The Township of Montclair, Essex County, hereby requests the submission of sealed proposals for Case

Manager. Details are fully described in the specifications.

Specifications are available at the Township website www.montclairnjusa.org or Purchasing Office, located on

the 3rd floor of the Municipal Building, 205 Claremont Avenue, Montclair, New Jersey 07042.

Proposers are required to comply with requirements on N.J.S.A. 40:5-31 et.seq. and NJ.AC. 17:27-1 et seq.

INSTRUCTIONS TO BIDDERS

Sealed proposals shall be received in accordance with public Advertisement as required by law, a copy of said notice being attached hereto and made part of these specifications.

BIDS FORWARDED THROUGH MAIL The Township of Montclair will not assume responsibility for proposal forwarded by mail. It is the individual's responsibility to see that bids are presented to the Qualified Purchasing Agent on the hour and at the place designated.

PROPOSAL FORM Each proposal is to be submitted on the Proposal Form in a sealed envelope, addressed to the "Qualified Purchasing Agent" Township of Montclair, NJ, bearing the name and address of the bidder with the envelope clearly marked.

Bidders are required to comply with the requirements ofN,J,S,A, 10:5-31 et seq. and N.J.A.C.17-27

NON-DISCRIMINATION Bidders are required to comply with the requirements of P.L. 175 C 127. If the bidder's total staff is more than 5 employees, but less than 50 employees, the affidavit entitled "Affirmative Action Affidavit", which is included in the proposal package, shall be completed and submitted with the proposal.

ASSIGNMENT, TRANSFER, CONVEY, SUBLET OR DISPOSAL OF CONTRACT The Contractor shall not assign, convey, sublet, or otherwise dispose of the contract or any part hereof to anyone without the written consent of the Township of Montclair.

NON-COLLUSION The form which is part of these specification shall be completed and submitted with the Proposal.

RESERVATIONS The Township Council reserves the right to reject any or all Proposals and also reserves the right to waive any informalities in the proposals received.

RIGHT TO TERMINATE CONTRACT The Township of Montclair reserves the right to terminate the contract on 30 days written notice to the successful bidder without penalty. This right shall be in effect during the term of the contract and may be exercised ifin the judgement of the Township of Montclair, the successful bidder is failing to fulfill their obligations or to provide adequate service'

SCOPE OF DUTIES:

Case Manager - 24 hours per week - working with individuals 55+ in the Township of Montclair, New Jersey.

Responsibilities include: case management with individuals with complex needs; information and referral; crisis

prevention; connecting with resources and follow-up; community engagement; and input on policies related to creating an age-friendly community.

Applicant will be required to become a SHIP Counselor and conduct related reporting. Applicant will be

required to keep case notes and gather data for reporting to funder.

Applicant must have reliable transportation and be a self-starter.

This position is open to individuals or agencies, but agencies must assign no more than two (2) case managers to this program.

Applicant must have excellent communication and organizational skills.

Education/experience requirements: BSW /LSW, experience with older adults, knowledge ofresources and entitlements.

BUSINESS REGISTRATION CERTIFICATE

A Business Registration Certificate serves two purposes:

• For public contracting, as proof of valid business registration with the New JerseyDivision of Revenue. All contractors and subcontractors must provide this documentationwhen seeking to do business with the State of New Jersey, and other public agencies in thisstate.

• To comply with Chapter 85, P.L. 2006, defined under N.J.S.A. 54A:7-1.2. You must use theBusiness Registration Certificate if you are an unincorporated construction contractorperforming work in New Jersey of you are a registered unincorporated contractor requestingproof of certification.

If you are a registered vendor but have not received the Business Registration Certificate in the mail, you may obtain a certificate online. Please note that this certificate is not required by all businesses in New Jersey, but only those doing business with the public sector.

You may check the online registration inquiry to determine if the business is already registered. If you have not registered but are required to have this certificate, you will need to complete Form NJ-REG. Representatives of the Division's Client Registration activity are available to assist in the registration process. 609-292-9292.

Form NJ-REG:

In most cases, you may submit Form NJ-REG online. Exceptions and additional requirements include:

• Any business including an out-of-state business with a presence or nexus in New Jersey,operating as a corporation, limited partnership, limited liability company or limitedliability partnership must first obtain legal authority to operate in the state prior to submittingForm NJ-REG. Generally, this is accomplished by filing a Certificate of Incorporation orFormation with the Division.

