ADDENDUM-2 Dt. 16/09/11 Tender / Enq. No.: U6509-3172/ABM Item: Electrical Installation Works Project No.: 66-6509-700 Client: Bharat Petroleum Corporation Limited, Mahul

As an outcome of the pre bid meeting held on 06-09-2011 at BPCL Mumbai Refinery, following amendments / clarifications are made by UIPL / BPCL. These notes supersede the related tender clauses and Addendum 1 and also become the part of tender document. A) Commercial Points: 1) Due date for submission of bids shall be 12:00 hrs. of 23/09/2011. Technical and un-priced

commercial bids shall be opened at 14:00 hrs. of due date at UIPL Pune office. 2) Waiver of EMD and Cost of Tender Document.

The waiver of EMD and Cost of Bid Document is applicable in regard to NSIC/SSI bidders subject to fulfilling all the conditions as per below:

a) SSI Unit should be registered with National Small Scale Industrial Corporation Ltd

(NSIC) b) The Unit should be registered for the item tendered. c) The monetary limit indicated in NSIC registration certificate should cover value of items

tendered. d) Registration Certificate is valid as on date of order. e) Photostat copy of valid NSIC registration certificate should be submitted in support f) Registration with DG&SD will not entitle tenderer to claim exemption from Security

deposit. 3) Delivery Period for Supply Order: Supply shall be completed within 12 months from the

date of LOI as per the schedule of supply to be agreed mutually after placement of LOI. 4) Completion period for Works Contract:

“12 (twelve) months for supply, installation, testing & commissioning of entire electrical system and further 3 (three) months for commissioning assistance during plant commissioning.”

“Though overall completion period is of 15 months, selected contractor is obliged to



prepare his schedule for various units/ areas in consultation with UIPL/BPCL after award of contract.”

“Completion period of 12 months for mechanical completion shall only be considered for applicability of COMPENSATION FOR DELAY”

5) Bid evaluation criteria: Offers shall be evaluated on Overall Lowest Basis Single Vendor

for the entire scope of tender (i.e. Supply and Services). Separate purchase order for supply portion and separate work order for Services portion shall be placed.

6) “C” form shall not be issued by BPCL. 7) Security Deposit shall be applicable for Services Contract as per terms and conditions

mentioned in GCC. 8) PBG shall be applicable for supply order as per terms and conditions mentioned in General

Purchase Conditions (GPC). Refer GPC attached. 9) Taxes & Duties:

I For Supply Scope:

a) Bidders are required to quote prices as per the bill of quantities (BOQ) for supply portion and rates shall be inclusive of all taxes and duties.

b) CENVAT Benefit: In the price summary format, bidder shall confirm the CENVAT benefit amount that can be passed to BPCL on account of ED (Excise Duty) and CVD (Countervailing duty). The classification of goods as per the central excise / customs tariffs should be correctly considered by the bidders while quoting the amount of CENVAT benefit in their price bid so as to ensure that cenvat benefits are not lost by BPCL on account of any error on the part of bidder. Offers shall be evaluated after deducting the CENVAT benefit confirmed. This CENVAT benefit confirmed by the bidders shall be treated as mandatory CENVAT benefit and it shall be proportionately deducted for each running bill. In case the contractor fails to provide the documents to BPCL for availing the CENVAT benefit either totally or partially, or submit incomplete invoices / incorrect tariff numbers, the amount of CENVAT benefit which could not be availed by BPCL shall not be released to the contractor. For availing cenvat credit against the items supplied, the excise invoice under Rule 11 must bear the name and address of BPCL Mumbai Refinery as Consignee with the other mandatory details as required under excise rules.



II For Services Scope:

a) Bidders are required to quote prices as per the bill of quantities (BOQ) for services portion and rates shall be inclusive of all taxes and duties except Service tax. Rate of service tax applicable shall be at the rate of 10.3%.

b) Bids shall be evaluated on the basis of landed cost at site after taking into account Cenvat Benefit available to BPCL. Bidder shall provide details namely Service Tax Registration Number along with the copy of registration certificate.

c) BPCL may claim Cenvat on service tax. The bidders should quote service tax (In rates as well as in values). Service tax and Education cess thereon shall be payable extra as actual against copy of invoice in triplicate indicating Service Tax and category of service. Bidders shall furnish the present rates of service tax and education cess as applicable.

c) Any Statutory variation in Service Tax, within the contractual completion period, shall be on owner’s account, against submission of documentary evidence. However, in case of delay in completion period beyond the contractual date, for reasons attributable to contractor, any increase in these rates shall be borne by the contractor, whereas any decrease shall be passed on to the owner. BPCL shall take CENVAT benefit as applicable.

d) Further, in case of delay in completion of work, due to reasons attributable to contractor, any new or additional taxes, duties or levies imposed after the contractual completion date shall be on contractor’s account.

e) Foreign contractors’ bid shall be compared considering Bill selling foreign exchange rate as on the date of priced bid opening, as declared on web site of RBI. Copy of such information shall form part of recommendation.

