ITEM TITLE: Presentation by Veenstra & Kimm Inc. on the Beardsley Functional Study CONTACT PERSON: Public Works Department

SUMMARY EXPLANATION & HISTORY: Veenstra & Kimm, Inc. were requested by the City to perform a functional study on Beardsley to assist in the planning of that road corridor in the future. As we continue to see growth in that area and the traffic in the area grows, it is important to plan ahead for this arterial. COST: The cost of this study is $9,575.

17-156 Motion by Riva, seconded by Lester to approve the consent agenda passed unanimously, RC. Public hearing on disposing real property described as the water tower site. Mayor Phillips opened the public hearing at 6:09 p.m. Jodi Eddleman reported receiving no comments. Mayor Phillips closed the public hearing at 6:09 p.m. 17-157 Motion by Kuhl, seconded by Livingston to approve Resolution 17097 relative to the disposal of certain real estate owned by the City of Norwalk, Iowa passed unanimously, RC. Consideration of a development agreement with Clark Development. 17-158 Motion by Riva and seconded by Livingston to approve the development agreement between the City of Norwalk and Clark Development LLC., passed unanimously, RC. Request from Ryan Boyington to approve a neighborhood sketch plan for approximately 14 acres of ground north of the existing Twin Lakes Subdivision. Council asked the Boyingtons to consider grading out a 26’ wide surface so that future streets would meet city standards. It was also noted that a binding agreement should be considered if there is a voluntary annexation in the future. Luke Parris mentioned obtaining easements also.

Consideration of a resolution accepting the infrastructure on the final plat for Legacy Plat 20. 17-160 Motion by Livingston, seconded by Riva to approve Resolution 17099 Accepting improvements known as Legacy Plat 20, passed unanimously, RC. Consideration of a resolution accepting the final plat for Legacy Plat 20. 17-161 Motion by Riva, seconded by Kuhl to approve Resolution 17100 approving the final plat of Legacy Plat 20, passed unanimously, RC. Request from Little Hands Big Dreams Daycare for exterior building lights. 17-162 Motion by Livingston, seconded by Lester to approve Resolution 17101 approving exterior building lighting at 730 Main Street, passed unanimously, RC. Orchard Hill Park Nancy requested that the council allow the construction of the park to start by the spring of 2018, so that all four phases of the park can be completed at one time. The council asked that construction be delayed until FY 19 and would like to revisit the project during the next budget season. 17-163 Motion by Lester, seconded by Livingston to adjourn meeting at 7:37 p.m., carried unanimously, voice vote.

JOB DESCRIPTION

Job Function:

Under general supervision of the City Clerk, performs a variety of administrative and clerical duties. Welcomes visitors by greeting them in person or on the telephone; answering or referring inquiries. Directs visitors by maintaining employee and department directories. Serves as the primary contact for the front counter. Responsible for maintaining standards of excellence in all facets of customer service and support for other staff members.

Equipment Used: General office equipment.

Duties and Responsibilities:

• Receives payments for fees, penalties, licenses, utility connection, utility bills, and bank deposits, etc.

• Balances daily collections and disbursements and prepares daily cash reports. • Serves as customer service representative assisting customers, guests or walk in traffic. • Primary contact for all new and current residents of Norwalk. Provide residents with superior

customer service in setting up their utilities and creating and distributing new resident informational materials.

• Updates and manages the content of the City’s website and Facebook page. • Answers the telephone directing calls to the appropriate City staff • Performs administrative support during absences of regular support staff or as assigned, utilizes

cross training to assist in support in other departments. • Develops and distributes various reports to department heads and the City Council. • Serves as proxy to the City Clerk in gathering and assembling agenda and minutes of the City

Council meeting. • Develops and coordinates community research projects and studies in support of the City

Manager and City Mayor. • Type letters, forms, and reports etc. • Assists with other clerical and office work as necessary • Performs other duties as apparent or assigned. • Develops and manages the writing, design, production and distribution of the monthly City of

Norwalk newsletter and Annual Norwalk Source Magazine. • Serves as back up for Accounts Payable, Utility Billing and balancing cash drawer. • Coordinator of all dog licensing, ordering supplies, record keeping, weekly and monthly

reporting. • Coordinate all aspects of the Compost It program – submit weekly and monthly financial and

new subscription data, coordinate bin deliveries, assure office has appropriate supplies, stickers, bags, magnets, bins, reports, program brochures, issue compost bin warranty/replacements, pricing, etc.

