Attachment B - Program Description

PROGRAM DESCRIPTION

1. Introduction and Project Necessity

1.1 Introduction: CMN is an accredited, tribally controlled, two-year community college. TheCollege serves the Menominee Nation, neighboring tribal nations, and surroundingcommunities. The main campus is located on the Menominee Reservation in Keshena,Wisconsin, with a second campus location near the Oneida Reservation. In 2003, ten-yearaccreditation was granted. In 2008, CMN was approved for a change in degree status toprovide a baccalaureate program in Elementary Education, with a focus in Science and Math.CMN now offers 1 baccalaureate degree program, 15 associate degree programs, five one-yeartechnical diplomas, and three certificate programs. An Associate of Science degree program inPre-Engineering and Materials Science is set to begin Fall 2010. CMN serves approximately650 students each semester; the majority of whom are degree-seeking students. The bulk ofCMN's student body is Native American and female.

1.2 Summary of Prior Results: In July 2007, CMN was awarded a grant from the NRC todevelop the President's STEM Leadership program at CMN. This project focused on servinghigh achieving Native American STEM majors, providing those students with scholarships,developing their leadership skills, and utilizing those skills to mentor other Native AmericanSTEM students.

The NRC Presidents STEM Leadership Program has also allowed CMN to develop a system foraddressing high-ability student needs by offering high-level math and science coursework. Itfacilitated the establishment of STEM Leadership Team to define criteria for student programacceptance, academic and behavioral reporting processes, and promotion and coordination ofsummer research internships. CMN has also used these high-ability students to re-establish anAmerican Indian Science and Engineering Society (AISES) higher education chapter to providesupport for each other and recruit other high-ability STEM students at various high schools inthe surrounding areas. The cohort groups have established the recognition and visibility whilepresenting CMN at national conferences and local high schools. The STEM LeadershipProgram is gaining visible recognition for CMN and NRC as these students successfully movealong into the various four-year institutions via summer internships or baccalaureate degrees.

To date, fourteen students have participated in this program. The program has retainedapproximately 78.5% of the 14 students, with over 92% continuing in higher education. Only onestudent has not either returned, continued their education outside the program, or will return,

* after participating in our Leadership program.

1.3 Proiect NecessityNeed to increase STEM recruiting efforts: In 2003, College of Menominee Nation began itsstrategic pursuit to enhance STEM programming. In seven years, the college has been able to

significantly advance the academic programs available to underrepresented minority students.During this time, the number of students majoring in STEM has more than quadrupled,documenting both student interest and quality academic content.

However, CMN's fiveSTEM degree programs make up 25% of CMN's academic programming. Although CMNrecently reached a successful milestone by documenting 25% of its enrollment in STEM majors,approximately 60% of the STEM majors were disproportionately enrolled within CMN'sBiological Science program and only a handful were enrolled in the Mathematics andSustainable Development degree programs. In Fall 2010, CMN will begin its first cohort ofstudents for the Pre-engineering/Materials Science program, which could potentially decreasethe number of Mathematics majors as well. In order for CMN to support, sustain, and advancethese advanced STEM programs, it is critical to increase the enrollment numbers within theseprogram areas. Increased recruitment is essential to achieving this objective.

Need for Student Support, Extra-Curricular Activities, and Leadership Activities: TheAmerican Association for the Advancement of Science (AAAS) identified post-secondarysupport programs that increase undergraduate retention as a key factor that facilitatesprogression of underrepresented minorities in STEM fields (AAAS, 2001). Success of CMN'sSTEM cohorts is deemed as one of the most essential aspects of this project. The need toensure their success literally drives the project in order to guarantee the long-term success ofthe STEM academic programs as well as to ensure successful transition of theseunderrepresented students in baccalaureate granting institutions and ultimately into NRC-prioritized careers. To date, CMN has piloted several intervention projects that have been basedon best-practice research in other minority serving institutions but tweaked to fit the uniquesituation within a tribal college setting. The interventions have been piloted at CMN withincoming high school students as well as older non-traditional students with and withoutfamilies; they have also been piloted with high achieving students as well as low achievingstudents. Regardless of the student population, the interventions have resulted in significantstudent retention and persistence over those not receiving prescribed interventions. Suchinterventions have included: tutoring, learning assistance, research, travel, professionalactivities, cohort activities and leadership activities. The intent of the NRC project is to takethese piloted interventions, make them available to all STEM students and integrate them intothe fabric of CMN's STEM programming.

2. Project Goals, Objectives, Strategies, Timeline, and Impact

2.1 Goals: The project goal is to prepare and pipeline underrepresented students into STEMcareers and those relevant to nuclear safety, security, and environmental protection.

2.2 Obsectives: CMN has three core objectives that will achieve the project goal. They are:" By June 2014, to increase the number of underrepresented students majoring in

* By June 2014, to increase the graduation rate of CMN's STEM cohorts by 10%.

2.3 Strategies & Methodology:Objective One: Increased recruiting efforts are a major strategy under objective one. At thistime, CMN has only one recruiter who must provide insight on all CMN programs to all regionalschools as well as to various adult populations. With the ever increasing STEM programming atCMN and the increased need to sustain these programs, CMN has prioritized the hiring of aSTEM focused recruiter for the NRC project. The recruiter will coordinate recruiting activities atregional schools, regional recruiting venues and events, and in local STEM focused youthprograms such as College of Menominee Nations long-term summer middle school youthprogram called STI. Because the recruiter will focus on STEM programs and work with STEMstaff and faculty, they will have an intimate knowledge of available programming and supportsystems to encourage students to enroll. The new position will also promote the NRC and thecareer opportunities the nuclear industry can offer.

