Earnest Money Deposit and tender fee will be accepted by Demand Draft on any nationalized Bank only situated at “SURENDRANAGAR”, drawn in favor of “GUJARAT ENERGY TRANSMISSION CORPORATION LTD”. Tender without EMD and tender fee shall be rejected. Two separate demand drafts for Tender fee and EMD should be submitted along with Technical Bid. The tenders are to be submitted by the intending bidders in single envelop with two separate sealed and super scribed envelopes as listed below: Envelope No.1: Technical bid and pre qualification requirement, bid data, details specification. Envelope No.2: Price Bid. Technical and pre qualification requirement bid details specification (envelope No.1) will be opened first and subject to evaluation based on the qualification criteria contained in the individual bid document. through tanker at 400KV Chorania s/s for one year.

1. TENDER SPECIFICATIONS:

The tender should be submitted in one sealed main envelop with clearly marked on the main envelope

tender for the work of “Providing & Fixing of AC under buyback scheme” The main envelop should contain

the two separate sealed covers. The technical scrutiny committee of the Corporation shall evaluate the

techno-commercial view of the tender. Tender should be in two bids.

i) Techno – Commercial Bid and 2) Price Bid. (To be submitted on-line)

(i) The technical bid

The technical bid cover should contain following documents:

(a) Self attested Xerox copies of the VAT/TIN registration of the company.

(b) Xerox certified copy of the PAN CARD of supplier

(c) You will have to provide the experience certificate of such work in GETCO or its sister concerns or

any government organization.

(e) The tenderer have to submit downloaded copy from the internet, filled all relevant column and signed

accordingly in sealed cover.

(ii) The commercial/price bid

The Price bid cover should contain price offered by you for trip of tanker, to be taken away by the Bidder.

a) Price quoted in the price bid is for delivery F.O.R. Destination, i.e at 400KV Chorania s/s.

b) Price should be inclusive of Tax & charges.

c) No price escalation will be allowed. Rate quoted should be firm up to the period of contract.

The tenders may be sent by Registered Post / Speed Post only. Tenders which are received late

after due date of receipt, will not be considered. The offer is liable to be out rightly rejected in case

the “Price Bid” and “Technical Bid” are not submitted separately as specified.

2. SECURITY DEPOSIT:

Security Deposit should be paid within 10 days after receipt of LOI or work order. The successful tenderers will be required to pay an amount equivalent to 10% of the value of the order as

a Security Deposit for satisfactory execution of the contract. Such Security Deposit will be payable in D.D.

If the full Security Deposit amount is not paid within 3 days after the receipt of the order, then the order will

be cancelled at the risk & cost of the Tenderer (at the discretion of the Corporation) and without entering





into any correspondences and this will be binding on the Tenderer.

Security Deposit will be refund after the date on which the final bill is paid or after completion of guarantee

/ maintenance period i.e. one year which the contractor has to maintain the work in good order whichever

is later.

Penalty clause is as per GETCO’s standard tender terms and conditions for supply. If you fail to execute

the order successfully, the order will be got completed through other agency and if required to pay higher

rates, in that case, difference of rates will be recovered from you.

3. PRICES:

Prices quoted should be FIRM and inclusive of all taxes, taxes as per Govt. rules and nothing will be paid extra. Installation charges must be clearly shown in technical bid. i.e. inclusive or exclusive.

4. VALIDITY OF THE OFFER:

The offer will have to be kept valid for a period of 180 days from the date of opening of technical bids. In

case of finalization of the tender is likely to be delayed, the tenderer’s will be asked to extend the same

without change in the prices or any terms and conditions of the offer. If any change is made, original or

during the extended validity period, the offer will be liable for outright rejection without entering into further

correspondence in this regard and no reference will also be made. 5. PRICE EVALUATION:

No price preference shall be given on any account. All tenders will be evaluated on firm price basis.

