1. INTRODUCTION: The Government of Uttarakhand has assigned the task of conducting Post Graduate Medical Entrance Examination for the session 2016-17 to the Hemwati Nandan Bahuguna Uttarakhand Medical Education University Dehradun, only on dated 30.01.2016. This competitive examination is meant for following courses, details of which are given in this information brochure at the respective chapters.

A. MD/MS/MDS/PG Diploma Courses in Medical/Dental Colleges of Uttarakhand against state seats/state quota seats

B. PG Diploma Courses in Govt. Medical Colleges of Uttar Pradesh only for in service Medical Officers of PHMS of Uttarakhand

C Fundamentals of Abdomino- pelvic Ultrasonography(FAPUS)—Level one for MBBS Doctors- 06 months course (New Course)

1.2 The eligible candidates who get selected through UKPGMEE - 2016 will get admission against available state / state quota seats in post graduate Medical/Dental courses by counselling on merit cum choice basis.

1.3 The Entrance Examination for admission to above Post Graduate Medical/Dental courses for session 2016-17 will be held on dated 30.01.2016 at Dehradun centre only.

1.4 Duration of Course

MD/MS/MDS: Three Years from the date of admission.

PG Diploma: Two Years from the date of admission

Fundamentals of Abdomino- pelvic Ultrasonography(FAPUS)—Level one for MBBS Doctors- 06 months course

2. GENERAL INSTRUCTIONS, TERMS AND CONDITIONS:

2.1 The applicants are required to fill the application form and fee by ONLINE mode only.

. The examination fee shall not be refunded under any circumstances.

2.2 The candidates have to complete the online application form in all respect and also to upload his/her photograph in the appropriate box. The candidates are further advised to re-check the entries/information given by him/her before submitting the same as there is no option for editing the entries after submission of application form. After submitting the form the candidates are required to take the print of the submitted form (hard copy). The candidates are advised to retain the copy of the

form submitted to the University for their best Interest for further reference and Queries.

2.3 Specifications for photograph are as below:

A photograph of minimum 35X45 mm with at least 75% coverage of face & head of the candidate taken after 01-12-2015.

A caption indicating name of candidate and date of taking photograph should be there at the bottom of photo.

Photograph should be taken in a white/very light coloured background. The photograph needs to display full front view of the face. Please look directly

into the camera with a natural expression. Please avoid with reflection of shadow on the face with red eyes. The photograph needs to be printed on a high quality paper with at least 600 dpi

resolutions. The colours must possess the natural appearance and skin tone. The photograph must not have been kinks, scratches and stains.

The candidates have to upload and paste the above specifications photograph in application form and advised to keep at least 06 copies of same photographs. The candidates will have to produce the same copy of photograph on admit card and in the process of counselling and admission etc.

2.4 Last date for submission of online application form is 21.01.2016.(09:00PM)

2.7 The admit cards will be available in the university website www.hnbumu.ac.in w.e.f. 25.01.2016. However, if due to any reason the candidates fails to receive the admit card, such candidates can obtained his/her duplicate admit card 02 hours before the commencement of the examination from the office of Controller of Examination, H.N.B. Uttarakhand Medical Education University Dehradun or at examination centres. Such candidates must bring one attested copy of the same photograph which he/she has affixed with the application form. Admit cards will not be sent by post in any case.

2.8 Only appearing in the UKPGMEE-2016 does not confer any rights to secure a post graduate Medical/Dental course state quota seats. The selection and admission to Post graduate course on a state quota seats in any Medical/Dental college is subject to fulfilling all the eligibility criteria, state reservation policy, provision of bond etc. Mentioned in the Information Brochure and/ or amendments made thereafter till the time of counselling.

2.9 Fee shall neither be carried forward to a future date not refunded under any circumstances.

2.10 In case the information provided by the candidate found wrong in the application form, his/her application will be summarily rejected. If any candidate secures admission in

the college/institute by providing wrong information in his/her application, detected later on in due course, his/her admission will be cancelled at the cost and risk of the candidate.

2.11 Candidates’ eligibility is purely provisional and is subject to the fulfilment of eligibility criteria as prescribed in this Information Brochure, during subsequent verifications of his/her documents at counselling, admission or afterwards.

2.12 University reserves the right to withdraw permission, if any, granted inadvertently to any candidate who is not eligible to appear in the UKPGMEE-2016 even though his/her admit card/ roll number has been issued.

2.13 Instructions in the Information Brochure are liable to change based on decisions consciously taken by the University/Counselling Board/Medical Education Department, Uttarakhand Government from time to time. There is no equity or any rights that are / or deemed to be arising in favour of candidate.

