Next up is the Supervisor's report. I'll keep it
brief. Just so everyone understands what's going
on out there, we have to have a court
stenographer, legally, to be able to do an online
video teleconference, and so there's a fee
associated with that. So, whenever possible, I'm
going to be brief. We also reduced the privilege
of the floor from five minutes to three minutes
for the same reason when that time comes.
So, the only thing that I'd like to
report on this evening is, leaders in the Town

and I are meeting three times a week currently to
go through a very thick document that was created
by HR Public Sector to take our Town from a
little bit of a disorganized organization to a
more professional organization.
It is the personnel policy, and it is
very particular, very specific, and we are going
through it line by line and having a really good
discussion, and in about an hour and a half we
get through about 10 to fifteen pages, so it
really takes time, but on the back end it's going
to really help us to operate well, to deal with
issues, to know what to do with all kinds of
particular HR-related issues.
So, I'm really happy with the progress.
I think it's an excellent use of taxpayer money
to really get us more professional in that way,
and you'll see that HR Public Sector comes up
later tonight. We're going to possibly consult
with them even more. That's all I have for a
report.
Councilmen, we'll start with Councilman
Solberg. Do you have anything for us?

Energy Committee did meet, and we made some
progress and had some discussions about several
of the clean energy capabilities in terms of --
oh, shoot, I wonder if Kelly is on.
There was two specific programs that were
of interest, one that we had discussed that was
the consolidation, and then the other one was
about purchasing of clean energy credits, similar
to purchasing like solar panels in neighboring
communities, and then instead of the panels being
on your actual home, that you can take advantage
of solar without having the physical array on
your home, which offsets the delivery charges.
So, we're also going to be looking at doing that.
We did find that there was a quick win on
adopting the permit, the standard permit. So,
there is some advantages to us adopting the
standard permit for installing solar in a
residential setting, in that the solar installers
then know exactly how to implement and process
the permit across the state. It's not trying to
identify how to do it in each municipality.
And it seemed pretty easy, so we're going
to try to push that through in talking with

Brian, and it's basically a fill-in-the-blank,
address, who to send it to, how much it costs.
It's very standard. It does not go into the
zoning. It's basically just the permit process
for a residential solar.
So we're going to see if we can get that
through in reviewing with Brian and then get it
adopted in a quick order, as that's one of those
items that gets us one step closer to that
ability, that certification. So, other than
that, nothing else.

Park Committee -- I lost track of the weeks.
There is -- tomorrow is the third Wednesday, but
I -- probably out of an abundance of caution, we
won't meet. I haven't talked to the Committee,

We don't have anything pressing right
now. I've got some issues to go over with Deb,

personnel policy, when we had talked about this
years ago, there was a consideration to take it
out of the Code and have it be a stand-alone

I have reviewed some of the Governor's
executive orders, and we are allowed to have bid
openings in a format not to the public, as long
as they're recorded, and Deb and Carol have all
that information if by the 21st of May there
still are bans on public meetings, and C.T. Male
will be administering the plans and spec book
entirely paperless through PDF or CDs, so there's
no issue with that, and this will be both the
Lakehill Sidewalk Project and the sidewalk

process here?
DEPUTY SUPERVISOR WHALEN: Sure. The
original highway agreement, 284, is something
that has to be done by Highway Law for permanent
improvements of highways in the form of $427,217
for 4.83 miles.
Due to the Covid-19 discussion and team
meetings this past Thursday and the Thursday
before, some questions come up with what is our
sales tax and mortgage tax revenues going to look
like, and my thoughts were, the State budget has
been passed. It includes chips from the Pave New
York and Winter Recovery fund, which is about the
sum of about $136,000.
In talking with our representatives, both
in the Assembly and Senate, that money can be
taken at any time from the Governor to fill in

voids due to the Covid-19, and they're already
being deducted beforehand. So, the thought was
to piecemeal the Highway Agreement by starting
off with $150,000, allowing me to pave what I
have currently ready, now that we're behind about
a month and a half, and we could revisit the rest
of the work moving forward knowing where our
finances are.
It's a conservative approach. It's a
smart approach. I highly recommend that for any
additional spending moving forward throughout the
whole Town budget. That's about all I have,
Eric.