Job Function: Under the administrative direction of the Finance Director, performs administrative, financial, office and clerical duties. The job will require mathematical abilities, account management and support that require a commitment to customer service. The position is also designed to implement procedures initiated by the City auditors.

Duties and Responsibilities:

SUMMARY EXPLANATION & HISTORY: For the last several years the City has entered into an agreement with the Iowa Department of Transportation (DOT) where the City assumed the snow removal operations on the segment of Hwy 28 within the corporate limits. In that agreement the DOT compensates the City in the amount of $40,068.00. This amount is based on 18 lane miles of roadway at a rate of $2,226.00 per mile. This year the DOT has presented the City with another agreement to perform the same services at the same rate. It should be noted that this may be the last year we can continue with this agreement as growth within the community is stressing our resources to maintain the level of service our residents are comfortable with receiving during snow emergencies. COST: There is no cost associated with approval of this resolution ALTERNATIVES:

RESOLUTION APPROVING 28E SUPPLEMENTAL AGREEMENT FOR SNOW REMOVAL ON IA-28 WITH THE CITY OF NORWALK

WHEREAS, the Iowa Department of Transportation (DOT) controls the Primary Road System within the state of Iowa; and

WHEREAS, Iowa Highway 28 is such a Primary Roadway that exists within the City of Norwalk; and WHEREAS, the DOT has presented the City Of Norwalk with a Supplemental Agreement for the purpose

of snow removal operations from July 1, 2017 to June 30, 2018 at a rate of $2,226.00 per lane mile for the 18 lane miles within the City. Since that time the DOT Commission has awarded Norwalk with a Local Development RISE Grant in the amount of $845,219. The DOT has notified us that we can begin incurring costs for the project as of June 13, 2017. Upon notification we asked V&K to provide the City with an engineering agreement for services (design & construction oversight). That agreement is attached. FUNDING:

Included in the $1.46M project noted above is $223,575.66 in engineering fees. The attached agreement includes $254,000 in engineering fees. This is due to the thought that the City should plan for additional pavement to the furthest extent of the certified site with an overall intent to keep long-term costs down. V&K is recommending that we include this additional 500-foot of pavement as an alternate when we bid the project. If prices are favorable the City could pave the entire 1,900-feet of certified site frontage. ALTERNATIVES:

1. Approve the attached resolution. 2. Modify the agreement for fees of $223,576.66 and approve the attached resolution. 3. Take no action at this time.

RECOMMENDATION: It should be understood that approving the agreement as presented would be an additional cost of approximately $30,500. This additional cost is beyond the budget number highlighted in blue above and would have to be funded by the City. Staff recommends Alternative 1.

ITEM TITLE: Public hearing and consideration of a rezoning request to rezone approximately 32 acres of ground north Delaware Street and approximately 800 feet west of Iowa Highway 28 from A-R Agricultural Reserve to M-1 General Industrial.