f) Notwithstanding the foregoing, OWNER shall not bear any liability in respect of :

i) Personal taxes on the personnel deployed by the Contractor, his Sub Contractor and

Agent etc. ii) The Corporate Taxes in respect of Contractor and his Sub-Contractor and other

Agents, Indian or foreign based.

iii) Any other taxes / duties/ levies The CONTRACTOR shall also comply with the provisions of the GCC (General Conditions of Contract) Section VII TAXES AND DUTIES.

g) INCOME TAX: Income tax at the prevailing rate shall be deducted from the CONTRACTOR’s bills as per Income Tax Act. OWNER shall issue necessary TDS Certificate to the CONTRACTOR. Bidders Shall provide their PAN No. , Service Tax Registration No. & VAT Registration No. in their un-priced bid.



10) Payment Terms: I For Supply Order a) 100% Payment shall be released through NEFT within 30 days on receipt and

acceptance of materials at site and submission of Performance Bank Guarantee equal to 10 % of Total Order Value. Payments shall be released once in a month against the monthly invoice to be raised by the vendor as per the mutually agreed supply schedule.

II For Service Contract

a) 75% payment shall be released against installation of material. b) 20% payment against testing & commissioning. c) Balance 5% shall be released against final acceptance.

Payments shall be released within 30 days of receipt of invoice along with all supporting documents duly certified by Engineer-in-charge.

The payment terms mentioned above for Service Contract are subjected to the following conditions: a) Monthly progressive payments shall be made towards the work completed as per the

payment terms and as per agreed rates, against running account bills submitted by the contractor.

b) There will be a deduction of 10% towards retention amount from every running account

bill which may be released against submission of Security Deposit as per GCC. c) Necessary deductions shall be made towards income tax, works contract tax etc. as

applicable as per terms of contract. 11) Bidders are required to quote prices as per the revised bill of quantities (BOQ) attached

herewith (Doc. No. 6509-EL-EC-00028 Rev 04 dt. 13.09.2011).



12) Summary of Schedule of Rates (SOR) shall be submitted along with the SOR as per the

Note:

a) Bidders to quote all inclusive rates for the supply items as per the SOR for supply i.e. the rates shall be inclusive of P&F charges, transportation charges, octroi charges, all other taxes and duties.

b) In case of discrepancy in the basic price indicated in figures and words, the prices indicated in figures shall be considered for price evaluation.

c) In case of discrepancy in the total basic price indicated in the Summary of SOR and the actual total as per the SOR, the actual total as per the SOR shall be considered for price evaluation.

13) The rates shall be valid and firm till the complete execution of the contract. 14) Compensation for Delay: (Clause No. 23.1 of GCC on pg 13) shall be replaced by :

“In case of delays in completing works in the stipulated time, owner reserves the right to recover liquidated damages at 0.5 % of the contract value for every week of delay or part there of subject to a maximum of 5 % of the total contract value until the work is satisfactorily completed and handed over. Such damages may be deducted by the Owner from any money due to the Contractor and any further amount due from the Contractor.” This compensation for delay clause shall be applicable only for Services Contract.

15) Delayed Delivery Clause: (Refer General Purchase Conditions (GPC) attached.) shall be applicable only for Supply Order.

16) Bidders to note that General Purchase Conditions (GPC) and Special Purchase Conditions

(SPC) shall form the part of the tender.



B) Technical Points:

1) Bidders to refer revised BOQ (BOQ Doc. No. 6509-EL-EC-00028 Rev 05 dt. 16.09.2011). 2) Bidders to refer excel file of SOR as per revised BOQ uploaded on UIPL/BPCL website.

The same shall be used for preparation and submission of price bids. Any tampering with the item description and quantity is not allowed and shall result in bid rejection.

3) Contents of note no. 4, Sheet no. 3 of 78 of Part II of Doc. No. 6509-EL-EC-00028 Rev.02

should be read as “EXPECTED COMPLETION PERIOD FOR THE SUBJECT WORK IS 12 MONTHS

1.0 Price Basis:

Indian bidder: FOT Site. Transportation charges to be indicated separately as per the price bid format below.

Foreign bidder: FOB Port of Shipment. Packing & Forwarding charges up to FOB shall be included in quoted price. Export permit/license if required shall be supplier’s responsibility & any expenditure towards same will by borne by the supplier. Refer price bid format below.

2.0 Delivery Basis:

Indian vendor: Date of receipt of material at site shall be considered as date of delivery. Foreign vendor: Date of clean Bill of Lading shall be considered as date of delivery.

3.0 Currency of quote: Change in currency once quoted shall not be allowed. 4.0 Documentation charges: Shall be included in quoted prices. 5.0 Offer evaluation and ordering basis: Refer Addendum 2 6.0 Part Order: Not Applicable 7.0 Firmness of prices: Quoted prices shall remain firm and fixed till complete execution of the

Indian Vendor: Shall be covered by BPCL and the same shall not be included in the quoted prices.

