BackgroundThefollowingdatesareproposedforthe2011UENSteeringCommitteemeetings.ThemeetingsarescheduledforthethirdorfourthFridayofeveryothermonth(excepttheJunemeeting).

The dates avoid conflicts with the schedules of the Board of Education, Board ofRegents,theUtahSchoolSuperintendentsAssociation,andUEAconvention.Toavoidpotentialconflicts,theOctobermeetingisscheduledonthefourthFridayofthemonth.TheJunemeetingisproposedforthesecondFridayofthemonth.

Meetingtimesareproposedasfollows:theCommitteeoftheWholewillbeginat9a.m.,andmeetingsoftheInstructionalServicesandTechnicalServicessubcommitteeswillfollowatapproximately10:30a.m.Itisanticipatedthatallmeetingswillbecompletedbynoon.

IssueAn evaluation committee consisting of representatives from each institution in theUtah higher education consortium has completed an evaluation of proposals inresponse to a RFP for a state-wide learning management system. The evaluationprocessissummarizedandrecommendationsoftheLMSevaluationcommitteearepresentedhereforapprovalbytheUENSteeringCommittee.

BackgroundAsreportedinpreviousUENSteeringCommitteemeetings,BlackboardwillbeendingsupportforBlackboardVistainDecember2012,andUENandallUSHEinstitutionsmustmigratetoanotherCMS/LMSplatform.UENandrepresentativesfromUSHEinstitutionshavebeenactivelyevaluatingpossiblereplacementsforBlackboardVistaforthepastseveralmonths.

Pre-RFP Proposal from Blackboard

SinceourcurrentLMScontractiswithBlackboard,wecouldextendourcurrentcontractwithBlackboard(andadoptBlackboardLearnasareplacementforBlackboardVista)withoutgoingthroughtheRFPprocess.SomeinstitutionsintheconsortiumexpressedinterestinapproachingBlackboardforacontractextensionandtoexplorebundlingofotherBlackboardproducts.

AfterreviewingacontractextensionproposalfromBlackboard(replacingVistawithBlackboardLearn), thecommitteevoted(8-1) tomoveaheadwithplans toselectareplacementbyacompetitiveRFPprocess.

RFP Process Overview

WejointlyauthoredaRFPforastate-widelearningmanagementsystemandformallyevaluatedproposalsfromvendors.TheRFPalsoincludedasectiontoprovidepricingforUtahK-12institutions.WepostedtheRFPforastate-widelearningmanagementsystemthroughTheUniversityofUtahPurchasingDepartmentonBidsynconOctober15th.ProposalsweredueonNovember18th,andwereceivedproposalsfrom8vendors.

Thethreefinalistswereinvitedtogivetwoweb-basedpresentationsduringtheweekofNovember29th-December3rd:onepresentationfortheRFPevaluationcommittee,andonepresentationopentofacultyandstudents.Thepresentationforfacultyandstudentswasarchivedandmadeavailableafterwardsforthosewhowerenotabletoparticipatelive.Membersoftheevaluationcommitteealsocheckedreferencesforallthreevendors.

UENanalyzedcostsofthethreeproposalsandprovidedcost-sharingestimates(costto UEN and cost to institutions) for the alternatives and scheduled a meeting onDecember7thwith theRFPCommitteemembers todiscus theseoptions.The costsharingmodelsgenerallyconsistofUENprovidinghostingandsupportfortheLMSandcontinuingtosubsidizethe licensingcosts(sameamountsas inFY2011),withinstitutionssharingtheremainderofthecostsproportionally,basedonFTE.

Committee members met again on December 10th to make a final decision ThatrecommendationwillbepresentedtotheUENSteeringCommitteeonDec.17th.

Summary

AnewLMSfortheUtahhighereducationconsortiumhasbeenselectedinacompetitivebidprocess,withcommitteerepresentationfromallstatehighereducationinstitutions.This process culminates several months of serious investigation about alternativelearningmanagementsystems,withinputfromfaculty,staff,andstudents.

