace”meansanyindoor,enclosedorpartiallyenclosed,areawhichisopento
thepublicandincludesaworkplace,aclub,aprivatedwelling,ifthatprivatedwelling
isusedforanycommercialchildcareactivityorforschoolingortutoring,andapublic
conveyance;

“regulation”meansaregulationmadeorinforceunderthisAct;
“secretary”meansthesecretarydesignatedundersection13;
“smoke”meanstoinhale,exhale,holdorotherwisehavecontroloveranignitedtobacco
product;
“staffmember”meansanystaffmemberasdenedinsection1ofthePublicService
Act,1995(ActNo.13of1995);
“tar”means theanhydrousand nicotine-freecondensateof thesmokeofa tobacco
product;
“thisAct”includesanyregulationmadeunderthisAct;
“tobaccoindustry”includesatobaccomanufacturer,awholesaledistributororanimporter
oftobaccoproducts;
“tobacco product”meansaproduct containingtobacco, that isintended for human
consumption,andincludes,butisnotlimitedto,anydevice,pipe,waterpipe,papers,
tubes,lters,portionpouchesorsimilarobjectsmanufacturedforuseintheconsumption
oftobacco;
“trademark”includes-
(a) anymarkwhetherregisteredorregistrablefortradepurposesoranyrecognised
versionthereofthatislikelytobetakenas,orconfusedwith,thattrademark;
(b) acerticationtrademarkorcollectivetrademark;and
(c) “atrademark”asdenedinsection1oftheTradeMarksinSouthWestAfrica
Act,1973(ActNo.48of1973);and
“workplace”-
(a) meansany indoor,enclosedorpartiallyenclosed, area inwhichemployees
performthedutiesoftheiremployment;
(b) includesanycorridor,lobby,stairwell,elevator,cafeteria,lounges,washroom
orothercommonareafrequentedbysuchemployeesduringthecourseoftheiremployment;and
(c) includesvehiclesusedinthecourseofwork.

Constitution of Committee
3. (1) TheCommitteeconsistsof12membersappointedby the
Minister,subjecttotheprovisionsofthissectionasfollows-
(a) twopersons,oneofwhomisthechairpersonoftheCommitteeandoneofwhomisalegalpractitionerasdenedinsection1oftheLegal
PractitionersAct,1995(ActNo.15of1995);
(b) oneregisteredmedicalpractitionerwhoisafullypaidupmemberof
theMedicalandDentalCouncilofNamibiacontemplatedinsection3
oftheMedicalandDentalAct,2004(ActNo.10of2004),nominated
bytheMedicalandDentalCouncilofNamibia;
(c) oneregisterednursewhoisafullypaidupmemberof theNursing
CouncilofNamibiacontemplatedinsection3oftheNursingAct,2004
(ActNo.8of2004),nominatedbytheNursingCouncilofNamibia;
(d) onememberrepresentinganon-governmentalorganisation,nominated
bya non-governmentalorganisationwhich theMinister reasonably
believesrepresentstheinterestsofpersonswhosehealthhasbeen
adverselyaffectedbytheuseoftobaccoproducts;
(e) sixstaffmembers,oneeachrespectivelynominatedbytheMinister
responsiblefornance,theMinisterresponsibleforagriculture,the
Minister responsible fortradeand industry, theMinister responsible
fortheenvironment,theMinisterresponsibleforlabourandtheMinister
responsibleforinformation;
(f) onemembernominatedbytheboardoftheNationalYouthCouncil
establishedbytheNationalYouthCouncilAct,2009(ActNo.3of2009);
and
(g) onememberrepresentingtheNUNW.
(2) TheMinistermustinwritinginvitetheMedicalandDentalCouncil
ofNamibia,theNursingCouncilofNamibia,thenon-governmentalorganisation,the
MinistersconcernedandtheNationalYouthCouncilcontemplatedinsubsection(1)(b)
to(f),asthecasemaybe,tonominate,withintheperiodstatedinthenotice,personsas
membersoftheCommitteeascontemplatedtherein.
(3) IfanyCouncil,organisationorMinistercontemplatedinsubsection(2)
failstosubmitanynominationconcernedascontemplatedtherein,theMinistermust
appointanappropriatememberorstaffmemberasamemberoftheCommittee,anda
personsoappointedisdeemedtohavebeenappointedintermsofsubsection(1).
(4) TheMinistermustassoonaspossibleaftertheconstitutionofthe
CommitteeoranychangeintheconstitutionoftheCommittee,asthecasemaybe,by
noticeintheGazettepublishthenamesofthemembersoftheCommitteeandthedates
ofcommencementoftheirtermsofofce.
Alternate members
4. (1) TheMinistermayappointforeachmemberoftheCommittee
apersontobethealternateofthememberconcerned.

