Oshima Chun Fong & Chung represents Oahu Sugar Company, Ltd. in this matter.

The Commission staffhas recommended that three water use permits (WUP 129, 130, and 131) be revoked pursuant to HRS § 174C-58( 4) due to four continuous years of non-use. The staff further recommends that the battery of wells which constitute WP2A, 2B, 2C, 2D, WP4A and 4B be required to be backfilled and sealed within two years.

Oahu Sugar does not oppose the revocation of the water use permits. Since sugar cultivation ceased in 1993, the water allocations have not been used. Also, there is no imminent future need for these allocations.

Oahu Sugar, however, strongly opposes the staff recommendation that the wells be deemed abandoned and required to be backfilled and sealed. Oahu Sugar has been exploring, and continues to explore, alternative uses for its wells. It is premature at this time to make a determination that these wells will not have a future use. We ask the Commission recognize the state of transition that this entire area is currently in and allow more time before ordering that the wells be sealed.

WP2 and WP4 are being considered as backup to WPl, which is the source of non potable water for the Waikele Golf Course and for the Mill Site. They could also serve as backup to WP7, which, although not currently in use, is being seriously considered for use by the Navy on the Waipio Peninsula. WP 1 and WP7 are old wells, and if and when maintenance requires that they be shut down, WP2 and WP4 could provide backup sources of water.

The Honolulu Board of Water Supply has also explored the possibility of utilizing the infrastructure that is in place in developing additional potable water supplies for the area.

o o Additionally, the Commission is aware that its Waiahole Ditch decision is currently being

appealed. If the supreme court were to significantly decrease the amount of water that flows through the Ditch to irrigate leeward lands, WP2 and WP4 could possibly be called upon to supplement Ditch flows as they had done during Oahu Sugar's history.

Granted, Oahu Sugar's plea to hold off on the decision on sealing the wells is premised on many "ifs" and "coulds". Oahu Sugar, along with State and City governments, other landowners and other interested parties have been grappling over the past few years with this major transition from sugar plantations, which had existed for a century. As this Commission is well aware, we are still in this period of transition. There are many moving parts to consider in making decisions about the future of this area and they are not confined to one region of the island. It is often not easy to reach finality on issues. Thus, all we are asking is, in light of the circumstances, that Oahu Sugar be given a little more time before having to determine whether or not there will be future uses for these wells.

Backfilling and sealing the wells will be expensive and permanent. Given the state of transition and uncertainty that we are in, it is premature to decide that WP2 and WP4 should be permanently put out of commission.

Oahu Sugar is cognizant of concerns when a well is not actively in use. Measures have been taken to mitigate these potential problems. For safety purposes and to guard against contamination, the well and pump station sites are accessible only through locked gates. The buildings are fully secured with tamper-prooflocks and a security guard makes daily rounds of these areas.

Neither WP2 nor WP4 is in such a state of disrepair as to render either impractical for use. Nor do either of them create any hazard to public health or safety.

Based on the above, Oahu Sugar respectfully requests that the Commission not accept the staff recommendation that WP2 and WP4 be backfilled and sealed. However, Oahu Sugar does not object to the revocation of Water Use Permit Nos. 129, 130 and 131.

On April 11, 1980, the Board of Land and Natural Resources approved the certification of Oahu Sugar Company, Ltd. 's (OS CO) existing uses and quantities of withdrawal for the subject wells. The water was used for sugarcane agriculture.

OSCo's certified withdrawals were adjusted on May 17, 1989, January 16, 1992, and December 6, 1995 in response to revised sustainable yield estimates and the reduction in OSCO's irrigated acreage.

In the summer of 1993, OSCO announced the closure of its sugarcane operations.

ANAL YSIS/ISSUES:

These wells have not been used for over four (4) years; the last report of water use was for December, 1993 (Exhibits 1 to 3). Partial or total nonuse of the water allowed by the permit for a period of four continuous years or more constitutes a ground for revocation of the permit, pursuant to §174C-58(4) Hawaii Revised Statutes (HRS).

In a letter dated February 2, 1998, the Commission notified OSCO of these proposed revocations.

This submittal fulfills the hearing requirement under § 174C-58 HRS for revocation of a water use permit.