• Out-of-state businesses that believe they do not have state tax nexus will file a paper formNJ-REG in order to obtain a Business Registration Certificate. Business entities that file formNJ-REG only will be subject to a nexus review, initiated and conducted by the Division ofTaxation.

• Individuals or Unincorporated Construction Contractors with no business tax of employerobligations may register using Form NJ-REG-A instead of Form NJ-REG in order to obtain theBusiness Registration Certificate. Individuals who have created and are operating as abusiness entity (e.g. LLC) may not use Form REG-A.

• Non-profit organizations although required to register for tax purposes are not subject to theproof registration requirement when contracting with public agencies in this state.

REQUIRED EVIDENCE AFFIRMATIVE ACTION REGULATIONS

P.L. 1975, C. 127 (N.J.A.C. 17:27)

If awarded a contract, all procurement and service contractors will be required to comply with the requirements of P.L. 1975, c. 127 (N.J.A.C. 17:27). Within seven (7) days after receipt of the notification of intent to award the contract or receipt of the contract, whichever is sooner, the contractor should present one of the following to the Purchasing Agent:

1. A photocopy of a valid letter from the U.S. Department of Labor that thecontractor has an existing federally-approved or sanctions AffirmativeAction Plan (good for one year from the date of the letter.)

During the performance of this contract, the contractor agrees as follows:

AMERICANS WITH DISABILITIES ACT OF 1990

Equal Opportunity for Individuals with Disabilities.

The CONTRACTOR and the TOWNSHIP do hereby agree that the provisions of Title II of the Americans with Disabilities Act of 1990 (the "Act") (42 U.S.C. 12101 et seq.), which prohibits discrimination on the basis of disability by public entities in all services, programs, and activities provided or made available by public entities, and the rules and regulations promulgated pursuant thereunto, are made a part of this contract. In providing any aid, benefit, or service on behalf of the TOWNSHIP pursuant to this contract, the CONTRACTOR agrees that the performance shall be in strict compliance with the Act. In the event that the CONTRACTOR, its agents, servants, employees, or subcontractors violate or are alleged to have violated the Act during the performance of this contract, the CONTRACTOR shall defend the TOWNSHIP in any action or administrative proceeding commenced pursuant to this Act. The CONTRACTOR shall indemnify, protect, and save harmless the TOWNSHIP, its agents, servants, and employees from and against any and all suits, claims, losses, demands, or damages of whatever kind or nature arising out of or claimed to arise out of the alleged violation. The CONTRACTOR shall, at its own expense, appear, defend, and pay any and all charges for legal services and any and all costs and other expenses arising from such action or administrative proceeding or incurred in connection therewith. In any and all complaints brought pursuant to the TOWNSHIP'S grievance procedure, the CONTRACTOR agrees to abide by any decision of the TOWNSHIP, which is rendered pursuant to, said grievance procedure. If any action or administrative proceeding results in an award of damages against the TOWNSHIP or if the TOWNSHIP incurs any expense to cure a violation of the ADA which has been brought pursuant to its grievance procedure, the CONTRACTOR shall satisfy and discharge the same at its own expense.

The TOWNSHIP shall, as soon as practicable after a claim has been made against it, give written notice thereof to the CONTRACTOR along with full and complete particulars of the claim. If any action or administrative proceeding is brought against the TOWNSHIP or any of its agents, servants, and employees, the TOWNSHIP shall expeditiously forward or have forwarded to the CONTRACTOR every demand, complaint, notice, summons, pleading, or other process received by the TOWNSHIP or its representatives.

It is expressly agreed and understood that any approval by the TOWNSHIP of the services provided by the CONTRACTOR pursuant to this contract will not relieve the CONTRACTOR of the obligation to comply with the Act and to defend, indemnify, protect, and save harmless the TOWNSHIP pursuant to this paragraph.

It is further agreed and understood that the TOWNSHIP assumes no obligation to indemnify or save harmless the CONTRACTOR, its agents, servants, employees and subcontractors for any claim which may arise out of their performance of the Agreement. Furthermore, the CONTRACTOR expressly understands and agrees that the provisions of this indemnification clause shall in no way limit the CONTRACTOR'S obligations assumed in this Agreement, nor shall they be construed to relieve the CONTRACTOR from any liability, nor preclude the TOWNSHIP from taking any other actions available to it under any other provisions of this Agreement or otherwise at law.