2.14 The candidate must ensure before filling the application form that he/she fulfils the eligibility requirements for admission/appearing in the entrance examination. Change of category is not permitted in later stage.The fee once paid shall not be refunded in the event of rejection of the application. Only eligible candidates will be considered for admission.

2.15 The candidates are advised to give their complete mailing address, ID proof Details and correct contact telephone numbers and email in the application form.

2.16 The records of the Entrance Examination & Counselling shall be preserved only

for a period of one year from the date of the Entrance examination. 2.17 In all the matters relating to examination, admission decision of University/

Counselling Board and Government of Uttarakhand as the case may be, shall be final. 2.18 A candidate found using unfair means in the Entrance Examination of violates law

will invite cancellation of his/her result, non-refund of examination fee and punishment as may be deemed proper by the Examination Committee of the University and as per the provision of law.

2.19 In case of any ambiguity in interpretation of any of the

instructions/terms/rules/Criteria the determination of eligibility/conduct of examinations/registration of candidate/information contained herein, the interpretation of the University/Counselling Board as the case may be, will be final and binding.

2.20 Candidates MUST bring to the examination centre the following documents in

original along with one attested photocopy- Admit card issued by the University/authorized person. Any one of the authorized photo IDs* (must be original and non-expired) PAN card /Driving License/Voter ID/ Passport/Aadhar Card.)

* The name of your photo identification must match with your name as shown on your admit card. If your name has been changed due to events such as marriage, you must show the relevant document mentioned at the time of written test (marriage certificate/Divorcee Decree/Legal Name Change Document).

The examination centre staffs on duty are authorized to verify the identity of candidates and may take steps to verify and record the identity of candidates. Candidates are required to extend requisite cooperation.

Candidate’s thumb impression/Signature/photographs will be taken twice, first at the time of examination in the presence of invigilator and second at the time of admission in the presence of Principal/admission committee of the medical college.

2.21 The examination will be conducted on 30.01.2016 (Saturday) from 11:00AM to 02:00PM (03Hrs.) at Dehradun centre only.

2.22 Candidates must reach their centre at least one hour before the commencement of the examination. No Candidate will be allowed in the examination centre 15 minutes after the commencement of the examination.

2.23 No candidate will be permitted to leave the examination hall before the completion of

the written examination. 2.24 Candidates should ensure before applying that their MBBS/BDS degree is recognized

by Medical Council of India/ Dental Council of India. If it is found at any time that MBBS/BDS degree is not recognized, the candidature/ result shall be cancelled/ deemed to be cancelled.

2.25 Possession/Use of Mobile phones/Electronics devices are strictly prohibited in the premises of Examination Centre. Candidates shall be liable for penal action for Possession/Use of Mobile phones/Electronics devices.

2.26 Carbon copy of answer sheet will be supplied to the candidates. Answer key will be uploaded on the University website www.hnbumu.ac.in. In case of requisition by a candidate only Answer sheet can be shown only to concerned candidate on payment of Rs. 500.00 as fee from the office of The Controller of Examination, H.N.B. Uttarakhand Medical Education University, 123 Ganga Vihar Haridwar Road, Dehradun.

3 ELIGIBILITY CRITERIA’S FOR UKPGMEE-2016

3.1 The Competitive Entrance Examination shall be open to such candidate, who:

For MD/MS/MDS/PG Diploma in Medical Colleges of Uttarakhand against state quota seats

Is an Indian citizen. Has passed the M.B.B.S/B.D.S Examination from a Medical/Dental College, situated in Uttarakhand state and recognized by the MCI/DCI. Has completed/will be completing compulsory rotatory internship training on or before 31.03.2016. No request for time relaxation in compulsory rotating internship under any circumstances will be accepted. Registration with M.C.I./Uttarakhand Medical Council/D.C.I./Uttarakhand Dental Council is utmost necessary and its documentary proof should be furnished at the time of counselling and admission in allotted college.

A candidate can register for and appear in UKPGMEE-2016 only once in the academic year 2016-17. A Candidate who is already admitted to any Post Graduate Medical/Dental course in any Medical /Dental College in the state of Uttarakhand will not be eligible to appear in the UKPGMEE-2016 till he/she completes his/her ongoing PG course and passes the examination.

Note: the criteria are subject to final decision by Hon’ble Supreme Court of India in writ/review petition no 379(c)/2013 Dr. Nikhil Himthani v/s State of Uttarakhand and others.