Objectives Two and Three: Two strategies have been identified to achieve objectives two andthree. Strategy one focuses on providing critically needed STEM student support activities. Asa minority serving institution, CMN has worked extensively with underrepresented students.This experience has resulted in a number of piloted initiatives that have established evidencebased support activities necessary for student success and achievement. Provision of a STEMAcademic Advisor is one of the foundational support activities necessary for STEM studentsuccess. The Advisor will possess extensive knowledge on the STEM programs and activitiesto better guide STEM majors. She will only see STEM majors which will also allow her to assistand encourage STEM students to participate in meaningful STEM extra-curricular activities,including the coordination of internships and research opportunities. She will also assist withstudent travel and AISES chapter activities. Her time will start at 5% and increase by 5% everyyear with the expected increase in STEM students.

Additional student support systems focus on tutoring and learning assistance. Many of ourunderrepresented students are underserved, having graduated from poverty-stricken schools.Anywhere from two-thirds to three-fourths of the entering freshman students are placed inremedial coursework, indicating a significant need for supplemental instruction. CMN intends toutilize NRC funds to provide a double safety support net to needy students. This will beaccomplished by providing learning assistants in the classroom. These individuals attend high-need classes and offer their assistance to students before and after class to increase studentlearning. Their services will be further enhanced with the availability of professional tutors whowill be able to provide one-on-one tutoring.

The last strategy under objectives two and three is to coordinate STEM student extracurricularand leadership activities. Part of this strategy is the facilitation of STEM student researchopportunities. There is a particular need to create more opportunities in field research wherestudents not only benefit from the hands-on learning experience, but are also able to experiencethe importance of their (STEM) work to the community as a student, as well as visualize howthey can continue to benefit society upon completion of their educational goals. Each researchopportunity will be assessed to ensure that STEM learning outcomes are an integral componentof each learning experience outside of the classroom.

Additional extracurricular and leadership activities will focus on providing students exposure toopportunities and experiences beyond CMN, beyond Keshena, WI, and beyond what they havealways known. This includes student travel to major research labs and major STEM studentassociation meetings, such as AISES which will help students understand the options open tothem, increase student participation with external opportunities, better prepare them for thetransfer into a baccalaureate degree granting institution, and ultimately increase student

retention rates. CMN will encourage these students to become active leaders within theinstitution, serving as high achieving role models.

3. Project Impact

3.1 Project Impact: CMN serves approximately 650 students each semester; the majority ofwhom are degree-seeking students. The bulk of CMN's student body is Native American, non-traditional, and female. 95% of the College's students receive financial aid. CMN's project willdirectly benefit over 160 to 300 underrepresented and underserved students majoring in STEMfields each year. CMN is a clear first step for American Indians pursuing a STEM education.This particular project will not only have a significant impact at CMN, but will also impact transferuniversities and the Nation in general. Project objectives and strategies will also result in thefollowing anticipated impacts including 1.) Increasing the number of underrepresented STEMmajors, 2.) Increasing STEM student retention, 3.) Increasing the number of underrepresentedSTEM graduates, 4.) Increasing the number of underrepresented students who enroll inbaccalaureate degree granting institutions, 5.) Increasing the number of underrepresentedminorities entering the STEM workforce. All of which are part of CMN's short term, mediumterm and long term goals as illustrated below.

4. Management Structure, Key Personnel, and Advisory Board -

4.1 Management Structure: The College has developed a project management process thatcorresponds to strategic goals, assures on-time completion, and provides the highest quality forthe completed project. College of Menominee Nation employs several management proceduresand governance protocol in projects to ensure effective and efficient project implementation.

Project Management Team: The cornerstone of our success is our team-based approach tothe development and management process. This practice will include in-depth involvement ofthe Project Investigator, who has overseen and coordinated a previous NRC project. Otherteam members include key CMN administrators from Student Services, Assessment ofLearning, Informational Technology and Academic Affairs. They along with staff and faculty fromthe Division of Letters and Sciences will work together in a collaborative process. The ProjectInvestigator, who reports to the President will carry overall responsibility for this project andprovide day to day oversight of project activities.

Fiscal Management College of Menominee Nation operates under fiscal management,property, personnel, and purchasing systems certified by a Certified Public Accountant asmeeting the requirements of the GAAP, OMB Management Circulars and the Single Audit Act.The Business Office is responsible for all fiscal transactions conducted by the College. They willwork closely with the Project Investigator and the Sponsored Programs Director on fiscalmanagement of the project. Every application for payment issued under the project will bereviewed and approved by the Project Investigator. Payments are verified against project fundsbefore payment is issued. The Business Office prepares monthly project budget reports to theProject Investigator for review. The college also has a Sponsored Program Director to assist inthe successful and timely administration of all grant related activities and reporting.

4.2 Key Personnel:

Project Investigator: Gary Besaw, Vice-President of Student Services will serve as ProjectInvestigator for the NRC project. Mr. Besaw has an M.S. in Education Administration, WisconsinCertification and extensive experience as both a K-12 Principal and Curriculum Director. Mr.Besaw has three years experience working with NRC under the President's STEM Leadershipproject. His responsibilities will include ensuring that the project is running on schedule and thatall strategies are completed. He will be responsible for the overall strategic management of theproject and will be involved in the design and implementation of each of the project components.He will also be heavily involved with completion of project activities. He will attend meetings asneeded with key staff, faculty, college administrators, College Board, and report to the CollegePresident on a monthly basis. He will also be responsible for NRC programmatic reportingrequirements. His time on this project is estimated at 20% throughout the project. A 3%increase in anticipated annually.