Due to the loss in return irrigation recharge resulting from the cessation of OSCO's irrigation practices in the Pearl Harbor area, the Commission staff is in the procesS of reviewing sustainable yields with a view towards optimizing withdrawals from the affected aquifers. This would include the backfilling or sealing of existing wells that have been drilled too deep so that total aquifer pumpage may be maximiud. (New well constructions are subject to the Hawaii Well Construction and Pump Installation Standards, January 1997 (HWCPIS), which requires initial design and pump testing at a depth below seal level not exceeding one-fourth of the theoretical thickness (41 times head) of the basal aquifer.)

The subject wells are very deep and very old. HWCPIS states:

"AU wells and test borings as defined in these Stllndards must be properly abandoned and permanently sealed to protect the ground-water resources of the State of Hawaii from contaminlltion and waste and to protect public health and safety, whenever:

1. Their purpose has been served, or

2. Their use has been permanently discontinued, and

3. Their physical condition is causing or threatening contamination, deterioration in quality, or waste of ground-water resources, or

4. Their state of disrepair makes their continued use impractical or creates a hazard to public health or safety."

The Commission staff recommends that the Commission require the owner to abandon and seal the wells within two (2) years, unless the owner can provide evidence, within sixty (60) days, showing that none of the above conditions for abandonment have been met.

Mr. Sakoda revised the recommendation on the request of Oahu Sugar Company because they were not comroruble with the words "interim permits·:

"That the Commission approve the reduction orosCo's allocation by 9.76 mgd to 60.62 m&d subject to the condition that water use permits issued accordinc to the proposed revised schedule shall be [interim permits) subject to review and adJustment by 1995.-

Mr. Sakoda stated that staff's main cmcem was that the permits be reviewed by 1995.

Mr. Cox mentioned that this was a IIilstantial decrease froOl what was given earlier. He understood OSCo stfIl used a large amount of surface water licensed from the state and asked If that was lost would OSCO need to go back to their original approval ror water use. He asked OSCo's representative for their comments.

Mr. Michael Burte said they could live with the real1ocatioo IS amended by staff. In the numbers on the pump by pump allocation. as the numbers become tighter there would be a need for flexibility between pump allocatiol'Js. The possibllty of the state wltbdrawtnc their water would remove substantial water from the Wa1abole System.

Mr. Cox recalled that the BWS hasn't always followed their pump by pump allocations and asked Mr. Sakoda If formal or Informal adjustments had been made. Mr. Hardy replied that allocations and needs were matched as much as posst"ble but adjustments need to be made from time to time. The numbers are not absolute In the sense that In a month by month pumpace, the DUmbers given are yearly averages. Hopefully, within the ttme period the Dumbers would remain within the averages. Whenrevlews were made of all the major water users, OSCo. stood out as bavlnc the most ·cushion·. In discuss10ns with OSCo., they acreed upon the reduction to the present allocations.

Chairperson Paty asked where pump' IS and 16 were located. These pump' bad the biggest reduction froOl 19 to 10 m&d Mr. Burke said those pumps were Just mauka of H-l. between WalpahJ and Makaki1o.. These pumps lrripte the Ewa plabw. wbleb pardallJ supply the XapoJeI City and Kapolei Vlnage area. Pumps 3-1 an wort tocether with IS and 16 as oae major system. As 1on& as there Is flexibility In the total amount It would be a workable number for 0SC0.

Mr. Martin submitted testimony and recommendations (see attached). He asked for the Commission's view on the concerns expressed.

Chairperson Paty understood that they would like to see broider distribution of dlscussioo. Mr. Marda replied that that was corTeCt, a broader distribution of discussion ~ rec::ocnItloo of other ri&bts that may need to be discussed.

Mr. Nakata asked If people are staDdlai In 1Ine for this water. Mr. Hardy asked If Mr. Nakata meant as far as actual applications for water use. there were none at this time. Altboush staff bas been askin& for information regarding updates for future demands.

Mr. Nakata felt NHAC's recommendation was appropriate and that the Commission should look at it.

Dr. Lewin asked for the .tatus of applications to the County regarding future water use In that area because the Commission has heard some concerns that there are applications for .. ter exceed what can be provided. Mr. Hardy said he can't answer for the County In 10 far as what's available In the Hawaii Water Plan because that Is more of a long-term plan.

Chairperson Paty recopllzed that by cutting the use down by 9 mgd does not mean there will be 9 mad for IOmeoDe else to use. New wells should be developed and utilized.