3.2

For PG Diploma in Govt. Medical Colleges of Uttar Pradesh for in service Medical Officers of PMHS, Uttarakhand *

Is an in-service Medical Officers of PMHS, Uttarakhand.

Has passed the M.B.B.S Examination from a Medical Colleges

recognized by the MCI.

Registration with M.C.I./Uttarakhand Medical Council is utmost necessary and its documentary proof should be furnished at the time of counselling and admission in allotted college

Must have completed minimum 03 year regular service in state

government and age not more than 45 year on 31-03-2016 (relax able by 05 year for SC/ST candidates)

Fundamentals of Abdomino- pelvic Ultrasonography(FAPUS)—Level one for MBBS Doctors- 06 months course. Candidates eligible as per clause 3.1 & 3.2 are also eligible for FAPUS -Level I subject to fulfilment of conditions and other details given in appendix –E & F as per Govt Order.

4 EXAMINATION FEE

4.1 Rs. 6000/- For General and OBC category candidates.

4.2 Rs. 3500/- For SC & ST category candidates.

4.3 Fees shall neither be refunded nor carried forwarded if the application for UKPGMEE-2016 is rejected/ candidature is found to be ineligible of candidate is unable to appear in the examination. Hence candidates are advised to read the eligibility criteria carefully before applying.

4.4 Fee of Rs. 6000/- (Six thousand) and 3500/- (Three Thousand and Five hundred only) as described above will be paid online through Net Banking, Credit or Debit card only. No cheque or draft will be accepted

5 SCOPE OF EXAMINATON, EVALUATION & ELIGIBLITY FOR ADMISSION FOR MD/MS/MDS/PG DIPLOMA COURSE

5.1 There will be one question papers in competitive entrance examination for Post graduate Medical courses (MD/MS/PG Diploma courses) and FAPUS- Level I as per details given in clause 6.1. Question paper for Post graduate Dental course (MDS) course will be set as per details given in 6.2 . 5.2 The competitive entrance examination for Post graduate Medical courses (MD/MS/PG Diploma courses) and post graduate Dental courses (MDS) shall be of one written paper of 300 multiple choice, single correct response questions. The language of question paper is English only.

5.3 All the questions will be objective type with multiple (A, B, C, D) choice of which only one will be the most appropriate answer or the correct choice. Each answer with correct choice shall be awarded one mark. Zero mark shall be given to no answer/wrong answer/ more than one choice is indicated against a question.

5.4 Syllabus: The syllabus for the test shall comprise of subject/knowledge areas as per the latest Graduate Medical Education Regulations/Graduate Dental Education Regulations issued by Medical Council of India/Dental council Of India with prior approval of Government of India.

5.5 The weight age in each specialty is indicative and purely provisional. The University reserves its rights to alter/vary/amend the same.

5.6 Answering method: Read the instruction of OMR Answer sheet carefully.

5.7 Qualifying criteria: Minimum qualifying score in each category is as follows:

(a) General Category : 50% score

(b) SC/ST/OBC Category: 40% score

(c) Persons with Disability (Gen. Category): 45% score

5.8 Negative Marking: There shall be no negative marking.

7 RESERVATION POLICY

7.1 Reservation policy will be applicable on all seats of state/state quota as per prevailing rules of Government of Uttarakhand, applicable at the time of counselling & 100 point roaster will be carried forward and applied college wise only.

7.2 If seats of SC, ST and OBC category remain vacant due to non availability of eligible candidates of their respective categories, than these vacant seats will be converted in the last (Second) counselling as follows:

a. In case of non availability of eligible OBC category candidates the vacant seats of the OBC category will be filled by eligible candidates from general category.

b. In case of non availability of eligible candidates of ST category the vacant seats will be filled by eligible candidates from scheduled caste category and in case of non availability of eligible candidates of SC category the vacant seats will be filled by eligible candidates from scheduled Tribes category. If eligible candidates of SC and ST category are not available than these vacant seats will be filled by eligible candidates from general category.

7.3 Regarding reservation, Government Orders issued time to time, by the Government of Uttarakhand will be applicable for reservation and the certificate issued by the competent authority of Uttarakhand Government will only be valid.

OBC Candidates are advised to check his/her OBC certificate carefully and ensure that it is valid, because the OBC certificate is valid for one year duration only(as per the Government Order No-590-/XVII-3/12-05(O.B.C.)/2010, dated 30.05.2012). The OBC certificate should be valid upto last date for admission for session 2016-17 as directed by Hon’ble supreme court of India/MCI/DCI or at the time of counselling and admission in the concerned college/Institutes. Candidates with invalid OBC certificate will be summarily rejected during the counselling and will not be considered at any cost.

