HISTORICAL SKETCH.

The General Assembly of Maryland in 1812 authorized The Collegeof Medicine of Maryland, founded in 1807, "to constitute, appoint andannex to itself, three other colleges or faculties, viz—The Faculty ofDivinity, The Faculty of Law and The Faculty of the Arts and Sci-ences," and declared that "the four colleges or faculties thus united,should be constituted an university by the name and under the title ofthe University of Maryland." In pursuance of this authority theUniversity was organized in 1813, being one of the oldest chartereduniversities in America, coming eighth according to official figures.

While the first faculty of law was chosen in 1813, and David Hoff-man was elected professor of law, and published in 1817 "A Courseof Legal Study addressed to Students and the Profession Generally"which the North American Review pronounced to be "by far the mostperfect system for the study of law which has ever been offered tothe public" and which recommended a course of study so comprehen-sive as to require for its completion six or seven 3 ears, no regularschool of instruction in law was opened until 1823. This was sus-pended in 1836 for lack of proper pecuniary support and on accountof the small number of students who were able or willing to spendthe time necessary, when admission to the bar was of little difficulty,to take advantage of the course of Professor Hoffman, whose idealsof legal education were far in advance of his times. In 1869 the LawSchool was reorganized, and in 1870 regular instruction therein wasagain begun. From time to time the course has been made morecomprehensive and the Board of Instructors increased in number. Itsgraduates now number more than sixteen hundred and included.among them are a large proportion of the leaders of the Bench andBar of the State and many who have attained prominence in theprofession elsewhere.

The lectures in this school, where all the professors were activelyengaged either upon the Bench or at the Bar, have been mainly givenin the afternoons. In order to afford deserving young men, who couldnot attend lectures except at night, the advantages of systematic in-struction in preparing for the Bar, two other Law schools were organ-ized under charters granted by the State of Maryland, viz.—the Balti-more Law School and the Baltimore University School of Law. These

schools, both of which were doing good work and steadily advancingtheir standards, were consolidated under the name of the BaltimoreLaw School, on the first day of February, 1911, and in 1913 had anenrollment of 270 students.

With a view of still further elevating the standard of legal educa-tion in this State, and at the same time affording to every young man,who has the requisite preliminary training, fitting him to successfullyprosecute legal studies, an opportunity to properly qualify himself forthe Bar, arrangements have been made by which the Baltimore LawSchool has become merged into the Law School of the University ofMaryland and the latter will, beginning with the session 1913-14, con-duct a day school and a night school, both having the same curriculum,faculty, and requirements for admission and graduation, and these willaim to accord with' those laid down by the Association of AmericanLaw Schools.

Location, Building and Library.

The buildings of the several departments of the University of Mary-land, except those of the School of Arts and Sciences in Annapolis,are all located at the corner of Lombard and Greene Streets, inthe City of Baltimore. The law building, which adjoins the medicaldepartment, contains two large lecture rooms and a library or readingroom. The large, pleasant reading room, maintained for the use of thestudents, contains a carefully selected library of text books on thevarious subjects embraced in the curriculum, reports of the SupremeCourt of the United States, the Federal Reporter, Lawyers ReportsAnnotated, English Common Law Reports, Maryland Reports, volumesof leading cases, digests, statutes, etc., as well as works on Englishand American History and Politics and the tables are supplied withthe leading Law Reviews. No fee is charged for the use of the library,which is annually growing in size and value by the addition of newvolumes of Reports and text books. The consolidation of the LawSchool with the Baltimore Law School has greatly increased the sizeand importance of the library, which now contains more than 5,000standard volumes. No attempt has been made to duplicate the Libraryof the Baltimore Bar, which the students of the Law School are, undercertain conditions, permitted to use. The Library will be open for theuse of the students from 10 A. M. to 11 P. M. and a librarian willbe in charge during those hours to assist the students in finding and

using the books. The students will be permitted to use the booksfreely in the reading room, but will not be permitted to take themfrom the library under any pretext whatever and any violation ofthis rule will be severely punished. As the books receive considerablehandling through their frequent use, the students are requested to usethem with care.