Mr. Tagomori cnmmented that like the West Hawail area, there have been numerous d1soJsstons with the BWS lD tenDs or what kind of applications are being requested for their system. DlscusskJns are also onaoin& alDOnl the major landowners about their .. ter aeeds. Much of this information Is In the Oabu Water Use and Development Plan and It Is bein& reviewed. If there Is to be a reallocation, there will be. formal procell tbrou&b the Commission.

Chairperson Paty wanted to assure that Mr. Nakata's concern that NHAC's suggestion be incorporated In the Plan. Mr. TaCOmori replied that public hearings and other processes will be followed.

Mr. Cox asked if the reduction of total approved uses to 18S mgd by 1995 was still belne looted at. Mr. Tagomori said they are lookln,c at such. plan.

Unanimously approved with the amendment propoced by Mr. Sakoda and with the understanding that there Is sooe nexlbillty on individual pumps for OSCO. and that staff .tart lookin& at 1on&-rance plans as suuested (CoxlChun).

Revision of Oahu Sugar Company's Ground-Water Use Permits

On May 17, 1989, the Commission on Water Resource Management (CWRM) approved adjustments to water use permits in the Pearl Harbor Water Management AIea (PHWMA) to comply with the CWRM's April 19, 1989 revisions to the PHWMA sustainable yields. The adjustments pnMded (or a S-year reallocation plan whkb incorporated the C'OIm!I'Jion 01 sugar C&DII! cultivation to urban development as well as the estimated Oahu Sugar Co. (OSCo.) optimum basal ground·water demand.

Staff Review of Existing Water Uses

Staff reviewed existing water use patterns and authorized uses foc aD major water usen within the PHWMA. OSCo. has agreed that 60.62 mad would be adequate lor their uses in the foreseeable future.

A well·by·weII reduction of walei' use permits bas been discussed with 0SC0. to achieve the )east amount of negative impact to them. The attached table shows lhe readjusted allocations by weDs.

Based on the submittal of the staff dated

April 11, 1980, I move that th, Board approve the issuance

of conditional certification to the major users of the

ground water who have filed the prescribed declarations,

in the amounts recommended by the staff in its submittal

dated April 11, 1980, subject to the "following:

1. Submi s.sion by each. user of a water use

plan, meeting the management objectives and policies of

the Board, within 3 months from the issuance of such

objectives and policies by the Board in the State's water

management plan.

2. Approval of the water use plans by the Board.

3. Review of the conditional certification

~ithin the next 3 years.

4. Reduction in the quantity of water conditionally

certified in the event that such water is not being bene­

ficially used as defined by law or that the water use plan

is not being implemented effectively.

5. Adjustment in quantity, in the case of Oahu

Sugar, upon the installation of a new and more accurate

metering system, but in no event will said adjustment exceed

the amount of the 1979 withdrawal as contained in the declared

use attached to the submittal.

With my CTD back from repair and recalibration, I decided to take advantage of the casing being out of the hole to run a salinity profile. Results are shown on Figure 1. The salinity through the entire

column is now quite low, almost comparable with Well 2301-21 in the WP-2 battery directly

downgradient (Figure 2). This represents a significant change over the three-week period when Glenn Bauer profiled the well (Figure 3). Looks like the well will be able to produce low salinity water.

Dear Mr. Wilson:

This letter and its enclosures presents the results of our investigation into the condition of the WP2 and WP4 batteries of wells. It also outlines our proposal for the disposition of these wells. Most of the information presented herein has already been given to and discussed with your staff in meetings at the well sites, and in the CWRM office.

Present Condition of the Wells

Our investigation to determine the condition of the wells, involved uncovering well heads, modifying some of the manifold piping to allow access, video logging to determine the depths and condition of the well casings, measuring water levels as a possible indicator of leakage, and creating salinity and temperature profiles through the water column of each well. Measuring point and water level elevations are summarized in Table 1. Casing and well depths are compiled in Table 2. The diameter of all the well casings is 1 2 inches.

WP 4A and 4B (Well Nos. 2301-11 to -17). Apparently, ten wells were drilled at this site but three of them, Nos. 18, 19, and 20 on Exhibit 1, were covered over and never used. No trace could be found of them in the field, either at individual well heads or as connected manifold piping. The other seven wells were found. Each of these has its own individual vault and all are manifolded as shown on Exhibit 2.