7.4 10% state general quota seats of MD/MS courses in Government Medical colleges will be reserved for regular PMHS officers, Uttarakhand (Provincial Medical and Health Services, Uttarakhand) only in clinical and Para-clinical subjects against which the specialist posts (designation) are available in the cadre as per the state Government Policy, who qualify in the UKPGMEE-2016 examination. The merit list of UKPGMEE 2016 qualified PMHS officers derived from the combined merit list provided by university will be further modified/updated by adding 10% additional marks to the marks obtained by the candidate for each year of his/her service done at remote/difficult areas of the state as defined by the Director General, Medical, Health & family welfare, Uttarakhand / state Government. The Director General, Medical, Health & family welfare, Uttarakhand will also issue a certificate for complete year experience of the officer candidate and this certificate

would be basis for giving weight age in the marks at the time of counselling. The maximum weight age will be upto total 30% of the total marks obtained by the candidate in UKPGMEE-2016 and the cut-off date for calculation of service in remote/difficult areas of the state be as off on 31.03.2016.

(a) All those regular PMHS, Uttarakhand, candidates, having qualified UKPGMEE-2016 and having MBBS degree from any Medical college, recognized by the MCI are eligible for 10% reserved seat for PMHS, Uttarakhand Doctors.

(b) “No Objection Certificate’’ issued from the competent authority is required at the time of counselling, for the PMHS Uttarakhand doctors opting for the above mentioned PG state quota seats.

(c) Service duration certificate in remote and /or difficult areas of Uttarakhand state issued from the Director General, Medical, Health & Family Welfare, Uttarakhand is required at the time of counselling, for the PMHS Uttarakhand doctors opting for the above mentioned PG state quota seats.

(d) In case of selection of the PMHS, Uttarakhand doctors, relieving certificate

issued by Director General, Medical, Health & family welfare, Uttarakhand is required to be submitted at time of admission in the concerned college.

(e) A Regular PMHS Uttarakhand doctor will also be eligible as a open candidate, but for this the eligibility criteria is as same as define for the open candidates and no weight age of marks for his/her service in remote and/or difficult areas, will be awarded.

(f) For the matter of N.O.C, Leave, Pay and execution of bond etc the PMHS candidates are advised to contact within time to the office of The Director General, Health & Family Welfare, Uttarakhand and settle down every concern much before the result of UKPGMEE-2016 and the counselling. The University/Medical education department does not take any responsibility for these service matters and non production of the NOC will summarily reject the candidate’s admission for the PG course.

7.5 50% of seats in Post Graduate Diploma Courses in Uttarakhand (If available at the time of counselling)

50% of seats in Post Graduate Diploma Courses in Uttarakhand will also be reserved for Regular Medical Officers in the PMHS Uttarakhand Government services, who have served for at least three years in remote and /or difficult areas of Uttarakhand. After acquiring the PG Diploma, the Medical Officers shall serve for two more year in remote and /or difficult areas as defined by State Government.

(a) All those regular PMHS, Uttarakhand, candidates, having qualified UKPGMEE-2016 and having MBBS degree from a Medical college, recognized by the MCI are eligible for 50% Post Graduate Diploma Courses reserved seat for PMHS, Uttarakhand Doctors in case seats are available.

(b) Service duration certificate issued from the D.G. Medical, Health &Family, welfare, Uttarakhand is required at the time of counselling, for PMHS Uttarakhand doctors opting for the above mentioned 50% PG Diploma state quota seats, showing that the candidate served in remote or difficult areas of Uttarakhand state for atleast three years.

(c) “No Objection Certificate” issued from the competent authority is required

at the time of counselling, for the PMHS Uttarakhand doctors opting for the above mentioned 50% PG Diploma state quota seats.

(d) In case of selection of the PMHS, Uttarakhand doctors, relieving certificate

issued by DGHS is required to be submitted at time of admission in the concerned college.

(e) A Separate merit list of PMHS, Uttarakhand doctors will be prepared by the counselling board for the above mentioned 50% reserved seats for PMHS, Uttarakhand Doctors only.

(f) For the matter of N.O.C, Leave, Age, Pay and execution of bond etc the PMHS candidates are advised to contact within time to the office of The Director General, Medical Health & Family Welfare, Uttarakhand and settle down every concern much before the result of UKPGMEE-2016 and the counselling. The University/medical education department does not take any responsibility for these service matters and non production of the NOC will summarily reject the candidate’s admission for the PG course.