Foreign Vendor:

Prices quoted must exclude transit insurance charges from FOB International Port of Exit as the same shall be arranged by BPCL. However, all transit insurance charges for inland transit up to FOB International Port of Exit must be included in quoted prices.

15.0 “DEFECT LIABILITY PERIOD” in respect of:

(i) Bulk Consumables shall be the date of delivery plus 6 (six) months (ii) In the case of other Material(s) shall be 18 (eighteen) months from the date of

delivery or 12 (twelve) months after the same have been put in service or commissioned, whichever is earlier;

(iii) In the case of altered or replaced Material(s):

(a) With respect to Bulk Consumables, shall be 6 (six) months from the date of alteration, repair or replacement as the case may be; and

(b) With respect to other Material(s), shall be 12 (twelve) months from the date of alteration, repair or replacement as the case may be.

16.0 DELAYED DELIVERY : As per GPC 17.0 INSPECTION AND TESTING

17.1 For Indian vendors, goods and services are subject to stage wise and final inspection by Owner/ UIPL for which no extra charges shall be payable by Owner. Travel, living and personnel expenses of Owner’s inspectors shall be borne by Owner. Travel, living and personnel expenses of UIPL’s inspectors shall be borne by UIPL. All built in import content shall be subjected to inspection by Third Party Inspection Agency nominated by BPCL for which charges are included in quoted prices and no additional charges will be paid by Owner.

17.2 For foreign vendors goods and services are subject to third party inspection.

Foreign bidders shall quote third party inspection charges separately.

17.3 Third Party Inspection Agency where ever applicable shall be nominated by BPCL. In general the following TPIA’s are in the approved list viz. Lloyds, DNV, BV or equivalent. However the bidder has option to specify in his bid the choice of the equivalent TPIA with supporting documents of PTR.

17.4 In addition to any tests to be conducted by the Vendor under the Contract or any

applicable codes or standards, the Material(s) shall be subject to inspection and/or testing by Inspector(s) (including Third Party Inspector(s)) at any time prior to shipment and/or despatch and to final inspection within a reasonable time after arrival at the Project Site. The Inspector(s) shall have the right to carry out the inspection or testing, which will include inspection and testing of the raw materials at manufacturers shop, at fabricators shop and at the time of actual despatch before and/or after completion of packing.

17.5 In addition to testing and inspection by Inspectors, BPCL may nominate an

institutional agency like Boiler-Inspectorate for official testing of coded equipment. The Vendor shall ensure that all procedures for preparation and performance of tests prescribed by such institution shall be scrupulously complied and observed.

17.6 Unless otherwise specified in the Contract, the inspection shall be carried out as

per the relevant standards/scope of inspection provided along with the Tender Enquiry/Purchase Order. All charges for Third Party Inspectors shall be borne by the Vendor and BPCL shall reimburse these charges at actual against documentary proof of payment (limited to the amount indicated in the Contract

towards third party inspection,) unless such inspection has become infructuous for any cause.

17.7 All manufacturers’ mill test certificates and analytical reports from material

laboratories in respect of raw materials employed and components incorporated shall have to be presented by the Vendor.

17.8 Before shipping or despatch, the Material(s) will have to be checked and

stamped by the Inspector(s) who may forbid the use and dispatch of any equipment and/or Material(s) which during tests and inspection fail(s) to comply with the specifications, codes and testing or other contractual requirements applicable thereto, and the Vendor shall not tender such rejected Material(s) for supply to BPCL nor shall incorporate the same in any Material(s) to be tendered for supply to BPCL.

17.9 The Vendor will inform BPCL at least eight (8) days in advance of the exact

place, date and time of tendering the Material(s) for required inspection and provide free access to the Inspector(s) during normal working hours at Vendor’s or his/its sub-Suppliers’ works, and place at the disposal of the Inspector(s) all useful means for undertaking the Inspection, checking the results of tests performed, marking the Material(s), getting additional tests conducted and final stamping of the Material(s).

17.10 All tests will be performed at the Vendors’ expense and if required by the

Inspector(s), shall be conducted in accordance with the Inspector’s instructions. The Vendor shall also bear the expense for the preparation and rendering of tests required by the Boiler Inspectorate or other statutory testing or certifying agencies/institutions.

17.11 Unless otherwise specified, all charges for the Inspection shall be borne by the

Vendor.

17.12 BPCL may, at its own expense, have its representative(s) witness any test or inspection. In order to enable BPCL’s / UIPL’s representative(s) to witness the tests/inspections, the Vendor shall notify BPCL/UIPL at least 15 (fifteen) days in advance, of the schedule of all inspection hold points prior to the initiation of equipment fabrication. BPCL shall be notified eight (8) calendar days in advance of any changes in the schedule of inspection. BPCL will advise the Vendor in advance whether it intends to have its representative(s) be present at any of the inspections.