SUMMARY EXPLANATION: In 2014, the City worked with the Iowa Economic Development Authority to have 55 acres of ground identified as a Certified Industrial Site. The Ancell/Knox property that was certified is located on the southend of town at the northwest corner of Delaware Street and Iowa Highway 28. After the site was certified with the state, the City annexed the ground. When ground is annexed into the City it defaults to the City’s A-R Agricultural Reserve zoning district. In late 2016 and early 2017, the City was contacted by representatives from Windsor Windows & Doors about the potential location of a window manufacturing facility in Norwalk at the certified site. Windsor Windows & Doors acquired 27 acres of the certified site for their facility and the City zoned the area to M-1 General Industrial in May 2017. At the time, the remainder of the Certified Site was left as A-R Agricultural Reserve, though the City’s future land use plan does identify the area for future industrial growth. During the Windsor Windows & Doors project, the City applied for and received $845,000 from the Iowa DOT’s RISE program. This grant was to pave Delaware Street from the intersection of Iowa Highway 28 through the area in front of Windsor Windows & Doors and extend west to area in front of the undeveloped Certified Site. This provided the City with a paved access to the remainder of the Certified Site, making the area more development ready. As part of the RISE grant, the Iowa DOT requires that adjacent project ground be zoned for industrial use. Therefore, for the City to proceed with the paving project, a rezoning of the remainder of the Certified Site needs to be considered. The area was identified for industrial growth in the City’s Comprehensive Plan and through the Certified Site process. Adjacent property to the north and east are currently zoned in the M-1 district as part of the Norwalk Business Center and Windsor Windows & Doors Project. The property to the south and west is not currently in the City and is a current farmstead with farm ground. All of the surrounding property is planned as industrial ground in the City’s future land use map. ALTERNATIVES:

1. Approve the rezoning to the City Council 2. Approve the rezoning to the City Council with conditions 3. Take no action at this time.

PLANNING & ZONING COMMISSION RECOMMENDATION: At the June 26, 2017 Planning & Zoning Commission meeting, the Commission recommended approval of the rezoning request. The request is in conformance with the City’s Comprehensive Plan and future land use map. Through the site certification process, the City has anticipated and planned for extension of City services and the necessary upgrades to the transportation network to accommodate industrial users in this area.

In 2005 the City acquired the western half of the old Highway 28 right-of-way north of Echo Valley Drive in Polk County. The right-of-way includes pavement for old Highway 28. Recently the City has entered into a development agreement with the adjacent property owner, Road Contractors, Inc., for improvements related property between Iowa Highway 28 and the old Highway 28. Part of that development agreement was that the City would vacate the City’s portion of old Highway 28 no later than July 15, 2017. The vacated right-of-way would then be included into the Road Contractors, Inc. Development Property. The attached resolution enacts the closing and vacation of the City owned portion of old Highway 28 north of Echo Valley Drive.

property has no value to the City and serves no public benefit; and

WHEREAS, said Development Agreement, entered into with Road Contractors Inc.,

included consideration representing the fair market value of the property. It is in the best interest of

the City of Norwalk, Iowa, that the property be conveyed to Road Contractors Inc.; and;

The developer’s engineer, Cooper Crawford & Associates LLC developed the plat and construction plans. Veenstra & Kimm, Inc. has submitted documentation that the public improvements have been installed in accordance with the plans and specifications for the project. A site inspection was conducted on June 23, 2017. The contractors have provided necessary bonds and with the acceptance of this resolution, the 4 year maintenance period will start. The developer, Diligent Development, is now requesting the City to accept the following improvements:

RESOLUTION ACCEPTING IMPROVEMENTS

KNOWN AS BLOOMING HEIGHTS

WHEREAS, the owner and developer, Diligent Development contracted with Cooper Crawford &

Associates LLC to develop construction plans and specifications for Blooming Heights: and, WHEREAS, Veenstra & Kimm, Inc. is responsible for overseeing all the infrastructure improvements

including the installation of the site grading and sub-grade preparation, sanitary sewer, streets, storm water, and water mains; and,

WHEREAS, Veenstra & Kimm, Inc. has submitted a letter stating that the work of constructing the site

grading, sanitary sewer, storm water, streets, and water mains have been completed and substantially complies with the terms, conditions, and stipulations of the plans and specifications; and,

WHEREAS, Diligent Development desires to dedicate the sanitary sewer, storm water, streets, and

water main improvements to the City of Norwalk as public improvements. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Norwalk, Iowa, that said

PARKLAND DEDICATION AGREEMENT

This Agreement is entered into between the City of Norwalk, Iowa (the "City") and

Diligent Blooming Heights, LLC and J C P, LC as of the XXth day of July 2017.