Other Staff: Additional personnel will be involved with the daily project activities and serveimportant coordination roles in the project. These positions include the STEM Advisor, STEMrecruiter, Faculty, Communication Specialist, Administrative Assistant, Professional Tutors andPeer Learning Assistants.

5. Institutional Commitment

5.1 Sustainability: CMN has pledged itself to accomplishing the objectives and strategiesoutlined in this proposal. The President has provided her support of the project as well ascommitted any additional college physical and human resources necessary to complete theproposed project (see letter). Additionally, the college has successfully coordinated an NRCfunded project over the last three years. These efforts are in the process of beinginstitutionalized, but the college must continue its strategic efforts to further increase theinstitution's STEM programming and services.

5.2 Dissemination: CMN has played a key role in facilitating the sharing and dissemination ofTribal College NRC project results during the annual NRC conference. CMN will continue itsleadership role in facilitating further dissemination to increase Tribal College participation inNRC funded projects. Annual project results will also be disseminated annually to the advisoryboards, CMN leadership committee, and faculty. This will assist in continued institutionalinvestment of the project. Additionally, CMN will disseminate the project plan, activities andresults to other key institutions upon request.

6. Project Evaluation

6.1 Evaluation: College of Menominee Nation has extensive experience coordinating programevaluations. The Advisory Board will play a key role in assessing the evaluation of the project;however all project staff will be involved somewhat. Overall, the evaluation will include a plandetailed with both process evaluations and formative evaluations.

The summative evaluation and analysis process will include reviewing data collected on a semi-annual basis. Interviews and surveys will be conducted and an overall project evaluation willdetermine the following: Was the project successful? How? Did the project meet the overallgoal? What standards were met? What components were most effective? Were the resultsworth the project's cost?

Additionally, a formative evaluation and analysis process to focus on project implementation andprogress will be conducted as well. The implementation evaluation phase will track whether theproject is being conducted as planned. Progress evaluation will determine to what extent projectgoals and objectives are being met. The formative evaluation activities will include thefollowing:

* Documenting the process of developing and implementing the program* Assessing the degree to which the project met its goals and the major learning from

project implementation* Determining the value of the project to students, faculty and partnering institutions

6.2 Performance Measures and Data Collection: The Advisory Board will review the projectdata collected no less than annually. Data will be collected continuously throughout the projectand placed in project specific databases developed to track project outcomes. Data will becollected by project staff as well as by Institutional Research. Key student data will be retrievedfrom CMN's Empower system to ensure accurate and detailed data. All data will be reviewed byInstitutional Research to ensure accuracy. Both the Institutional Research Director and theAdvisory Board will provide the essential unbiased review and evaluation of the project.

In conjunction with the Institutional Research Director, the ASL Committee will set long andshort term data collection and analysis goals for revised courses including persistence andcompletion rates. They will also continue to compile and analyze CAAP testing data. TheInstitutional Research Director will provide reports on the long and short term goals to the ASLCommittee no less than annually. All documents, e.g., course syllabi, program outcomes andcurriculum maps, Institutional Research Reports to the ASL Committee, are part of the ASLCommittee Official Record. 2. Award Package

§ 215.41 Grantee responsibilitiesThe Grantee is obligated to conduct such project oversight as may be appropriate, to managethe funds with prudence, and to comply with the provisions outlined in 2 CFR 215.41 Withinthis framework, the Principal Investigator (PI) named on the award face page, Block 11, isresponsible for the scientific or technical direction of the project and for preparation of theproject performance reports. This award is funded on a cost reimbursement basis not to exceedthe amount awarded as indicated on the face page, Block 16., and is subject to a refund ofunexpended funds to NRC.

The standards contained in this section do not relieve the Grantee of the contractualresponsibilities arising under its contract(s). The Grantee is the responsible authority, withoutrecourse to the NRC, regarding the settlement and satisfaction of all contractual andadministrative issues arising out of procurements entered into in support of an award or otheragreement. This includes disputes, claims, protests of award, source evaluation or other mattersof a contractual nature. Matters concerning violation of statute are to be referred to suchFederal, State or local authority as may have proper jurisdiction.

Sub-recipients, sub-awardees, and contractors have no relationship with NRC under the termsof this grant/cooperative agreement. All required NRC approvals must be directed through theGrantee to NRC. See 2 CFR 215 and 215.41.

Nondiscrimination(This provision is applicable when work under the grant/cooperative agreement is performed inthe U.S. or when employees are recruited in the U.S.)

No U.S. citizen or legal resident shall be excluded from participation in, be denied the benefitsof, or be otherwise subjected to discrimination under any program or activity funded by thisaward on the basis of race, color, national origin, age, religion, handicap, or sex. The Granteeagrees to comply with the non-discrimination requirements below:

Generally, Title VI of the Civil Rights Act of 1964, 42 USC § 2000e et seq, provides that it shallbe an unlawful employment practice for an employer to discharge any individual or otherwise todiscriminate against an individual with respect to compensation, terms, conditions, or privilegesof employment because of such individual's race, color, religion, sex, or national origin.However, Title VI, 42 USC § 2000e-1 (a), expressly exempts from the prohibition againstdiscrimination on the basis of religion, a religious corporation, association, educationalinstitution, or society with respect to the employment of individuals of a particular religion toperform work connected with the carrying on by such corporation, association, educationalinstitution, or society of its activities.

