Several multilateral agreements or negotiations try to establish an important link between the legal principles and the scientific approach for the sustainable management of resources (fisheries i.e.) within and beyond national jurisdiction.

• De nombreux accords multilatéraux ou négociations tentent d'établir un lien important entre les principes juridiques et la démarche scientifique pour la gestion durable des ressources (pêche par exemple) au sein et au-delà des juridictions nationales.

This approach is followed in the context of European Law, no doubt bringing added value to the Mediterranean regional level, which goes beyond the strict framework of the European Union.

• Cette approche est suivie dans le contexte du droit européen, en apportant sans doute une valeur ajoutée propre au niveau régional méditerranéen, lequel va au-delà du cadre strict de l’Union Européenne.

The protection of the marine environment implies, previously and the adoption of legal measures, alongside a good knowledge of various scientific knowledge of the marine environment parameters.

This interaction of Law and Sciences is also presented by the EU as an instrument of participation for the preservation of the marine environment for a sustainable growth.

• La protection de l’environnement marin implique, préalablement et concomitamment à l’adoption de mesures juridiques, une bonne connaissance des différents paramètres scientifiques de connaissance du milieu marin.

• Cette interaction du droit et des sciences exactes est aussi présentée par l’UE comme un instrument de participation a la préservation de l’environnement marin pour une croissance durable.

A few examples illustrate this interaction meets a real approach to sustainable development, in the context of the "blue economy“ :

AN INTERACTION BETWEEN ENVIRONMENTAL LAW AND THE EXACT SCIENCES AT THE MULTILATERAL GENERAL LEVEL (PART I),

A few examples illustrate this link : On 21 April 2012, 94 States established the Intergovernmental Science-Policy Platform on Biodiversity and Ecosystem Services as an independent intergovernmental body to strengthen the science-policy interface for biodiversity and ecosystem services for the conservation and sustainable use of biodiversity, long-term human well-being and sustainable development.

• Quelques exemples illustrent ce lien : • le 21 avril 2012, 94 États ont créé la plate-forme de Science-

politique intergouvernementale sur la biodiversité et Services écosystémiques comme un organisme intergouvernemental indépendant pour renforcer l'interface science-politique pour la biodiversité et l'utilisent de services écosystémiques pour la conservation et le développement de la biodiversité, le bien-être humain à long terme et développement durable.

The United Nations Conference on Sustainable Development called for effective application of an ecosystem approach and the precautionary approach, in accordance with international law, in the management of activities having an impact on the marine environment.

At the global level, FAO has continued to assist in the implementation of the ecosystem approach to fisheries and aquaculture at the national and regional levels. A tool box to assist the implementation of the ecosystem approach to fisheries has been developed.

• La Conférence des Nations Unies pour le Développement Durable réclame une application efficace d'une approche écosystémique et du principe de précaution, conformément au droit international, dans la gestion des activités ayant un impact sur l'environnement marin.

• Au niveau mondial, la FAO a continué d'aider à la mise en œuvre de l'approche écosystémique des Pêches et de l'aquaculture au niveau national et régional. Une « boîte à outils » pour aider à la mise en œuvre de l'approche écosystémique des pêches a été développée.

The Convention on Biological Diversity (CBD) is developing this approach through the identification of “ecologically or biologically significant marine areas ». At its sixteenth meeting, the Subsidiary Body on Scientific, Technical and Technological Advice of the Conference of the Parties to the CBD adopted recommendation XVI/4,entitled “Marine and coastal biodiversity: ecologically or biologically significant marine areas”. The South East Atlantic Fisheries Organization reported that the ecosystem approach is incorporated in its Convention.

• La Convention sur la Diversité Biologique (CDB) développe cette approche par le biais de l'identification des « zones marines importantes sur le plan écologique et biologique ». A sa seizième réunion, l'Organe Subsidiaire consultatif de la Conférence des Parties à la CDB, sur les aspects scientifiques, techniques et technologiques, a adopté la recommandation XVI/4, intitulé «  la biodiversité Marine et Côtière : aires marines importantes sur le plan écologique ou biologique ".

• Le South East Atlantic Fisheries Organization a indiqué que l'approche écosystémique était incorporée dans la Convention.

The Permanent Commission for the South Pacific also reported that it is now using an ecosystem approach in undertaking assessments on the impacts of economic activities on critical marine habitats in the Region.

