REPEATEDLYREACHED AND GRABBED FOR THE PASSENGERS FLOOR BY HIS DOOR AND REFUSED TOCOOPERATE AND FOLLOW DIRECTIONS. ABOVE DEF. DID EXIT THE ABOVE VEH. FROM THEDRIVERS SIDE AS OFFICERS WALKED DEF. TO THE PATROL VEH. ABOVE DEF. DID BECOMEAGGRESSIVE AND BEGAN TO PUSH AND PULL OFFICERS. ABOVE DEF. DID GRAB OFFICER L.WOODS AND TACKLED OFFICER TO THE GROUND. AFTER NUMEROUS ATTEMPTS AND ASTRUGGLE, OFFICERS WERE ABLE TO DETAIN DEF. OFFICER L. ROACH DID RECOVER A 1 1/2FOOT TO 2 FOOT WOODEN STICK WITH A BLACK HANDLE FROM SIDE DOOR OF PASSENGERSEAT OF VEHICLE. OFFICER L. WOODS WAS SEEN AND TREATED AT ECMC FOR HIS INJURIES.ABOVE DEF. WAS TAKEN TO ECMC. FOR A MENTAL EVALUATION (941).DEF. CHRISTOPHER URBANCZYK WAS ARRESTED BY A DISTRICT OFFICERS JOHNSON ANDWOODS AND CHARGED WITH: PL 240.20-1,2,3, LOC69-1,2, PL 205.30, PL 265.01-2, PL 120.05-3**CLEARED WiTH ONE ARREST.

On 4-11-10 @ 2145hrs I was involved in a traffic stop in which an irrational person tackled me to theground which caused injury to my right leg. I was seen @ ECMC and checked for abraisions andbruising. I was ordered to follow-up w/occupational therapy if any pain or issues with walking arriselater. Dr. stated to return and remain on duty 4-11-10.

240.20-1,2,3 Disorderly ConductIn that the defendant, while at Smith and South Park, did intentionally cause and recklessly create a risk ofpublic inconvenience, annoyance and alarm·by-engagiAg in-violent and tumultuous behavior, by makingunreasonable noise and by using abusive and obscene language while at Smith and South Park, a publicplace, in that the defendant did while at Smith and South Park, while seated in the front passenger seat ofa 1994 Nissan, NY reg. EVT2286, wave at officers and did hold up a can of beer and drink from same andafter officers stopped and approached the vehicle the defendant did slam the beer to the vehicle floor anddid begin punching the dash board of the vehicle and did yell and scream, "I hate the Police. Fuck thePolice. I hate my life." and after exiting the vehicle did fight with officers, said conduct causing persons toapproach this location and causing annoyance and alarm to numerous persons in this area.

69/69·1,2 Drinking in Public Places and Vehicles - Prohibited .In that the defendant did possess and did drink an alcoholic beverage, to wit, Labatt's beer, in a movingvehicle, in a public place, to wit, at Smith and South Park, in that the defendant did while at Smith andSouth Park, while a front seat passenger in a 1994 Nissan, NY reg. EVT2286. have in his possession andunder his control a 12 ounce can of Labatt's Blue beer and did wave same at officers and did drink fromsame in full public view and was observed doing same by officers .

. 265.01-2 Criminal Possession of a Weapon in the Fourth DegreeIn that the defendant, while at Smith and South Park, did knowingly possess a dangerous instrument withthe intent to use the same unlawfully against another, in that the defendant did while at Smith and SouthPark, when the 1994 Nissan, NY reg. EVT2286 in which he was a passenger was stopped after he wasobserved drinking from a 12 ounce can of Labatt's Blue beer, have in his possession and under his controlan axe handle with black tape on one end which was recovered from the passenger side of this vehiclebetween the door and the seat and the defendant did reach for this weapon repeatedly while officers wereordering him to exit this vehicle, Weapon recovered and submitted for evidence by P.O. LashondraRoach.

205.30 Resisting ArrestIn that the defendant, while at Smith and South Park, did intentionally attempt ot prevent P.O. DustinJohnson, a Police Officer, from effecting the authorized arrest of Christopher S. Urbanczyk, in that thedefendant did while at Smith and South Park, after being placed under arrest for Drinking in Public andDisorderly Conduct, fight and struggle with officers and did push, shove and grab officers and did tackleP.O. Lance Woods and pull him to the ground causing injury and had to be forcibly subdued andhandcuffed with the aid of a chemical agent spray.