Modifications/Prior ApprovalNRC's prior written approval may be required before a Grantee makes certain budgetmodifications or undertakes particular activities. If NRC approval is required for changes in thegrant or cooperative agreement, it must be requested of, and obtained from, the NRC GrantsOfficer in advance of the change or obligation of funds. All requests for NRC prior approvalshould be made, in writing (which includes submission by e-mail), to the designated GrantsSpecialist and Program Office no later than 30 days before the proposed change. The requestmust be signed by both the PI and the authorized organizational official. Failure to obtain priorapproval, when required, from the NRC Grants Officer may result in the disallowance of costs,or other enforcement action within NRC's authority.

Lobbying RestrictionsThe Grantee will comply, as applicable, with provisions of the Hatch Act (5 U.S.C. §§1501-1508and 7324-7328) which limit the political activities of employees whose principal employmentactivities are funded in whole or in part with Federal funds.

The Grantee shall comply with provisions of 31 USC § 1352. This provision generally prohibitsthe use of Federal funds for lobbying in the Executive or Legislative Branches of the FederalGovernment in connection with the award, and requires disclosure of the use of non-Federalfunds for lobbying.

The Grantee receiving in excess of $100,000 in Federal funding shall submit a completedStandard Form (SF) LLL, "Disclosure of Lobbying Activities," regarding the use of non-Federalfunds for lobbying within 30 days following the end of the calendar quarter in which there occursany event that requires disclosure or that materially affects the accuracy of the informationcontained in any disclosure form previously filed. The Grantee must submit the SF-LLL,including those received from sub-recipients, contractors, and subcontractors, to the GrantsOfficer.

§ 215.13 Debarment And Suspension.The Grantee agrees to notify the Grants Officer immediately upon learning that it or any of itsprincipals:

(1) Are presently excluded or disqualified from covered transactions by any Federal departmentor agency;

(2) Have been convicted within the preceding three-year period preceding this proposal beenconvicted of or had a civil judgment rendered against them for commission of fraud or a criminaloffense in connection with obtaining, attempting to obtain, or performing a public (Federal,State, or local) transaction or contract under a public transaction; violation of Federal or Stateantitrust statutes or commission of embezzlement, theft, forgery, bribery, falsification ordestruction of records, making false statements, tax evasion, receiving stolen property, makingfalse claims, or obstruction of justice; commission of any other offense indicating a lack ofbusiness integrity or business honesty that seriously and directly affects your presentresponsibility;

(3) Are presently indicted for or otherwise criminally or civilly charged by a governmental entity(Federal, State, or local) with commission of any of the offenses enumerated in paragraph(1)(b); and

(4) Have had one or more public transactions (Federal, State, or local) terminated for cause ordefault within the preceding three years.

b. The Grantee agrees that, unless authorized by the Grants Officer, it will not knowingly enterinto any subgrant or contracts under this grant/cooperative agreement with a person or entitythat is included on the Excluded Parties List System (http://epls.arnet.,ov).

The Grantee further agrees to include the following provision in any subgrant or contractsentered into under this award:

'Debarment, Suspension, Ineligibility, and Voluntary Exclusion

The Grantee certifies that neither it nor its principals is presently excluded or disqualified fromparticipation in this transaction by any Federal department or agency. The policies andprocedures applicable to debarment, suspension, and ineligibility under NRC-financedtransactions are set forth in 2 CFR Part 180.'

Implementation of E.O. 13224 -- Executive Order On Terrorist FinancingThe Grantee is reminded that U.S. Executive Orders and U.S. law prohibits transactions with,and the provision of resources and support to, individuals and organizations associated withterrorism. It is the legal responsibility of the Grantee to ensure compliance with these ExecutiveOrders and laws. This provision must be included in all contracts/sub-awards issued under thisgrant/cooperative agreement.

Award Grantees must comply with Executive Order 13224, Blocking Property and ProhibitingTransactions with Persons who Commit, Threaten to Commit, or Support Terrorism. Informationabout this Executive Order can be found at: www.fas.orq/irp/offdocs/eo/eo-13224.htm.

Procurement Standards. § 215.40-48Sections 215.41 through 215.48 set forth standards for use by Grantees in establishingprocedures for the procurement of supplies and other expendable property, equipment, realproperty and other services with Federal funds. These standards are furnished to ensure thatsuch materials and services are obtained in an effective manner and in compliance with theprovisions of applicable Federal statutes and executive orders. No additional procurementstandards or requirements shall be imposed by the Federal awarding agencies upon Grantees,unless specifically required by Federal statute or executive order or approved by OMB.

TravelTravel must be in accordance with the Grantee's Travel Regulations or the US GovernmentTravel Policy and Regulations at: www..qsa..ov/federaltravelrequlation and the per diem ratesset forth at: www..asa..qov/perdiem, absent Grantee's travel regulation. Travel costs for thegrant must be consistent with provisions as established in Appendix A to 2 CFR 220 (J.53). Allother travel, domestic or international, must not increase the total estimated award amount.

Domestic Travel:Domestic travel is an appropriate charge to this award and prior authorization for specific tripsare not required, if the trip is identified in the Grantee's approved program description andapproved budget. Domestic trips not stated in the approved budget require the written priorapproval of the Grants Officer, and must not increase the total estimated award amount.