(2) ThealternatetoamemberoftheCommitteemay,intheeventofthe
member’sabsencefromameetingoftheCommittee,attendthemeetinginthecapacity
ofamember.
Qualications of members
5. (1) NopersonisqualiedtobeamemberoftheCommitteeifhe
orshe-
(a) isnota Namibiancitizenorhasnotbeenadmitted toNamibiafor
permanentresidence;
(b) isamemberoftheNationalAssemblyortheNationalCouncil;
(c) isanunrehabilitatedinsolvent;
(d) isofunsoundmindandhasbeensodeclaredbyacompetentcourt;
(e) hasbeenfoundguiltybyacompetentcourtofcorruptpracticesorany
crime,andhasbeensentencedtoimprisonmentwithouttheoptionofa
ne;
(f) isanemployee,employer,director,memberortrusteeofanybusiness,
company,closecorporationortrustinvolvedinthetobaccoindustryin
anyway;or
(g) hasanysharesinanybusiness,company,closecorporationortrust
involvedinthetobaccoindustry.
(2) Anypersonwhoisintermsofsubsection(1)disqualiedtobeamember
oftheCommitteeandwho,whileheorsheissodisqualiedandknowingorhaving
reasonablegroundsforknowingthatheorsheissodisqualied,sitsasamemberofthe
Committee,commitsanoffenceandisliabletoapenaltyofN$500foreachdayonwhich
heorshesosits,whichmayberecoveredbytheCommitteebyactioninanycompetent
courtforthebenetoftheFund.
Term of ofce of members
6. (1) Subjecttosection7,amemberoftheCommitteeholdsofce
foratermofthreeyears.
(2) AmemberoftheCommitteeiseligibleforreappointmentattheexpiration
ofthatterm,butmaynotholdofceformorethantwoconsecutiveterms.
Vacation of ofce by members and lling of vacancies
7. (1) AmemberoftheCommitteemustvacateherorhisofceifthe
member-
(a) isconvictedofanoffenceandsentencedtoimprisonmentwithoutthe
optionofane;
(b) resignshisorherofcebygivingtheMinisteronemonth’snoticein
writingofhisorherintentiontoresign;

(c) hasbeenabsentforthreeconsecutivemeetingsoftheCommitteewithout
leaveoftheCommittee;
(d) isremovedfromofcebytheMinisterundersubsection(2);or
(e) issubjecttodisqualicationasstatedinsection5.
(2) TheMinistermay,bynotice inwriting, removea memberof the
CommitteefromofceiftheMinister,aftergivingthememberareasonableopportunity
tobeheard,issatisedthatthemember-
(a) isguiltyofneglectofdutyormisconduct;
(b) isincapable,byreasonofphysicalormentalillness,ofperformingthe
dutiesofhisorherofce;
(c) isanemployee,employer,director,memberortrusteeofanybusiness,company,closecorporationortrustinvolvedinthetobaccoindustryin
anyway;or
(d) hasanysharesinanybusiness,company,closecorporationortrust
involvedinthetobaccoindustry.
(3) IftheofceofamemberoftheCommitteebecomesvacant,thevacancy
mustbelledinthemannerprovidedforinsection3,bytheappointmentofanother
personasmemberoftheCommitteefortheunexpiredportionofthetermofofceof
thepersonwhoceasedtoholdofce.
Remuneration
8. (1) Members-
(a) oftheCommittee,and
(b) ofanysubcommitteewhoarenotmembersoftheCommittee,
whoarenotinfulltimeemploymentoftheStatemustbepaidsuchremunerationor
allowances,aswellassuchotherbenets,astheMinister,withtheconcurrenceofthe
Ministerresponsiblefornance,maydetermine.
(2) Anyremuneration,allowanceorbenetcontemplatedinsubsection(1)
maydifferfrommembertomemberaccordingtotheofceheld,anddutiesandfunctions
performedby,thememberconcerned.
Conduct of members and disclosure of interest
9. (1) AmemberoftheCommittee,andamemberofanysubcommittee
whoisnotamemberoftheCommittee,maynot-
(a) engageinanactivitythatmayunderminetheintegrityoftheCommittee
orasubcommittee;
(b) participateinanyinvestigationordecisionconcerningamatterinrespect
ofwhichthememberhasanancialorotherpersonalinterest;or

(c) useanycondentialinformationobtainedintheperformanceofhisor
herfunctionsasamembertoobtain,directlyorindirectly,anancialor
otheradvantageforhimselforherselforanyotherperson.
(2) EverymemberoftheCommitteeandeverymemberofanysubcommittee
whoisnotamemberoftheCommittee,mustinwritingdisclosetotheMinisteranydirectorindirectnancialinterestwhichthememberhasoracquiresinanybusinesscarriedon
inNamibiaorelsewhereorinanybodycorporatecarryingonanybusinessinNamibia
orelsewhere.
(3) Amemberwhohasoracquiresanynancialorotherpersonalinterest,
eitherdirectlyorindirectly,inanymatterwhichisbeforetheCommitteeorasubcommittee
fordiscussionanddeterminationmust-
(a) immediatelyandfullydisclosetheinteresttotheCommitteeorthe
subcommittee,asthecasemaybe;and
(b) withdrawfromanyfurtherdiscussionordeterminationbytheCommittee
orsubcommittee,asthecasemaybe,ofthatmatter.
Meetings of Committee
10. (1) TheCommitteemustholdatleastonemeetingperyearand-