17.13 Even if the inspection and tests are fully carried out, the Vendor shall not be

absolved from its responsibilities to ensure that the Material(s), raw materials, components and other inputs are supplied strictly to conform and comply with all the requirements of the Contract at all stages, whether during manufacture and fabrication, or at the time of Delivery as on arrival at site and after its erection or start up or consumption, and during the defect liability period. The inspections and tests are merely intended to prima facie satisfy BPCL that the Material(s) and the parts and components comply with the requirements of the Contract.

17.14 The Vendor’s responsibility shall also not be anywise reduced or discharged

because BPCL or BPCL’s representative(s) or Inspector(s) shall have examined or commented on the Vendor’s drawings or specifications or shall have witnessed the tests or required any chemical or physical or other tests or shall have stamped or approved or certified any Material(s).

17.15 Unless otherwise specifically permitted by the Contract, no Material(s) shall be

dispatched for delivery or delivered under the Contract without being stamped or otherwise approved for delivery by the Inspector(s).

17.16 Notwithstanding approval by the Inspector(s), if on testing and/or inspection after

receipt of the Material(s) at Project Site, any Material(s) is/are found not to be in strict conformity with the contractual requirements or specifications, BPCL shall have the right to reject the same and hold the Vendor liable for non-performance of the Contract.

18.0 Bid Evaluation:

18.1 Where only Indian Bids are under comparison

Bids shall be evaluated on the basis net effective price (i.e. landed cost at site including all taxes and duties, freight charges and third party inspection charges (if applicable) minus CENVAT benefit / set off available to BPCL ).

18.2 Inspection Charges:

Foreign bidders shall quote third party inspection charges separately. Third party inspection charges shall be considered for evaluation while arriving at Suppliers’ landed prices. TPI charges shall not be applicable for Indian vendors as the materials supplied by Indian vendors shall be inspected by UIPL. TPI if any for indigenous items decided by owner, charges will be borne by BPCL.

18.3 Other Conditions Related To The Bid Evaluation:

i. Canvassing in any form will make the bid liable for rejection. ii. Unsolicited clarifications to the offer and/or change in prices during its validity period would render the bid liable for outright rejection. iii. Bidders are advised to ensure that their bids are complete in all respects and conform to our terms, conditions and Bid Evaluation criteria (applicable only for press tenders / contracts) of RFQ. Bids not complying with Owner’s requirement may be rejected without seeking any clarifications. v. Bid should be complete covering the individual item wise total scope of work indicated in the Bid documents. vi. OWNER reserves the right to split the quantities / items of the RFQ / Tender while placement of order between more than one vendors as required. vii. OWNER also reserves the right to consolidate the quantities of RFQ / Tender where it is commercially prudent to place single order.

19.0 Commercial Loading

a) Basis of Loading

The Foreign Bids shall be loaded on FOB Port of Exit prices and the Indian Bids shall be loaded on FOT Dispatch Point prices.

b) Commercial Loading:

i) Differential Payment Terms

Any differential payment terms offered by a supplier as against the terms specified in the GPC shall be loaded @ 14% simple interest per annum for the applicable period. In case a supplier asks for release of final payment (due after receipt and acceptance of materials) along with dispatch documents, loading for one month will be considered.

ii) Deviation to Performance Bank Guarantee (PBG) clause:

Performance Bank Guarantee by vendors (for 10% of order value) shall be furnished. However, for order value upto Rs. 10.00 lakh, PBG will not be applicable. In case a supplier offers to give a PBG for less than 10% of order value, or for a lesser period than what is provided in GPC / SPC / ITB loading shall be done for the differential amount and/ or the differential period.

For differential period/ amount loading, the following example will amplify the methodology (if GPC / SPC / ITB specifies 10% PBG/CPBG for 18 months):

For differential period : 10% for 18 months - No loading 10% for 12 months - 10% x 6/18 = 3.3% 10% for 6 months - 10% x 12/18 = 6.7% No PBG - 10 %

In case of Differential Amount Amount Offered by Bidder Loading a) 10% Nil b) Less than 10% Differential between the offered percentage and 10%

iii) DEVIATION TO PRICE REDUCTION CLAUSE:

i. In case a vendor does not accept the price reduction clause or takes exception to the percentage rate, loading shall be done to the extent of maximum of 5% of the order value or the differential percentage not agreed by the vendor.

ii. In case vendor takes an exception that price reduction in case of delayed

delivery should be restricted to 5% of delayed portion only and not on total order value, then price loading @ 5% shall be done.

iv) Freight charges:

Indian Suppliers shall quote firm freight charges up to destination by road transport. If a vendor does not quote freight charges, his offer shall be loaded with maximum freight charges as quoted by the other bidders or prorated (with respect to approx. distance) on maximum freight charges as quoted by the other bidders whichever is more.

v) Octroi Charges : Bidders to quote octroi charges in terms of % as applicable at

the time of bidding. If Octrai is not applicable, bidder shall clearly state “ Not Applicable” . If a bidder does not quote octroi charges or mentions only “As applicable”, his offer shall be loaded with maximum octroi charges as applicable/quoted by the other bidders.

vi) Material is required at BPCL warehouse/site on door delivery basis. Freight &

octroi shall be paid by the supplier. Freight shall be paid by BPCL as per Purchase Order conditions. Octroi will be reimbursed at actuals on documentary proof, subject to maximum Octroi charges as indicated in the price bids.

vii) Any differential in taxes and duties will be cost loaded on case to case basis. However, if a supplier states that taxes/duties are not applicable at present and will be charged as applicable at the time of delivery then his bid shall be loaded by the maximum rate of taxes/duties applicable as on the date of price valuation.