The Library of the Peabody Institute and the Enoch Pratt FreeLibrary contain many works on the law which are available to thestudents without charge.

Course of Instruction.

The course of instruction in the Law School extends through threescholastic years of thirty-two weeks each, with an average of at leastten hours of class room work each week, and aims to present a generaland complete view of the science of law, with reference not only toits growth by judicial exposition, but also to the principles which havebeen engrafted upon it by positive enactment. The course of studyembraces both the theory and the practice of the law, and is designedto thoroughly equip the student for the practice of his profession,when he attains the Bar.

Scientific education is afforded in the principles of the CommonLaw, Equity, the Statutory Law of the State of Maryland and thePublic Law of the United States.

Instruction is given by discussion of assigned cases and by lecturesdelivered between the hours of 4 and 7 P. M. in the Day School and7 and 9 P. M. in the Night School. The School thus offers specialinducements to young men who are engaged in offices or in businessduring the day and have only the evening hours for study.

The system of instruction embraces the study of assigned cases andof approved text-books. It is believed that instruction given throughthe use of cases alone is unnecessarily laborious, not conducive touniformity, and likely to produce confusion in the student's mind,unless supplemented by the aid of proper text-books. Accordingly,a system of instruction, involving the use of both cases and text-books,is followed.

Students desiring to do so, may take elective or special courses.Such students are not candidates for the degree of Bachelor of Laws,but will receive certificates of proficiency in the branches pursued.

Courses of instruction will be arranged with special reference to thosedesiring to obtain a knowledge of certain branches of the law, as anaid in business, or in the management of estates.

The Law School endeavors to uphold a high standard of legal edu-cation and it aims to give the student a comprehensive view of thewhole field of the Law and particularly a knowledge of the funda-mentals of American Law, in order to enable him to pass the exam-ination for the Bar, if he has chosen the legal profession for his lifework, or to fit him to properly care for his business interests, if hedesires legal education merely as the accomplishment of the well-equipped man of business or man of culture.

The lectures are intended to present all the leading principles of thecommon law applicable to the subject, and the modification of thecommon law by statute, and to give illustrations of the applications ofthe common and statute law. Special attention is given to the statutesin force in Maryland, and to peculiarities of the law in that State,where there are such; but the reasons for these statutory modificationsand local peculiarities are explained so that the student may in a shorttime acquaint himself with the local peculiarities of the law in an)State in which he may practice.

Readings from text-books and adjudicated cases will be assigned onthe subjects treated of in the lectures.

It will be seen that the full course of study extends over three yearsand as the Faculty is satisfied that students, who have not made con-siderable progress in the law before entering the Law School, woulddo themselves and the School an injury by attempting to graduate ina shorter period, no student will be permitted to receive the degree ofLL.B. until after three full years of study at this School, unless ad-mitted to Advanced Standing, as explained on page 17 of this cata-logue.

Hours of Lectures.

The lectures to the several classes attending the Day School will btbetween 4 and 7 P. M. The lectures in the Night School will be be-tween 7 and 9 P. M. and the lectures and sessions of the Practice Courtwill be at 8 P. M. every Friday evening during the session. Memberrof the Intermediate and Senior classes in both the Day and NightSchools will be required to attend all sessions of the Practice Court.

Practice Court.

The Law School endeavors not only to thoroughly equip its studentswith an accurate knowledge of legal principles, but also to train themin the application of that knowledge and fit them for the practice ofthe law. To that end, special care and thought will be devoted to theconduct of the Practice Court, which will be in session throughout thescholastic year.

The work of the Practice Court is designed to afford opportunitynot only for the argument of law questions, but also for the prepara-tion and conduct of a case through all its stages, as nearly as possiblein accordance with the same procedure used in actual trial work. Aset of Court rules has been adopted, in accordance with which thestudents are required to prepare and file their pleadings and conducttheir cases. The students will be furnished with statements of facts,supposed to represent the claims of the respective parties to the litiga-tion, from which they will draft the necessary pleadings, and preparetheir cases for trial The cases will proceed through the regularstages of actual litigation, including the examination and cross-exam-ination of witnesses, the latter being impersonated by volunteers fromthe lower classes. Students will thus be enabled to familiarize them-selves with the practical duties of court practice to an extent whichthe mere argument of mooted questions of law does not afford. Thefaithful discharge of Practice Court duties is a condition of gradua-tion, and the character of the student's work therein will be consideredin awarding the grade prize in the Senior Year.