COUNCILMEMBER SOLBERG: This is a subset
of what our plan was originally, and it's known
that this funding would be available to us, but
with the unsteady budget and the way things are
looking, that this would be a conservative moving
forward step in terms of the paving that you want
to do?
DEPUTY SUPERVISOR WHALEN: That's
correct, Councilman. Looking at what I have
ready, looking at what funds are there and

available right now with the State, if I could
get my funding submitted to the State, meaning
get partial work done, the 150,000, get it
submitted, there's a better chance of that being
fully funded, the $136,000, and then I would then
go from there taking roads that haven't been
prepped yet to be done on the schedule, prep
them, and that will buy time moving forward by a
month and a half, two months.
We'll be able to see what's going on with
our revenue stream coming in and give us a better
perspective on whether we should not do any more
paving or allow for more to be done.
SUPERVISOR CONNOLLY: It will give us a
different perspective. I don't know if it will
give us a better perspective. I was speaking
with our Town Budget Officer about this, and that
was her opinion, that we're months away from
really understanding how this is going to impact
us, how it's going to impact the county, how it's
going to impact the state.
So, it's quite the mess right now, but I
appreciate Joe taking a conservative approach
here. I think that it's a really safe approach

in regards to how we operate the Town and how we
fund the different funds. So I'm in favor of it.

season can you pave? When do you normally stop?
DEPUTY SUPERVISOR WHALEN: I paved last
year in October, John, and that was Lake Road.
We did that late October. I mean, the blacktop
plants usually shut down the week before
Thanksgiving, but it's really weather related.
It snowed the week before Thanksgiving last year.
So, I'm comfortable saying I could go into
mid-October.

discussion that I would want to have would be
that because this was not budgeted for and is an
ongoing expense, except for the development of
the employee, the personnel policy. The other
services that they're going to perform -- and I
had a chat with Jeanette, and I understand that
the services are needed, and I agree with that.
I just want to figure out how we're going to
finance that going forward.
Are we going to adjust the budget or what
is the plan for financing?

speak to that?
MS. BORTHWICK: Sure. I think we've got
a lot of things to talk about in terms of
budgeting and what we can afford to do to, but on
this particular issue, Kelly, we just hired a new
bookkeeper, and she is coming in under the cost
of Joann, rightfully so.
Joann has a long time of experience in,
and so her pay rate would be higher than somebody
just coming into the position. So, that's
understandable. So, there's room there.
Although, that gets offset somewhat with some of
the costs we have to pay to Joann. I think
there's room to do this.
Just from my perspective, I don't believe
that this is just a budget consideration. I
think we've had -- in the almost four years that
I've been there, we've had a lot of issues that
could or did or would have created some legal
issues, and I think having an HR expert in there,
rather than trying to guess at it, is the right
step to move forward.
And I also believe that this resolves
many of the issues that I have experienced in the

four years there regarding employees and having a
bookkeeper making decisions about employees,
where the bookkeeper should really just be
processing information, because their expertise
is not in the HR field. And I think it's really
good for the Town from the liability perspective,
and I think Deb Kaelin can chime in on that, but
I also think for the employees, having an
objective third party on the outside to resolve
some of the issues that arise in the Town will be
extremely helpful.
And I would just ask you to consider not
just the cost, because I think the cost is a
reasonable cost for the HR things that we
encounter, but also the potential impact in how
it's going to save us or minimize our potential
costs and liability or other issues.