20.0 FORMAT FOR SUBMITTING PRICE ; As per SOR and Price Summary sheet indicated in Addendum 2

The price should be submitted in the format given below on bidder’s Company’s letterhead. Bidders shall refer Part III of the technical specification for scope while preparing price bid.

“ALL BIDDERS MUST SUBMIT THEIR PRICE BIDS ALONG WITH ALL THE SHEETS IN

ORIGINAL. ALL SHEETS INCUDING ANY ATTACHMENTS ETC. MUST BE SIGNED AND

STAMPED ON ALL THE PAGES AND THE ENVELOPE MUST BE SEALED WITH

ADHESIVE ON ALL THE SIDES. NON COMPLIANCE TO THIS CONDITION SHALL

RESULT IN REJECTION OF OFFER.”

21.0 INTERPRETATION OF CONTRACT DOCUMENTS

21.1 The several Contract Documents forming the Contract are to be read together as a whole and are to be taken as mutually explanatory.

21.2 Should there be any doubt or ambiguity in the interpretation of the Contract

Documents or in any of them, the Vendor shall prior to commencing the relative supply or work for supply under the Contract apply in writing to BPCL for resolution of the doubt or ambiguity. Should the Vendor fail to apply to BPCL within 7 days from the date of receipt of the Order for its clarification as aforesaid, the Vendor shall perform the relative work and/or make the relative supply at his own risk.

21.3 Any item of supply or service relative thereto shown, indicated or included by

expression or implication in any document forming part of the Contract shall be deemed to form part of the Scope of Supply with the intent that the indication or inclusion of the supply or service within any of the said documents shall be a sufficient indication of the Scope of Supply or service covered by the Contract.

21.4 No verbal agreement or assurance, representation or understanding given by

any employee or officer of BPCL/UIPL or so understood by the Vendor shall anywise bind BPCL or alter the Contract Documents unless specifically given in writing and signed by or on behalf of BPCL as an Agreed Variation to the relative term(s) in the Contract Document(s).

21.5 Clause headings given in this or any other Contract Documents are intended only

as a general guide for convenience in reading and segregating the general subject of the various clauses, but shall not govern the meaning or import of the clauses there under appearing or confine or otherwise affect the interpretation thereof.

22.0 APPROVED VENDORS FOR MAJOR BOUGHT OUT ITEMS: As indicated in technical specifications.

23.0 IRRECONCILABLE CONFLICTS

In the event of an irreconcilable conflict between the provision of General Purchase Conditions and/or the Special Purchase Conditions and/or Addendum (s) and/or the Agreed Variations to the Tender Documents and/or the Purchase Order and/or between any of the other said documents so that the conflicting provision(s) cannot co-exist, to the extent of such irreconcilable conflict, the following order of precedence shall apply so that the conflicting provision(s) in the document lower in the order of precedence set out below shall give way to the conflicting provision(s) in the document higher in the order of precedence, namely: (i) Purchase Order / Work Contract; (ii) Addendum(s) / Addenda (s) to the Tender Document; (iii) Special Purchase Conditions / Special Conditions of Contract; (iv) General Purchase Conditions / General Conditions of Contract; (v) Other Contract Documents.

PREAMBLE 1. The Schedule of Rates/ Prices (SOR) shall be read in conjunction with the drawings, the Conditions

of Contract and the Specifications as these documents are jointly explanatory and descriptive of the works included in the Contract. Any interpretation of the scope of work, made from SOR or Technical Spec. in isolation shall not be valid for any extra claims.

2. The quantities of work and material in Schedule of Rates/ Prices (SOR) are not to be considered as

limiting or exceeding the amount of work to be done and material to be supplied by the bidder. The quantities in the Schedule of Rates/ Prices (SOR) are an estimate of the amount of work but the work will be measured on completion and the bidder will be paid on the actual measurement of work agreed to by the Engineer in-charge.

3. Special methods of measurements used, if any are stated at the head of or in the text of the Schedule

of Rates/ Prices (SOR) for the trades or items affected. All other items are measured net in accordance with the drawings and no allowance has been made for wastage. The units quoted are based on metric units that is one tonne equals to 1,000 kg.

4. General directions and descriptions of work and materials given elsewhere in the Contract documents

are not necessarily repeated in the Schedule of Rates/ Prices (SOR). Reference is to be made to the other documents for information and guidance.