A Court Clerk will keep the docket, Court records and papers filedin the various cases. Permanent "advisory counsel" will be assignedto each student from among the members of the Faculty.

The cases assigned will be such as to illustrate the principles in-volved in all the courses covered by the curriculum, particularly thoseon Pleading and Practice. The course will extend through the Inter-mediate and Senior Years, affording two full years of Practice Courtwork. The Court will sit in several parts or divisions and cases will betried in each division.

The Practice Court will be under the supervision of Randolph Bar-ton, Jr., Esq., assisted by several associates.

The Practice Court will meet once a week during the session—onPriday evenings at 8 o'clock.

Each student enrolled as a member of the Intermediate and SeniorClasses will be required to satisfactorily prepare and argue at leasttwo cases in the Practice Court during the academic session.

Timely notice of the assignments of the students will be given.All members of the Intermediate and Senior Classes will be re-

quired to attend the sessions of the Court. During the session, lectureswill be delivered by the Director to the classes on the method ofexamination of legal questions for oral arguments, preparation ofbriefs, Legal Ethics and Practice.

Requirements for Admission.

Applicants for admission to the Day or Night School must be atleast eighteen years of age, must present evidence of good moral char-acter and if candidates for the degree of Bachelor of Laws will berequired to give to the study of the law three scholastic years of atleast thirty-two weeks each, with an average of at least ten hours' class-room work each week, and to have completed at the time of admissionto the School a four years' High School Course or such a course ofpreparation as would be required for admission to the principal Col-leges and Universities in Maryland; but persons who are unable tocomply with these entrance requirements or to spend three years in thestudy of law may be received as special students, not candidates forthe degree, and upon completing the whole or any part of the course,may receive certificates of proficiency in the work completed, accordingto standards to be fixed.

THE FACULTY will consider that students are properly qualified forentrance as candidates for the degree of Bachelor of Laws, who havereceived a bachelor's degree from any reputable college or university,or certificate of graduation from any of the Normal or High Schoolsof the State of Maryland, or other reputable institution of a similarcharacter, or have certificates showing that they have passed the en-trance examinations to one of the principal colleges or universities inMaryland or a college or university maintaining a standard equalthereto. In the absence of such degree or certificate, candidates forthe degree of LL.B. must satisfactorily pass an examination in theordinary studies required for admission to colleges in this State, andparticularly upon the following subjects:

All students are required when entering for each session to reportat the office in person, enroll and procure tickets of admission to thelectures. The date of enrollment for each session will be noted,and names not upon the register will not be placed upon theclass rolls. The stipulated period of attendance upon the Law Schoolfor the purpose of graduation, and for insertion in the certificate re-quired to take the examination for admission to the bar before theState Board of Law Examiners, will be calculated from the register,and the class rolls made therefrom.

Advanced Standing.Students may be admitted to advanced standing in the Junior or

Intermediate classes upon satisfying the requirements for the work ofthe preceding year or years. These requirements may be met by pre-senting a certificate from any law school of accredited standing showingthat the student has successfully completed equivalent courses in a lawschool, covering at least as many hours as are required for such sub-jects in this School. No credit will be given for study pursued in a law•office.

Fees and Expenses.The fees for each term are payable strictly in advance at the com-

mencement of each term, and tickets of admission to the lectures areissued only on payment of fees.

The charges for instruction are as follows:Students attending and taking the examinations of one class:

For Term of four months $40.00For Session of eight months $80.00

Special students will be charged according to the courses pursued.There will be a matriculation fee of ten dollars charged and payable

for each student at the time of matriculation and an additional chargeof ten dollars to each graduate as a diploma fee.

Students of this School and of the Baltimore Law School, who wereenrolled and had attended lectures at their respective schools prior toJune I, 1913, will be subject to the same fees and expenses as werein force at their respective schools on June I, 1913.