100 percent with what you're saying, Jeanette.
This is a very inexpensive insurance policy
working for us to have everything, our HR, I
mean, all of this written down, as you said, so

bookkeeper.
This needs to be set in stone in a more
formal way and just simplify our process, and for
$600 a month, to me, is really a just expense.
COUNCILWOMAN STEWART: I don't disagree
at all with the need for HR services, and if the
offset, at least in the first year, covers the
$600 a month, I'm not -- I'm fine with if we need
fund balance to cover the cost of redoing the

difference between what we were paying the former
bookkeeper and the current bookkeeper, there's
plenty of cushion to stomach that cost for this
fiscal year, and then next fiscal year we would

MS. BORTHWICK: Yes, and I also believe
by offloading this to -- number one, it's
professionals. So this is their expertise. This
is what they do. So that, to me, is really
important, but I also believe that we can get
Sarah up to speed such that some of the work that
I am doing that really should be in the
bookkeeper duties, I can pass off to her, which
will draw back my cost to the Town, and so I see
some give and take there, and that's really what
the goal is, is to kind of sit and open up that
room there so that Sarah takes on more of the
bookkeeping and that I step back from some of
that work and do more of the oversight.

to relieve pressure from folks who can't make

As far as the mailing, I spoke with both
postmasters, and I can't control the mail issues
at post offices and mail going in the right
places, and both me and Mr. Luft spoke with both
post office postmasters, and he's understanding a
little bit better.

start of the utility billing module
implementation. That's probably going to take a
good six months, and that would include the
online payment option. We're hoping, I believe
the goal would be to go live on the fourth
quarter billing.
So, the only thing is, is that although
they can't come inside the building, there is
absolutely a box on the back door outside the
building where people are more than welcome to
drop their payments, but there are people that
are used to walking inside the building and
making their payments at the Building Department
window. So, the other option is just to drop it
in the box. That box is looked at every day.
COUNCILMEMBER SOLBERG: Jeanette, what is
your local bank?
MS. BORTHWICK: It's BSNB, and I know
where you're going. I don't recommend it because
there is no way for us to really try and figure
out all of these clients. That's 2,800 clients.

Timber Creek Drive is 2,915 feet from
Benedict Road to Tamarack Street. Linden Court
is a 747-foot cul-de-sac off Timber Creek Drive.
Basswood Court is 812 feet and begins and ends on
Timber Creek Drive. The portion of Tamarack
Street being dedicated as part of Phase 1 is
1,140 feet from Timber Creek Drive to Eastline
Road.
Acceptance includes water main, storm
sewer infrastructure, and three stormwater
management areas. The Town accepts all
responsibility of maintaining and repairing the
roadways. The roads will be open to the public
24 hours a day, 7 days a week, and the Town will
accept full legal liability of these roadways.

Management Officer, is reviewing, and we have
worked with them recently to button up issues
after snow melt.
So, they're much improved as of today
versus when the snow melted in March, but they
are not working on site. They are shut down.

significant amount of water that has flown down
Eastline Road in those new developments, and with
the lack of good footing on some of the land
there with the grass, it is showing a lot of mud
that's flowing through those conduits and runoff
down Eastline Road.
So, that's where my concern is, if there
is an inspection, and there's not a lot of
construction going on currently, so there's not a
lot of eyes on that. Joe, are you --

Lippmann is with us here today, but I believe
that contract can be terminated at any point; is

we do see that it is for the remainder of 2020,
but it is month-to-month and can be terminated,
once that need is eliminated, for whatever
reason.
SUPERVISOR CONNOLLY: Just for the
benefit of the residents that are listening, the
plan here is for this situation to be temporary.
Right now we're in the middle of this isolation,
Covid-19 issue, so there probably isn't going to
be much in the way of planning activity that
needs to be done. So, it's not going to really
affect us financially to a large degree.
Then, once we come out of isolation, the
Board is considering a possible moratorium, and
if that were to pass, there would be an extended
period where Town planning would be fairly
minimal, on the smaller scale for sure.
So, after Covid-19 and if we were to go
into moratorium, on the back end of the

we get a full assessment of what's our stormwater
time constraints and how much effort is going
into that.