WHEREAS, Diligent Blooming Heights, LLC owns land being platted as Blooming Heights Plat 1;

WHEREAS, J C P, LC owns undeveloped ground to the west of Blooming Heights

Plat 1, identified in the legal description in Exhibit A; WHEREAS, Diligent Blooming Heights, LLC has entered into a purchase agreement

for the ground owned by J C P, LC, identified in the legal description in Exhibit A; WHEREAS, Diligent Blooming Heights, LLC is planning a second phase of the

Blooming Heights subdivision on the ground identified in the legal description in Exhibit A; WHEREAS, the Diligent Blooming Heights, LLC has developed 41 single family lots

in the Blooming Heights Plat 1 subdivision and is required to provide 783 square feet of parkland for each single family lot for a total of 32,103 square feet (0.74 acres) of parkland.

WHEREAS, the Diligent Blooming Heights, LLC has requested that the City allow the 0.74 acres of required parkland dedication to be dedicated in the planned second phase of Blooming Heights located on the J C P, LC ground that is identified in the legal description in Exhibit A; and

WHEREAS, the City has authority to require parkland dedication and to consider alternatives to parkland dedication in the City’s Subdivision Regulations Section 16.06.11; and

NOW, THEREFORE, in consideration of the mutual obligations contained m this Agreement, the parties hereto agree as follows:

1. J C P, LC agrees:

A. To require that 32,103 square feet (0.74 acres) of parkland is dedicated to the City at the time that the area identified in Exhibit A is developed, in addition to any other parkland required for the development the area identified in Exhibit A.

2. Diligent Blooming Heights, LLC agrees:

A. To dedicate 32,103 square feet (0.74 acres) of parkland to the City at the time that the second phase of Blooming Heights is developed in the area identified in Exhibit A, in addition to any other parkland required for the development the area identified in Exhibit A.

The City’s Subdivision Regulations require that all residential developments dedicate parkland to the City. For Single-Family Residential developments, the City requires 783 square feet of parkland for each single-family home. If a Developer is not proposing parkland within a development, they can request the City enter into an agreement to meet the parkland requirement through other means. The Blooming Heights Plat 1 subdivision is a 41 lot single-family development. Per Subdivision regulations, the developer is required to provide 32,103 square feet (0.74 acres) of parkland for the development. During preliminary platting, the developer indicated that they would not locate a park within the first phase of development. During final platting of Blooming Heights Plat 1, the City staff and the developer discussed that the developer would include 0.74 acres of parkland in the second phase of the Blooming Heights development to the west. The 0.74 acres of parkland would be in addition to any parkland required for additional single-family lots developed in the second phase. The attached Parkland Dedication Agreement is a draft that memorializes the developer will provide the parkland for Blooming Heights Plat 1 in a park identified during the development of the second phase of Blooming Heights. The staff will provide a finalized agreement prior to the Council meeting.

Magnolia Circle is a cul-de-sac originating on the northeast side of Crabapple Drive.

TRAIL PLAN: The neighborhood will have 5’ sidewalks along both sides of the street.

ZONING HISTORY FOR SITE AND IMMEDIATE VICINITY:

This site is zoned as R-1(100). Surrounding ground is zoned R-1 (100) and Agricultural.

Adjacent uses are compatible and no buffer is required.

STAFF ANALYSIS – SUBDIVISION ORDINANCE:

The Subdivision Ordinance requires that Final Plat submissions include such criteria as boundaries of property, engineer’s certificate, easements and right-of-way widths. SUMMARY EXPLANATION & HISTORY: The Cort Landing Plat 2 is an extension of Cort Landing Plat 1 which has access from Elm Avenue from the north and Hwy 28 from the east. This development is generally located on the south west corner of Elm Avenue and Sunset Dr. (Hwy 28). The developer’s engineer, Civil Engineering Consultants, Inc. developed the plat and construction plans. Veenstra & Kimm, Inc. has submitted documentation that the public improvements have been installed in accordance with the plans and specifications for the project. A site inspection was conducted on June 23, 2017. The contractors have provided necessary bonds and with the acceptance of this resolution, the 4 year maintenance period will start. The developer, Cort Landing LLC. is now requesting the City to accept the following improvements:

