1 Background and this Report 1.1 Overview and Update of the RP

The loan for $100 million was approved by ADB Board on 11 September 2015 for the Hubei Enshi Qingjiang River Upstream Rehabilitation Project (Loan No. 3277-PRC). The Project is located in Enshi City and Lichuan City consisting of four components: (i) improvement of wastewater management; (ii) enhancement of flood management; (iii) integration of water and environmental management; and (iv) strengthening of inclusive capacity development.

Based on the requirements of the Safeguard Policy Statement (2009) of ADB, the PMO of Enshi Prefecture prepared the RPs for Enshi City and Lichuan City respectively during the PPTA, which were approved by ADB in November 2014.

According to RP dated November 2014, the main resettlement impacts of Lichuan subproject are permanent collective rural land acquisition, permanent land acquisition of state-owned land and rural house demolition. 607.395 mu of land will be permanently occupied by the subproject, including 497.8 mu of collective land, 109.6 mu of state-owned land. 855.2 mu of land will be temporary occupied, including 522.54 mu of state-owned land and 329.7 mu of collective construction land. 6300m2 of rural houses will be demolished. In total, 694 HHs (HHs) with 2,925 persons are affected, of which, 679 HHs with 2,862 people will be only affected by land acquisition, 15 HHs with 63 persons will be only affected by house demolition.

According to the agreement with ADB, the RPs should be updated based on the final design and the detailed measurement survey (DMS) of land acquisition and resettlement (LAR), and be approved by ADB prior to the commencement of civil works.

According to the procurement plan, the Lichuan Subproject has 8 civil works contracts. The preliminary design / contraction drawing design (detailed design) is carried out by the contract packages. The RPs therefore will be updated as per the completion of detailed design and resettlement detailed measurement survey of contract package.

In July 2017, the Lichuan PMO updated the RP for LC01. However, due to the failure to reach the agreement with the bid winner, Hangzhou Municipal Engineering Company, LTD to sign construction contract and after consultations with the ADB, the LC01 was repackaged with the Wastewater Collection Pipeline for Yuanbao River as the LC10, which will be re-procured. In December 2017, the Lichuan PMO updated the RP for the repackaged LC10, and submitted it to ADB for review.

In April 2017, the detailed design for Contracts LC03, LC04, LC05, LC06 and LC07 was completed.

During October-December 2017, the Lichuan PMO organized the related agencies carrying out the resettlement DMS for LC03, LC04, LC05, LC06 and LC07 based on final design. The tentative schedule for the remaining contract packages involving in land acquisition and resettlement are as follows per the current project implementation plan.

1.2 Description of Contracts and Overview of Resettlement Impacts

Generally, the final design of Contracts LC03, LC04, LC05, LC06 and LC07 has changed slightly as compared to that in the feasibility study report.

According to the DMS, the main type of resettlement impacts of the above contracts is LA. It is expected that 449.5 mu of collective land will be acquired additionally, affecting 583 households with 2,502 persons. No house demolition is involved. See Table 1-2.

1.3 This Report

The resettlement policies and compensation rates have not varied. Therefore, the resettlement impacts, budget and implementation schedule are updated in this report, which should be read together with the RP approved by ADB in November 2014.

Compared to the former RP, the resettlement impacts of Contracts LC03, LC04, LC05, LC06 and LC07 have changed slightly. See Table 1-3.

The LA area has been reduced mainly because some river segments have been managed by the Lichuan Municipal Water Resources Bureau using domestic funds and are not included in the Subproject.

2 Impacts of Contracts LC03~07 According to the detailed design and the DMS, the main type of resettlement impacts of the

above contracts is LA. No house demolition is involved. 2.1 LA

449.5 mu of land will be acquired for Contracts LC03~07, including 310.7 mu of cultivated land, accounting for 69.1%, 66.3 mu of garden land, accounting for 14.8%; 10.2 mu of woodland, accounting for 2.3%; 62.3 mu of unused land, accounting for 13.9%, affecting 583 households with 2,502 persons. See Table 2-1.

See Appendix 1 for specific LA impacts of the contracts.

2.2 Temporary Land Occupation

The temporary land occupation will be induced by the construction of wastewater collection pipeline for Yuanbao River in LC03. The pipeline for Yuanbao River will be buried in the ecological protection zone of the banks of Yuanbao river together with River Management, involving no extra temporary land occupation. 2.3 LA Impact Analysis

LA for Contracts LC03~07 will affect 20 administrative villages in 4 townships / sub-districts (Duting and Dongcheng Sub-districts, and Liangwu and Yuanbao Xiangs), Lichuan City. These villages have 10,116 mu of cultivated land in total, in which 310.7 mu will be acquired for Contracts LC03~07, with an overall land loss rate of 3.1%.

The per capita net income of farmers of the affected villages in 2016 was within the range of 4,500-5,800 yuan, in which agricultural income accounts for 10%~20%. It is expected that income loss rates arising from LA will be less than 10%.

In general, since the acquired land is distributed linearly along rivers, the AHs will suffer some land and income losses, but their livelihoods will not be affected. Their lost income can be made up through cash compensation, and direct or indirect employment.

3 Resettlement Policies and Compensation Rates 3.1 Policies and compensation rates for LA

LA compensation includes land compensation, resettlement subsidy, and compensation for young crops and ground attachments, and is based on location-based composite land price.

The LA compensation rates are based on the Notice of the Hubei Provincial Government on Disclosing Uniform AAOV Rates and Location-based Land Prices for Land Acquisition of Hubei Province (HPG [2014] No.12), and the Implementation Measures for Collective Land Acquisition and House Demolition in the Urban Area of Lichuan City (LMG [2015] No.4). See Table 3-1.