5. The bidder shall be deemed to have visited the Site before preparing his Tender and to have studied

and examined for himself the conditions under which the work will have to be priced and all other matters affecting the carrying out of the work and the cost thereof. The bidder will also acquaint himself with the prevailing requirements of State, Central/State Government or any conditions levied by any Local Competent Statutory Body or any Agency duly authorized in connection with carrying on such works and he shall be responsible for compliance of such obligations including taking permission wherever necessary, submitting information when called for etc.

6. A price or rate in figures is to be entered against each item in the Bills of Quantities, against which

quantities are in SOR.

7. The prices and rates inserted in the Schedule of Rates/ Prices (SOR) are to be the full inclusive value of the work described under the various items, including all cost and expenses which may be required for preliminary and for the completion of the work described, together with all cost and obligations set forth or implied in the Conditions of Contract, the Specifications and the Drawings.

8. Where prices have been entered against Lump Sum items in the Schedule of Rates/ Prices (SOR),

payment for such affected items shall be made in monthly installments (subject to the provisions of relevant clause/clauses of the Conditions of Contract) in proportion to the extent of which at the end of the month the relevant works have been done at the discretion of the Engineer in-charge.

9. In order to cover for contingencies and additional works, the provisional sums included in the Schedule

of Rates/ Prices (SOR) shall be expanded as occasion arises under the direction of the Engineer in-charge. Any reduction or additional work executed will be measured and valued at the rates inserted in the respective Schedule of Rates/ Prices (SOR). Where such rate is not directly available, the same shall be interpolated from relevant Clause of the Conditions of the Contract.

10. The Employer reserves the right to adjust arithmetical or other errors in the tender in accordance with

the following general rules. In the event of discrepancy between words and figures quoted, the description in words shall prevail. Similarly in the event of an error in the amount column arising as a result of wrong insertion, the unit or item rates shall be regarded as firm and insertions amended

accordingly. The bidder shall quote rates in figures and words for all the items listed in Schedule of Rates/ Prices (SOR) against which quantities are appearing.

11. The rates quoted shall include supply of all the materials by the bidder viz. Cement, sand, bricks,

structural steel, consumables like welding rods, gases, insulation material, ferrules, etc. and nothing whatsoever will be supplied by the Employer except stated in the Scope of Supply – Annexure –II of the SCC.

12. The bidders shall note that the Structural Steel materials shall be procured from approved

manufacturers’ viz. SAIL, TATA STEEL and RINL. Prior approval shall be obtained for procurement from any other vendor.

13. Owner/ UIL reserves the right to cancel/ delete/ curtail any item or group of work if necessary. Such a

step shall not be construed as reason for changing the rates

14. In this part of bid, the bidder shall not stipulate any conditions. There shall not be any overwriting. Bidder shall fill in this part of the Bid and submit the same in a separate, sealed cover. In case any corrections are required, the original writings shall be neatly cut / penned through and rewritten nearby. No overwriting or erasure of original writings by use of ‘White Correction fluid’ or otherwise is permitted. In case any erasure using ‘White correction fluid’ is found, the offer shall be liable to be rejected. All corrections / cuttings / alterations shall be signed in full by the Bidder and dated.

15. The Schedule of item nos. may not be found in continuous serial order. The missing nos. indicates that

the items against missing nos. are not applicable in the scope of the particular tender and hence deleted.

16. The quantities shown against the various items are only approximate and may vary to any extent

individually subject to conditions given in General Conditions of Contract / Special Conditions of contract. No claim shall be entertained during currency of the Contract towards any items due to the above including where the CONTRACTOR has quoted low / high rates.

17. Quoted rates shall include the assembly of the equipment which will be delivered in multiple

components in presence of the vendor/Drgs/ Specifications. If the components of the package units were received in loose condition, the erection contractor to assemble & erect the same.

18. Quoted painting rates shall include the colour coding and lettering on the equipment as per project

specification.

19. Quoted rates shall include preparation of AS BUILT Drawings & Final Field documentation etc. for all the site activities which will be submitted by the contractor in required no of copies to BPCL/UIPL.

20. Notation :

Unloading at site, shifting from stores to foundation, handling, unpacking, erection, alignment, assembling of all accessories, oil filling, testing and commissioning of following transformers including filtration of oil and drying out. CABLE LAYING, TERMINATION, CABLE TRAY SUPPLY AND INSTALLATION

15 CABLE LAYING

Laying of 33kV (E), 11kV(UE), 6.6kV (UE) & 1.1KV grade cables in built-up trenches, directly buried in ground, oncable trays, vertical raceways, clamped on structures/ walls/ ceiling, pulled through pipes and conduits etc. asshown in the standard/ project drawings and as per UIPL specification. Unit rates quoted for installation of cablesshall be same irrespective of route and method of laying. The rates shall include laying, pulling of cables, properdressing of cables on cable trays, racks, vertical raceways and supply and installation of saddles, spacers andnylon chord for tying as required, tagging of cables, clamps (Lead markers at every 10m interval), hardware, fixingof cable markers, trefoil clamps for single core cables at every 1.2m along route length etc. (including supply ofsuitable FRP trefoil clamps, fixing hardware, tags, etc.) as detailed in specification. Sealing with Fire / Waterproofcompound wherever required (excluding supply of compound) shall be carried out by the vendor.