SANITARY SEWER • 921’ of 8” sanitary sewer main • 4 manholes

WHEREAS, the owner and developer, Cort Landing LLC contracted with Civil Engineering Consultants, Inc. construction plans and specifications for Cort Landing Plat 2; and,

WHEREAS, Veenstra & Kimm, Inc. is responsible for overseeing all the infrastructure improvements

including the installation of the site grading and sub-grade preparation, sanitary sewer, streets, storm water, and water mains; and,

WHEREAS, Veenstra & Kimm, Inc. has submitted a letter stating that the work of constructing the site

grading, sanitary sewer, storm water, streets, and water mains have been completed and substantially complies with the terms, conditions, and stipulations of the plans and specifications; and,

WHEREAS, Cort Landing LLC desires to dedicate the sanitary sewer, storm water, streets, and water

PARKLAND DEDICATION AGREEMENT

This Agreement is entered into between the City of Norwalk, Iowa (the "City") and

Cort Landing, LLC (collectively referred to as the "Developer") as of the XXth day of June 2017.

WHEREAS, the Developer has developed 37 single family lots in the Cort Landing subdivision and is required to provide 783 square feet of parkland for each single family lot.

WHEREAS, the Developer has requested that the City allow for an alternative to the parkland dedication requirement for the 37 single family lots in the Cort Landing subdivision; and

WHEREAS, the City has authority to require parkland dedication and to consider alternatives to parkland dedication in the City’s Subdivision Regulations Section 16.06.11; and

NOW, THEREFORE, in consideration of the mutual obligations contained m this Agreement, the parties hereto agree as follows:

1. The Developer agrees:

A. To provide grading of the Orchard View Park, located on Orchard Hills Drive, in an amount equal to the fair market value of the required parkland for the development, as determined by the following formula:

Cost per acre of ground ($xxxx) X Acres of Parkland Required (0.67 acres) = $XXXX

B. To make a contribution to the City Park fund in an amount equal to the fair

market value of the required parkland for the subdivision ($XXXX) in the event that Orchard View Park is not constructed as anticipated, and the Developer’s grading services are not needed.

2. The City agrees:

A. To accept the grading services as a contribution to the development of the park

system in lieu of a dedication of ground for the required parkland within the Cort Landing subdivision.

B. To provide the Developer with a grading plan for the Orchard View Park

C. To provide the Developer with ninety (90) days notification of the need for the

grading services.

D. To provide thirty (30) days notification of the need for a contribution to the

ITEM TITLE: Discussion and Direction for a Proposed Rate Increase of Irrigation Rates CONTACT PERSON: Public Works

SUMMARY EXPLANATION & HISTORY: Staff has been working on assembling data regarding an over view of water usage. While performing this research, it is evident that our peak months of usage are consistently in the summer when participation is low and temperatures are high. It is during these periods that irrigation of lawns is the cause of the consumption peaks during the summer. Realizing that irrigation is a luxury in an effort to keep yards green, we are suggesting a “user fee” be applied. Currently our irrigation rate is the same as our water rate, which will be $5.93 per thousand gallons as of July 1, 2017. On June 12th the Utility Advisory Commission considered this issue and passed a recommendation to the council suggesting increasing the rate on irrigation water to twice that of potable water or $11.86 per 1000 gallons.