The LA compensation rates have not varied from those in the former RP.

4 Livelihood Restoration The resettlement objective of the Subproject is to ensure that the APs receive compensation for

their full losses, and proper resettlement and restoration, so that they can share the benefits of the Subproject, and that subsidies are granted to help them overcome temporary difficulties, and restore their income and living levels, and the affected entities’ productivity and profitability are improved or at least restored to the pre-subproject level.

As discussed above, Contracts LC03~07 will have minor LA impacts, so the APs’ livelihoods will be almost unaffected. The main livelihood restoration measures are: 1) cash compensation; and 2) giving priority to the APs in training and employment.

5 Resettlement Agencies 5.1 Organizational Structure

The resettlement agencies are consistent with those in the RP. The Enshi Prefecture PMO is responsible for project implementation and resettlement. In

March 2016, the Enshi Prefecture PMO and resettlement expert Yin Jianjun entered into a consulting contract (CS3-2), where the resettlement expert would assist the Enshi Prefecture PMO in preparing the final RP and progress reports, and providing relevant training.

The Lichuan PMO is responsible for the implementation and resettlement of the Lichuan Subproject.

The LAR of Contracts LC03~07 will be implemented by the Lichuan Resettlement Office, and the affected township governments / sub-district offices, and village committees. 5.2 Institutional Capacity and Training

With the assistance of the Enshi Prefecture PMO, the resettlement expert trained 50 resettlement staff members of Enshi and Lichuan Cities in September 2016, covering:

Internal resettlement monitoring mechanism; ADB’s resettlement policy and experience; ADB’s resettlement M&E; Key points of the RP; and Key points in resettlement implementation, etc.

Through training, the staff has a better understanding of ADB’s involuntary resettlement policy

and becomes more capable of handling LAR affairs.

6 Public Participation and Grievance Redress 6.1 Public Participation

According to the applicable policies and regulations of the PRC, Hubei Province, Enshi Prefecture and Lichuan City, it is very necessary to conduct public participation at the preparation and implementation stages in order to protect the lawful rights and interests of the APs, reduce grievances and disputes, and realize the resettlement objectives properly by developing sound policies on resettlement, preparing an effective RP, and organizing implementation properly.

1) PR updating stage During RP preparation, the Lichuan PMO, affected townships and villages, design agency and

external M&E agency disclosed subproject information, impacts and resettlement policies in diverse ways to the APs. During October-December 2017, the Lichuan PMO conducted a DMS according to the detailed design, and conducted extensive participation and consultation to incorporate the APs’ comments and suggestions.

7 Resettlement Investment 7.1 Estimated Resettlement Budget

Based on prices in 2017, the estimated resettlement budget is 44.69.6 million yuan, including LA compensation of 21.099 million yuan (47.2%), and other costs (including management costs, M&E costs and contingencies) of 23.596 million yuan (52.8%). See Table 7-1.

By contract, the resettlement budget of LC03 is 107,000 yuan, accounting for 0.4%; that of LC04 14.934 million yuan, accounting for 33.4%; that of LC05 11.384 million yuan, accounting for 25.5%; that of LC06 7.548 million yuan, accounting for 16.9%; and that of LC07 10.629 million yuan, accounting for 23.8%.

7.3 Fund Management

Resettlement funds will be disbursed on the following principles: All costs related to LA will be included in its general budget, and disbursed before resettlement. Resettlement funds must be disbursed in strict conformity with the applicable state regulations and the RP, and the compensation rates should not be lower than those specified in the RP.

In order that resettlement funds are available timely and fully to ensure the restoration of the production level and living standard of the AHs, the following measures will be taken:

All costs related to resettlement will be included in the general budget. Financial and supervisory agencies will be established at different levels to ensure that all

funds are fully and timely available. The resettlement budget may be increased due to the change of the project area, the

modification of the compensation rates and inflation, but the IA will ensure that compensation fees are fully paid.

In addition, the municipal finance and audit departments have the power to monitor and audit the use of resettlement funds. The external M&E agency will perform follow-up monitoring on the availability of compensation fees for the AHs during external monitoring.

8 Resettlement Implementation and M&E 8.1 Resettlement Implementation

According to the construction schedule, Contracts LC03~07 will be constructed from April 2018 to October 2019. In order to coordinate resettlement with construction, information disclosure and public participation began in October 2017, and LAR will begin in April 2018 and end in April 2019. 8.2 Resettlement M&E

The LAR of Contracts LC03~07 will be subject to internal and external monitoring. 1) Internal monitoring The Enshi Prefecture and Lichuan PMOs will establish an internal monitoring mechanism and a

basic resettlement database to monitor resettlement activities. The Enshi Prefecture and Lichuan PMOs will submit an internal monitoring report to ADB

quarterly. Such report should indicate the statistics of the past 3 months in tables, and reflect the progress of LA, resettlement and use of compensation fees through comparison.

2) External monitoring The Enshi Prefecture PMO will appoint an independent M&E agency to monitor resettlement

implementation. Shanghai Yiji Construction Consultants Co., Ltd was engaged in April 2017 as resettlement M&E agency.

On this basis, the M&E agency will submit monitoring and evaluation reports to ADB semiannually.

A routine monitoring report should at least include the following: 1) subjects of monitoring; 2) progress of resettlement; 3) key monitoring findings; 4) key existing issues; and 5) basic opinions and suggestions.

Based on construction and resettlement implementation progress, the external monitoring schedule for Contracts LC03~07 is detailed in Table 8-1. And 2 external monitoring reports have been submitted to the ADB by the Monitor.