(b) anymeetingoftheCommitteethereaftermustbeheldatadate,place
andtimedeterminedbytheCommittee.
(2) If forany reasona meetingdeterminedby thechairpersonor the
Committee,asthecasemaybe,cannottakeplace,thesecretary,withtheconcurrenceof
thechairperson,mustconvenethenextmeetingoftheCommittee.
(3) Thechairperson-
(a) mayatanytimeconveneaspecialmeetingoftheCommittee;
(b) mustconveneaspecialmeetingoftheCommitteeifrequestedthereto
bytheMinisteroratleastthreemembersoftheCommittee.
(4) ThechairpersonpresidesatallmeetingsoftheCommitteeatwhichhe
orsheispresent.

andvoting;and
(c) thememberpresidinghasadeliberativevoteand,intheeventofany
equalityofvotes,alsoacastingvote.
(8) TheCommitteemayinviteanypersonwhohasexpertknowledgeofa
matterbeforetheCommitteefordetermination,toattendameetingoftheCommittee
andtotakepartindiscussionsinrelationtothatmatter,butsuchpersonhasnovote.
(9) Thesecretarymustkeeporcauserecordstobekeptofalltheproceedings
atmeetingsoftheCommittee.
(10) Thesecretarymustsubmitorcausetobesubmittedassoonaspossible
afteranymeetingoftheCommitteehastakenplace,butnotlaterthan15workingdays
afterthemeeting,acopyoftheminutesofthatmeetingtotheMinisterandthePermanent

11. (1) TheCommitteemayestablishoneormoresubcommitteesto-

Committeemayrefertothesubcommitteeforthepurpose;or

(2) UntiltheCommitteeisfullyconstituted,andduringanyperiodoftime

notavailableforanyreason,theDeputyMinisterresponsibleforhealth,orifheorsheisnotavailableforanyreason,thePermanentSecretary,mayperformthedutiesand
functionsoftheCommitteeuntiltheCommitteeisfullyconstitutedorabletofunction
again.
(3) AnydutyorfunctionperformedbytheMinister,theDeputyMinisteror
thePermanentSecretary,asthecasemaybe,inaccordancewithsubsection(2)isdeemed
tohavebeenperformedbytheCommittee.
PART 3
REDUCTION OF DEMAND FOR TOBACCO PRODUCTS
Advertising, sponsorship and promotion
15. (1) Subjecttosubsection(3),nopersonmay-
(a) publish,displayorbroadcastanadvertisementrelatingtotheuseof
tobaccoproducts,includingtheuseoftobaccotrademarks,logos,brand
namesorcompanynamesusedontobaccoproducts;or
(b) usetobaccotrademarks,logos,brandnamesorcompanynamesused
ontobaccoproductsforthepurposesofadvertisinganyorganisation,
serviceactivityorevent.
(2) Nomanufacturer,importer,distributororretaileroftobaccoproducts
may-
(a) organiseorpromoteanyorganisedactivitythatistotakeplaceinwhole
orinpartinNamibia;
(b) makeanynancialcontribution toanyorganisedactivity that is to
takeplace,oristakingplace,orhastakenplaceinwholeorinpartin
Namibia;
(c) makeanynancialcontributiontoanypersoninrespectof-
(i) the organisation or promotion of any organised activity in
Namibiabythatperson;
(ii) theparticipation,bythatperson,inanyorganisedactivitythatisto
takeplace,oristakingplaceinwholeorinpart,inNamibia.
(3) Aretailerof tobaccoproductswhichposts inaccordancewithany
regulationsignsatthepointofsalethatindicatetheavailabilityoftobaccoproductsand
thepricethereofdoesnotcontravenesubsection(1).
(4) Noreplicatoyorcandytobaccoproductmaybesoldordisplayedatany
retailorwholesalepointoranyotherplacewherebusinessiscarriedon.