(g) A Regular PMHS Uttarakhand doctor will also be eligible as a open candidate, but for this the eligibility criteria is as same as define for the open candidates

7.6 3% seats of the annual sanctioned state quota shall be filled up by the eligible candidates under physically handicapped category which will be considered candidates with locomotory disability of lower limbs between 50% to 70% provided that in case any seat in this 3% quota remains unfilled on account of unavailability of candidates with locomotory disability of lower limbs between 50% to 70% then any such unfilled seat in this 3% quota shall be filled up by persons with locomotors disability of lower limbs between 40% to 50%-before they are included in the annual sanctioned seats for General Category candidates.

a. The Locomotors disabilities candidates are advised to obtain prescribed Certificate issued by the Spl. Medical board, constituted by the Director General, Medical, Health & family welfare, Uttarakhand especially for this purpose and to be submitted at the time of counselling. They will have to submit an affidavit in the Medical Board, on Rs.10/- stamp paper duly notarized mentioning the declaration that they have not previously appeared in the above Spl. Medical Board or any other medical board constituted for the said purpose.

b. The above Spl. Medical Board is functioning on every first & third Thursday of each month from 10.00 AM onwards in the office of The Chief Medical Officer. Chander Nagar, Dehradun.

c. Locomotors disability certificate issued by any other authority/board Other than above mentioned Spl. Medical Board shall not be entertained.

7.7 For PG Diploma Courses in Medical Colleges of Uttar Pradesh for Medical Officers of PHMS of Uttarakhand

Total 15 (Fifteen) PG Diploma seats in Government Medical colleges of Uttar Pradesh

will be reserved for regular in service PMHS officers, Uttarakhand (Provincial Medical

and Health Services, Uttarakhand), who qualify in the UKPGMEE-2016 examination.

The merit list of UKPGMEE 2016 qualified PMHS officers derived from the

combined merit list provided by university will be further modified/updated by adding

10% additional marks to the marks obtained by the candidate for each year of his/her

service done at remote/difficult areas of the state as defined by the DGMH/ state

Government. The Director General, Medical, Health & family welfare, Uttarakhand will

also issue a certificate (see Appendix) for complete year experience of the officer

candidate and this certificate would be basis for giving weight age in the marks at the

time of counselling. The maximum weight age will be upto total 30% of the total marks

obtained by the candidate in UKPGMEE-2016 and the cut-off date for calculation of

service in remote/difficult areas of the state be as off on 31.03.2016.

(a)All those regular in service PMHS, Uttarakhand, candidates, having qualified

UKPGMEE-2016 and having MBBS degree from any Medical college, recognized by

the MCI are eligible.

(b) Candidate must not be more than 45 year (50 years for SC/ST candidates)of age as

on 31-03-2016 and have completed 03 year of regular service without any adverse

entry in service records.

(c)female candidate will be preferred for DGO

(d) “No Objection Certificate’’ issued from the competent authority is required at the

(e) Service duration certificate in remote and /or difficult areas of Uttarakhand state issued from the Director General, Medical, Health & family welfare, Uttarakhand is required at the time of counselling, for the PMHS Uttarakhand doctors opting for the above mentioned PG state quota seats.

(f) In case of selection of the PMHS, Uttarakhand doctors, relieving certificate issued by Director General Medical, Health & Family Welfare, Uttarakhand is required to be submitted at time of admission in the concerned college.

The service condition and service bond will be executed by Director General, Medical, Health & family welfare, Uttarakhand. H.N.B. Medical Education University will not be responsible for any matter related with service condition.

9 PROVISION OF BOND

(Applicable only for MD/MS Courses in Govt. Medical Colleges of Uttarakhand against state seats/state quota seats)

Providing Health services in remote areas of Uttarakhand is a difficult task. In spite of the best efforts of the Government, a large numbers of doctors’ post are still vacant in the state. Therefore provision has been made for subsidized fees for candidates willing to sign Bond of service in Uttarakhand. In this context the selected candidates desirous to avail the reduced fees structure have the option to execute a bond at the time of admission for compulsory service in remote hilly areas of Uttarakhand state, as per the Government Order No. 1145/XXVIII(1)/2013-U.O.-03/2008 dated 23.05.2013, details of the terms and conditions are detailed in (Appendix. B.)

After allotment of seats candidates are advised to immediately contact the concerned Govt. Medical college about details of admission process and essential documents required as per provision of service bond given in appendix B. Candidates who fails to submit the required bond documents will not be eligible for subsidized fee benefits.