Special arrangements may be made by members of the Bar, or others,not regular students of the Law School, for attending any particularpart or branch of instruction at rates of charge in proportion to theabove.

Opportunity for Attending Other Lectures.All the courses upon History and Politics at The Johns Hopkins

University are open to law students upon the payment of very moder-ate fees, and are given at hours which do not interfere with the attend-ance upon the lectures at the Law School.

Privileges, Courts, Etc.

Any student entered in one class has the privilege, if he sees fit, tobe present at the lectures in the subordinate class or classes; and anygraduate of the school has the privilege of attending all the lectures forthe session next ensuing his graduation.

There are ten Courts in almost continuous session in Baltimoreduring the entire scholastic year; the students have unusual oppor-tunities to learn the law by attendance on the Courts, and are advisedto attend the Courts when they can conveniently do so, and to givecareful attention and thought to the proceedings.

It has been the practice heretofore for students to form Quiz Clubs,composed of from five to ten members. They can, if properly con-ducted, be made very improving, and students are advised to formthem. iS

EXAMINATIONS AND REQUIREMENTS FORGRADUATION.

DEGREES—The Law School confers the degree of Bachelor of Lawson students who have attended the course of lectures to all three classes,have attained the required standard at the examinations, have sub-mitted to the Faculty a satisfactory thesis, and have argued the re-quired number of cases in the Practice Court.

EXAMINATIONS—There are six examinations each session—two ofthe Senior Class, two of the Intermediate Class, and two of the JuniorClass. Each class has an examination at the close of each term. Theexaminations are oral, or by printed questions to be answered in writ-ing. Each examination is valued at ioo.

The subjects of study will be classified into major and minor subjects.To be graduated and receive the degree of LL.B., a student must

have obtained the passing grade of 75 per cent, on each distinct sub-ject; but a student who has failed only upon one minor subject may,in the discretion of the Faculty, be graduated, provided he has at-tained an average of 80 per cent, or above on all major subjects. Inmarking all examination papers, composition and clearness of expres-sion will be taken into account.

THESIS—Each candidate for a degree must prepare a satisfactorytypewritten thesis of not less than three thousand words on some legaltopic to be selected by the Faculty. This thesis must represent originalinvestigation on the part of the student. In no case will a mere com-pilation of authorities be accepted. Theses must be handed in on orbefore May 1 of the year in which the degree is to be granted. Eachwriter must attach to it a sealed envelope containing his name.

The subjects for the theses for the next session will be given to thestudents in November, 1913. The attention of the students is calledto the fact that the Faculty will require a high standard of excellencein the theses.

Honors and Prizes.In the year 1914 two prizes will be awarded:One to the student of the graduating class who obtains the highest

average grade for the entire course, and one to the student of thegraduating class who submits the most meritorious thesis.

Rules of the Court of Appeals at page 35.Board.

Board can be had in the city at prices varying from $4 to $10 a week.19

RULESOF THE

COURT OF APPEALS OF MARYLANDREGULATING ADMISSION TO THE BAR

Adopted in pursuance of the Act of 1898, Ch. 139.

FIRST.

All applications for admission to the Bar shall be made by petition to the Courtof Appeals. The petition shall be under oath, and shall state:

(a) The full name, age, residence, and place of birth of the applicant.(b) If the petitioner shall apply for admission as a member of the Bar of

another State or of the Courts of the United States pursuant to section 6 ofchapter 139 of the Acts of 1898, the petitioner shall state that he is now an actualresident of this State, and shall further name the State in which and the Courtby which the petitioner was admitted to the Bar, and shall also state that thepetitioner has, for at least five years before filing his said petition, been engagedas a practitioner or teacher of the law or a Judge in such state. The petitionershall file with his petition a copy of his license to practice, duly certified, or acopy of the record of the Court in which he was so admitted, certified asrequired by law for the authentication of the records of Courts of other Stateswhen offered as evidence in the Courts of this State.