(5) Notwithstandingthissection,theMinistermayprovidebyregulation-
(a) forthephasingoutofexistingsponsorshiporcontractualobligations,if
any;and
(b) formattersrelatingtoadvertisementsoftobaccoproducts.
(6) Anypersonwhocontravenesorfailstocomplywithsubsection(1),(2)
or(4),commitsanoffenceandisliableonconvictiontoanenotexceedingN$200000
ortoimprisonmentforaperiodnotexceeding10yearsortobothsuchneandsuch
imprisonment.
Packaging and labelling of tobacco products
16. (1) Whereapersonsellsorimportsforsaleanytobaccoproduct
andthetobaccoproductiscontainedinapackage-
(a) thepackagemustbelabelledintheprescribedmannerandmustbear
theprescribedwarningconcerningthehealthhazardsincidentaltothe
smokingoftobaccoproductsandotherrelevantinformation;and
(d) thequantitiesoftheconstituentspresentinthetobaccoproductconcerned
mustbestatedonthepackage.
(2) Anypersonwhocontravenesorfailstocomplywithsubsection(1),
commitsanoffenceandisliableonconvictiontoanenotexceedingN$200000
ortoimprisonmentforaperiodnotexceeding10yearsortobothsuchneandsuch
imprisonment.
PART 4
REDUCTION OF SUPPLY OF TOBACCO PRODUCTS
Measures to prevent illicit trade in tobacco products
17. (1) Nopersonmaysellorimportforsaleanytobaccoproduct,unless
thepackagebearsthestatement“SalesonlyallowedinNamibia”oranyothereffective
markingindicatingtheoriginthereofandthenaldestinationforsale.
(2) Anypersonwhocontravenesorfailstocomplywithsubsection(1),
commitsanoffenceandisliableonconvictiontoanenotexceedingN$200000ortoimprisonmentforaperiodnotexceeding10yearsortobothsuchneandsuch
imprisonment.
Prohibition of sale of tobacco products to persons under the age of 18 years
18. (1) Nopersonmay-
(a) sellorsupplyanytobaccoproducttoanypersonundertheageof18
years,whetherforhisorherpersonaluseornot;or
(b) engageanypersonundertheageof18yearsinthesellingoftobaccoproducts.

(3) TheMinistermayprescribethesizeandcontentofthenoticereferred
toinsubsection(2).
(4) Anypersonwhocontravenesorfailstocomplywithsubsection(1)or
(2),commitsanoffenceandisliableonconvictiontoanenotexceedingN$100000
ortoimprisonmentforaperiodnotexceedingveyearsortobothsuchneandsuch
imprisonment.
Prohibition of free distribution and reard
19. (1) Nomanufacturer,distributor,importerorretailerofatobacco
productmayforfree,oratareducedprice,otherthananormaltradediscount-
(a) distributeanytobaccoproduct;or
(b) supplyanytobaccoproduct,
toanypersonforsubsequentdistribution.
(2) Nopersonmayofferanygift,cashrebateorrighttoparticipateinany
contest,lotteryorgame,toanypersoninconsiderationofthepurchaseofatobacco
product,orthefurnishingofevidenceofsuchapurchase.
(3) Anypersonwhocontravenesorfailstocomplywithsubsection(1)or
(2),commitsanoffenceandisliableonconvictiontoanenotexceedingN$200000
ortoimprisonmentforaperiodnotexceeding10yearsortobothsuchneandsuch
imprisonment.
Restrictions on use of vending-machines and prohibition of such sale from date
determined by Minister
20. (1) FromadatedeterminedbytheMinisterbynoticeintheGazette,
nopersonmayselltobaccoproductsfromavending-machine.
(2) UntilthedatedeterminedbytheMinisterascontemplatedinsubsection
(1),thesaleoftobaccoproductsfromvending-machinesisrestrictedtoplacesinwhichpurchasesfromsuchmachinesareinaccessibletopersonsundertheageof18years.
(3) Itistheresponsibilityofanypersonduringsuchtimeasheorsheis
responsiblefororhascontrolofthepremisesinwhichanyvending-machineiskeptto
ensurethatnopersonundertheageof18yearsmakesuseofanysuchmachine.
(4) ThePermanentSecretarymayinwritingdirecttheownerofavending-
machineinquestionorthepersonincontrolthereof-
(a) totakesuchprecautionarymeasuresasarespeciedinthedirectionto
preventthevending-machinebeingusedbypersonsundertheageof18years;or
(b) toremovethevending-machinefromthepremiseswithintheperiod
speciedinthedirection.

PART 5MANUFACTURING AND EXPORT STANDARDS
Standards for manufacturing and export of tobacco products
21. (1) Alltobaccoproductmanufacturersmustcomplywithsuch
standardsasmaybeprescribed,irrespectiveofwhetherthetobaccoproductconcerned
isintendedforexportornot.
(2) Everytobaccoproductmanufacturermustprovide,intheprescribed
mannerandwithintheprescribedperiod,suchinformationabouttheproductandits
emissionstotheMinisterandthepublicasmaybeprescribed.
(3) ApersonmayonlyexportatobaccoproductfromNamibiaiftheproduct
meetsthestandardscontemplatedinsubsection(1)aswellastheproductandtesting
standardsofthecountryofnaldestination.
(4) Ifnoproductandtestingstandardsexistinthecountryofnaldestination,
thetobaccoproductintendedforexportmustcomplywiththestandardsreferredtoin
subsection(1).
(5) Anypersonwhocontravenesorfailstocomplywithanystandards
prescribedundersubsection(1)orfails,withintheprescribedperiods,toprovidethe
Ministerwithinformationprescribedundersubsection(2)commitsanoffenceandis
liableonconvictiontoanenotexceedingN$200000ortoimprisonmentforaperiod
notexceeding10yearsortobothsuchneandsuchimprisonment.
PART 6
PROTECTION FROM EXPOSURE TO TOBACCO SMOKE
Protection from exposure to tobacco smoke
22. (1) Thesmokingoftobaccoproductsin-
(a) apublicplace;
(b) anyareawithinaprescribeddistancefromawindowof,ventilationinlet
of,doorwaytoorentranceintoapublicplace;or
(c) anyplacecontemplatedinsubsection(3),
isprohibited.
(2) Theowneroforpersoninchargeofaplaceoranareacontemplatedin
subsection(1)mustensurethatnopersonsmokesinthatplaceorarea.
(3) TheMinistermayprohibitthesmokingofanytobaccoproductinany
prescribedoutdoorpublicplace,orsuchportionofanoutdoorpublicplaceasmaybe
prescribed,ifpersonsarelikelytocongregatewithincloseproximityofoneanotheror
wheresmokingmayposeareorotherhazard.