10 RESULT AND SELECTION CRITERIA:

10.1 Course wise Merit list will be made separately.

10.2 Merit of the candidates obtaining equal marks shall be determined in order of preference as under:

(a) According to age i.e. older getting preference over younger. (b) In case age being same than in order of alphabet the names will be placed

in merit. 10.3 The course wise entrance examination result will be declared by the university

and Merit list (combined & category wise) of eligible candidates for admission to the Post Graduate Medical/Dental Courses will also be placed in the university website www.hnbumu.ac.in.

10.4 Candidates can download their Score card from the University website: www.hnbumu.ac.in.

11 COUNSELLING

The schedule and detailed procedure for course wise counselling will be notified separately in University website www.hnbumu.ac.in after publication of the result. Candidates are advised to regularly visit the University website for updates regarding UKPGMEE-2016.

The general instruction for eligible candidates are given below

11.1 The eligible candidates who have qualified the UKPGMEE-2016 will be given admission on available seats in post graduate courses by the Counselling Board, approved by the Uttarakhand Government for this purpose, according to their rank, and the seat available at that time

11.2 The dates, timing and details of course wise counselling will be put on the

relevant websites as detailed earlier and in prominent news papers widely circulated after publication of result as per the time schedule of MCI/DCI/Hon’ble courts of India.

11.3 Having name in the merit list of eligible candidates will not be the right of the

candidate for getting PG seats unless he/she fulfil all the eligibility criteria of course regarding state reservation policy, provisions of bond etc. Mentioned in the information brochure and /or amendments made thereafter till the time of counselling.

11.4 One time online counselling registration Fee of Rs 1000/- (one thousand

only) will be charged for all round of counselling. 11.5 The seat once allotted by the counselling board cannot be altered under any

circumstances in the particular counselling session.

12 JURISDICTION Any dispute concerning UKPGMEE-2016 would be subject to exclusive jurisdiction of the competent courts within the territorial jurisdiction of Uttarakhand only.

13 DISCLAIMER

Instances of provision of incorrect information detected at any stage of the selection

process will automatically disqualify the candidate from the selection process and

he/she will not be allowed to appear for UKPGMEE in future. If such instances go

undetected during the current selection process but are detected in subsequent years,

such disqualification will take place with retrospective effect and the Principal/Dean

of the concerned college/institute shall have the authority to cancel admission of the

candidate and to proceed legal action against him/her as all the

information/documents furnished by the candidate will be scrutinized/verified by

competent authorities.

WHEREAS, the present PG medical student of this bond has opted for the subsidized fees and in consideration there of agrees to serve the State as a Medical Officer/Specialist Doctor on contract basis for minimum of two years in any of the Government Hospital/Health Centre situated in hilly region of the State after completion of the MD/MS Course. Attendance at all prescribed course and training course is compulsory and absence from which without prior permission from the Appropriate Authority will attract disciplinary and other action as per rules laid down by the Uttarakhand Government.

2. (2) That the PG medical student during his/her study at the Government Medical Colleges of Uttarakhand shall be governed by the prescribed standing orders, code of conduct and any other instructions in this regard and violation of these orders/instructions shall attract penalties awarded by the Government of Uttarakhand/Competent Authority and other action as per rules laid down by the Government/Competent Authority whose decision shall be final.

2. (3) That the PG medical student after successful completion of MD/MS Degree Course/Training unless he/she is prevented from doing so by death or on account of ill health or by being removed from the college roll on the grounds that he/she is considered by the Appropriate Authority to be unfit to continue as a PG medical student (of which the decision of Government of Uttarakhand/Appropriate Authority shall be final), if offered position as a medical officer/Specialist on contractual basis in any of the

Government Hospital/Health Centre in hilly areas of Uttarakhand, shall serve as such for a minimum of two years.

2.(4) That the medical student who have already got subsidized medical education in his/her MBBS course by the Uttarakhand State Government and got selected in MD/MS courses of

Government Colleges of Uttarakhand and opt again for subsidized medical education for his/her post graduation education shall also be bound to serve the state of Uttarakhand as medical officers/Specialist on contract basis at least for a period of two years in addition to the number of years laid down for compulsory service in his/her MBBS bond in any of the Government Hospital or Health centre situated in hilly region of the state failing which he/she shall be liable severally or jointly to pay the Government the total bond amount for both the bonds (executed by him/her) along with compound interest thereupon on prevailing Bank lending rate, as may be determined by the Government of Uttarakhand.