All common carrier travel reimbursable hereunder shall be via the least expensive classrates consistent with achieving the objective of the travel and in accordance with theGrantee's policies and practices. Travel by first-class travel is not authorized unlessprior approval is obtained from the Grants Officer.

International Travel:International travel requires PRIOR written approval by the Project Officer and the GrantsOfficer, even if the international travel is stated in the approved program description andthe approved budget.

The Grantee shall comply with the provisions of the Fly American Act (49 USC 40118) asimplemented through 41 CFR 301-10.131 through 301-10.143.

Intangible and Intellectual PropertyIntangible and intellectual property of this award shall generally follow provisions established in2 CFR 215.36.

Inventions Report - The Bayh-Dole Act (P.L. 96-517) affords Grantees the right to elect andretain title to inventions they develop with funding under an NRC grant award ("subjectinventions"). In accepting an award, the Grantee agrees to comply with applicable NRCpolicies, the Bayh-Dole Act, and its Government-wide implementing regulations found at Title37, Code of Federal Regulations (CFR) Part 401. A significant part of the regulations requirethat the Grantee report all subject inventions to the awarding agency (NRC) as well as includean acknowledgement of federal support in any patents. NRC participates in the trans-government Interagency Edison system (http://www.iedison.qov) and expects NRC fundingGrantees to use this system to comply with Bayh-Dole and related intellectual property reportingrequirements. The system allows for Grantees to submit reports electronically via the Internet. Inaddition, the invention must be reported in continuation applications (competing or non-competing).

Patent Notification Procedures- Pursuant to EO 12889, NRC is required to notify the owner ofany valid patent covering technology whenever the NRC or its financial assistance Grantees,without making a patent search, knows (or has demonstrable reasonable grounds to know) thattechnology covered by a valid United States patent has been or will be used without a licensefrom the owner. To ensure proper notification, if the Grantee uses or has used patentedtechnology under this award without license or permission from the owner, the Grantee mustnotify the Grants Officer. This notice does not necessarily mean that the Governmentauthorizes and consents to any copyright or patent infringement occurring under the financialassistance.

Data, Databases, and Software - The rights to any work produced or purchased under a NRCfederal financial assistance award are determined by 2 CFR 215.36. Such works may includedata, databases or software. The Grantee owns any work produced or purchased under a NRCfederal financial assistance award subject to NRC's right to obtain, reproduce, publish orotherwise use the work or authorize others to receive, reproduce, publish or otherwise use thedata for Government purposes.

Copyright - The Grantee may copyright any work produced under a NRC federal financialassistance award subject to NRC's royalty-free nonexclusive and irrevocable right to reproduce,publish or otherwise use the work or authorize others to do so for Government purposes.Works jointly authored by NRC and Grantee employees may be copyrighted but only the partauthored by the Grantee is protected because, under 17 USC § 105, works produced byGovernment employees are not copyrightable in the United States. On occasion, NRC may askthe Grantee to transfer to NRC its copyright in a particular work when NRC is undertaking theprimary dissemination of the work. Ownership of copyright by the Government throughassignment is permitted under 17 USC 4 105.

Records Retention and Access Requirements for records of the Grantee shall followestablished provisions in 2 CFR 215.53.

Organizational Prior Approval SystemIn order to carry out its responsibilities for monitoring project performance and for adhering toaward terms and conditions, each Grantee organization shall have a system to ensure thatappropriate authorized officials provide necessary organizational reviews and approvals inadvance of any action that would result in either the performance or modification of an NRCsupported activity where prior approvals are required, including the obligation or expenditure offunds where the governing cost principles either prescribe conditions or require approvals.

The Grantee shall designate an appropriate official or officials to review and approve the actionsrequiring NRC prior approval. Preferably, the authorized official(s) should be the sameofficial(s) who sign(s) or countersign(s) those types of requests that require prior approval byNRC. The authorized organization official(s) shall not be the principal investigator or any officialhaving direct responsibility for the actual conduct of the project, or a subordinate of suchindividual.

Conflict Of Interest Standards for this award shall follow OCOI require~ments set forth inSection 170A of the Atomic Energy Act of 1954, as amended, and provisions set forth at 2 CFR215.42 Codes of Conduct.

Dispute Review Proceduresa. Any request for review of a notice of termination or other adverse decision should beaddressed to the Grants Officer. It must be postmarked or transmitted electronically no laterthan 30 days after the postmarked date of such termination or adverse decision from the GrantsOfficer.

b. The request for review must contain a full statement of the Grantee's position and thepertinent facts and reasons in support of such position.

c. The Grants Officer will promptly acknowledge receipt of the request for review and shallforward it to the Director, Office of Administration, who shall appoint an intra-agency AppealBoard to review a grantee appeal of an agency action, if required, which will consist of theprogram office director, the Deputy Director of Office of Administration, and the Office ofGeneral Counsel.

d. Pending resolution of the request for review, the NRC may withhold or defer paymentsunder the award during the review proceedings.

e. The review committee will request the Grants Officer who issued the notice oftermination or adverse action to provide copies of all relevant background materials anddocuments. The committee may, at its discretion, invite representatives of the Grantee and theNRC program office to discuss pertinent issues and to submit such additional information as itdeems appropriate. The chairman of the review committee will insure that all review activities orproceedings are adequately documented.