(4) Theowneroforpersoninchargeofaplaceorareacontemplatedin

announcementsinordertoinformanypersonwhoentersorwhoisinoronsuchplace
orareaofanyprohibitionsonsmoking.
(5) Anemployermustensurethat-
(a) employeesmayobjecttosmokingintheworkplaceincontraventionof
thisActwithoutretaliationofanykind;
(b) employeeswhodonotwant tobeexposed to tobaccosmoke in the
workplacearenotsoexposed;
(c) it isnota conditionofemployment,expresslyor implied, thatany
employeeisrequiredtoworkwheresmokingispermitted;and
(d) employeesarenotrequiredtosignanyindemnityforworkingwheresmokingispermitted.
(6) Anypersonwhocontravenesorfailstocomplywithsubsection(1)
commitsanoffenceand isliableonconvictiontoanenot exceedingN$500or to
imprisonmentforaperiodnotexceedingonemonthortobothsuchneandsuch
imprisonment.
(7) Anypersonwhocontravenesorfailstocomplywithsubsection(2)or
(4)commitsanoffenceandisliableonconvictiontoanenotexceedingN$60000or
toimprisonmentforaperiodnotexceedingthreeyearsortobothsuchneandsuch
imprisonment.
(8) Anypersonwhocontravenesorfailstocomplywithsubsection(5)
commitsanoffenceandisliableonconvictiontoanenotexceedingN$100000or
toimprisonmentforaperiodnotexceedingveyearsortobothsuchneandsuch
imprisonment.

TOBACCO PRODUCTS CONTROL FUND
Establishment of fund for control of tobacco products
23. ThereisestablishedafundtobeknownastheTobaccoProductsControlFund.

(b) fordefrayingexpensesincurredinadministeringtheFundorbymembers
oftheCommitteeorsubcommitteesoftheCommittee;
(c) tocontributetothetreatmentoftobaccorelatedillnessesanddiseases;
(d) toconducttrainingontobaccorelatedprogrammes;and
(e) toprovidefundingfor-
(i) theformulationandimplementationofprojectsandprogrammes
inordertocontrolthesmokingoftobaccoproducts;and
(ii) technicalassistance,guidanceandtrainingintheidentication,
planning,preparation,appraisal,monitoring,evaluation,
financing, implementationormanagementof projects and
programmesreferredtoinsubparagraph(i).
(2) SpecicdonationstotheFundmaybeutilisedinamannerasagreedto
betweentheFundmanagementandthedonor.
Administration of Fund and accountability
26. (1) ThePermanentSecretaryis,forthepurposesoftheStateFinance
Act,1991(ActNo.31of1991),theaccountingofceroftheFund.
(2) ThePermanentSecretaryisresponsiblefortheadministrationoftheFund,
subjecttothedirectionsoftheMinistergivenafterconsultationwiththeCommittee,and
totherulesmadeundersubsection(3).
(3) TheMinistermay,withtheconcurrenceoftheMinisterresponsiblefor
nance,makerulesrelatingtotheadministrationoftheFund.
(4) ThePermanentSecretarymust,subjecttothissection,openandmaintain
abankingorsavingsaccountinthenameoftheFundwith-
(a) anybankinginstitutionorbuildingsocietyregisteredunderthelaws
governingbankinginstitutionsandbuildingsocietiesinNamibia;or
(b) thePostOfceSavingsBankestablished in termsof thePostsandTelecommunicationsAct,1992(ActNo.19of1992).

27. (1) ThenancialyearoftheFundendson31Marchineachyear.
(2) ThePermanentSecretarymust-
(a) keepsuchbooksofaccountasarenecessarytorepresentfairlythestate
ofaffairsandbusinessoftheFundandtoexplainthetransactionsand
nancialpositionoftheFund;and
(b) notlaterthanthreemonthsaftertheendofeachnancialyear,submit
suchaccountstotheAuditor-Generalforaudit.
(3) TheAuditor-GeneralmustsubmitareportontheauditoftheFundtothe
MinisterwhomusttablethereportintheNationalAssemblywithin60days,iftheNational
Assemblyisinsession,or,ifitisnotinsession,within30daysaftercommencementof
itsnextsession.
(4) AnymoneyoftheFundwhichisnotrequiredforimmediateusemay
beinvestedastheMinister,withtheconcurrenceoftheMinisterresponsiblefornance,
maydirect.
(5) AnyunexpendedbalanceintheFundattheendofanynancialyear
mustbecarriedforwardasacreditintheFundtotheensuingnancialyear.