The petitioner shall also file a certificate of a Judge of the State in whichhe was so admitted or a certificate from two members of the Bar of this Statecertifying how long they have known the applicant and that he is not a personoi bad or dissolute habits, but of good moral character, and that he has never,so far as known to the person or persons certifying, been guilty of any criminalor disgraceful conduct, and that he is, at the time of such certificate, a memberof the Bar in good standing, and that he has been actively engaged as prac-titioner or teacher of the law or Judge in such State for at least five yearsbefore filing of said petition.

(c) If the petitioner shall not apply for admission as a member of the Barof another State, the petition shall further state:

That the petitioner has studied law in the office of a member of the .Bar ofthis State or in a law school of the United States for at least two years, thatwhile so studying the law he diligently pursued the course of study prescribedin Rule 5.

The petitioner shall file with his petition a certificate from the member of theBar in whose office he studied, or if the petitioner studied in a law school, acertificate from the President, Dean or any instructor of such school, certifying

that the petitioner has pursued under his direction for at least two years thecourse of study prescribed in Rule 5, and that the petitioner is not a person ofbad or dissolute habits but of good moral character, and that he has never, sofar as known to the person certifying, been guilty of any criminal or disgracefulconduct.

The certificates hereinbefore provided for shall be prima facie evidence ofthe facts stated in them.

The petition shall be filed at least ten days before the day fixed for an exam-ination by the State Board of Law Examiners.

SECOND.

All applicants for admission to the Bar, including members of the Bar ofother States, shall pay a fee of twenty-five dollars at the time of filing theirpetition.

No petition will be considered or referred to the State Board of Law Exam-iners until said fee is paid to the Treasurer of the said Board.

THIRD.

All applications for admission to the .Bar, except applications from membersof the Bar of other States, shall be referred to the State Board of Law Exam-iners, who shall examine the applicants as to their qualifications to practice law.

FOURTH.

The Board of Law Examiners shall meet twice annually, once in the monthof June, and once in the month of November, at such place in the State ofMaryland as said Board may determine, for the purpose of conducting suchexamination. Thirty days' public notice of the time and place of meeting shallbe given.

The said Board shall hold such other meetings for the purpose of conductingexaminations at surh time and place and on such notice as may be directed bythe Court of Appeals from time to time by special orders.

FIFTH.

All examinations shall be in writing: All applicants shall be examined bysaid Board on each of the following subjects: ( i ) Elementary Law; (2) Con-tracts; (3) Torts; (4) Wills and Administration of Estates; (5) Corporations;(6) Evidence; (7) Equity; (8) Real Property; (9) Personal Property; (10)Criminal Law; (11) Domestic Relations; (12) Pleading and Practice at Lawand in Equity (at Common Law and in Maryland) ; (13) Constitutional Law;(14) International Law; (15) Legal Ethics.

The .Board may at its election, in addition to the written examination, examineorally any or all of the applicants.

The State Board of Law Examiners may prescribe rulef for the conduct ofexaminations, provided that the applicants shall be allowed at least six hoursin which to prepare the answers in the written examination.

SIXTH.

The State Board of Law Examiners shall, as soon as practicable after suchexamination, report to the Court of Appeals all their proceedings in connectionwith such examination. They shall file with their report a copy of the questionsasked and all the replies. The report shall also state the conclusions of saidBoard as to the qualifications of all applicants and shall recommend in the caseof each person examined that he be or be not admitted to the Bar.

SEVENTH.

The names and places of residence of all persons recommended by saidBoard for admission to the .Bar shall be published once a week for three suc-cessive weeks in two daily newspapers published in the City of Baltimore beforethe day fixed for the ratification of the report of the State Board of LawExaminers.

If no exceptions are filed to the report of the Board of Law Examinerswithin thirty days after their report is filed, the recommendations contained intheir report shall be adopted, the action of the Board ratified and the applicantsadmitted or rejected, as recommended by the .Board.

If exceptions to the report of the Board shall be filed, such exceptions shallbe heard and decided by the Court. In case an exception shall be filed to therecommendation of the Board that any applicant shall be not admitted to theBar, and the exception relates to the qualification of the applicant to practicelaw, no new examination will be held, but the exception heard and determinedon an examination of the applicant's answers to the questions asked him. Ifthe exception relates to the moral character of the applicant, the exceptant andthe applicant shall have the right to produce evidence in support of or againsttheir exception before the Court or before an Examiner appointed for thepurpose of taking testimony.

