After graduating from Stetson School of Law, Harvey was employed by the State Attorney’s Office. As a state prosecutor, Mr. Cohen handled thousands of criminal cases. He conducted over 40 jury trials, countless motion practice and depositions. Mr. Cohen branched out as a solo practitioner without staff or associates. He has been able to grow his firm to over 50 employees, including 16 attorneys.  In 2004 and 2005 during the many hurricanes we had here in Florida, Mr. Harvey V. Cohen started representing hurricane damage cases. Mr. Cohen, met with some restoration companies and thought of a way to teach them assignment of benefits so that they could get paid directly from insurance companies, just like medical doctors and Pip suits. Mr. Cohen, has literally handled thousands of insurance claims. Mr. Cohen is a great supporter of the Leukemia Lymphoma Society.  Mr. Cohen, continues to work with the restoration industry and the legislature in Tallahassee. Mr. Cohen also collaborates with the consumer advocate office and the chief financial officer’s office regarding insurance issues and consumer protections. In 2013, Cohen Battisti Attorneys went to Tallahassee to fight against anti-consumer-based legislation that tried to do away with the assignment of benefits by introducing the House Bill 909 and Senate bill 1600.

How long does the insurance company have to pay my claim?

Answer: Most insurance policies have a provision which states a time frame

for payment of claims. However, if you review these provisions they will typically read as follows:

"We will pay your claim within 20 days of the date you and we reach an agreement in writing or 30 (or 60) days after entry of an appraisal award or entry of a final judgment". The foregoing language may not be the precise language of your policy, but it does contain the essence of the policies often seen in Florida.