ITEM TITLE: Discussion and Direction for a Proposed Rate Increase for Hydrant Meter Deposits and Rates for Bulk Water

SUMMARY EXPLANATION & HISTORY: It has been brought to our attention that our Agreement for Hydrant Meter Usage needs some updating. The deposit has not been adjusted for quite some time and it does not reflect the current cost to replace a hydrant meter unit. We currently offer 1 ½” and 2” hydrant meters,

and the existing $950 deposit does not cover the cost of meter, backflow device, and other equipment. The cost of a 2” hydrant meter is currently $1,435 without the backflow preventer, operating wrench, cart, and hose that are included in the Agreement. With these items included, we are recommending the deposit be increased to $1,800.00 In addition, the current rate for bulk water/hydrant water is $5.93 per thousand. Staff recommended to the Utility Advisory Commission the bulk rate be increased to 1.5 times that amount. This would put the rate at $8.90. The commission then voted to recommend to the Council that the rate be increased to twice the rate of potable water. This item is for discussion and recommendation to staff to prepare an ordinance for presentation to the City Council.

ITEM TITLE: Discussion regarding the vacation of ROW near O’Learys CONTACT PERSON: Luke Parris, AICP – Community Development Director

On May 4, 2017, the City received a letter from Eric O’Leary, owner of O’Leary Funeral & Cremation Services Celebration of Life Center, regarding City owned Right-of-Way (ROW) on the north side of the property. Mr. O’Leary has requested that the City consider vacating this ROW so that he may purchase for potential site expansion. Mr. O’Leary identified that he would like expand the driveway in this location, construct a workshop/garage for the business, and place a garbage dumpster near the new workshop/garage. The request letter from Mr. O’Leary and a map identifying the ROW area are attached. Staff review of the site indicates that this ROW area was like planned for a western expansion of Parkhill Drive at some point. With the current location of O’Leary’s and the City State Bank building, it is unlikely that the ROW area could accommodate a through connection of Parkhill Drive to Iowa Highway 28.

ITEM TITLE: Discussion regarding the zoning and future land use designation for the Stark Property east of 50th Street near County Line Road

CONTACT PERSON: Luke Parris, AICP – Community Development Director

City staff recently met with Real Estate agents seeking to list the Stark Property on the northern side of town near 50th Avenue and County Line Road. The agents requested information on allowable uses for the property and indicated they wished to market the ground as it is currently zoned. The City determined that there is a conflict between the current zoning and the recently approved future land use. The property is approximately 225 acres and currently zoned a mix of A-R, IC, and PC. The area is also located within the approach zone of the Des Moines International Airport. This zone has restrictions on building height; has restrictions on site lighting; recommends low intensity uses; and requires special noise mitigation measures during building construction. The approach zone does not circumvent the City’s ability to determine appropriate land uses within the zone. In 2016, the City adopted the updated future land use plan and map. In that planning effort, changes were made to the proposed land uses for this area. The new future land use map calls for a new Sub Area of Residential/Commercial Flex development along 50th Avenue and low density residential development to the east. The Residential/Commercial Flex corridor was identified because the City was running out of potential commercial development along our main thoroughfare of Iowa Highway 28. The concept is that 50th Avenue would become the secondary commercial corridor within the community due to the development of Veteran’s Parkway in West Des Moines and the connection to 50th Avenue from Maffit Lake Road. Prior to 2016, the previous future land use plan and map identified the entire area, including the North Shore development, as Sub Area 2 in the City that required special planning. The plan identifies residential uses, retail uses, office uses, and educational/municipal/community uses in the Sub Area. Both the 2016 updated future land use plan, and the previous future land use plan, are in conflict with the current zoning. The previous plan would have allowed the uses in the PC district and the office type uses in the IC district, though not any of the more intense industrial uses. The change in the 2016 update would not allow the IC and the PC uses in the areas they are currently zoned. The Residential/Commercial Flex area along 50th Avenue would allow some office uses but primarily retail and residential. Currently, with the zoning in place, portions the Stark Property can be developed with uses compatible with the IC or PC district. This is not in conformance with the City’s Comprehensive Plan and Future Land Use Plan. To conform, the City would need to consider a rezoning of the property or an amendment to the Future Land Use Plan. The City staff is looking to clarify an approach for handling this non-conformity.