f. Based on its review, the committee will prepare its recommendation to the Director,Office of Administration, who will advise the parties concerned of his/her decision.

o The Grantee is not authorized to rebudget between direct costs and indirectcosts without written approval of the Grants Officer.

o The Grantee is authorized to transfer funds among direct cost categories up to acumulative 10 percent of the total approved budget. The Grantee is not allowedto transfer funds if the transfer would cause any Federal appropriation to be usedfor purposes other than those consistent with the original intent of theappropriation.

b. Federal Financial Reports

The Grantee shall submit a "Federal Financial Report" (SF-425) on a quarterly basis for theperiods ending March 31, June 30, September 30, and December 31, or any portion thereof,unless otherwise specified in a special award condition. Reports are due no later than 30days following the end of each reporting period. A final SF-425 is due within 90 days afterexpiration of the award. a. Where a funding period is specified, a Grantee may charge to the grant only allowable costsresulting from obligations incurred during the funding period and any pre-award costs authorizedby the NRC.

b. Unless otherwise authorized in 2 CFR 215.25(e)(2) or a special award condition, anyextension of the award period can only be authorized by the Grants Officer in writing. Verbal orwritten assurances of funding from other than the Grants Officer shall not constitute authority toobligate funds for programmatic activities beyond the expiration date.

c. The NRC has no obligation to provide any additional prospective or incremental funding. Anymodification of the award to increase funding and to extend the period of performance is at thesole discretion of the NRC.

d. Requests for extensions to the period of performance should be sent to the Grants Officerat least 30 days prior to the grant/cooperative agreement expiration date. Any request forextension after the expiration date may not be honored.

Automated Standard Application For Payments (ASAP) ProceduresUnless otherwise provided for in the award document, payments under this award will be madeusing the Department of Treasury's Automated Standard Application for Payment (ASAP)system < http://www.fms.treas.qov/asapl >. Under the ASAP system, payments are madethrough preauthorized electronic funds transfers, in accordance with the requirements of theDebt Collection Improvement Act of 1996. In order to receive payments under ASAP, Granteesare required to enroll with the Department of Treasury, Financial Management Service, andRegional Financial Centers, which allows them to use the on-line method of withdrawing fundsfrom their ASAP established accounts. The following information will be required to makewithdrawals under ASAP: (1) ASAP account number - the award number found on the coversheet of the award; (2) Agency Location Code (ALC) - 31000001; and Region Code. Granteesenrolled in the ASAP system do not need to submit a "Request for Advance or Reimbursement"(SF-270), for payments relating to their award.

Audit RequirementsOrganization-wide or program-specific audits shall be performed in accordance with the SingleAudit Act Amendments of 1996, as implemented by OMB Circular A-133, "Audits of States,Local Governments, and Non-Profit Organizations."http://www.whitehouse.qov/omb/circulars/a133/al33.html Grantees are subject to theprovisions of OMB Circular A-1 33 if they expend $500,000 or more in a year in Federal awards.

The Form SF-SAC and the Single Audit Reporting packages for fiscal periods ending on or afterJanuary 1, 2008 must be submitted online.

Organizations expending less than $500,000 a year are not required to have an annual audit forthat year but must make their grant-related records available to NRC or other designatedofficials for review or audit.

III. Programmatic Requirements

Performance (Technical) Reports

a. The Grantee shall submit performance (technical) reports electronically to the NRC ProjectOfficer and Grants Officer on a semi-annual basis unless otherwise authorized by the GrantsOfficer. Performance reports should be sent to the Program Officer at the email addressindicated in Block 12 of the Notice of Award, and to Grants Officer at:Grants PPR.Resource(@NRC.GOV. (NOTE: There is an underscore between Grants andPPR).

b. Unless otherwise specified in the award provisions, performance (technical) reports shallcontain brief information as prescribed in the applicable uniform administrative requirements 2CFR §215.51 which are incorporated in the award.

c. The Office of Human Resources requires the submission of the semi-annual progress reporton the SF-PPR, SF-PPR-B, and the SF-PPR-E forms. The submission for the six month periodending March 3 1 st is due by April 3 0 th, or any portion thereof. The submission for the six monthperiod ending September 3 0 th is due by October 3 1st or any portion thereof.

d. Grant Performance Metrics:

The Office of Management and Budget requires all Federal Agencies providing funding foreducational scholarships and fellowships as well as other educational related funding to reporton specific metrics. These metrics are part of the Academic Competitiveness Council's (ACC)2007 report and specifically relates to Science, Technology, Engineering, and Mathematics(STEM) curricula.

As part of the FY 2010 HR grant awards, in addition to the customary performance progressreport requested on the SF-PPR, SF-PPR-B, and SF-PPR-E forms, HR requires the followingmetrics to be reported on by the awardees as follows:

Curriculum Development Awards

1. Overall number of new courses developed in NRC designated STEM areas;2. Number of students enrolled in new STEM courses;3. Number of these enrolled students retained in STEM major.

Unsatisfactory Performance

Failure to perform the work in accordance with the terms of the award and maintain at least asatisfactory performance rating or equivalent evaluation may result in designation of theGrantee as high risk and assignment of special award conditions or other further action asspecified in the standard term and condition entitled "Termination."

Failure to comply with any or all of the provisions of the award may have a negative impact onfuture funding by NRC and may be considered grounds for any or all of the following actions:establishment of an accounts receivable, withholding of payments under any NRC award,changing the method of payment from advance to reimbursement only, or the imposition ofother special award conditions, suspension of any NRC active awards, and termination of anyNRC award.