PART 8
PROVISIONS ON ENFORCEMENT OF THE ACT
Complaints
29. (1) Anypersonwhobelievesonreasonablegroundsthattherehas
beenacontraventionofthisActinrespectofanypublicplacemayinwritingcomplain
totheownerorpersoninchargethereof,specifyingtheparticularsofthecomplaint.
(2) Theownerorotherpersonreferredtoinsubsection(1)must,within10workingdaysofreceivingacomplaintreferredtointhatsubsection,investigateorcause
thecomplainttobeinvestigated,andifitappearsthatacontraventionhasoccurred,he
orshemusttrytoresolvethecomplaint.
(3) Ifacontraventionreferredtoinsubsection(1)isonthepartof-
(a) theownerorpersoninchargeofthepublicplaceconcerned,suchowner
orpersonmustresolvethecauseofthecomplaintorgiveanassurance
thatsatisesthecomplainantthattherewillbenorepetitionofthecause
ofthecomplaint;
(b) anyemployeeorotherpersoninsuchplace,theownerorotherperson
referredtoinsubsection(1)mustseektoobtainfromthatemployeeor
otherpersonanassurancethatsatisestheownerorpersonconcerned
thattherewillbenorepetitionofthecauseofthecomplaint.

30. (1) TheMinistermay-
(a) subjecttothelawsgoverningthepublicservice,appointanysuitable
personasaninspector;
(b) designateanystaffmemberintheMinistryasaninspector,
toperformthepowerscontemplatedinsection31.
(2) Alocalauthoritymay,withthepriorwrittenapprovaloftheMinister,
authoriseanystaffmemberofthelocalauthorityconcernedasaninspectortoperformthepowerscontemplatedinsection31withinitslocalauthorityarea.
(3) Anypersonappointedordesignatedasaninspectorundersubsection(1)
orauthorisedasaninspectorundersubsection(2)mustbefurnishedwithacerticateof
appointmentsignedbytheMinisterorthechiefexecutiveofcerofthelocalauthority
referredtoinsection1oftheLocalAuthoritiesAct,1992(ActNo.23of1992),asthe
casemaybe.
Entry, search and inspection of place, premises, vessel, vehicle or public
conveyance
31. (1) InordertomonitorandenforcecompliancewiththisActinso
farasitrelatestotheadvertisementandsaleoftobaccoproductsandtheillicittradeof
tobaccoproducts,includingcounterfeitandcontrabandtobaccoproducts,aninspector
maywithoutwarrantornotice,atanyreasonabletimeenteranyplace,premises,vessel,
vehicleorpublicconveyance,whichisnotahome.
(2) Aninspectormayenterahomeonly-
(a) withtheconsentoftheowneroroccupier;or
(b) ifauthorisedbyawarrantundersubsection(3)todoso.
(3) Amagistrate,or judgeof theHighCourt, inchambersandhaving
jurisdictionmayissueawarrantonwrittenapplicationbyaninspectorstatingunder
oathorafrmationthereasonsfortheneedtoentertheplaceinordertomonitorand
enforcecompliancewiththisActascontemplatedinsubsection(1).
(4) InordertomonitorandenforcecompliancewiththisActascontemplated
insubsection(1)aninspectormay-
(a) questionanypersoneitheraloneorinthepresenceofanyotherperson
onanymattertowhichthisActrelates;
(b) orderanypersonwhohascontroloverorcustodyofanybook,document,
tobaccoproductorthingtoproducewithoutdelay,atsuchtimeandplace
asmaybedeterminedbytheinspector,suchbook,document,tobacco
productorthing;