PLANNING & ZONING DISCUSSION The Commission discussed this issue at their June 26, 2017 meeting. The Commission members had differing opinions. Some members felt that the City should stay with the Residential planned recently developed Future Land Use Update in 2016. Others felt the City should keep the area as Industrial Commerce and Professional Commerce as it is currently zoned.

ITEM TITLE: Variance Request to Discharge Clear Water into the Sanitary Sewer System CONTACT PERSON: Public Works Department

SUMMARY EXPLANATION & HISTORY: The discharge of clear water into the sanitary sewer system is a prohibited act according to Norwalk Municipal Code, Chapter 95 section 95.04. Under paragraph 2 it says “Surface run-off or Groundwater. Connect a roof downspout, sump pump, exterior foundation drain, areaway drain, or other source of surface run-off or groundwater to a building sewer or building drain which in turn is connected directly or indirectly to a public sanitary sewer.” The City has an ongoing program that identifies instances where foundation drains and sump pumps discharge into the sewer system, offers an incentive to disconnect, and levies a penalty if the practice continues. We are experiencing an instance where a property is discharging a foundation drain into their yard as required. However this property has such a significant amount of ground water on a continual basis and the discharge saturates the yard, soaks adjacent ground, flows over the sidewalk, and then into the street. This situation causes ice buildup in the winter and algae in the summer. There is not any storm sewer or secondary storm in this area. It is due to this situation that we request a variance to allow this property to connect their sump pump discharge into the sanitary sewer until a secondary storm line can be made available. Staff has discussed this issue with the Iowa Department of Natural Resources (DNR). The DNR does not have any issues with this alternative, noting that this type of restriction is a City issue only. ALTERNATIVES:

1. Take action to approve the variance request 2. Discuss and consider other alternatives 3. Take no action

RECOMMENDATION: Staff recommends Alternative No. 1.

RESOLUTION NO

RESOLUTION APPROVING VARIANCE TO DISCHARGE CLEAR WATER INTO THE SANITARY SEWER SYSTEM

WHEREAS, the City Of Norwalk has an ordinance which states that clear water such as sump pumps and foundation drains shall not discharge into the sanitary sewer system; and

WHEREAS, property owners are directed to discharge clear water into the storm sewer system whenever

available or into their yards; and WHEREAS, there exists some areas where storm sewer does not exist and that ground water is so

significant that discharge above ground is not practical. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Norwalk, Iowa, that Section 1: That the City approves a variance allowing the discharge of clear water into the sanitary sewer system on a temporary basis until storm sewer/secondary storm sewer can be made available. Section 2: That the determination to allow such a variance would be the discretion of the Public Works Director based on the nature of each individual situation.

BUSINESS OF THE CITY COUNCIL AGENDA STATEMENT

ITEM TITLE: Discussion and Direction for Application of Storm Water Fees CONTACT PERSON: Public Works Department

SUMMARY EXPLANATION & HISTORY: In January 2010 a formal policy was adopted for Calculating a Storm Water Drainage Utility Charge. The staff at City Hall discovered that when this calculation was entered into the billing system the rate was entered incorrectly and some properties have incorrect measurements which affect the amount of the monthly fee. Utility Billing staff and the Community Development Intern has gone through every account and measured the square feet of impervious area of each location, then re-calculated the units billed with the correct rate for each commercial property. The measurement of square feet for each property was provided by Community Development and will continue to be provided to the Utility Billing Clerk for any new commercial properties. The correct rate also needs to be entered into the utility billing software. At this time the annual revenue from this fee is $46,381.20. With the corrections the annual revenue will be $114,762.36. An increase in revenue of $68,381.16. The question now posed to the City Council is how this adjustment is applied. The Utility Advisory Commission considered this at their June 12, 2017 meeting and after discussion voted to recommend to the Council is to implement the corrected rates effective January 1, 2018 which would allow most customers time to adjust their budgets accordingly. By delaying fee to that date there is a result of $28,500 in lost revenue. With the direction from the council, staff will prepare an ordinance to have the correct rate incorporated into the City Code.