RecommendationWerecommendedthattheUENSteeringCommitteeapprovethedecisionoftheLMSevaluationcommitteesothatUENcanworkwithTheUniversityofUtahpurchasingdepartmenttofinalizeacontractandbeginimplementationplanningforthenewLMS.

IssueIn October, the Instructional Services Subcommittee reviewed and approved thebroadcastpoliciesdescribedbelow.Thisitemisnowpresentedasasecondedmotionfrom the Instructional Services Subcommittee for approval by the UEN SteeringCommittee.

BackgroundNationallyandlocally,publicbroadcastershavecraftedenduringprinciples,policiesand practices to protect and advance our trust and integrity. These policies haveprovided legal protections for some stations. Lacking clearly defined policy, UENproposes adoption of the industry standard:Wingspread Conference Statement ofEditorial Principles for Public Broadcasting from 1984. Aworking group of publicmediaprofessionals isalsoupdating thesepoliciesbasedonnewdigitalmediaandresultswillbepresentedforCommitteeconsiderationwhentheybecomeavailable.

Wingspread Conference 1984

TheWingspread Conference on Editorial Integrity in Public Broadcasting held in1984wasconvenedinanattempttoclarifytheFirstAmendmentrightsandeditorialindependence of government funded public broadcasting. Strong protections arein place through the U.S. Constitution, Public Broadcasting Act of 1967, and FCCLicensing,butpublicbroadcastersalsohaveadiversityof licenseetypes,governingstructures,anddiversityoffundingsourcesincludingthegovernmentthatmakesthemparticularly vulnerable to external pressures and intrusions into their independentexercise of editorial discretion. Adoption of these Principles by licensees has beenimportant in court cases in which the programming or production decisions havebeen challenged.Participants in the 1984 conference includebroadcasters from 18licensees,attorneys,journalists,boardmembers,andcommunicationsauthorities.NoUtahbroadcasterswereat theconference.DallinH.OaksparticipatedaschairmanofthePBSBoardofDirectors.SinceKUENwaslicensedin1986,thesepolicieswereneveradoptedformally,althoughtheyhavebecometheindustrystandardduringtheensuingyearsandhavesincebeenadoptedbyPBS,theNationalAssociationofPublicTelevisionStations,andmanystationlicensees.

Five Principles

• WehaveaFiduciaryResponsibilityforPublicFunds

A new project calledEditorial Integrity for Public Broadcasters in the 21st Century envisions expanding this dialog to informand shape a new foundation ofprinciples,policies,andpracticesthatadheretothebesttraditionsandcorevaluesofpublicbroadcasting,andhelp realize thepotentialof emergingdigitalpublicmedia.FindingsfromthisgroupwillbepresentedtotheUENSteeringCommitteewhentheybecomeavailable.

Policy Considerations

I. Purpose

a. The mission of public broadcasting is to bring to Americans the highestaccomplishmentsofoursocietyandcivilizationinallofitsrichdiversity,topermitAmerican talent to fulfill the potential of the electronicmedia to educate andinform,andtoprovideopportunitiesforthediversegroupingsoftheAmericanpeopletobenefitfromapatternofprogrammingunavailablefromothersources.

b. Nooneismoreimportanttothefulfillmentofpublicbroadcasting’smissionthanthemenandwomenoftheboardsoftrusteesofthelicenseestations.Theyarecustodiansoftheirinstitutions’fiscalreputation,acurrencynecessarytoacquiresupportfromthosewhosetaxesanddonationsmakepublicbroadcastingpossible.Theyarealsothefinalguardiansofpublicbroadcasting’seditorialintegrityanditsreputationinthemarketplaceofideas,wherereputationislegaltender.

II. Policy

a. Editorial integrity in public broadcasting programmingmeans the responsibleapplication by professional practitioners of a free and independent decisionmakingprocesswhichisultimatelyaccountabletotheneedsandinterestsofallcitizens.

b. In order to assure that programsmeet the standards of editorial integrity thepublichasarighttoexpect,thefollowingfiveprinciplesandguidelinesestablishafoundationfortrusteeaction.Theprinciplesandguidelinesalsoformabasicstandardbywhichtheservicesofapublicbroadcastinglicenseecanbejudged.Atthesametime,theyformabasisforevaluatingallaspectsofapublicbroadcastingstation’s governance, from enabling legislation to the policy positions of thelicenseeboard.Theultimategoaloftheprinciplesandguidelinesistoassistpublicbroadcastingtrusteesinfulfillingtheirvitalroleinthisimportantpublicservice.