part-time planner, do we need a full-time
planner, or is our planning minimal and we just
stay the course with what we have.
So, it gives us options and it allows us
to not bring anybody on full-time with benefits
or even part-time in the process of dealing with
Covid and a possible moratorium.

week. When we're out of the Covid stay-at-home
order, we also propose having an M.J. staff

more time is warranted, we will bring that to the

So, what we proposed, again, understanding the
financial constraints and unknowns right now, we
had originally put together a three-task proposal
which would prepare a report card of the existing
Comprehensive Plan, which again would bring us to
a point where we know what areas need to be
updated and then subsequent proposals would be
issued to the Town for consideration with a
better understanding of what needs to happen.
For right now, the $7,000 does include
Task 1 and Task 2, and Task 1 is what we are
calling project coordination. It consists of up
to four meetings to sit down with the Town and
establish the work plan essentially to move
forward with the Comprehensive Plan revision. It
helps set up a public engagement plan, and then
Task 2 is the public engagement piece, which is
required by state law to have a public engagement
and to have public hearings, so all of that would
be covered under Task 2.
Out of Task 1 and Task 2 we do expect to
put that with the vision that would be utilized
in any kind of revision to the Comprehensive Plan

which would then set you up for any revisions and
GEIS down the road as well. So, they are the
important first two steps that need to happen
before you can really go through that process.
COUNCILWOMAN STEWART: What is the --
refresh my memory, because I don't know how to
split the screen, but what is the cost of the
report card, which to me is kind of the most
important part? Why do the first two if you
don't produce the report card. So what was the
cost of the report card?
MS. LIPPMANN: The report card is an
additional $10,000. So, all in, Tasks 1, 2, and
3 is $17,000, and we had split that up as a way
to, at least at this point, get the ball rolling
as the Town has a better chance to evaluate how
the Covid-19 pandemic was going to affect
finances, and that was the reason we proposed at
least initiating Task 1 and Task 2 as more time
is able to pass and be able to reflect on when it
is appropriate to continue on.
COUNCILWOMAN STEWART: The cost sounds
reasonable. Chuck is right too. We're not
looking at exorbitant funds right here. My only

concern is that the first two tasks, without the
third, are kind of meaningless, and if we're
going to do it, we should commit to doing it,
because you get pretty much nothing towards a
review of the Comp Plan if you don't evaluate or
have some evaluation of the first -- I mean, the
first step is just an outline, it's just an
action plan. The second one is take the
information. If you don't know what you got out
of the first two steps, why are we doing it?
I understand it saves money, but we're
spending money to get nothing if we don't do the
third step.
SUPERVISOR CONNOLLY: Well, I wouldn't
view it as nothing. Step 2 is the public
engagement piece where we're reaching out to the
public and gathering data to see what the public
would like to see happen with the Town over the
next ten, 15, 20 years.
MS. LIPPMANN: Yes, Task 1 and Task 2 are
absolutely your foundation of what you need to
have to go on to Task 3, but I would agree with
you that if you're not getting the report card,
you're not getting that whole analysis until

we've completed Task 3, but as the Supervisor
stated, Task 2 is absolutely essential to the
foundation of the Comprehensive Plan, and it is
what needs to happen first.
So, again, we proposed those three tasks,
and we can either start off with Task 1 and Task
2 for now, or all three. We tried to be flexible
with the Town, given the current situation, in
how we proposed that.
SUPERVISOR CONNOLLY: And the intention
is to go ahead at the next Town Board meeting or
two Board meetings or three Board meetings,
whenever we're ready, to do Step 3. That is the
intention.
The only thing that would really stop us
from doing that is if we got significant data
back from the county and the state that basically
freezes everything, and if that situation were to
happen, that's not going to be forever. So, Step
1 and Step 2 will be put to use. So, I don't
know. I would just disagree with you on this, I
guess.