Corporation may go for the price L-2 depending upon the exigency. If Corporation feels that there is lack

of serious competition or any other reasons, Corporation may negotiates with the L-1 party. Corporation’s

decision shall be final and binding to all the parties.

6. QUANTITY DISTRIBUTION:

As per current practice, in case where the quantity is to be distributed to more than one supplier, 100% quantity shall be given to the parties who are techno-commercially qualified and the L-1 prices.

7. If the Tenderer fails to pay the Security Deposit or defaults in execution of the orders placed or if

Corporation suffers any financial loss due to this, then Corporation will be at liberty to adjust the amount

from other orders of the same firm or by encasing the Bank Guarantee. 8. PAYMENT TERMS:

Payment shall be made by the Limbdi Transmission Division on completion of the job and production of

work completion certificate of the Sub-Station In charge, after following the procedure’s of GETCO.





9. REPEAT/ADDITIONAL ORDERS:

The Corporation reserves the right to place repeat orders / additional orders on the successful tenderer up

to 50% of the original quantity of the A/T at the same prices terms and conditions stipulated in the original

order mutually agreed upon. 10. EXECUTION OF THE WORK:

The party will have to complete the job within 30 days on getting information from the field OR Division Office. The work of installation shall be carried out through experienced & conversant technician only.

11. POST TENDER CORRESPONDENCE / ENQUIRIES:

Any correspondence or enquiry subsequent to opening of Technical and Commercial bids is not

desirable, if the same is indulged into, it will be considered for disqualifying the tender. The Tenderer will

be required to abstain from pursuing / canvassing the matter, directly or indirectly with any Officers of the

Corporation, as otherwise the same would also amount to disqualification of the tender.

12. Tenderer must submit offers / bids along with Bar chart indicating how the Tenderer intends to

complete the work in the stipulated time limit. 13. SITE VISIT:

(i) The bidder is advised to visit the site and examine the site condition. Where in the work is proposed to

be carried out and to get himself fully Acquainted at his own responsibility for all information that may be Necessary. All cash and Liabilities arising out of the site visit shall be at bidder account.

(ii) The contractor shall be deemed to have carefully examined the work & site Conditions, the general conditions, the special conditions, specifications, Schedules, drawings shall be deemed to have visited the site of the works & to have fully informed himself regarding the local conditions

(iii) If there shall have any doubts as to the meaning of any portion of these general conditions or special conditions of the scope of work of the specifications or any other matter concerning the contract, he shall in good time before submitting his tender, send for the particulars thereof & submit them to the Engineer in writing in order that such doubt may be removed.

14. The GETCO shall have the right to make any changes, additions / deletions or modifications in any terms /

conditions of the tender and / or specifications as may be deemed necessary by the Corporation at its sole

discretion at any time before the due date of opening of the tender.

15. Tenderer should furnish a list of orders for similar items executed by them indicating the name of the party

and their order reference to whom they have supplied, to be furnished in Annexure- 6. Failure to do this

will result on suppliers tender being rejected without any reference. In case of bought out items they

should furnish the back up guarantee from their principals.

16. Corporation does not accept the printed conditions of any Tenderer. It will be ignored without any

reference; hence tenderers should withdraw such printed conditions if they have any.





17. If the tenderer’s desires to quote with any technical deviations they should specifically quote the deviation

& the ISS or BIS Nos. in the body of the tender itself under the respective Annexure of this tender

document. If technical deviations furnished by the Tenderer are not agreeable to the Corporation, the

offers may be ignored. However it will be solely at Corporation’s discretion to consider the technical

deviations OR not for considering the Tenderer. No correspondences of the Tenderer after opening of the

bid will be entertained in this matter.

18. Revision of prices or any commercial terms affecting the price after opening of technical bids shall not be

considered and will be ignored.

19. Please give suitable declarations as under: I / We declare that we are Authorized Distributor OR Dealer for

all the tendered items.