EIGHTH.

When it shall be determined by the Court of Appeals that an applicant isqualified to practice law and is of good moral character, an order will be passeddirecting that he be admitted to the Bar on taking the oath required of a mem-ber of the Bar by the Maryland Code of Public General Laws, Article 10,Section 10.

NINTH.

The members of the .Board of Law Examiners shall be entitled to the sumof ten dollars per day for every day actually spent in the discharge of theirduties, travelling and other expenses, provided the fees and expenses of saidBoard shall not exceed the sum paid by applicants as fees.

For the guidance and control of the State Board of Law Examiners the fol-lowing additional rule is adopted by the Court of Appeals of Maryland this

seventh day of May, 1902, under and in virtue of the authority conferred uponthe Court by the Act of Assembly of 1898, Chapter 139.

TENTH.

In the rating of applicants the Examiners shall take into consideration theexcellence or defects of the applicant's preliminary education in marking theexamination papers and in making out his ratings and in determining the ques-tion whether he should pass the examination; and the applicant's attainmentsin this respect may be ascertained by the Examiners from the examinationpapers, or in such other method as the Examiners may prescribe.

ELEVENTH.

No person who is not an actual bona fide resident of this State at the time hemay apply for admission to the Bar shall be permitted to take the examinationprescribed by the aforegoing rules; nor shall any person under twenty-one yearsbe allowed to take such examination.

Departments of the University of Maryland.

The University of Maryland is represented by five departments, each havinga distinct Faculty of Instruction.

i st. The SCHOOL OF MEDICINE, in Baltimore, Md. This School was estab-lished in Baltimore in 1807, and offers a high-grade course in medicine, extend-ing over a period of four years, and leading to the degree of Doctor of Medi-cine. It represents the Department of Medicine.

2nd. The SCHOOL OF LAW, in Baltimore, Md. This School, founded in 1812,and reorganized in 1869, is designed, by means of a course of study coveringthree years, to qualify its students for the degree of Bachelor of Laws, and foran intelligent practice of the law. It represents the Department of Law.

3rd. The DEPARTMENT OF DENTISTRY was organized in 1882, and is designedto teach the art of dentistry as an integral part of the SCHOOL OF MEDICINE,The course of study leading to the degree of Doctor of Dental Surgery coversa period of three years.

4th. The DEPARTMENT OF PHARMACY was established in 1840 as the Mary-land College of Pharmacy, and affiliated with the SCHOOL OF MEDICINE in 1904.The course of study, including thorough training in the art of dispensing andmethods of proper selection of drugs, covers two years, and leads to the degreeof Doctor of Pharmacy.

5th. The COLLEGE OF LIBERAL ARTS, at Annapolis, Md. ST. JOHN'S COLLEGE,

Annapolis, founded in 1696 as King William's School, has by affiliation becomethe Department of Arts and Sciences of the UNIVERSITY OF MARYLAND. Thecurriculum leads to the degree of Bachelor, or Master, of Arts and Sciences.

(a) Seniors in St. John's College may elect twelve requisite hours a weekin the Law School of the University. The degree of Bachelor of Arts orBachelor of Science is conferred upon such students at the end of the year.The Professional Degree may be reached in two years more.

(b) Students who have completed the Junior Year in St. John's Collegeand who have made an approved choice of electives may, if they desire, dothe entire work of the Senior Year in the Medical School of the University.If they successfully complete the work of the first medical year, they aregraduated with their class with the degree of A.B. from St. John's College.

By taking advantage of this privilege, a man may complete the Undergrad-uate and Medical courses in seven years.

During three of these years, or until he has completed the work of the JuniorClass, he is a resident student in St. John's College, and for four years he is aresident in the Medical School in Baltimore.

At the end of the fourth year, he receives the A.B. degree, and at the endof the seven years the M.D. degree, but credit from the Medical School cannotbe accepted in subjects for which credit has already been given in the College•of Liberal Arts.

This association has been established for sixteen years past in the Universityand has been attended with success ever since its organization.