III. Standards

a. We Are Trustees of a Public Service

1. Public broadcasting was created to provide a wide range of programmingservicesofthehighestprofessionalismandqualitywhichcaneducate,enlightenandentertaintheAmericanpublic,itsaudienceandsourceofsupport.Itisanoncommercial enterprise, reflecting theworthypurpose of the federal andstate governments to provide education and cultural enrichment to theircitizens.

2. Astrusteesofthispublicservice,partofourjobistoeducateallcitizensandpublicpolicymakers toour function,and toassure thatwecancertify toallcitizensthatstationmanagementresponsiblyexercisestheeditorialfreedomnecessarytoachievepublicbroadcasting’smissioneffectively.

b. Our Service is Programming

1. Thepurposeofpublicbroadcastingistoofferitsaudiencepublicandeducationalprogrammingwhichprovidesalternativesinquality,typeandscheduling.Allactivitiesofapublicbroadcastinglicenseeexistsolelytoenhanceandsupportexcellentprograms.Nomatterhowwellotheractivitiesareperformed,publicbroadcastingwillbejudgedbyitsprogrammingserviceandthevalueofthatservicetoitsaudiences.

2. Astrustees,wemustcreatetheclimate,thepoliciesandthesenseofdirectionwhichassuresthatthemissionofprovidinghighqualityprogrammingremainsparamount.

c. Credibility Is the Currency of our Programming

1. As surely as programming is our purpose, and the product by which ouraudiencesjudgeourvalue,that judgmentwilldependupontheirconfidencethat our programming is free from undue or improper influence. Our roleas trustees includes educating both citizens and public policymakers to theimportanceofthisfactandtoassuringthatourstationsmeetthischallengeinaresponsibleandefficientway.

2. Astrustees,wemustadoptpoliciesandprocedureswhichenableprofessionalmanagementtooperateinawaywhichwillgivethepublicfullconfidenceintheeditorialintegrityofourprogramming.

d. Many of our Responsibilities Are Grounded in Constitutional or Statutory Law

1. Publicbroadcastingstationsaresubjecttoavarietyofstatutoryandregulatoryrequirementsandrestrictions.Theseincludethefederalstatuteunderwhichlicenseesmustoperate,aswellasotherapplicablefederalandstatelaws.PublicbroadcastingisalsocloakedwiththemantleofFirstAmendmentprotectionofafreepressandfreedomofspeech.

2. Astrusteeswemustbesurethattheseresponsibilitiesaremet.Todosorequiresus to understand the legal and constitutional framework within which ourstationsoperate,andtoinformandeducatethosewhosepositionorinfluencemayaffecttheoperationofourlicensee.

e. We Have a Fiduciary Responsibility for Public Funds

1. Publicbroadcastingdependsuponfundsprovidedbyindividualandcorporatecontributions;andby local, stateand federal taxes.Trusteesmust thereforedevelopandimplementpolicieswhichcanassurethepublicandtheirchosenpublicofficialsalikethatthismoneyiswellspent.

2. As trustees, wemust assure conformance to sound fiscal andmanagementpractices.Wemust also assure that the legal requirements placed onus byfundingsourcesaremet.Atthesametime,wemustresisttheinappropriateuseofotherwiselegitimateoversightprocedurestodistorttheprogrammingprocesswhichsuchfundingsupports.

RecommendationItisrecommendedthatCommitteemembersapprovethepoliciesasrecommendedbytheInstructionalServicesSubcommittee.

NEtwork ProjECt UPdAtE – diSCUSSioN

IssueThis report provides the status of the progress UEN has made with the NationalTelecommunications Information Administration (NTIA) Broadband TechnologyOpportunityProgram(BTOP)infrastructureawardof$13.4millionmadetoUENinFebruary2010.Thisawardinvolvesextendingbroadbandservicesto130communityanchor locations (elementary schools, charter schools, libraries, and head startlocations).