20. Tenderer should specifically mention in the offers and should indicate in Block letters the name of the

Partners / Proprietor / Directors who is / are the signing authority. 21. GUARANTEE:

You will be responsible for the proper performance of the equipments / materials for the respective guarantee period for 12 months. The after sales Service should be clearly mentioned in the bid and supplier has to provide free services as offered by the manufacturer. In case of failure of providing free services, charges per service of each AC will be deducted from the security deposit.

22. OTHER CONDITION OF WORKS:

The Corporation’s General Conditions of contract will apply to all contracts and supplier will be deemed to be fully aware of the Corporation’s general conditions of contract for the supply of plant equipment and materials except the conditions modified in this commercial terms and conditions and any ignorance of these Conditions, will not exempt supplier from their liability to abide by the same.

23. Please note that any additional conditions / deviations, if any, found in the Commercial terms & conditions,

then the Price Bids of such tenderers will not be opened and no further correspondences in the matter will

be allowed.

24. If in any company, the interest of any employee of the GETCO or his relative as defined in Section VI of

the Company’s Act. 1956, is 10% or more, GETCO will not deal with such company at all. Tenderer

therefore, must specifically disclose this fact in his technical Bid. Non-disclosure of such facts would

disqualify the Tenderer for further dealing with GETCO. 25. ARBITRATION:

All questions, disputes or differences whatsoever which may at any time arise between the parties to this

agreement touching the agreement or subject matter thereof, arising out of or in relation there to and





whether as to construction or otherwise shall be referred to the decision of the Sole Arbitrator, appointed

by the Chairman, GETCO, for that purpose, who shall be a retired High Court Judge or retired District and

Sessions Judge, and the decision of the said Arbitrator shall be final and binding upon the parties.

Reference to the arbitration shall be governed by the provisions of Indian Arbitration & Conciliation Act.

1996 as amended from time to time and the rules made there under. 26. JURISDICTION:

All questions, disputes or differences arising under out of or in connection with the Tender / Contract if

concluded shall be subject to the exclusive jurisdiction of the court under whose jurisdiction the place from

which the tender / Acceptance of tender is issued, is situated i.e. Limbdi 27. SUBMISSION OF OFFERS:

The firm having single legal entity and having two or more works / factory and submits offers from two or

more different works / factory, in such case Corporation will consider only ONE lowest offer for allocation

of quantity. Many of the tenderers are submitting their offers with the conditions of advance

payment along with the order; such conditions are not acceptable by the Corporation.

28. The Tenderer if being an agent, who submits its offer to Corporation, will have to give information and

declare the name of the principle from which he will procure the materials and supply to Corporation along

with company’s written confirmation about quality and backup performance guarantee. Only on getting

complete information from Agent, such offer if found suitable shall be taken in consideration.

29. Corporation reserves the right to cancel any or all the offers / bids or to accept any offer without assigning

any reasons. Also in case Corporation finds that there is an attempt of cartel in the prices, Corporation

reserves the right to consider or reject any or all the parties offers without assigning any reasons thereof. 30. Corporation reserves the right to increase or decrease the quantity against each item/s while placing the

order.

31. Tenderer should invariably fill up all the details of all the Annexure including the prices in the Price Bid

Annexure of this tender document. This is mandatory. Also all the Annexure should be duly signed by

authorized signatories with their rubber stamp and along with Company’s Rubber (Round) seal / stamp

affixed on each paper.

32. The tenderers are required to furnish the technical information and the guaranteed technical particulars

(GTP) along with company seal and signature of the Tenderer on each and every page / papers of the

tender documents. 33. The following List of Annexure and Documents should be invariably submitted along with the tender:

1) Technical Specifications with Guaranteed Technical Particulars





2) Annexure – 1 TO 5

3) All the above documents should be duly filled in, signed & stamped with company’s seal should be

submitted along with the Technical Bids

34 All the costs of the stamp papers are to be borne by you as per the Govt. Of India’s latest guidelines.

a. The contractor shall make their own arrangements for the necessary approach, road, for transport of their materials and be responsible for the compensation on account of damage to crop etc. & shall till completion of work.

b. All the royalty charges, Octroi and other duties & all taxes will be paid by the contractor and no extra be claimed on this account.