The rate shall include shifting from stores / BPCL Warehouse / location within refinery, handling of cabledrums from Purchaser's stores to place of work and shifting of unused / empty cable drums back to BPCLWare House, rolling of balance cables in drums, sealing ends, tagging/ labelling & shifting to locationshown by Engr-in-Charge. Further testing of cables i.e meggering of HV/MV power, lighting and control cablesand hipot testing for HT cables is also included.

Wherever cable enter or leave the sleeve, cable tags shall be provided. supply and spreading over CrushedStone Dust, supply and laying of bricks or tiles or semi RCC Hume pipes for cable protection, areexcluded and mentioned elsewhere.Scope of applying the fire retardant coating on HV/ LV/ Control cables (as specified in UIPL spec. ), areconsidered separately and shall not be included in this item.

Wherever the cables leaving from trenches and entering on the vertical cable trays in plant , necessary steelsupport structure of 2m height shall be provided around the cable trays to avoid damaging of cables during materialhandling etc. If any lighting / power / control cable coming close to hot pipe lines (steam/hydrocarbon lines etc. ), shall be re-

routed or shall be covered with asbestos cloth / fibreglass cloth to avoid overheating / damage of cables.

For equipments such as welding machine etc. temporary cable laying shall be arranged by contractor.

Note : The Electrical Contractor shall carry out survey of existing cable trenches and decide the route from MRS-4(New GIS) Switchgear to CCR 22kV Switchgear (CCR Substation). Any modification of existing civil trenches,dismantaling and re-installation of civil structure obstructing this extention of cable trenches needs to be done bythe Contractor. The route survey involves the route of approx. 2km of the cable installation / trench installation route.

17 REMOVAL OF CABLES / WIRES

17.1

Removing of 33 kV(E) OR 6.6 kV (UE), 11kV(UE) OR 1.1 kV grade, armoured cables from cable trays eitherlocated above ground or inside RCC cable trenches or through floor conduits, on the pipe rack, through hume pipesor directly buried in ground inclusive of all consumables such as clamps, cable tags, markers for buried cables,hardware, clamps, The rate shall include shifting, handling, re-coiling of cables on cable drums or cutting into piecesif required and shifting to Purchaser's stores / Ware house or cut cable pieces to Scrap Yard. 18 INSTALLATION OF CABLE TERMINATIONS, JOINTING

The scope of work shall include glanding and termination of following types of Heat shrinkable, indoor/outdoorindustrial type end termination kits, terminations, straight through jointing kits for following sizes of cables.Termination charges shall include making the requisite holes in the gland plate, fixing the glands, terminating thecables in the glands, mounting of core balance CT if required, earthing the cable armour, crimping the Al/ Cu cablelugs on each core, neatly clamping the cables in cable alleys/ wiring troughs and connecting to the terminals.Consumable items like Crimping paste, insulation tapes etc, stripping of cable insulation, Fixing of cable glands,putting on PVC hoods is in the scope of Contractor. Cable jointing work shall be done by person certified by the jointkit supplier. All Cable terminations, installations shall be as per IS1255.


A) HV CABLE TERMINATIONS

Hipot testing shall be carried out on cables before cable termination. HT cable gland not required at Switchgearend.

20 INSTALLATION OF PRE-FABRICATED CABLE TRAYS & ACCESSORIES

Assembly and installation of pre-fabricated perforated and ladder type hot dip GI cable trays and accessories onover-head racks, trenches, process plants etc. Job involves installation of all cable tray accessories like straightrun, Bends, Tees, Reducers, fishplates, splices, elbow up/ downs, cable tray covers etc. even though only straightlengths are indicated below shall be in Contractor's scope. Cable tray bends shall be fabricated / modified at sitewherever required. The rate quoted shall include erection of tray with all accessories, stainless steel hardware ofSS-304 (coupler plates, nuts, bolts, washers, spring, anti-loosening washers etc.) as per UIPL Spec.ANNEXURE-II TO SPEC. NO. 6509-EL-EC-00028 attached herewith, welding materials, touch-up paint and otherconsumables. Also the cable tray installation rates shall not include the rates for supply and installation of steelsupports which are covered under a separate item.

Scope also includes supply of GI Spray Paint Cans and GI Spray painting of all welded joints of GI cable trays atsite to avoid rusting. All the cable trays at the entry points from the trench shall be bitumen painted to avoidcorrosion upto a height of 500mm from FFL.