2. (5) That the sureties shall be liable severally and jointly to fulfil the conditions of this bond provided the student is declared a Non-Service Liability under Para 5 and 6 herein below. This bond shall subsist throughout the period until the PG student serve the State as a medical officer/Specialist on contractual basis in the any of the Government Hospital/Health Centre in hilly areas of Uttarakhand for a minimum of two years after completion of MD/MS course, as the case may be, and shall only be discharged from service liability under the bond when the State Government/Appropriate Authority (Directorate, Medical, Health & Family Welfare/Medical Education, Uttarakhand) has issued a certificate to this effect.

2. (6) That if PG medical student does not or refuses to serve the State as a medical officer/Specialist on contractual basis in any of the Government Hospital/Health Centre in hilly areas of Uttarakhand for a minimum of two years after completion of MD/MS course, as the case may be, under the present service bond, the Bond Amount shall be paid by the sureties severally and jointly to the Government along with compound interest thereupon on prevailing Bank lending rate, as may be determined by the Government of Uttarakhand.

2. (7) That both the sureties agree that the Bond Amount or any other amount which they under the present bond are liable to pay the Government severally or jointly, shall be recoverable from them as arrears of land revenue under the Uttar Pradesh Public Moneys (Recovery of Dues) Act, 1972 (as applicable in the State of Uttarakhand) or any other law relating to recovery of money as arrears of land revenue.

2. (8) That the PG medical student and his/her father/mother/legal guardian as first surety agree that the original degree of MD/MS course awarded to the student would be kept in the safe custody of the principal,..............................Medical college till the conditions of this bond are fulfilled by the student and his/her sureties and the State Government/Appropriate Authority (Directorate, Medical, Health & Family Welfare Medical Education, Uttarakhand) has issued a certificate to that effect under the sub-para (5) above.

3. That the PG medical student once having joined the college will not be permitted to withdraw from the college after admission without payment or recovery as the case may be, of the Bond Amount calculated at the rate of Rs. 5,00,000/-(Rupees Five Lakh) per year or part thereof limited to the maximum of Rs 15 lakh along with compound interest thereupon on prevailing Bank lending rate, as may be determined by the Government of Uttarakhand, minus the subsidized fees already paid. It is agreed that the PG medical student shall be

withdrawn/removed from the roll of the Government Medical Colleges, Uttarakhand by the Appropriate Authority on any of the following grounds:-

(i) Unsatisfactory/disciplinary conduct during the course or training at the College and till the date of the course completion as determined by the college authorities and approved by the Director General, Medical Health & Family Welfare/Director, Medical Education, Uttarakhand whose decision shall be final and binding on the student.

(ii) Unsatisfactory academic progress as reported by the college authorities and approved by the Government of Uttarakhand whose decision shall be final and binding on the student.

(iii) Knowingly furnishing false particulars for admission to the said college.

(iv) Failing to give correct medical history as required at the time of pre-admission Medical Board.

(v) Any other condition which may be imposed by Government/Appropriate Authority from time to time.

4. That it is agreed that admission to Government Medical Colleges of Uttarakhand under the present bond implies service liability as Medical Officer/Specialist on contract basis for minimum of two years in any of the Government Hospital/Health Centre in hilly areas of Uttarakhand. If PG medical student decides not to continue as a service liability or intends to withdraw from the college at his/her own volition, he/she shall be allowed to continue his/her studies or withdraw from the college as a Non-Service Liability after payment of full fees of the course minus the subsidized fees already paid calculated from beginning of the course along with compound interest thereupon on prevailing Bank lending rate, as may be determined by the Government of Uttarakhand.

5. Conditions of Non-Service Liability because of Medical reasons:

That the PG medical student will be declared to have become Non-Service Liability on being declared medically unfit by a medical Board for service in hilly areas of Uttarakhand due to any disease/disability detected at any stage during the course, as under:-

(i) The Medical Board headed by Director General, Medical Health and Family Welfare, Uttarakhand will express their opinion on the circumstances under which the Student acquired the disease/disability and whether or not he/she had any control over those circumstances. On recommendations of the Medical Board, the PG Medical Student may be declared a Non-Service Liability.

If on the recommendations of the Medical Board headed by Director General, Medical Health and Family Welfare, Uttarakhand, the PG medical student is found permanently unfit for service in hilly areas of Uttarakhand during his/her course of studies, he/she would be removed from Service Liability and shall be liable to pay the Bond Amount

along with compound interest thereupon on prevailing Bank lending rate, as may be determined by the Government of Uttarakhand.

(ii) The Bond Amount will be paid within one month of being declared Non-Service Liability failing which the amount shall be recovered from PG medical student and his/her sureties of the Student severally or jointly in the manner as provided in sub-para (7) of para 2 of this Bond.