35. All the tenderers must ensure that all the relevant documents / papers submitted with the tender should be

serially numbered, properly bounded / tied together and properly documented. This must be adhered to.

36 All the above points should be complied by the Tenderers. If not, tenders are likely to be ignored without

making any further reference.

37 Experience: Experience of related work is necessary






GENERAL TERMS AND CONDITIONS OF CONTRACT

1. The water supply to be provided for a maximum 12 Months. ૧. આ ટે�ડર અંતગ�ત પાણી વધુમાં વધુ ૧૨ મિહનાઓ માટે સ'લાય કરી શકાશે.

2. The tank capacity of supply of water should be 3000-4000 liters. ૨. પાણીના સ'લાયના ટે�કરની કેપસેીટી ૩૦૦૦-૪૦૦૦ લીટર હોવી જ�રી છે.

3. Any excess trip of 720 Nos./year shall be under the written/verbal approval of 400KV Chorania substation

head and the same shall be regularized by an office note giving clear reasons for the trips beyond

stipulated no. of trips. ૩. વાિષક ૭૨૦ ;ીપથી વધારાની ;ીપ માટે ૪૦૦કેવી ચોરણીયા સબ$ટેશનના અિધકારીની લેિખત/મૌિખક અનમુિત જ�રી છે અન ે તે અંગેની ઓિફસનોટ $પ= કારણ દશા�વીન ેમંજુર કરાવવી.

4. The vehicle to be used for supply of water shall be in up-to-date condition including its tanker body. Also

the water should be supplied from government authorized supply centre. ૪. પાણીના સ'લાય માટેનુ ં વાહન �યવિ$થત ક�ડીશનમાં હોવુ ંજ�રી છે અન ેપાણીનું ટે�કર અંદરથી $વ>છ રાખવું જ�રી છે. તદુપરાંત પાણીનો સ'લાય ગવન�મે�ટ �માિણત સ'લાય સે�ટર ખાતેથી હોવો જ�રી છે.

5. The period of the contract shall be for one year. The period further one year can be extended on mutual

agreed terms as per same rates, terms and conditions. However, in case service provided by the contractor is found unsatisfactory, GETCO reserves the right to terminate the contract without any issue of notice. ૫. કો�;/ટનો સમયગાળો એક વષ� નો રહેશે. આ સમયગાળો વધુ એક વષ� માટે પર$પરની મંજુરીથી વધારી શકાશે. તેમ છતાં જો કો�;/ટર @વારા પાણીના સ'લાયની અસંતોસકારક સેવા પૂરી પાડવામાં આવશે તો જેટકો @વારા કોઈપણ Bતની નોટીસ આ'યા વગર કો�;/ટ રદ કરવામાં આવશે.

6. The bills for trips of the vehicle shall be paid on monthly basis. ૬. પાણીના સ'લાયની ;ીપના બીલો માિસક ધોરણે ચુકવવામાં આવશે.

7. The lodging and boarding of driver shall be born by owner. ૭. પાણીના સ'લાયના વાહનનો Cાઈવર ની રહેવાની તથા ખાવા-પીવાની �યવ$થા સ'લાયરે કરવાની રહેશે.

8. The penalty is applicable in all case for non-supply of water due to absence of driver/vehicle or both as

per GETCO terms and conditions. ૮. Cાઈવર કે વાહનની ગેરહાજરીને કારણે જો પાણીના સ'લાય ન મળે તો જેટકોની શરતો �માણે અઠવાિડયાના ૧/૨ % �માણે પનેEટી લાગશે.

9. The Drivers should be provided with enough money to cover the cost of fuel, repairs and incidental

expenditure while in journey and arrange another vehicle in case of failure of running unit. No changes in

rates for supply of water will be allowed due to hike in fuel charges of supply vehicle.