The twenty-sixth session of the IOC Assembly endorsed programmes objectives for the IOC-UNESCO Integrated Coastal Area Management Programme, which include further development of ecosystem-based management and the large marine ecosystem approach.

• La Commission Permanente du Pacifique Sud a également signalé qu'elle utilise maintenant une approche écosystémique dans les évaluations des activités économiques sur les habitats fragiles dans la Région.

• La vingt-sixième session de l'Assemblée de la COI- UNESCO a approuvé les objectifs du Programme Intégré d’Aménagement des Zones Côtières (Integrated Coastal Area Management Programme), lesquels incluent également le développement de la gestion axée sur les écosystèmes et l'approche écosystémique la plus large.

CONCLUSION regarding the link between the legal principles and the scientific approach for the sustainable management of marine resources within and beyond national jurisdiction.

These scientific approaches for the sustainable management of marine resources, especially fisheries can offer a support to the international law and its evolutions and implementation of UNCLOS for a better management of sustainable development.

Such an approach closely combining law and science can also help to reduce conflict in the exploitation of the marine resources (fisheries but also mineral resources) within and outside national jurisdiction

• CONCLUSION concernant le lien entre les principes juridiques et la démarche scientifique pour la gestion durable des ressources marines au sein et au-delà des juridictions nationales. Ces approches scientifiques pour la gestion durable des

ressources marines, en particulier la pêche, peuvent offrir un soutien aux évolutions du droit international et la mise en œuvre de la CNUDM, pour une meilleure gestion du développement durable.

Une telle approche combinant étroitement Droit et Science peut également aider à réduire les conflits dans l'exploitation des ressources marines (pêche, mais aussi ressources minérales), à l’intérieur et au-delà de la juridiction nationale

AN INTERACTION BETWEEN ENVIRONMENTAL LAW AND THE EXACT SCIENCES AT THE LEVEL OF THE EU APPROACH (PART II)

The EU protects and preserves the marine environment by establishing an original legal framework closely associating the exact sciences to facilitate the sustainable development.

1. The interaction between the law, the economy and the exact sciences: «Marine Knowledge 2020»- The knowledge is necessary to the achievement of good environmental status of the marine waters in accordance with the framework directive “strategy for the marine environment”, which is the component of the integrated maritime policy devoted to the environment. - The knowledge is a fundamental component of the EU plan to incorporate the marine and maritime research and contributes to the achievement of the European digital strategy (communication page 4).

• 1) L’INTERACTION ENTRE LE DROIT, L’ECONOMIE ET LES SCIENCES EXACTES : « CONNAISSANCE DU MILIEU MARIN 2020 »

• La connaissance est nécessaire à la réalisation d'un bon état écologique des eaux marines, conformément à la directive-cadre «stratégie pour le milieu marin», qui est le volet de la politique maritime intégrée consacré à l'environnement.

• La connaissance constitue une composante fondamentale du plan de l'UE visant à intégrer la recherche marine et la recherche maritime et apporte une contribution à la réalisation de la stratégie numérique européenne (communication page 4).

2 The « global » legal and scientist approach : the « Marine Strategy Framework Directive» (2008) and the « Maritime Spatial Planning» (2013) - This directive sought for 2011 "the sustainable use of the seas and conservation of marine ecosystems" via an integrated framework laying down operational guidelines and specific measures. - Member States sharing a marine region should develop - in close cooperation - plans for a “good ecological status” of their maritime waters, relying on detailed the State of the marine environment assessments and defining actions to be undertaken and the objectives to be achieved.

• 2) L’APPROCHE JURIDIQUE ET SCIENTIFIQUE « GLOBALE » : LA DIRECTIVE CADRE « STRATEGIE POUR LE MILIEU MARIN » (2008) ET LA « PLANIFICATION DE L'ESPACE MARITIME » (2013)

• Cette directive visait à obtenir pour 2011 « l'utilisation durable des mers et la conservation des écosystèmes marins » via un cadre intégré fixant les orientations opérationnelles et des mesures spécifiques.

• Les États membres partageant une même région marine doivent élaborer- en coopération étroite - des plans garantissant le « bon état écologique » de leurs eaux maritimes, s'appuyant sur des évaluations détaillées de l'état de l'environnement marin et définissant des actions à entreprendre et des objectifs à atteindre.