(c) seizeanybook,document,tobaccoproductorthingwhichintheopinion
oftheinspectormayserveasevidenceinanymatterintermsofthis
Act;
(d) examineorcausetobeexamined,makeextractsfromorcopiesof,any
book,document,tobaccoproductorthingproducedtoorseizedbytheinspectorandorderanypersonwhointheopinionoftheinspectoris
qualiedtodosotoexplainanyentryinthebook,documentorthing;
and
(e) orderanemployeetoappearbeforetheinspectoratsuchtimeandplace
asmaybedeterminedbytheinspectorandquestionthatemployee.
(5) Aninspectorperforminganyfunctionintermsofthissection-
(a) maybeaccompaniedbyaninterpreterandanyotherpersonreasonably
requiredtoassistinconductingtheinspection;
(b) mustproduceonrequestthecerticateofappointmentreferredtoin
section30(3);
(c) mustprovideareceiptforanybook,document,tobaccoproductorthing
seizedorproducedintermsofsubsection(4);and
(d) mustreturnanythingsoseizedorproducedwithinareasonabletime.
(6) Anypersonwho-
(a) failstogiveorrefusesaccesstoaninspectorwhorequestsentranceto
anypremises;
(b) hinders,opposes,obstructsorundulyinuencesaninspectorwhois
exercisingapowerorperformingadutyconferredorimposedunderor
bythisAct;
(c) failsorrefusestogiveinformationthatheorshemaylawfullyberequired
togivetoaninspector;or
(d) givestoaninspectorfalseormisleadinginformationknowingittobe
falseormisleading,
commitsanoffenceandisliableonconvictiontoanenotexceedingN$50000or
toimprisonmentforaperiodnotlessthanveyearsortobothsuchneandsuch
imprisonment.
Presumptions and evidence
32. IncriminalproceedingsrelatingtothisAct-
(a) acopyoforextractfromabook,documentorthingmadebyaninspector
undersection31(4)(d)andcertiedbyhimorhertobetrueandcorrect,ispresumed,unlessthecontraryisproved,tobeatrueandcorrectcopy
oforextractfromtherelevantbook,documentorthing,andisonits
productionincourt primafacieproofofanyentrytowhichitrelates;

(b) acerticatestatingtheresultofanexamination,analysisortestscarried
outinrespectofatobaccoproductandpurportingtobesignedbythe
analystwho carried out the examination,analysisor test,mustbe
acceptedas primafacieproofofthefactsstatedinthecerticate;
(c) aquantityofatobaccoproductinoruponanyplace,premises,vessel,vehicleorpublicconveyanceatthetimeasampleofitisobtainedbyan
inspectorforthepurposesofthisActispresumed,unlessthecontrary
isproved,tobeinthesameconditionorpossessthesamepropertiesas
suchsample.
Forfeiture and destruction
33. (1) ThecourtconvictinganypersonofanoffenceunderthisActmay
declareanytobaccoproductorotherthingtowhichtheoffencerelates,tobeforfeited
totheState.
(2) Atobaccoproductoranyotherthingforfeitedundersubsection(1)must
bedestroyedorotherwisedealtwithasthePermanentSecretarymaydirect.
Compounding of certain minor offences
34. (1) Ifapersonreceivesfromaninspectoranoticationinwriting
allegingthatthatpersonhascommitted,ataplaceandonadateandatatimeorduring
aperiodspeciedinthenotication,anoffencelikewisespecied,namely-
(a) acontraventionoforfailuretocomplywithsection15(1),(2)or(4),16
or17;
(b) acontraventionoforfailuretocomplywithsection18(1)or(2);
(c) acontraventionoforfailuretocomplywithsection19(1)or(2);
(d) acontraventionoforfailuretocomplywithsection20(1),(2)or(3);
or
(e) acontraventionoforfailuretocomplywithsection22(1),(2),(4)and
(5),
andspecifyingtheamountofthenecontemplatedinsubsection(6)thatacourttryingthatpersonfortheoffenceinquestionwouldprobablyimposeonhimorher,thatperson
maywithin30daysafterthereceiptofthenoticationdeliverortransmitthenotication,
togetherwithasumofmoneyequaltothatamount,tothemagistrateofthedistrictor
areawhereintheoffenceisallegedtohavebeencommitted,andthereuponthatperson
maynotbeprosecutedforhavingcommittedthatoffence.
(2) Apersonreceivinganoticationissuedundersubsection(1)froman
inspectorwhohasbeenauthorisedbyalocalauthorityascontemplatedinsection30(2),
maydeliverortransmitthenotication,togetherwithasumofmoneyequaltotheamount
speciedinthenotication,tothelocalauthorityconcerned.
(3) Thelocalauthorityconcernedmustnotlaterthansevendaysafterreceipt
ofasumofmoneyasprovidedinsubsection(2),forwardtothemagistrateofthedistrict
orareawhereintheoffenceisallegedtohavebeencommitted,acopyofthenotication
relatingtothepaymentinquestion.