Based on the slightly lower water levels in these wells compared to WP 2 and WP 1 (Table 1) and the observed flow of water into the tunnels when the pump was dewatered to provide access to the well heads, it seems probable that these wells are or have the potential to leak into the overlying alluvium at an undesirable rate. The salinity profiles demonstrate that all seven wells are slightly brackish (Exhibits 3 to 9).

WP 2A. 2B. 2C & 20 (Well Nos. 2301-21 to -32). These twelve wells were installed in a rectangular pattern at 50-foot spacing (Exhibit 10), making them easy to locate. Two of the wells are in the large pump vault, six are in individual vaults which are reasonably intact, and the other four had to be unearthed with a backhoe (Nos. 21, 26, 27 and 28 on Exhibit 10). For these last four, 12-inch pipe extensions with bolted flange tops were installed to bring their well heads ab~ve ground.

Except for their undesirably shallow casing depths listed in Table 2, all of the WP2 wells were found to be in reasonably good condition. The small dewatering pump in the large pump vault is still operating. It turns on about once every five minutes and runs for only a few seconds, removing 10 to 15 gallons of water which had accumulated in its sump over the five-minute interval. Based on this nominal discharge and the apparently normal water levels in the wells, the leakage rate from this battery of wells is relatively insignificant. The salinity profiles also showed that the water quality of the wells is excellent (Exhibits 11 to 22).

Proposed Disposition of the Wells

Based on the physical condition of the WP 4 wells and their slightly brackish water quality, Amfac proposes to seal all seven of them. The sealing process would consist of the following: installation of clean basalt gravel to 25 feet below the bottom of the casing; putting five feet of sand as a seal on top of the gravel; and then installing grout to the top of the well casing using a tremie pipe. After the grout has been allowed to set, each of the well vaults would be backfilled to the ground surface using select borrow material which is free of organics. The cost of this work is substantial and has not been anticipated in our current budget. For this reason, we ask for a period of two years from your acceptance of this proposal to complete the work.

Due to the excellent water quality and relatively good condition of the WP 2 wells, we ask that you allow us to keep the wells as they are. Since they pose no threat to the aquifer and are an asset to Amfac, we are discussing possible arrangements with others for the potential use of the wells.

1. February 18, 1998: CWRM revoked the WUPs for Oahu Sugar Co. wells WP 2A, 2B (Well Nos. 2301-21 to 26), WP 2C, 2D (Well Nos. 2301-27 to 32), and WP 4A, 4~ (Well Nos. 2301-11 to 20).

2. Late February to Mid March, 1998: Oahu Sugar Co., located and exposed all wells to access from the ground surface for WP 2A, 2b, 2C, & 2D, and all but three wells for WP 4A, 4B.

3. March 24, 1998: Oahu Sugar Co. consultant, Tom Nance, logged 19 wells with a salinity and temperature probe, and determined the depth of each well. A water level data logger was installed in one well.

4. Late March to Early April, 1998: Roscoe Moss Drilling Co. video logged 19 wells to view the condition and length of casing and the geological formations penetrated by each well.

S. Early April, 1998: Tom Nance surveyed in bench marks for each exposed well and measured water levels in each. He determined that the static water levels in WP 4A, 4B were about 0.3 feet lower than water level elevations in WP 2 battery and WP 1 battery.

6. April 6, 1998: CWRM staff met Jim Wriston and Tom Nance in the field to examine the condition of wells and pump appurtenances and photographed all of the exposed wells in the WP 2 and WP 4 batteries. Tom Nance provided staff with copies of all salinity and temperature profiles obtained.

7. April 9, 1998: CWRM staff met with Jim Wriston and Tom Nance to examine options for abandonment, sealing, capping, and/or possible future use of the wells. Tom Nance provided staff with a preliminary table showing well and casing depths, bench marks, and water level elevations.

Future Actions

1. Middle to Late April, 1998: Staff to view video logs of wells.

2. Middle April to early May, 1998: Oahu Sugar Co. to submit preliminary plans on disposition of wells.

3. May, 1998: Make draft recommendations for final disposition of these wells.

4. May 1998: Re-evaluate draft recommendations with Oahu Sugar Co.

S. June, 1998: Brief CWRM on the final recommendations at the June 1998 CWRM meeting.