Other Federal Awards With Similar Programmatic ActivitiesThe Grantee shall immediately provide written notification to the NRC Project Officer and theGrants Officer in the event that, subsequent to receipt of the NRC award, other financialassistance is received to support or fund any portion of the program description incorporatedinto the NRC award. NRC will not pay for costs that are funded by other sources.

Prohibition Against Assignment By The Grantee

The Grantee shall not transfer, pledge, mortgage, or otherwise assign the award, or any interesttherein, or any claim arising thereunder, to any party or parties, banks, trust companies, or otherfinancing or financial institutions without the express written approval of the Grants Officer.

Site VisitsThe NRC, through authorized representatives, has the right, at all reasonable times, to makesite visits to review project accomplishments and management control systems and to providesuch technical assistance as may be required. If any site visit is made by the NRC on thepremises of the Grantee or contractor under an award, the Grantee shall provide and shallrequire his/her contractors to provide all reasonable facilities and assistance for the safety andconvenience of the Government representative in the performance of their duties. All site visitsand evaluations shall beperformed in such a manner as will not unduly delay the work.

IV. Miscellaneous Requirements

Criminal and Prohibited Activitiesa. The Program Fraud Civil Remedies Act (31 USC M 3801-3812), provides for the imposition

of civil penalties against persons who make false, fictitious, or fraudulent claims to theFederal government for money (including money representing grant/cooperativeagreements, loans, or other benefits.)

b. False statements (18 USC § 287), provides that whoever makes or presents any false,fictitious, or fraudulent statements, representations, or claims against the United States shallbe subject to imprisonment of not more than five years and shall be subject to a fine in theamount provided by 18 USC § 287.

c. False Claims Act (31 USC 3729 et seq), provides that suits under this Act can be brought bythe government, or a person on behalf of the government, for false claims under federalassistance programs.

d. Copeland "Anti-Kickback" Act (18 USC § 874), prohibits a person or organization engaged ina federally supported project from enticing an employee working on the project from givingup a part of his compensation under an employment contract.

American-Made Equipment And ProductsGrantees are hereby notified that they are encouraged, to the greatest extent practicable, topurchase American-made equipment and products with funding provided under this award.

Increasing Seat Belt Use in the United StatesPursuant to EO 13043, Grantees should encourage employees and contractors to enforce on-the-job seat belt policies and programs when operating company-owned, rented or personally-owned vehicle.

Federal Leadership of Reducing Text Messaging While DrivingPursuant to EO 13513, Grantees should encourage employees, sub-awardees, and contractorsto adopt and enforce policies that ban text messaging while driving company-owned, rentedvehicles or privately owned vehicles when on official Government business or when performingany work for or on behalf of the Federal Government.

Federal agencies are generally barred from accepting funds from a Grantee to paytransportation, travel, or other expenses for any Federal employee unless specifically approvedin the terms of the award. Use of award funds (Federal or non-Federal) or the Grantee'sprovision of in-kind goods or services, for the purposes of transportation, travel, or any otherexpenses for any Federal employee may raise appropriation augmentation issues. In addition,NRC policy prohibits the acceptance of gifts, including travel payments for Federal employees,from Grantees or applicants regardless of the source.

Minority Serving Institutions (MSls) InitiativePursuant to EOs 13256 13230, and 13270, NRC is strongly committed to broadening theparticipation of MSIs in its financial assistance program. NRC's goals include achieving fullparticipation of MSIs in order to advance the development of human potential, strengthen theNation's capacity to provide high-quality education, and increase opportunities for MSIs toparticipate in and benefit form Federal financial assistance programs. NRC encourages allapplicants and Grantees to include meaningful participations of MSIs. Institutions eligible to beconsidered MSIs are listed on the Department of Education website:http://www.ed.gov/about/offices/list/ocr/edlite-minorityinst. html

Research MisconductScientific or research misconduct refers to the fabrication, falsification, or plagiarism inproposing, performing, or reviewing research, or in reporting research results. It does notinclude honest errors or differences of opinions. The Grantee organization has the primaryresponsibility to investigate allegations and provide reports to the Federal Government. Fundsexpended on an activity that is determined to be invalid or unreliable because of scientificmisconduct may result in a disallowance of costs for which the institution may be liable forrepayment to the awarding agency. The Office of Science and Technology Policy at the WhiteHouse published in the Federal Register on December 6, 2000, a final policy that addressedresearch misconduct. The policy was developed by the National Science and TechnologyCouncil (65 FR 76260). The NRC requires that any allegation be submitted to the GrantsOfficer, who will also notify the OIG of such allegation. Generally, the Grantee organizationshall investigate the allegation and submit its findings to the Grants Officer. The NRC mayaccept the Grantee's findings or proceed with its own investigation. The Grants Officer shallinform the Grantee of the NRC's final determination.

Publications. Videos, and Acknowledgment of SponsorshipPublication of the results or findings of a research project in appropriate professional journalsand production of video or other media is encouraged as an important method of recording andreporting scientific information. It is also a constructive means to expand access to federallyfunded research. The Grantee is required to submit a copy to the NRC and when releasinginformation related to a funded project include a statement that the project or effort undertakenwas or is sponsored by the NRC. The Grantee is also responsible for assuring that everypublication of material (including Internet sites and videos) based on or developed under anaward, except scientific articles or papers appearing in scientific, technical or professionaljournals, contains the following disclaimer:

"This [report/video] was prepared by [Grantee name] under award [number] from [name ofoperating unit], Nuclear Regulatory Commission. The statements, findings, conclusions,and recommendations are those of the author(s) and do not necessarily reflect the view ofthe [name of operating unit] or the US Nuclear Regulatory Commission."