(4) Ifthemagistratendsthattheamountspeciedinthenoticationexceeds
theamountcontemplatedinsubsection(6)inrespectoftheoffenceinquestion,the
magistratemustnotifythelocalauthorityoftheamountwherebytheamountspecied
inthenoticationexceedstheamountsodetermined,andthelocalauthorityconcerned
mustimmediatelyrefundtheamountofsuchexcesstothepersonconcerned.
(5) Anymoneypaidtoamagistrateintermsofsubsection(1)ortoalocal
authorityintermsofsubsection(2)mustbedealtwithasifithadbeenpaidasanefor
theoffenceinquestion.
(6) Theamounttobespeciedinanoticationissuedundersubsection(1)
astheamountofthenethatacourtwouldprobablyimposeinrespectofanoffence,
maynotexceed-
(a) inthecaseofacontraventionoforfailuretocomplywithsection22(1),
theamountofN$500;
(b) inthecaseofacontraventionoforfailuretocomplywithsection15(1),
(2)or(4),16,17,section18(1)or(2),section19(1)or(2),section20(1),
(2)or(3)andsection22(1),(2),(4)and(5)theamountofN$3000.
Jurisdiction of magistrate’s courts
35. Notwithstandinganyotherlaw,amagistrate’scourthasjurisdictionto
imposeanypenaltyprovidedforinorunderthisAct.
Levy on import, distribution or sale of tobacco products
36. (1) TheMinister,inconsultationwiththeMinisterresponsiblefor
nance,maybyregulationimposealevyontheimport,distributionorsaleoftobacco
products.
(2) Alevyreferredtoinsubsection(1)ispayabletotheFundintheprescribed
mannerandattheprescribedtimes.
(3) Regulationsmadeintermsofsubsection(1)mayprescribe-
(a) therateandmannerofcalculatingordeterminingthelevyortheamount
ofthelevy;
(b) theperiodsandmethodsofassessmentofthelevy;
(c) theinformationtobeprovidedtothePermanentSecretaryforthepurpose
ofassessingthelevy;
(d) inwhichmannerandwhenthelevyispayable;
(e) bywhomthelevyispayable;and
(f) penalties for the latepaymentof the levy,or forproviding false
informationorforthefailuretoprovideinformationtothePermanentSecretaryrelatingtotheassessmentofthelevy.

(4) Anypersonwhofailstopayanylevyreferredtointhissectioninthe
prescribedmannerandattheprescribedtimescommitsanoffenceandisliableon
convictiontoanenotexceedingN$50000orto imprisonmentforaperiodnotless
thanveyearsortobothsuchneandsuchimprisonment.
Regulations
37. (1) TheMinistermaymakeregulationsinrelationto-
(a) themannerormethodofdeterminingthequantitiesofconstituentsin
tobaccoproducts;
(b) thelocation,content,sizeandformatofanysignrequiredintermsof
thisAct;
(c) thestandardsthatatobaccoproductmustcomplywith,including-
(i) theamountsofsubstancesthatmaybecontainedintheproduct
oritsemissions;
(ii) substancesthatmayormaynotbeaddedtotheproduct;
(iii) theignitionpropensityofcigarettes;and
(iv) productdesignandcomposition;
(d) methodstoaccessconformity,andmethodsoftestingandmeasuring
compliance,withanyprescribedstandard;
(e) anyinformationthatamanufacturerofatobaccoproductmustsubmit
totheMinisterandtothepublic,includinginformationinrespectof-
(i) research conducted into a tobacco product by amanufacturer
orbyapersonwhoconductedresearchpaidforinwholeorin
partbyatobaccomanufacturer;
(ii) thequantityofatobaccoproductmanufactured;
(iii) marketingexpenditure;and
(iv) information on product composition, ingredients, hazardous
propertiesandemissions;
(f) anyancillaryorincidentaladministrativeorproceduralmatterthatis
necessarytobeprescribedfortheproperimplementationoradministration
ofthisAct;and
(g) anyothermatterrequiredorpermittedtobeprescribedintermsofthis
ActinordertoachievetheobjectsofthisAct.
(2) Regulationsmadeunder subsection (1)(a)mayprescribe for thedeterminationofthequantitiesofconstituentsintobaccoproductsanymannerormethod
orstandardssetoutinapublicationwhichintheopinionoftheMinisterisgenerally
recognizedasauthoritative.

(3) TheMinistermust,not less than threemonthsbefore issuingany
regulationunderthisAct,causeadraftoftheregulationtobepublishedintheGazette,
togetherwithanoticedeclaringtheintentionoftheMinistertoissuesucharegulation
andinvitinginterestedpersonstofurnishhimorherwithanycommentsthereonor
representationsinconnectiontherewithwithinaspeciedperiod.
(4) Subsection(3)doesnotapplyinrespectof-
(a) a regulationwhich,after thatsubsectionhavebeencompliedwith,
hasbeenamendedbytheMinisterinconsequenceofcommentsor
representationsreceivedbytheMinisterinpursuanceofthenotice
publishedintermsofthatsubsection;
(b) anyregulationinrespectofwhichtheMinisterisoftheopinionthatit
isinthepublicinterestthatitbeissuedwithoutdelay.
(5) Aregulationmadeintermsofsubsection(l)mayprescribepenaltiesforanycontraventionthereoforfailuretocomplytherewithofanenotexceeding
N$4000ortoimprisonmentforaperiodnotexceedingoneyearortobothsuchne
andsuchimprisonment.
Short title and commencement
38. (1) ThisActiscalledtheTobaccoProductsControlAct,2010,and
comesintooperationonadatetobedeterminedbytheMinisterbynoticeintheGazette.
(2) Differentdatesmaybedeterminedundersubsection(1)inrespectof
differentprovisionsofthisAct.
