News Briefs from Washington FFIEC Issue Policy Statement on Examination Reports As part of its ongoing exam modernization initiative, the Federal Financial Institutions Examination Council last week issued a policy statement aimed at promoting clarity and consistency of examination reports. The policy statement—which is intended to reduce regulatory burden for community banks—includes principles that “set forth minimum expectations of what should be included in all reports of examination (ROE).” Among other things, the principles establish that all ROEs should present conclusions and issues in order of importance; document the condition and risk profile of the institution; discuss the adequacy of the institution’s risk management practices; and document issues of supervisory concern or warranting prompt corrective action. Concurrently, the agencies are rescinding their 1993 Interagency Policy Statement on the Uniform Core Report of Examination. Read the policy statement.

Op-Ed Challenges Efforts to Open Investor Capital to Credit Unions On the eve of the largest credit union industry lobbying event of the year, a Newsmax op-ed columnist Friday argued against a rule change being considered at the National Credit Union Administration (NCUA) that would allow institutional investments in credit unions. “At their core, credit unions are not-for-profit cooperatives, set up so their customers are ultimately the decision-makers for the institutions,” wrote Drew Johnson, senior fellow at the National Center for Public Policy Research. “Investor capital could change all of that.” He added that institutional investors—including pension funds, mutual funds, insurers and hedge funds—are most likely to be attracted to large and fast-growing credit unions, which would further widen the gap between the largest bank-like credit unions and small, focused institutions. Specifically, Johnson argued, credit union management is likely to be more attuned to large institutional investors than to a single member-owner, and facilitate large credit unions growing out of sync with their statutory mission. “Unless the NCUA does something to change the current trend, credit unions will be little more than a group of billion-dollar actors in search of profits while exploiting their not-for-profit structures,” he wrote. IRS Releases ‘Dirty Dozen’ List, Common Tax Season Scams The Internal Revenue Service (IRS) recently released its 2019 “Dirty Dozen” list of common tax scams, reporting phishing as one of the most common tactics used to commit tax fraud. The agency urged taxpayers to be on the lookout for new variations of phishing schemes, unscrupulous tax return preparers, and scams related to identity theft during the 2019 tax season. Read news release. The IRS issues its annual “Dirty Dozen” scam list to raise awareness on common scams taxpayers may encounter during the filing season and provide tips to avoid them. Educational Foundation Awards $22,000 in College Scholarships The NBA is pleased to announce the 2019-2020 Nebraska Bankers Educational Foundation (NBEF) William B. Brandt Memorial Scholarship winners. Each recipient will receive a $2,000 scholarship to continue theireducation at the state or privately funded Nebraska college or university in which they are enrolled.

The NBA extends our gratitude to the Brandt family and the many other banks and bankers who have made these scholarships possible through financial gifts to the foundation. As the fund had grown with recent contributions, the NBEF was able to add two additional scholarships for this year!

In addition, thank you to the bankers who took time to write recommendation letters for these Nebraska students. The selection process was very difficult as always with many high-quality applicants. Compliance Alliance Q&A Q: We have a question on a loan that is a refinance of a purchase ofa second home and is adding funds to pay off personal credit cards. Should be report the HOEPA Status as "Code 3 - NA"?

A: Assuming the loan is just secured by the second home and is not also secured by the principaldwelling, then yes, it should be reported as "Code 3 - NA" like you said. The reason for this is that HOEPA only applies to: ...a high-cost mortgage, which is any consumer credit transaction that is secured by the consumer's principal dwelling... https://www.consumerfinance.gov/policy-compliance/rulemaking/regulations/1026/32/

So, the HOEPA rules do not apply to this particular loan and, thus, it would be reported as not applicable for HMDA purposes.

Banking Industry to Donate $173,167 to the University of Nebraska The NBA’s University Foundation Allocation Committee made the following allocations for 2019-2020:

UNIVERSITY OF NEBRASKA - LINCOLN — $96,000 Department of Agricultural

Economics Internship Program - $75,000 Based upon program criteria, the UFAC awarded $2,500 scholarships for seniors, $2,000 scholarships for juniors, $1,500 scholarships sophomores, and $1,000 merit-based scholarships for freshmen students majoring in agricultural finance and banking. Since 2005, UFAC has funded scholarships for UNL’s Ag Econ internship program in the amount of $860,500.

COB Department of Finance Scholarship Program - $11,000 UFAC awarded five $2,000 scholarships and one $1,000 scholarship for juniors and/or seniors majoring in finance, banking, or business. Since 2008, UFAC has funded 91 scholarships for UNL CBA students in the amount of $146,500.

COB Professorship/Faculty Fellow - $10,000

UNIVERSITY OF NEBRASKA - OMAHA — $24,000 NBA Honors Program and NBA Distinguished Scholarship Award Program - $19,000

UFAC awarded three $1,000 scholarships for students with up to 30 hours who have demonstrated an interest in finance and/or banking; two $2,000 scholarships to students with 30 or more hours who have declared a major specialization in finance and/or banking; and four $3,000 scholarships to students with 58 or more hours who have declared a major specialization in finance and/or banking. Since 1995, UFAC has funded 153 scholarships for UNO finance and/or banking students in the amount of $314,500.

NBA Professorship - $5,000

UNIVERSITY OF NEBRASKA - KEARNEY — $24,000 CBT Scholarship Program with Focus on Banking-Related Careers - $24,000

The committee awarded 27 scholarships for students who are demonstrating a commitment to pursuing banking-related careers in Nebraska: six one-year $750 scholarships for freshmen; six one-year $750 scholarships for sophomores; seven one-year $1,000 scholarships for juniors; and eight one-year $1,000 scholarships for seniors. A total of 279 scholarships have been funded for the UNK College of Business & Technology banking program since 2010 in the amount of $274,500.

The U.S. is dealing with burdensome stocks following six years of record production in both corn and soybeans. That has weakened our hand not only in trade discussions, but also on the global export market. Darin will take a look at the most recent Quarterly Stocks numbers (released on March 29, just a few days before the conference) marking the end of the second quarter for corn and soybeans 2018-2019 marketing year. Given the latest information on quarterly stocks, trade issues, and possible spring acreage Darin will discuss what it all might mean for the rest of the 2018-2019 marketing year. He’ll also look at what price is telling us about what old-crop ending stocks might actually be. This helps us outline possible risk management strategies not only for leftover old-crop but looking ahead to new-crop as well.

The beef, pork and poultry industries are set up for an increase in production during the course of the next few years. This increase in supply will result in price weakness unless demand is stable domestically and growing internationally. The grain sector, in many ways, is faced with the same challenge. Many farmers and ranchers are asking the question of what should we expect for price risk during the course of the next few years for any of the livestock or grain commodities? And what strategies should we employ to protect against this price risk.

11:30 a.m. "Overview of Technologies in Agriculture and Potential Effects on Profitability” Joe Luck, Ph.D., P.E., Associate Professor and Precision Agriculture Engineer, UNL

Technology adoption in agricultural operations was exceptionally high when commodity prices were at all-time highs recently. Since that time, adoption has slowed, and many producers have focused on how to best deploy such systems to optimize productivity in their operations. This presentation will provide an overview of technologies that may effect on-farm profitability and present case studies that demonstrate how to use data collected to drive implementation decisions.