MS. LIPPMANN: So, unfortunately, after
Task 3, there is still work to be done before the
Comprehensive Plan has been updated and can be
adopted.
So what we -- there's really another fee
to the process, which would be evaluated once
we've gotten through Tasks 1 through 3 to
determine what effort is really needed on the
Comprehensive Plan. It may just be a couple
sections. It may be a much larger effort than
that. So, that gets determined after the
completion of Task 3. So, it is important to
note that that is not the complete package.
After that, there is still more work to be done.

throw numbers at it because it can vary much
depending on what section and what level of
effort is required for each area and how much
work is required to bring it up to date.
So, we have said that those fees are to
be determined once we've evaluated the existing
Comprehensive Plan and determined how much effort
is required to update those sections.
COUNCILMEMBER SOLBERG: What's your
expected timeline for Phase 1 and 2 being
completed even with Covid?
MS. LIPPMANN: Just for comparison sake,
we had suggested about a six-month period for
Task 1 through 3. So really depending on the
public engagement approach selected by the Town,
I would expect that to be about a three-month
process approximately.

80,000 there, bidding service is an increase of
15,000, and construction inspection is an
increase of 14,000 totaling the 109,322, but Ed
will comment on why those expenses are there and
why they're needed.
MR. HERNANDEZ: Can you hear me?
SUPERVISOR CONNOLLY: Yes, we can.
MR. HERNANDEZ: This contract amendment
does several things. One, it allows us to move
forward with preparing the work needed to take
advantage of the WQIP $5 million grant. We need
to start working on that and getting the
information to DEC with the assumption that the
project is going to move forward. If it does
move forward, when it moves forward, we'll be
able to take advantage of that $5 million grant,
so we want to be working on that.
It allows us to keep, maintain monthly
reports and items that we need to provide to EFC
to maintain existing financing in place, and then
it also updates our budget that goes back to even
2016, and it increases it to allow us to manage
the five contractors. There is going to be
substantially more contractors on the project

than was anticipated, and it's going to just
update our hourly rates going back, now that
we're in 2020.
I don't expect -- most of this money is
for managing the project once construction
begins. Very little of it will be spent between
now and then, but it will allow us to maintain
and move forward with the grant and funding that
we currently have in place.
SUPERVISOR CONNOLLY: And most of this
money is not going to be spent right away. It's
mainly being approved to help advance the grant,
the $5 million grant and doing some
administrative work until we can either break
ground or have a vote on a permissive referendum,
either/or, right?
MR. HERNANDEZ: That is correct. We'll
be spending very little money. In fact, I'd be
surprised to spend more than a few thousand
dollars between now and when we actually move
forward with construction. Obviously it depends
on how much time it takes, but the majority of
this is just to put us in a place where we're
prepared to move forward should the permissive

referendum pass, and it also allows us to
maintain the current funding and take advantage
of the $5 million grant should that get approved.
SUPERVISOR CONNOLLY: Right, if it
happens. Just so the public knows, I'm putting
the finishing touches on, I think it's a
six-minute long video that is updating the public
on where we're currently at and the different
paths forward that could exist, and I'm having Ed
and our attorneys, everybody look at the video
before it goes out. So, expect that in the next
couple days.
I do want to comment on, you know, we did
talk to some other engineering firms, and there
was some ideas about possibly have a second
engineering firm come in and handle some of these
tasks, but after I had lengthy discussions with
Dick Doyle, who has extensive background and
history working with large septic system
installations, and Dan from the county, from
Saratoga County Sewer District, what they shared
with me was that if you have two engineering
firms working on a large project like this with
multiple pieces, it can create -- if anything

goes wrong, it can create a fairly negative
situation where one engineering firm is blaming
the other engineering firm and everybody points
fingers, and you end up with a situation where
you have less accountability.
I am confident in talking with Ed and
talking to lots of people who have worked with Ed
on the county level and big projects that he's
worked on, much bigger than this one, that he has
the skill set and his firm has the skill set to
pull this thing off or I wouldn't be putting this
forward for the Board to consider.
So, just wanted to supply some of the
background as, number one, why is this on the
agenda, and what the logic is behind it.

hour, and I just felt that he would be a really
good fit for the Ethics Committee.