BackgroundTheNationalEnvironmentalProtectionAct(NEPA)EnvironmentalAssessment(EA)isrequired forany federally fundedproject thathas thepotentialofenvironmentalimpactincludinggrounddisturbance,airandnoisepollution,criticalhabitat,historicsitesorstructures,wetlandsandwaterways.

ASpecialAwardCondition(SAC)wasplacedonUEN’sBTOPgrantbyNTIA,soallgrantfundingwasonholduntilNTIAissuedafindingofnosignificantimpact(FONSI)onthecompleteenvironmentalassessmentreportsubmittedbyUEN.WithinsixmonthsoftheSAC,UENhadtoestablishwithNTIAthattheBTOPprojectiscompliantwiththeNationalEnvironmentalPolicyAct(NEPA)andNationalHistoricPreservationAct(NHPA).AdraftEnvironmentalAssessment(EA)wassubmittedattheendofJulyforcomment,andarevisedseconddraftwassubmittedonSeptember24th.UENreceivedadditionalcommentsandrequestsforchangesandincorporatedthoseintothethirdandfinaldraftsubmittedonNovember11th.

UEN was notified in early December that our Environmental Assessment (EA) had been approved. We received the finding of no significant impact (FONSI) letter on December 7th. A copy of the FONSI letter is attached to this report.

JeffEgly,KevinDutt,andDanPatterson(OneTel)allprovidedimportantcontributionsontheEnvironmentalAssessmenttoreceivethisapproval.

NTIA “started the clock” onUEN’s project plan and implementation schedule lastJanuary.ThechallengeisnowthattheEAiscompleted,UENmuststayontrackwiththeprojecttimelineregardlessoftheimpactoftheenvironmentalassessmentinordertocomplywithBTOPrequirements.UENhashadmeetingswiththetelcomprovidersonthesitesurveyworkinanticipationofimplementationbeginningnextyear.

UEN is also working with Qwest Communications to satisfy the security interestrequirements of NTIA with regards to ownership of property and the federalgovernment’s interest in theassetspaid forby theBTOPgrant.UENresponded toa letter fromNTIA onDecember 3rdwith two alternatives to the security interestrequirementsforcompliance.WeexpecttohaveafinaldecisionbyDecember10thonthesecurityinterestplanwithQwestfortheproject.

UEN Professional DevelopmentstaffpresentedseveraleducationaltechnologysessionsforeducatorsattheUEAconvention.

• Science Teachers’ Open House at the Utah Museum of Natural History.UENstaffpresentedinteractive video demonstrations, distributed new promotionalmaterialsandconductedscienceteachertrainingonFridayafternoon,November5.Priortotheevent,UENsentemailinvitationstotargetededucators.Thisfirst-of-its-kindeventwaswell-attendeddrawingnearly 200 attendees including teachers from as farawayastheUintahBasinandIronCounty.

Feedbackfromtheconferencewasextremelypositive,andwewouldliketoextendourappreciationtothemembersoftheUtahSAINTConferenceCommitteeforwhatwebelievewasthemostsuccessfulUtahSAINTConferencetodate.

WealsorecognizeandextendourappreciationtoDixieStateCollegefortheirsupportandwillingnesstodonatethefacilitywhereweheldtheevent.

LauraHunterreportedtotheSteeringCommitteeontheUtahEPSCoRProposal.TheExperimental Program to Stimulate Competitive Research (EPSCoR) is a programdesigned to fulfill the National science Foundation’s (NSF) mandate to promotescientificprogressnationwide.ThisprogramisdirectedatthosejurisdictionsthathavehistoricallyreceivedlesseramountsofNSFResearchandDevelopment(R&D)funding.

In August Utah was awarded an NSF under the EPSCoR Research InfrastructureImprovement programwith SteveCorbató a PI for that complementary effort. Thisaward will leverage the facilities and statewide reach of the UEN to expand thecapabilities of the research and education communities to more effectively engagefacultyandstudentsacrossUtahinScience,technology,engineeringandmathematicsfields.