This involves RCC required for construction of trench with RCC precast incombustable slab / covers and filled upwith crushed stone dust after installation of cables. Localised standard class B Brick wall separation / cableprotection, half round hume pipes etc., for cable protection, crushed stone dust shall be used in trenches. Providing, mixing, placing in position RCC of grade M25 ready mix concrete (RMC) using 20 mm down coarseaggregate as per IS:456 with integral corrosion inhibiting admixture POLYALK CP293 of M/s. 38 INSTALLATION OF EARTHING & LIGHTNING PROTECTION SYSTEM

The scope shall cover necessary approval from statutory authorities as detailed in Part-II, Section-1, Page 16 of 78of this tender. This shall also cover stage wise statutory approval by CEA authority for electrical system based onthe stage wise readiness of the installation/ commissioning.

38.1

Installation of earth pit material with Electrode, Funnel, test links, inspection chamber etc. as per latest version ofIS:3043 and Installation & testing of Earthing pit as specified in Part-II, Section-6. The installation rates shall includeexcavation, construction of the earth pits including all materials required for construction of earth pits, placing therod and fixing test links on those pipe/rod/plate electrodes in test pits and connecting to main earth grid conductors,construction of Earth pit chamber. Refer installation standard 6509-EL-MA-00002.

All hardwares (nut, bolt, washer etc.) shall be in electrical contractor's scope of supply as per UIPL standards. Allhardwares such as nuts, bolts, washer etc. shall be in Electrical Contractor's scope of supply as per the installationstandard drawings. If resistance value of earth pit found more than the specified value, then contractor shallarrange for additional layers of charcoal and salt & special chemicals, if any, to bring down the earth resistancevalue to the acceptable value.

Earth pit with Pneumatic drillingDue to the Hard Rock area, Drilling/ Excavation of following Earth pits shall be done by Pnuematic Boring machine assembly mounted on truck with Detachable Boring head. This shall include making of 20m deep bored earth pit including installation of Class-C, 50 NB GI pipes, GI clamps including required tools and tackles for construction of Earth pit chamber.Installation of earth pit material with Electrode, Funnel, test links, inspection chamber etc. as per latest version of IS:3043 and Installation & testing of Earthing pit as specified in Part-II, Section-6. The installation rates shall include excavation, construction of the earth pits including all materials required for construction of earth pits, placing the rod and fixing test links on those pipe/rod/plate electrodes in test pits and connecting to main earth grid conductors.

43 Stenciling / Letter Painting

Letter painting / Stenciling of electrical equipment and their ON/OFF switches, Breakers, feeders etc. shall beincluded in Electrical Contractor's scope of supply (including equipments which are in Package Vendor's scope).This shall be as per the requirement given in CEA/ OISD. Electrical equipments shall include Transformer, HTSwitchgear, LT Switchgear, all Panels, LCS, Distribution Boards and other electrical equipments includingflameproof equipments. Stenciling shall be of 1inch, 2 inch, 3 inch etc.sizes based on Purchaser's requirement(inscription details and size of inscription character for ease of reading etc. ) on top of the equipment, on front andback side (white background with black stenciling).

44 CIVIL WORK RELATED TO ELECTRICAL INSTALLATION CONTRACT

44.1

Excavation in following type of soil for cable laying / earthing and backfilling the excavated area,compacting/consolidation after backfilling and disposing the surplus earth / excess soil to a place outside the site,as directed by the Engineer-in-charge. The scope includes Chipping of concrete and making PCC / RCC good asper original condition in following areas. The scope also includes disposing off the surplus /waste/excess/debris/unserviceble earth outside BPCL refinery and in the area approved by BMC (BMC approval isnot in BPCL's scope). Special Notes:

1) Daily Safety briefing for the contract workmen shall be carried out by contract supervisor in order to reduce hazard during working.

2) Before cutting any cable, contractor shall ensure that the cable is dead by a suitable electrical equipment.

3) The use of Personal Protective Equipments (PPE) shall be done regularly to reduce risk of dangerous occurance (e.g. safety belts), provide physical barrier between the user and the hazard(e.g. apron, face shield ) etc. as per OISD 155. Also while working on live, contractor shall Ware HT / LT gloves to avoid any untoward incidents. Electrical Contractor shall Ware safety belts when working at height above 2.0 m to protect persons from injury. Penalty shall be applicable in case of PPE's and safety belts are not being followed by Electrical Contractor.

4) The Electrician shall have Wiremen Licences from Govt. of Maharashtra.

5) Electrical Contractor is liable to dewater the cable trenches at any stage of project during the entire project execution period due to rain (monsoon) or construction water etc. while laying / removing of cables etc. It shall be responsibility of contractor to keep construction work site free from water at his own cost.

6) Adequate quantity (minimum 4 sets) of portable Walkie-Talkie system including its permission as per OISD 149, clause 11.2.4 shall be used by Electrical Contractor for fast commissioning activities.

7) Contractor shall carry out electrical jobs by strictly complying of a) Part BPCL / UIPL safety rules and regulation b) Indian electricity rules 1956 c) Indian Petroleum rules 1934 d) OISD 149 and other relevant OISD / BIS rules.
