The Overview
Three-hour licensing procedure was issued by IndonesianInvestment Coordinating Board (BKPM) on January 30, 2017. Thisis a good news for foreign investors related to energy and mineralresources. This rapid licensing procedure is given for nine types ofoperations (eight of which are for oil and gas sectors and one ofthem is for electricity procurement industry).

The nine types of operation in the field of energy sectors that are served by the three-hour licensing service include:
1. Temporary business license for LPG (oil, fuel, liquefied petroleum gas).
2. Temporary business license for CNG (storage of processed products or compressed natural gas).
3. Temporary business license for LNG (liquefied natural gas).4. Temporary business license for Oil residue processing industry.5. Temporary business license for General trade of oil and fuel.6. Temporary business license for General trade of processed
products.7. Temporary business license for Oil refining.8. Temporary business license for Natural gas processing, and.9. Temporary business license for Electricity procurement industry.

This new system is expected to boost the investment inIndonesian energy sectors because similar licenses usuallytake between 20 to 45 business days to complete if they aredone through the regular service in BKPM—which oftenrequires companies to deal with complicated bureaucracysystems. This is often considered overwhelming,especially when there is some error in the documents as thecompany has to start the process from the very first step dueto the unavailability of license or document revision policy.

The issuing of the three-hour license service is an effort doneby the government of Indonesia that expects to improveforeign investment in this field. Although it is also said thatinvestors may still experience several challenges, including thetransportation and difficult topography in Indonesia that makethe transportation and distribution cost becomes extremelyexpensive. Infrastructure is also noted to be another obstaclethat should be improved by the government.

However, this government’s attempt to cut the bureaucracyprocedure in licensing, especially in the energy sector is seen tobe a fresh air for the foreign investors.Companies of those nine categories can obtain the licenses ifthey can fulfill all of the documents and technicalrequirements that are set to be the administrativerequirements, as written in the Decree No. 15/2016, issued bythe Ministry of Energy and Mineral Resources, concerning thethree-hour licensing service, especially for infrastructure in thefield of energy and mineral resources.