- This global approach from "marine environment" is complemented by a strictly “space” approach to planning of maritime space, for the purposes of controlling human activities engaged for the purpose of making them more sustainable and effective. Also, in March 2013, the Commission proposed legislation to create a common framework for “maritime spatial planning and integrated coastal zone management”. - Such a device is part of European efforts to promote a sustainable "blue economy". The objectives of this schedule are before any economic (encourage investment, especially), but also the protection of the marine environment.

• Cette approche globale à partir du « milieu marin » est complétée par une approche proprement « spatiale » de planification de l’espace maritime, aux fins de contrôler les activités humaines qui s’y exercent aux fins de les rendre plus durables et efficaces. Aussi, en mars 2013, la Commission a proposé une législation visant à créer un cadre commun pour la planification de l’espace maritime et la gestion intégrée des zones côtières.

• Un tel dispositif participe des efforts européens en vue de favoriser une « économie bleue » durable. Les objectifs de cette planification sont avant tout économiques (encourager les investissements, notamment), mais également la protection de l’environnement marin.

3) THE « REGIONAL » LEGAL AND SCIENTIFIC APPROACH (MEDITERRANEAN, BALTIC, EAST-CENTER ATLANTIC, I.E.)

Example: The strategy for the Mediterranean SeaThe Mediterranean dimension of the integrated EU maritime policy focuses on strengthening cooperation and governance in order to foster sustainable growth in this region. The implementation of the strategy is facilitated by a set of measures and tools specific to that area.

• 3) L’APPROCHE JURIDIQUE ET SCIENTIFIQUE « REGIONALE » (MEDITERRANEE, BALTIQUE, ATLANTIQUE CENTRE-EST, ETC.)

• Exemple : La stratégie conçue pour la mer Méditerranée

• La dimension méditerranéenne de la politique maritime intégrée de l’UE met l'accent sur le renforcement de la coopération et de la gouvernance afin de favoriser une croissance durable dans cette région. La mise en œuvre de la stratégie est facilitée par un ensemble de mesures et d’outils spécifiques à cette zone.

Communication from the Commission on November 11, 2009, "For a better governance in the Mediterranean through an integrated maritime policy” :

This strategy is based according to the Commission on the improvement of the governance of Maritime Affairs that must reconcile economic development with the protection of the environment. The success of this policy naturally requires strengthening and improvement of cooperation with third countries in the whole of the area.

• Communication de la Commission du 11 novembre 2009, intitulée «Pour une meilleure gouvernance dans la Méditerranée grâce à une politique maritime intégrée» :

• Cette stratégie repose, selon la Commission, sur l’amélioration de la gouvernance des affaires maritimes qui doit concilier le développement économique avec la protection de l’environnement. Le succès de cette stratégie nécessite bien naturellement un renforcement et une amélioration de la coopération avec les pays tiers de l’ensemble de la zone.

But for the Commission, in its communication, this is not enough.

"Policymakers must further take into account the links that exist between the different maritime activities. This new design of the maritime policy should "encourage abandoning the sectoral actions to favor a comprehensive global approach”.

• Mais pour la Commission, dans sa communication, cela ne suffit pas.

• « Les décideurs doivent davantage prendre en compte les liens qui existent entre les différentes activités maritimes.

• Cette nouvelle conception de la politique maritime devrait « inciter à abandonner les actions sectorielles pour privilégier une conception globale ».

Under the terms of the abovementioned communication from the Commission, new actions should particularly include:• encourage stakeholders and administrations to define more comprehensive maritime affairs priorities;• to strengthen cooperation between stakeholders and administrations in all sectors related to the marine sector, in the entire Mediterranean basin;• help the Member States to exchange best practice through existing Community funding for territorial cooperation.

• Aux termes de la communication précitée de la Commission, les nouvelles actions doivent notamment:

• encourager les parties prenantes et les administrations à définir des priorités plus globales des affaires maritimes;

• renforcer la coopération entre les parties prenantes et les administrations dans tous les secteurs liés au domaine maritime, dans tout le bassin méditerranéen;

• aider les États membres à échanger les meilleures pratiques grâce aux fonds communautaires existants consacrés à la coopération territoriale

CONCLUSION• Both the international instruments mentioned above that of the EU integrated maritime approach reflect a sustainable development of marine resources involving interaction between environmental law and the exact sciences for sustainable development.