Trafficking In Victims Protection Act Of 2000 (as amended by the Trafficking VictimsProtection Reauthorization Act of 2003)

Section 106(g) of the Trafficking In Victims Protection Act Of 2000 (as amended as amended,directs on a government-wide basis that:

"any grant, contract, or cooperative agreement provided or entered into by a Federaldepartment or agency under which funds are to be provided to a private entity, in whole or inpart, shall include a condition that authorizes the department or agency to terminate the grant,contract, or cooperative agreement, without penalty, if the grantee or any subgrantee, or thecontractor or any subcontractor (i) engages in severe forms of trafficking in persons or hasprocured a commercial sex act during the period of time that the grant, contract, or cooperativeagreement is in effect, or (ii) uses forced labor in the performance of the grant, contract, orcooperative agreement." (22 U.S.C. § 7104(g)).

Executive Compensation

.2 CFR 170.220 directs agencies to include the following text to each grant award to a non-federal entity if the total funding is $25,000 or more in Federal funding.

Reporting Subawards and Executive Compensation.

a. Reporting of first-tier subawards.

1. Applicability. Unless you are exempt as provided in paragraph d. of this award term, you mustreport each action that obligates $25,000 or more in Federal funds that does not includeRecovery funds (as defined in section 1512(a)(2) of the American Recovery and ReinvestmentAct of 2009, Pub. L. 111-5) for a subaward to an entity (see definitions in paragraph e. of thisaward term).

2. Where and when to report.

i. You must report each obligating action described in paragraph a. 1. of this award term tohttp://Www.fsrs.gov.

ii. For subaward information, report no later than the end of the month following the month inwhich the obligation was made. (For example, if the obligation was made on November 7, 2010,the obligation must be reported by no later than December 31, 2010.)

(Todetermine if the public has access to the compensation information, see the U.S. Security andExchange Commission total compensation filings at http://www.sec.gov/answers/execomp.htm.)

2. Where and when to report. You must report executive total compensation described in

paragraph b. 1. of this award term:

i. As part of your registration profile at http://www.ccr.gov.

ii. By the end of the month following the month in which this award is made, and annuallythereafter.

c. Reporting of Total Compensation of Subrecipient Executives.

1. Applicability and what to report. Unless you are exempt as provided in paragraph d. of thisaward term, for each first-tier subrecipient under this award, you shall report the names andtotal compensation of each of the subrecipient's five most highly compensated executives forthe subrecipient's preceding completed fiscal year, if-

2. Where and when to report. You must report subrecipient executive total compensationdescribed in paragraph c. 1. of this award term:

i. To the recipient.

ii. By the end of the month following the month during which you make the subaward. Forexample, if a subaward is obligated on any date during the month of October of a given year (i.e., between October 1 and 31), you must report any required compensation information of thesubrecipient by November 30 of that year.

d. Exemptions

If, in the previous tax year, you had gross income, from all sources, under $300,000, you areexempt from the requirements to report:

i. Subawards,

and

ii. The total compensation of the five most highly compensated executives of any subrecipient.

e. Definitions. For purposes of this award term:

1. Entity means all of the following, as defined in 2 CFR part 25:

i. A Governmental organization, which is a State, local government, or Indian tribe;

ii. A foreign public entity;

iii. A domestic or foreign nonprofit organization;

iv. A domestic or foreign for-profit organization;

v. A Federal agency, but only as a subrecipient under an award or subaward to a non-Federalentity.

2. Executive means officers, managing partners, or any other employees in management

positions.

3. Subaward:

i. This term means a legal instrument to provide support for the performance of any portion ofthe substantive project or program for which you received this award and that you as therecipient award to an eligible subrecipient.

ii. The term does not include your procurement of property and services needed to carry out theproject or program (for further explanation, see Sec. __ .210 of the attachment to OMB CircularA-133, "Audits of States, Local Governments, and Non-Profit Organizations").

iii. A subaward may be provided through any legal agreement, including an agreement that youor a subrecipient considers a contract.

4. Subrecipient means an entity that:

i. Receives a subaward from you (the recipient) under this award; and

ii. Is accountable to you for the use of the Federal funds provided by the subaward.

5. Total compensation means the cash and noncash dollar value earned by the executive duringthe recipient's or subrecipient's preceding fiscal year and includes the following (for moreinformation see 17 CFR 229.402(c)(2)):

i. Salary and bonus.

ii. Awards of stock, stock options, and stock appreciation rights. Use the dollar amountrecognized for financial statement reporting purposes with respect to the fiscal year inaccordance with the Statement of Financial Accounting Standards No. 123 (Revised 2004)(FAS 123R), Shared Based Payments.

iii. Earnings for services under non-equity incentive plans. This does not include group life,health, hospitalization or medical reimbursement plans that do not discriminate in favor ofexecutives, and are available generally to all salaried employees.

iv. Change in pension value. This is the change in present value of defined benefit and actuarial

pension plans.

v. Above-market earnings on deferred compensation which is not tax-qualified.

vi. Other compensation, if the aggregate value of all such other compensation (e.g. severance,termination payments, value of life insurance paid on behalf of the employee, perquisites orproperty) for the executive exceeds $10,000.