(iii) The quantum of Bond Amount to be recovered in each case shall be decided

taking into account the following factors:- (a) Time elapsed between joining the MD/MS course and date of becoming

Non-Service Liability. (b) Severity of the disease/disability. (c) Nature of the disease/disability whether constitutional for example as

result of any accident on land, sea or air.

(iv) Based on the above factors, the Bond Amount to be recovered from the PG medical student and his/her sureties shall be computed as under:-

(a) The Bond Amount shall be calculated at the rate of Rs. 5,00,000/- (Rupees Five Lakh) per year or part thereof limited to the maximum of Rs 15 lakh along with compound interest thereupon on prevailing Bank lending rate, as may be determined by the Government of Uttarakhand minus the subsidized fees already paid in Government Medical Colleges, Uttarakhand.

A basic minimum sum shall be recovered in all cases for the free

medical education and allied facilities provided by the Government. Depending on the year in which the PG student has been admitted and the year of study in which the PG student is declared Non-Service Liability, minimum charges as under shall always be levied in addition-

(b) Bond Amount (in addition to a maximum of Rs 1,80,000.00 mentioned above) shall be decided on severity of the disease/disability suffered by the student (in instances of diseases/disability).

(v) However, full waiver of money may be granted by the Government of Uttarakhand is case of grave illness/severe disability necessitating withdrawal from the college or on death of the PG student on the basis of individual cases.

(vi) Provided that the PG student point (i) above, may be allowed to continue his/her stay in the hostel on payment of the normal expenses of education including tuition

fee and fees for boarding and lodging facilities as applicable from time to time if he/she has contracted the disease/disability in the circumstances over which he/she has no control and for which he/she has not refused treatment. The decision of the Government in this regard shall be final.

6. Conditions of Non-Service Liability because of non-medical reasons:” (1) That the PG medical student shall also be declared to have become Non-Service Liability in any of the following condition:-

(i) If he fails to attain attendance below 50% in any consecutive terms of the course for reasons other than medical.

(ii) If he fails to qualify final PG examination within a period of five years from the date of admission in the college.

(2) Where the PG medical student becomes Non-Service Liability under sub-para (1) above, Government shall have right to recover from the student and his/her sureties full tuition fees at the rate of Rs. 5,00,000/- (Five Lakh) per year (minus tuition fees already paid) for each year of the student’s stay at the Medical college along with compound interest. 7. That where PG medical student is declared a Non-Service Liability under Para 5,6 and any other provision of this Bond, the sureties shall jointly and severally be liable to pay forthwith to the Government full fees of the MD/MS course for the period from the date of admission to date of becoming non service liability or removal from the college rolls, limited to a maximum of Rupees Fifteen Lakh minus fee paid along with compound interest thereupon on prevailing Bank lending rate, as may be determined by the Government of Uttarakhand. Additional Simple interest shall be levied for late payment i.e. if payment is delayed beyond 45 days from the date of becoming Non-Service Liability or from the date of withdrawal from college. In case of removal from the college, all dues will be settled before leaving the college. 8. That where PG medical student refusing two years service in hilly regions of Uttarakhand as offered by the Department under this Bond, offers to pay the Government the Bond Amount, he/she may be released from Service Liability by the administration of the medical college on payment of the Bond Amount along with compound interest thereupon on prevailing Bank lending rate, as may be determined by the Government of Uttarakhand in the account of medical college concerned. 9. That PG medical student while taking admission in Government Medical Colleges, Uttarakhand shall deposit a sum of Rupees 5000/- (Rupees five thousand only) as refundable security money. If the PG medical student withdraws from the college on his/her volition prematurely, the security money shall stand forfeited to the Government.

10. That liability of the sureties shall not be impaired or discharged by reason of time being granted, any forbearance of the Government or any other person authorized by it (whether with or without the knowledge or consent of the surety) nor shall it be necessary for the Government to sue the PG medical student and his/her first surety before suing the second surety. 11. That it is agreed that except in cases where any sum of money is recovered by the Government under the present Bond as arrears of land revenue, if there is any dispute to the effect, meaning of these presents, or otherwise, however, except as to matters for which specific provision has been made in these presents, the same shall be referred to the sole arbitration of the Principal Secretary/Secretary, Department of Medical Education, Government of Uttarakhand or any other person appointed by him as the sole arbitrator whose decision shall be final and binding on the parties. The provision of the Arbitration and Conciliation Act 1996, as amended from time to time, shall apply to such arbitration.