૯. વાહનના Fધણ, રીપેર તથા આકિ$મક ખચા�ની જવાબદારી જે તે સ'લાયરની રહેશે. અન ેવાહનની ગેરહાજરીમાં બીB વાહનની �યવ$થા જે તે સ'લાયરની રહેશે. વાહનના Gયુલના ભાવ વધારાને કારણે ન/કી કરેલ ઓડ�રના ભાવમાં કોઈ પણ ફેરફાર થશે નિહ.

10. If you fail to execute the order successfully, the order will be got completed through other agency and if

required to pay higher rates, in that case, difference of rates will be recovered from you. ૧૦. જો તમે સફળતાપૂવ�ક ઓડ�ર પુરો કરવામાં િનHફળ જશો, તો તે ઓડ�ર અ�ય એજ�સી @વારા પુરો કરવામાં આવશે અન ેજો તે માટે વધુ ભાવ આપવાની જ�િરયાત ઉભી થશે, તો ભાવ નો તફાવત તમારી પાસેથી વસુલ કરવામાં આવશે.

11. If required GETCO can terminate the order by giving one month advance notice. ૧૧. જો જ�ર જણાશે તો જેટકો એક મિહના ની એડવા�સ નોટીસ આપીન ેઓડ�ર રદ કરી શકશે.

12 During a day supplier can be called at any time and for any number of times, i.e. more than once as per

Bill should be submitted in triplicate at the end of month to concerned office for necessary processing. The

bills should be accompanied with copy of registered entry for no. of trip details duly signed by the shift

in-charge of control room of 400KV Chorania s/s. The bill will be paid subject to submission of advance

receipt within a period of 20 days of receipt of the bills. ૧૩. પેમે�ટ મિહનાના અંતે િબલની Iણ કોપી ઓિફસમાં આગળની કાય�વાહી માટે જમા કરાવવી. આ િબલની સાથે ૪૦૦ કેવી ચોરણીયા સબ$ટેશનના ક�;ોલ �મના શીGટ-ઇન-ચાજ�ની સહી વાળા રJ$ટરની કોપી રજુ કરવી. એKવા�સ રીસી'ટ સાથેના બીલની ચુકવણી, િબલ મLયાના ૨૦ િદવસની અંદર કરવામાં આવશે.

14. Security Deposit: The contractor will have to pay security deposit amounting 10 % of the order value. ૧૪. િસ/યોરીટી િડપોઝીટ: કો�;/ટરે ઓડ�રની કુલ રકમ ના 10% રકમ િસ/યુિરટી ડીપોઝીટ તરીકે જમા કરાવવી. 15. If any legal liability occurs on account of any lapse in this regards, the same will be at contractor’s

account. Any misbehavior of the driver will be reported to the supplier and if he fails to provide new

driver within 24 Hrs, GETCO reserves the right to terminate the contract or approach another supplier

from open market at the risk and cost of the contractor.





૧૫. જો કોઈ ભૂલચૂકને કારણે કોઈ કાયદાકીય ગુચવણ ઉભી થશે, તો તેની સંપૂણ� જવાબદારી કો�;/ટરની રહેશે. જો Cાઈવરની કોઈપણ �કારની ગેરવત�Mંકની નNધ થશે અને જો સ'Eયાર ૨૪ કલાકમાં નવા Cાઈવરની િનમMંક કરવામાં અસફળ રહેશે, તો જેટકો પાસે કો�;ા/ટ રદ કરવાનો અિધકાર રહેશે અન ેઅ�ય સ'લાયરને કો�;ા/ટરના જોખમે અન ેખચ. ખુEલા બBરમાંથી લઇ શકશે.

16. GETCO reserves the right to split up the work between two or more parties. ૧૬. બે અથવા વધુ પાટ2 વ>ચે કામની વહેચણી કરવાનો જેટકોને અિધકાર છે.

17. All the general terms and conditions contained in the GETCO’s booklet of contracts for works, not

specifically brought out herein above in the terms and condition shall be applicable to the proposed
